Westernsocietieswereruledaccordingtoliberalprinciplessuchasespontaneusorderuntilahundredyearsago.Bythetimeof
WWIanewparadigmbeganbyreplacingthoseprinciplesforaninterventionistaitudePhilosophicalbackgroundmaybefoundinthe
socalledcontractsocialtheory,headedbyHobbes,RousseauandRawlsamongothers.AustrianSchoolhasdeliveredawiderangecritics
relyingontheantisocialcharacterofthistheory.

I.INTRODUCCIN
Lalosofaestileneconomapuesnospermiteconocerdedndevienenlasideasquelafundamentan.Siendountanto
escrupulososdiramoslalabordeleconomistapodrareducirsealadelmerotcnicocapazdeimplementarlaspolticas
econmicasqueseledemanden.PeroloseconomistasdelaEscuelaAustriacareclamanunpapeldiferenteparalaprofesin.
Paralosaustriacoseleconomistanopuedesernuncauntcnicomatemticoquediseeimpuestosalamedidadelpartido
polticodeturnoenelpoder.Eleconomistaaustriacoemplealalosofa,lahistoria,lasociologa,elderecho,etc.,ytodas
aquellasramasdelascienciassocialesquepuedanayudaracomprenderlanaturalezadelasdecisioneseconmicasdelser
humanoensociedad.Estetrabajoseinsertaclaramenteenlatradicinaustriacayporellosuenfoqueesbastantealejandodel

espolearonclaramenteelpesodelestado.Nosotrosnosvamosacentrarenlalosofa,enparticularenlateoradelcontrato
socialdesarrolladaprincipalmentepornombrescomoHobbes,Kant,Rousseau[1]ymsrecientementeJohnRawls.Creemos
queesesateoralaquehapenetradofuertementeennuestrassociedadeshastahacerlasmutarenbuenamedidasuherencia
histrica,pasandodesociedadesdetipohayekiano(deordenespontaneo)aotrasrawlsianas(decontratosocial).
Enunprimerlugarestudiaremosqueslateoradelcontratosocialatravsdesusdiferentesproponentesyposteriormente
lacriticaremos.Enunsegundolugarexpondremoslosanlisisdelosprincipalesautoresaustriacossobrelasconsecuencias
socialesdelcambiodeparadigma,estoes,quhasignicadoparanosotroselcambiodeparadigmaanivelmoral,

llamadocontractualismomsclsicoenarboladoporHobbes,Locke,KantyRousseau;yporotroladoseencuentrannuevos
proponentesdelcontratosocial,cuyoprincipalexponenteesellsofoestadounidenseJohnRawls,quienseconvirtien
todaunareferenciamodernatraslapublicacindesuobraUnateoradelajusticia,publicadaen1971.

Proporcionaunintentodeexplicacinomnicomprensivadelorigenyfuncionamientodelasociedad.Losautoresclsicos,a
partirdeunidealacercadelserhumanodesarrollanloquesehadadoenllamarestadodenaturalezaqueesincapazde
garantizarlapaccayprolcacooperacinsocial.Dichoestadodenaturalezapuedeserdediferentetipo:hobbesianode

freemenbecomespossibleonlywhentheindividualsareconstrainedonlytoobeytheabstractrulesthatdemarcatethedomainofthe
meansthateachisallowedtouseforhispurposes.Solongasanyparticularends,whichinasocietyofanysizemustalwaysbetheends
ofsomeparticularpersonsorgroup,areregardedasajusticationofcoercion,theremustalwaysariseconictsbetweengroupswith
dierentinterests.Indeed,solongasparticularpurposesarethefoundationofpoliticalorganization,thosewhosepurposesaredierent
areinevitablyenemies;anditistruethatinsuchasocietypoliticsnecessarilyisdominatedbythefriendenemyrelation.Rulesofjust

contractualistas,rawlsiano,distribucionista,intervencionistaosocialista[11].
TheresistanceagainstthenewmoralsoftheOpenSocietywasstrengthenedalsobytherealizationthatitnotonlyindenitelyenlarged
thecircleofotherpeopleinrelationtowhomonehadtoobeymoralrules,butthatthisextensionofthescopeofthemoralcodenecessarily
broughtwithitselfareductionofitscontent.Iftheenforceabledutiestowardsallaretobethesame,thedutiestowardsnonecanbe
greaterthanthedutiestowardsallexceptwherespecialnaturalorcontractualrelationsexist.Therecanbeageneralobligationtorender
assistanceincaseofneedtowardsacircumscribedgroupoffellowmen,butnottowardsmeningeneral.Themoralprogressbywhichwe
havemovedtowardstheOpenSociety,thatis,theextensionoftheobligationtotreatalike,notonlythemembersofourtribebutpersons
ofeverwidercirclesandultimatelyallmen,hadtobeboughtatthepriceofanaenuationoftheenforceabledutytoaimdeliberatelyat
thewellbeingoftheothermembersofthesamegroup.Whenwecannolongerknowtheothersorthecircumstancesunderwhichtheylive,
suchadutybecomesapsychologicalandintellectualimpossibility.Yetthedisappearanceofthesespecicdutiesleavesanemotionalvoid
bydeprivingmenbothofsatisfyingtasksandtheassuranceofsupportincaseofneed[12].
Porlotanto,concluyeHayek,quenoesrealmentesorprendentesielprimerintentodelhombremodernoenfavordelos
valoresdelordenextensofracasaraensuintentodeemergerdeentrelosvalorestribaleshistricos.Nodebemosperderde

