Among the MDWFP staff attending were: Dr. Sam Polles, Executive Diredor; Robert Cook, Deputy
Executive Dircctor; Michael Bolden, Larry Castle, Jennifer Head, Colonel Steve Adcock, Jason
Thompson, and counsel, Doug Mann and Drew Malone, SpecialAssistant Attorneys General.
Chairman Deviney gaveled the meeting to order at 2:01 p.m.
OPENING PRAYER

Larry Castle, Director ofTechnical Programs, opened the meeting with prayer.
OATH OT OFFICE

Robert Taylor, having been appointed by Governor Phil Bryant to serve a five year term beginning July
1, 2016 and ending lune 30, 2021, was sworn into office by Notary Sharon Polzin.
MINUTES

ACTION: Upon motion by Commissioner Cossar and seconded by Commissioner Coopwood, the
minutes ofthe lune 22,2016 Regular Meeting were unanimously approved.
ACTION: Upon motion by Commissioner Coopwood and se.onded by Commissioner Cossar, the
minutes ofthe special Meeting held on July 11, 2015 were unanimously approved.
AGENDA

Dr. Sam Polles, Executive Director, requested two additions to the July 20, 2016 agenda under OTHER
BUSINESS, namely, Alligator Permit Sales and FY18 MDWFP Budget

ACTION: Upon motion by Commissione. Cossar and seconded by Commissioner Wagner, the agenda
for luly 20, 2016 was unanimously approved as amended.

PUBLIC COMMENTS

David Smith, President, Mississippi Hunting Dog Association, expressed his confusion on
knowing whom to contact concerning the rules for hunting in the National Forests. He also
requested a contact person at MDWFP to answer questions.
Dr. Polles informed Mr. Smith that anything with National Forests goes through the federal
chain of command. The first link is the State (Mississippi) Supervisor for the U.S. Forest Service,
second is the Atlanta Office, and the final link is the Washington Office. Dr. Polles designated
himself, Larry castle, Director of Technical Programs, and chad Dacus, Director of Wildlife
Bureau, as contact persons to answer his questions.

Senator Mike Seymour read a statement listing concerns with the U. S. Forest Service, MDWFP
rules and regulations, and law enforcement citations against dog hunters. Dr. Polles replied to
Senator Seymour's statements concerning law enforcement and stated that there are always
two sides to a story and sometimes three. Dr. Polles requested that Senator Seymour sit down
with relevant staff and discuss the law enforcement issues. Robert Cook, Deputy Executive
Director, stood up and offered to meet with the Senator, any of his constituents and the Law
Enforcement Command Staff right then and there. Mr. Cook further stated that the law
enforcement officers at MDWFP risk their lives every day on behalf of the citizens in Mississippi,
and take allegations of frivolous enforcement adivity very seriously. Senator Seymour stated
that he would indeed like to meet immediately following the Commission meeting.

Representative Doug Mcleod thanked the Commission for the letter he received in the mail
recently and stated that he relied on this Commission to protect the hunting in Mississippi. He
brought up issues with killing hogs and transportation of ho8s in his area. Rep. Mcleod
suggested keeping the lines of communication open between David Smith (Miss. Dog Hunters
Association) and MDWFP with a yearly meeting.

chairman Deviney thanked Representative Mcleod for coming and stated that he is always
welcome to come to the monthly MDWFP Commission meetings.
LICENSE SALES REPORT

Jason Thompson, Director of License/Boat Registration, presented the License Sales Report for the
month of June 2016. He stated that FY16 closed out on a good note generating over 516,000,000 in
revenue, 37% ofthis amount was collected from Louisiana residents totaling over 56,000,000.

