Inputs Regarding Transfer and Posting Policy 2016

Background for proposed amendments.


It has been observed that the transfer and posting policy of the Judicial
officers normally revolves around the place of domicile of the judicial officers, but in
many cases, the place of domicile becomes irrelevant. The judicial officers who used
to reside with their families at the place of posting are normally not much concerned
for their posting near to the place of domicile. The requirements for married judicial
officers residing with their families at the place of posting are totally different as
against the judicial officers who are unmarried or the judicial officer whose family is
settled in the district of domicile or residing at some other city. The paramount
consideration for a married judicial officer who used to reside alongwith his family is
quality education and proper residential facilities. So a judicial officers residing
alongwith his family is least concerned regarding the distance from the place of his
domicile and for such judicial officers the availability of quality education of his
children and proper residential facilities is the prime consideration. In the same
manner a judicial officer who is unmarried or a married judicial officer whose family
is residing in the district of domicile is least concerned with the educational
institutions and residential facilities at the place of his posting. A proper residence at
judicial rest house is sufficient for such judicial officers who is unmarried or who is
residing without his family. The paramount consideration for a judicial officer who is
unmarried or a judicial officer whose family is settled at the district of domicile is less
distance. Such judicial officers may be posted at a Sub-Division near to his district of
domicile where proper education facilities are not available or where proper
residences of the judicial officers are not available. Similarly a judicial officer whose
family is residing at a place other than the district of domicile is least concerned for a
posting near to his district of domicile. For example a judicial officer whose district of
domicile is Mianwali and his family is residing at Lahore is least concerned for his
posting near Mianwali District and for such judicial officers the posting adjacent to

Lahore is more beneficial. The background is given to elaborate different positions of


judicial officers regarding their transfer and posting. So in the light of above
background the following amendments are suggested in the proposed The Punjab
Judicial Officers Transfer Policy 2016. In the 3rd Para the phrase right man at right
place is not explain so 3rd Para may be rephrase in the following manner.

Province of Punjab is one zone and the principle right man at right
place maybe adopted for the purpose of transfer and posting of judicial officers.
Paramount consideration maybe as under:-
(I) A judicial officer, in ordinary circumstances, shall not be posted beyond 200
K.M. from his district of domicile however a judicial officers maybe posted
beyond 200 K.M. distance from his district of domicile in the following
eventualities.
A judicial officer who used to reside with his family at the place of his posting
maybe posted at a place where proper educational facilities and official
residences are available.
A judicial officer whose family is settled at a place other than his district of
domicile maybe posted beyond 200 K.M. from his district of domicile and
within 200 K.M. from the place where his family is settled.
An unmarried female judicial officer maybe posted near to the place where his
family is settled.
A married female judicial officer maybe posted at a place where the husband of
such judicial officers is residing.
A judicial officer whose children are studying in colleges or universities maybe
posted at a Divisional Headquarter for proper education.
The choices given ATR form should be given preference for the purpose of
transfer and posting of the judicial officers.
