WearepleasedwiththedecisionoftheU.S.CourtofAppealstodissolvetheadministrativeinjunctionthathadtemporarily
suspendedconstructionactivitiesontheDakotaAccesspipelineinanareaneartheproposedcrossingoftheMissouriRiveratLake
Oahe.TheAppealsCourthasnowjoinedwiththeFederalDistrictCourtindenyingtheStandingRockSiouxTribesmotionforan
injunctiontostopconstructionoftheDakotaAccesspipeline.
ThedecisionsbytwoseparatefederalcourtsshowthattheU.S.ArmyCorpsofEngineersactedwithgreatcareandfollowedthelaw
withrespecttotherivercrossingpermitsissuedtoDakotaAccess.TheArmyCorpsandDakotaAccesscarefullyconsideredthe
viewsofallpotentiallyaffectedtribesthatchosetoparticipateintheconsultativeprocessprescribedbyCongress,andfullycomplied
withboththeletterandthespiritoftheNationalHistoricPreservationAct.Theircarefulandsensitiveworkhasbeenreviewedand
approvedbyhighlyqualifiedprivateandstateemployedarcheologists.WecontinuetobelievethattheArmyCorpswillsoonissue
theeasementforapproximately1,100feetnecessaryforthecrossingbeneaththeMissouriRiverthesoleremainingauthorization
necessaryforcompletionoftheproject.
InlightofSundayscourtdecision,DakotaAccesslooksforwardtoapromptresumptionofconstructionactivitieseastand
westofLakeOaheonprivateland.Wereiterateourcommitmenttoprotectculturalresources,theenvironmentandpublicsafety.We
echotheurgingsoftheNorthDakotaGovernor,itstwoSenators,itsCongressmanandlocalenforcementofficialsthatanyprotests
beundertakeninapeacefulandlawabidingmanner.AllconstructioneffortswillbeundertakeninclosecoordinationwithStateand
locallawenforcementofficials,andwearehopefultheirlawenforcementeffortswillbesupplementedbythoseofthefederal
government.