FINAL40 Miss. Admin. Code Part 6. Chapter 1- Rules & Requlations for Miss. State Parks
Rule 1.2 - Sedion T, - Firearms, Fireworks. and Explosives

Jennifer Head, Director of State Parks, stated that this rule was up for final passage. No comments
were received and staff recommended approval.
ACTION: By motion of commissioner Cossar and seconded by Commissioner Wagner, Final Rule 1'2
was approved unanimously bythe commission as presented,
FY

2018 MDWIP BUDGET REOUEST

Dr. Polles requested to move consideration of the MDWFP FY18 budget from Other Business to now,
following the Parks request. The Commission unanimously concurred with his request and this item
was brought before the Commission for consideration.
Jennifer Head requested approval ofthe overall MDWFP FY18 operating budget request in the amount
of 584,940,313. The increases presented are as follows:

Monroe Countv Board of Supervisors Request to Rename Hwv 278 [andinq


Larry Pugh, Director of Fisheries Bureau, presented a Resolution from the Monroe CountY Board of
Supervisors requestinB MDWFP to name a boat ramp facility, located at the crossing of U. S. Highway
278 over the Old channel for the TombiSbee River in Monroe County, Mississippi, in memory and
honor of Thomas '"Tommy" Thornton ofAmory. Mr. Thornton was an avid outdoorsman and supporter
of Wild Turkey Federation, MDWFP, and Ducks unlimited.

unanimously by the Commission as presented,

shooting range attendance, and Governors 5K Run. No action was required ofthe Commission

OTHER BUSINESS

Alliqator Permit Report


Ricky Flynt, Alligator/Furbearer coordinator, presented details of the on-line sale of Alligator Permits
held July 25, 2016. His presentation began with a history of Alligator permit sales. over the years the
process in getting permits has changed in response to public comment, as well as staff evaluation of

how things are progressing each year. Flynt started preparing customers for the alligator permit
process in February, 2015, through a number of media outlets, including radio, television, magazine
and newspaper articles. six thousand users were Wing for 9OO permits on July 25th All 900 were sold
within 45 minutes, the same time frame as last year.
ACTIONt Chairman Deviney requested a working session in the near future, for the commission and
staffto investigate best methods for the sale of Alligator Permits in the State of Mississippi.

Next Commission meeting date was set for Wednesday, August \1,2016 at 2 p,m. in the Commission
Conference Room located at 1505 Eastover Drive,lackson, Mississippi 39211.

1. The venomous snake presents a reasonable danger to human

life.

2. The venomous or a non-venomous snake is on lands in which the record title is


vested in such persons, or on lands which contain the p ncipal residence ofsuch

3. The nongame mammals have entered into or taken up residence in buildings or
destroyed or damaged yards, plants, domestic animals, or agricultural products.

commercial captive
propagation permit for nongame wildlife upon the permittee's conviction
of any violation of regulations of the Department relating to nongame
wildlife, upon conviction of any Class I Fish or Wildlife violation, or upon
conviction under any Fedeml conservation statute.

c. Upon revocation of a commercial captive propagation permit for


nongame wildlife, the permittee shall have six (6) months to dispose of
legally acquired nongame stock.
d. Nongame stock may not be disposed ofto corpomtions or partnerships
in which, by determination ofthe Department, the pemittee is a principal.
e. Permittee must report disposition of nongame stock to the Department
within 30 days of hnal disposition. This report shall specifu nongame
stock disposed of and recipients of this stock.

f. A

holding that pemit has acquired breeding stock, has established a
breeding facility, and is attempting to propagate nongame wildlife in

1. The premises ofthe commercial captive propagation facility shall be subject to


inspection by Department personnel at all times.

2. Complete wdtten rccords of all changes in nongame wildlife breeding stock


shall be kept and made available for examinatiofl by Depaxhnent personnel.

3. Shipping tickets, invoices, or bills of lading shall be maintained for hve years
ftom the date of tEnsaction to show source of supply or disposition of nongame
wildlife.
4. Each commercial propagator shall provide a sunmary report to the Depafinent
upon requesting renewal of a commercial captive propagation permit. Data to be
included in the report shall pertaifl to both breeding stock and specimens raised
for rcsale. This report shall indicate the numbers, by species and subspecies, of all
nongame wildlife that were bought or sold during the pemit yeax, the name ofthe
seller or purchaser, and the complete ad&ess and telephone number of the seller
or puchaser.

