Attention is invited the reference cited. Hon'ble Supreme Court in para 26 of the
Judgment dated, 22.2.2013 in CA No 1643113 Sneha Cherian Vs. State of Keralia l2ttXtt
(1) KLT 7551 has laid down the following directions.

(i) A teacher, who

was relieved -fro* set"vice under Rules 49 and 52 oJ'Chaptar

XIV A of the KER, is entitled to get preference .for appointmenl under" lilrlc
5 I A only if the teacher" has a minimum prescribed conlinnous service in crrt
academic ))ear as on the dcrte of relief.

(ii)

The Manager of an aided school can, however, appoint teochers in

vacancies occnrred due lo death, relirement, prontotion, resigrtalion, k.tngterm leave etc. provided they are estcrblished vacctncies and the ctltltrovcrl ccrrt
be granted subject to the conditions under Rule 49 of Chapter XIL/ I of thc
KI-:R.

(iii)

Approval can also be granted to appointments made to the approt,ad

vacancies arising and continuing he1'ond 3lst Marc'h due tr.t .strnt'tionirtg ol
additional divisions.

(w)

The Manager canmake appointments in school even if the durcrtion of whiclt

is less than one academic year but on daily wages basis and i/ the durution