Deformasimilarlagentequeseconsideraalineadaporlasociedaddemercadonosonportadoresdeunanuevamoralsino
simplementesongentequenohaaprendidolasreglasdeconductadelasociedadabiertaenlaquevivenyquequieren
imponeratodossusconcepciones,queellosconsiderannaturales,delasociedadtribal.EnespecialHayekapuntaaquela
izquierdanoentiendequeeltratamientoigualitariocomoellospidensoloesfactibleenunsistemaenelcuallasacciones
individualesdelosparticipantesestnrestringidas,perojamsenunsistemadeordenextensoguiadoporaccionescuyo

TheRousseauesquenostalgiaforasocietyguided,notbylearntmoralruleswhichcanbejustiedonlybyarationalinsightintothe
principlesonwhichthisorderisbased,butbytheunreectednaturalemotionsdeeplygroundedonmillenniaoflifeinthesmallhorde,
leadsthusdirectlytothedemandforasocialistsocietyinwhichauthorityensuresthatvisiblesocialjusticeisdoneinamannerwhich
gratiesnaturalemotions.Inthissense,however,ofcourseallcultureisunnaturaland,thoughundesigned,stillarticialbecauserelying
onobediencetolearntrulesratherthanonnaturalinstincts.Thisconictbetweenwhatmenstillfeeltobenaturalemotionsandthe
disciplineofrulesrequiredforthepreservationoftheOpenSocietyisindeedoneofthechiefcausesofwhathasbeencalledthefragilityof
liberty:allaemptstomodeltheGreatSocietyontheimageofthefamiliarsmallgroup,ortoturnitintoacommunitybydirectingthe
individualstowardscommonvisiblepurposes,mustproduceatotalitariansociety.[14]

IV.CONSIDERACIONESFINALES
Seraunaterriblefaltadecomprensindelosprincipiosbsicosdeunasociedadlibresipensramosquela
reduccin/eliminacindelestadoquepropugnaelliberalismovaunidoaunmalentendidoindividualismoenelquecada
personaviveaisladaynotienerelacionesconotrossereshumanos,fundamentalmenteatravsdelacooperacinyla
asociacin.Esoatentacontralamsntimanaturalizahumana,fuertementesocial.Loquepretendeelliberalismoesdevolver
elpoderasuslegtimosciudadanos.Hayekseala:
Themischievousideathatallpublicneedsshouldbesatisedbycompulsoryorganizationandthatallthemeansthattheindividualsare
willingtodevotetopublicpurposesshouldbeunderthecontrolofgovernment,iswhollyalientothebasicprinciplesofafreesociety.The
trueliberalmustonthecontrarydesireasmanyaspossibleofthoseparticularsocietieswithinthestate,voluntaryorganizations
betweentheindividualandgovernment,whichthefalseindividualismofRousseauandtheFrenchRevolutionwantedtosuppress;buthe
wantstodeprivethemofallexclusiveandcompulsorypowers.Liberalismisnotindividualisticintheeverybodyforhimselfsense,
thoughnecessarilysuspiciousofthetendencyoforganizationstoarrogateexclusiverightsfortheirmembers[15].