An examination of records of acquisitions of breeding stock made in the


previous twelve months. This should include records of both specimens
acquired fiom outside of the State of Mississippi and of specimens
acquircd by permit within the State of Mississippi. These records should
indicate the nurnber and species that were acquired and include
appropdate documentation that the specimens were legally obtained,
including permits, bills of sale, and similar documentation.
g. The wildlife biologist shall prepaxe, at the permittee:s expense, a report
detailing the results of the inspection. The repofi may include
photographs, line drawings, maps, tables, photocopies of documents,
and/or charts, and shall include information on the physical structures of

b. The importer shall maintain documentaxy evidence of the origin of his

from the state in which the wildlife originated.

c. Each importer shall keep complete records of all nongame wildlife in


his possession for the year in which the permit is valid, including records
shovr'ing the point of odgin of imported nongame wildlife, from whom
they were acquired, to whom they werc sold, how maay of each species
were sold.

Rule 3.1 REGULATIONS REGARDING COMMERCIAL FISHING.

A. The following

rules, rcgulations and required licenses relative to freshwater


commercial fishing, commercial fishing equipment tags, seines, nets and traps and wholesale
minnow dealers are hereby adopted for all residents and non-residents for public waters
identified in Mrss. CoDE ANN. $51-3-1. Nonresidents shall comply with all subsections of MISS.
CoDE ANN. $49-7-9.1, except for the subsection which specifies the fee for a resident
commercial fishing license.

B. Non-game gross fish, non native fish, minno\,r's, non-game fish, cmwfish, and
lieshwater shrimp may be taken and sold from freshwaters of Mississippi, except in those waters
specifically in section H which are closed to freshwater commercial fishing equipment and slat
baskets as stated herein.

5. A person holding a Freshwater Commercial Fishing License can be assisted by


a helper who has any valid license issued by the Mississippi Department of Wildlife, Fisheries,
and Parks. Anyone in the boat with a licensed commercial fisherman is considered a helper.

There are no license exemptions for helpers. Helpers who do not have a commercial fishing
license cannot sell. resell or ship for sale nongame gross fish or non native fish.

6. Persons who have a freshwater commercial fishing license are allowed to fish
crawfish traps and freshwater shrimp traps as described herein.
D. FRESHWATER COMMERCIAL FISHING EQUIPMENT

I. TROTLINES:
a. Trotlines must have hooks at least 24 inches apart and tied so they
cannot slip together.
b. No trotlines or throw lines shall exceed I "000 feet.

2. SNAC LINES: There is no open season on the use ofsnag lines.


3. HOOP NETS and BARREL NET:
a. Hoop or barrel nets shall be made of number | 5 or bigger twine or cord
and treated: the minimum mesh size shall be three (3) inch square measure.

b- Lead requirements: maximum of seven per license holder, up to 35


yards in lengrh, three (3) inch square measure, number l5 twine or bigger and treated.
c. Heans may be trsed only in the Mississippi River where it is a common
boundary between Mississippi and another state (oxbow lakes included).

d. Hoop nets or barrel nets must be set at least 100 yards apart EXCEPT
nets may be fished on each end of a lead, as such, this constitutes one set and each set mu$ be
100 yards apa(.

e. Persons with Mississippi resident commercial fishing licenses or


pertinent license ofborder state fishing barrel nets andTor hoop nets in Mississippi waters, which
are common boundaries between Mississippi and another state (oxbow lakes included). may use
the same mesh size allowed in the other state; EXCEPT. leads, heafts and wings are prohibited in
Mississippi wateB when attached Io barrel or hoop nets with minimum mesh of less than three
(3) inches square measure.

8. SLAT BASKETS are defined as commercial fishing devices used solely for the

capture of catfish.

a. Pursuant the Mississippi Code of 1972, as amendedr Section 49-7-9.1


and Section 49-7-12, ANY PERSON using a slat basket in Mississippi waters must have a valid
slat basket license for each slat basket
b. Slat baskets fished in Mississippi waters shall:

i. Be made entirely of wood and/or plastic slats in a boxlike or


cylindrical shape, not to exceed six (6) feet in length or fifteen (15) inches in width and height or
diameter:

ii. Have no more than two (2) throats, have at least four (4) slot
openings ofa minimum one and one quarter (17i) inches by twenty-four (24) inches evenly
spaced around the sides of the catch area which must begin at the rear of the basket and run
twenty-four (24) inches toward the throat end of the basketd. Slat baskets shall be placed at least one hundred (100) yards apart and
may not be used with any form of leads, netting or guiding devices (Section 49-7-9.1).

E. IAGGING REQUIREMENTS:
1. After June 30, 2013, Commercial Fishing Equipment, and all SIat Baskets
must display the license holders' MDWFP Number on a waterproof tag provided by the licensed
fishermen. No other number will be needed.

waterproof marking or engraving their MDWFP Number on a waterproof Commercial Fishing
Equipment Tag in legible numbers at least %" in height.

the MDWFP Number on them is legible.


4. A Commercial Fishing Equipment Tag shall be attached to one end ofthe float
line of gill or trammel nets; or on the front hoop ofany hoop, barrel net; or within five (5) feet of
one end ofthe main line ofeach trotline, or attached to the front end ofa slat basket, except on
border waters as defined below.

5. All commercial fishing equipment and slat baskets must be tagged on those
border lakes and waterc that are part of the reciprocal resident license agreements between
Mississippi/Louisiana Part 4 Rule 3.3, and between Mississippi/Arkansas Part 4 Rule 3.2. The
rcciprocal agreements DO NOT give non-resident license holders authority to fish in border
waters ofa state ofwhich they do not possess a license.

6. Cill nets, trammel nets, hoop nets, and trotlines fished by RXSIDENTS of
Louisiana and Arkansas in Mississippi waters specified in those reciprocal agreements must tag
their commercial fishing equipment with the type of tag specified in the state where they are
licensed. Persons with a Louisiana resident sportfishing or a basic fishing license using
"recreational hoopnets" or any other commercial fishing equipment must either purchase a
Louisiana commercial fishing license or a nonresident Mississippi commercial fishing license to
fish commercial fishing equipment in Mississippi waters. Louisiana residents must tag their
equipment using the same criteria as Mississippi residents, EXCEPT their license number must
be on the tag while fishing on the Mississippi side of state border line waters.
7. Crawfish traps and freshwater shrimp traps fished in public water shall be
marked with a waterproof tag provided by the fishermen, with the fishermen's name and
MDWFP Number legibly printed on the tag using the same criteria as other commercial
equipment

RULE 3.2 RECUL,ITIONS REGARDING THE COMMERCAL HARYEST OF PADDLEFISH


AND PADDLEFISH EGGS.

A. The following rules, rcgulations and required licenses and pemits relative to
commercial harvest of the American Paddlefish (spoon bill catfish) and possession of any
Paddleflsh (Polyodon spathula) ot Bowfifi, (Amia calya) eggs *e hercby adopted.
B. The following rules, regulations and required licenses and permits do not pertain to
persons engaged in sport fishing.

C. Persons permitted in another state to harvest Paddlefish accessing reciprocal border


waters from their respective border state may transport their catch into and through Mississippi
but no other rights are granted to them that are not specified in this rule. Such persons may fish
for and harvest Paddlefish fiom these rcciprccal border water areas when these waters are open
to Paddlefish harvest as specified in 40 Mississippi Administrative Code Part 3 Rule 3.4.