gobierno,seadelgradoquesea,central,regional,etc.
AjuiciodeHayeklaprecipitacin,lafaltadepacienciayconanzaenlacapacidaddeconstruirorganizacionesvoluntarias
ensociedadesunodelosgrandesmalesdenuestrotiempopuesinmediatamenteantecualquiersituacincontrovertidase
demandaurgentementelaactuacincoercitivadelgobierno.Noobstante,nadapuedeprecisamentesermsantisocialque
ungobiernoqueenlugardelimitarseaproveerunmarcolegalenelcualseproduzcaelcrecimientoespontneointervenga
activamenteenlasociedadpuesromperesoslazossocialesdeposiblecreacinyhardelasociedadunenteinmvile
incapazdereconocerseasmismacomosociedadvivaydinmica.
Esjustamenteelgranmritodelordenespontneoquesecreenenelsenodelasociedadungrannmerodiferentes
organizacionesdetipovoluntario,comunidades,mutualidades,clubes,asociaciones,etc.,dedicadasalosmsdiversos
mbitoscomolaciencia,lasartes,eldeporte,etc.[16]Resultadodeesemodelodesociedadsellegaraauna
internacionalizacinsocialculturalpaccaycooperativa.Dosciudadanossituadosenpuntosalejadosdelmundopueden
tenermsencomndebidoasupasinporelartequeconsusvecinosdeescalera,yesprecisamentelaconcepcin
voluntaristayasociacionistadelasociedadlaquetienelacapacidaddepotenciaresasnuevasredesinternacionalesde
relacin.
Laactualtendenciadelosgobiernosdeatraerhaciasurbitalosgrandesgruposdeinters(lobbies)tiendeadestruirlas
verdaderasrelacionessocialesdetipoespontneoyvoluntario,ycomoresultadolosindividuossededicanaagruparselo
mejorposibleparaobtenerlasddivasdelpolticodelturnoenlugardeproducirycolaborarenelmercado.
Noobstante,apesardetodoloexpresadoenestetrabajoqueremosrecalcarqueparcialmentelasdemandasdelos
individuosenlassociedadesoccidentalessonentendibles,ylosonpordosrazones.Primeroporquenocarecendetodo
sentidoprctico,ysegundoporqueefectivamenteexisteuncontratoquesehadecumplir.
Enelcasodelospasessocialdemcratas,esdecir,prcticamentetodosenOccidente,existeunaconstitucinquebienpodra
cumplirlasfuncionesdecontratosocialexpreso.Dichostextoslegalescontienendisposicionesdetiposocialdemcrata.Si
llevramosacabounanlisistpicamentedederechocivilobservaramosqueexisteuncontratoentreelestadoylos
ciudadanospuesefectivamentesevotayseprometehacercumplirlaconstitucin[17][18].Dichoacuerdoreejael
compromisodelestadoydetodosuaparatajepolticopublicodegarantizaralosciudadanosciertosserviciosacambiode
queestosentreguenpartedesurentayriquezaascomolaexigenciadeacatamientodelasllamadasreglasdeljuego,que
bienpodranrepresentarelcontratosocialrawlsiano.Apartirdeesemomentolosciudadanosllevanacabosusplanesde
accincontandoconqueelestadoharsuparte,esdecir,losciudadanospagansusimpuestosyporlotantotienenmenos
rentadisponibleperosabenquetendrnlosserviciosdeeducacinysanidad,entreotros,cubiertosporelestado.
Esdeestaformaquepodemoscomprenderquesiunadelaspartesnocumpleconsuobligacinlaotrapuedesentirseenel
derechodereclamarloquelecorresponde.Eseesjustamenteelfenmenoalquehemosasistidoenlosaosdelacrisis
econmicafundamentalmenteenEuropaentre2009y2012.Hemosvistocomomillonesdeciudadanossesentan
defraudadosensusexpectativaslegtimas,acusandoalestadodediferentescosas,desdeinoperanciahastafraude.Noes
nuestraposicinnilaunanilaotra.Nosotrosdefendemosqueelestadohafalladosimplementeporquetenaquefallar[19].
Seacomofuerenodebemossertanarrogantescomoparapensarquelasocialdemocraciaesuncompletosinsentidopueses
unarealidadqueestemodelohavenidofuncionandoencasitodoslospasesdeEuropaOccidentaldesdelaSegundaGuerra
Mundialyenalgunosconbastantexito,talesseanlospasesnrdicos,Suecia,DinamarcayFinlandia[20].Porlotantonos
parecejustoycomprensiblequelosciudadanoshayancredodebuenafequeelestadopuedeydebeproveer,porejemplo,
serviciossanitariosporqueashavenidoocurriendoconrelativanormalidaddurantevariasdcadasendiferentespases.
Enresumen,siexistaesecontratosocial,aceptadoporlainmensamayoradelosciudadanosysusrepresentantespolticos
almandodelosresortesdelestado,porloqueunincumplimientoensuobjetodebesertenidoencuentaenelanlisis,
tambinparalosliberales,peroantesemejantesituacinloquenosdiferenciadelosintervencionistasdetodoslospartidos
eslasolucinadaralproblema.Porsupartelosintervencionistasantimercadoclamanporunareorganizacindelestado
puesleshaestadoengaandoprometiendocosasqueluegonocumplipormalasartesensugestinyporhabrselo
regaladoaotrosgruposdepresin,fundamentalmenteelsectorbancarioygrandesempresas.Pero,cmoloveelliberal?
Dandoporhecholaexistencia(quenolegitimidad)delaconstitucinentantoquecontratosocialsuincumplimientodebe
seratendidodeformatemporal,comoahoraexplicaremos.Permtasenosutilizarunagrcaanalogamdica.Pensemosque