I. Paddlefish Harvest During the Egg Harvest Season

Unlawful Acts

I . It shall be unlau{ul for any person without a resident Mississippi Commercial


Fishing License and a Paddlefish Haivester Permit to fish for, attempt to take, take, possess,
barter for, or sell Paddlefish, or to possess, receive, obtain or acquire Paddlefish eggs or Bowfin
eggs, except as provided for in section D.

2. It shall be unlawful for persons with Paddlefish Harvester and Paddlefish


Helper Permits to haflest, possess, sell, exchange, transport or ship Paddlefish flesh, Paddlefish
parts, Paddlefish eggs or Bowfin eggs to anyo[e who is not a Paddlefish Processor or Paddlefish
Processing Agent, except as provided for in section D.
3. It shall be unlawful for a Paddlefish Helper to fish for, take, aftempt to take, or
harvest or rcmove Paddlefish from nets when he/she is not in the immediate presence of a
Paddlefish Harvester (See K4).

prohibited in Rule 3.4, Paddlefish nets miy remain in the water ovemight.

fail to remove Paddlefish from Paddlefish Nets at least once daily during daylight hours.

8. It shall be unlawful to harvest, take or possess Paddlefish less than 37 inches

1. lt shall be unlawful to possess, exchange, sell or attempt to sell a Paddlefish
that does not remain whole alter capture with the eggs remaining entirely within the body cavity
of the Paddlefish until the Paddlefish are exchanged with a Paddlefish Processor or a Paddlefish
Processing Agent. This regulation also applies to nonresident commercial fishermen in reciprccal

reciprocal border waters from their respective border state may transport their catch into and

M. Paddlefish Processing, Storage and Disposal During the Egg Haryest Season
Unlawful Acts
1.

It shall be unlawful to process Paddlefish at any location that does not comply

wiLh Federaland Srate Health Regulalions.

2. It shall be unlawful for anyone to process Paddlefish unless they have a


Paddlefish Processor Permit or a Paddlefish Processing Agent Permit (see E8 for definition of
processing).

3. It is unla$dll to dispose of Paddlefish or Paddlefish pafis in violation of the


applicable waste disposal regulations established by the Mississippi Department of
Environmental Quality. A copy ofthe Paddlefish Transaction FoIm that documents the harvest
shall accompany Paddlefish transported for waste disposal.

4. tt shall be unlawful to receive, acquire, possess,


wholesale or bulk contajners that do not contain Paddlefish Labeling.

Paddlefish eggs without a Paddlefish Transaction Form signed by the Paddlefish Harvester and
the Paddlefish Processor or Paddlefish Processing Agent which identifies the Paddlefish products

6. It shall be unlawful for any person to possess, buy, sell, exchange or ship across
the Mississippi state line whole Paddlefish, Paddlefish parts, and./or Paddlefish eggs without the
proper Paddlefish permits and a Documented Paddlefish Transaction Form with the product.

7. It shall be unlau4.rl for any person, business, pafinership, firm, or cooperation


to make or submit any false record, account, or label fot or any false identification of Paddlefish
or Bowfin and their parts which has been or is intended to be impoded, exported, tansported,
sold, purchased, or bartered in intrastate or interstate commerce.

REQUIREMENTS FOR PADDLEFISH HARVEST.

A.

This rule outlines the requirements and procedures for obtaining pemits required for the
commercial harvest ofPaddlefish (spoonbill catfish) and possession of any paddlefish or
Paddlefish eggs and the repoding ofthese activities.

B.

This rule also outlines the requirements and procedures for obtaining the permits to
acquire Paddlefish for processing and distribution.

C.

Definitions:

l. Paddlefish Harvester Mississippi resident as set forth in MS Code Section 497-9 and incorporating the provisions of 49-7-3(2), who possesses a valid Paddlefish Harvester
Pemit that allows such person to fish for, attempt to take, possess, and transport paddlefish to a
Paddlefish Processor for documentation ofharvest, after which the sale and processing including
the removal ofeggs may take place.
2. Paddlefish Helper - Mississippi resident as ser forth in MS Code Section 49-79 and incorporating the provisions of49-7-3(2), who possesses a valid Paddlefish Helper permit
who assists a pe$on with a Paddlefish Harvester Permit with the fishing for, attempting to take,
and taking of Paddlefish. A Paddlefish Harvester permit can substitute for a paddlefish Helper
permit when assisting a Paddlefish Harvester.

3. Paddlefish Processor - Persons who

possess a valid Paddlefish processor


Permit which allows them to purchase, attempt to purchase, barter for, process, sell, ship, import,
and expoft Paddlefish, Bowfin, Paddlefish eggs or Bowfin eggs. The Paddlefish processor shall
document the Paddlefish harvest of the Paddlefish Hanr'ester fiom whom he/she receives.

5. Paddlefish Egg Harvest Season September I'i through April 30'h of each
calendar year when paddlefish have eggs suitable fot producing caviar. Paddlefish harvest for
eggs is only legal on Paddlefish Harvest llalegqlqllllJqils Zoaes as specified in 40 Mississippi
Administrative Code Paft 3 Rule 3.4.

November I tha! they intend to purchase a Paddlefish Harvester Permit.

8. Those applicants that intend to purchase a Paddlefish Harvester Permit and/or a

Fish Hatchery in Enid Mississippi on a date specified in the mailing notification. Failure to
attend the mandatory meeting will render a person ineligible to purchase those Paddlefish
permits.

9. Applications for Paddlefish Helper Permits, Paddlefish Processor Permits, and


Paddlefish Processing Agent Permits will be accepted online from October I until April 10, or by
calling the MDWFP Fishedes Office in Jackson, Mississippi, 601-432-2200.

Mississippi Department of Wildlife, Fisheries, and Parks has the right to


issue the number of Mississippi Paddlefish Harvester and Mississippi Paddlefish Processor
Permits as it deems necessary and advantageous for the state.
10. The

permit applicants have not been convicted, within the last three (3) yeaIs, of any violations of

Transaction Form that contains the signature ofthe Paddlefish Processor.
3. The Paddlefish Harvester and Paddlefish Processor shall retain a copy of each
Paddlefish Transaction Form, and the Paddlefish Harvester shall submit the original. either Stage
2 or Stage 3, to the MDWFP on a monthly basis by the l5'h of each month following the month
ofharvest- Ifno Paddlefish werc harvested or handled in a month. a Paddlefish Transaction Form
shall be submitted indicating such. Paddlefish Transaction Forms for the month ofApril will be
submitted by April 25.
4. The Paddlefish Processor shall, within 24 hours ofa receipt ofa Paddlefish(s),
submit an electronic copy of the Shge 3 of the Paddlefish Transaction Form by intemet, email,
or fax to the designated person in the MDWFP Jackson Office. Ifno Paddlefish were harvested
or handled in a month, a Paddlefish Transaction Form shall still be submitted indicating such.
5. The sale of Bowfin eggs shall also be documented on a Paddlefish Tmnsaction
Form, on a separate form from any documentation of Paddlefish, with "Paddlefish" in the form
title crossed out and "Bowfin" written in its place. Total length shall be recorded in place ofeye

to tail fork length.

6. During the Summer Paddlefish Harvest Season, the harvest of Paddlefish shall
be recorded on forms supplied by MDWFP. These forms are to be submifted to MDWFP no
later than September l5'i.

7. The Paddlefish Processor shall submit Paddlefish Tmnsaction Forms to


MDWFP each month listing the pounds of eggs processed and distribution ofproducts.
a. The Monthly Processor Form and Paddlefish Transaction Forms will be
submitted by the Paddlefish Processor by the 15rh ofthe month following the month ofharvest.
