Incaseofsavings/fixeddeposit/currentaccount(withcreditbalance),the
banker is the debtor, and the customer is the creditor. This is because the
bankerowesmoneytothecustomer.Thecustomerhastherighttodemand
backhismoneywheneverhewantsitfromthebanker,andthebankermust
repaythebalancetothecustomer.
Incaseofloan/advanceaccounts,bankeristhecreditor,andthecustomeris
thedebtorbecausethecustomerowesmoneytothebanker.Thebankercan
demandtherepaymentofloan/advanceontheduedate,andthecustomer
hastorepaythedebt.
Acustomerremainsacreditoruntilthereiscreditbalanceinhisaccountwith
thebanker.Acustomer(creditor)doesnotgetanychargeovertheassetsof
thebanker(debtor).Thecustomer'sstatusisthatofanunsecuredcreditorof
thebanker.

Licensee. This happens when the banker gives a sale deposit locker to the
customer. So, the banker will become the Licensor, and the customer will
becometheLicensee.

4.RelationshipofBailorandBailee
The relationship between banker and customer can be that of Bailor and
Bailee.
1.Bailmentisacontractfordeliveringgoodsbyonepartytoanothertobe
heldintrustforaspecificperiodandreturnedwhenthepurposeisended.
2.Bailoristhepartythatdeliverspropertytoanother.
3.Baileeisthepartytowhomthepropertyisdelivered.
So, when a customer gives a sealed box to the bank for safe keeping, the
customerbecamethebailor,andthebankbecamethebailee.

5.RelationshipofHypothecatorandHypothecatee
TherelationshipbetweencustomerandbankercanbethatofHypothecator
andHypotheatee.Thishappenswhenthecustomerhypothecates(pledges)
certainmovableornonmovablepropertyorassetswiththebankerinorderto
get a loan. In this case, the customer became the Hypothecator, and the
BankerbecametheHypothecatee.

6.RelationshipofTrusteeandBeneficiary
A trustee holds property for the beneficiary, and the profit earned from this
property belongs to the beneficiary. If the customer deposits securities or
valuableswiththebankerforsafecustody,bankerbecomesatrusteeofhis
customer.Thecustomeristhebeneficiarysotheownershipremainswiththe
customer.

7.RelationshipofAgentandPrincipal
The banker acts as an agent of the customer (principal) by providing the
followingagencyservices:
Buyingandsellingsecuritiesonhisbehalf,
Collectionofcheques,dividends,billsorpromissorynotesonhis
behalf,and
Actingasatrustee,attorney,executor,correspondentorrepresentative
ofacustomer.
Banker as an agent performs many other functions such as payment of
insurancepremium,electricityandgasbills,handlingtaxproblems,etc.

8.RelationshipofAdvisorandClient
When a customer invests in securities, the banker acts as an advisor. The
advice can be given officially or unofficially. While giving advice the banker
hastotakemaximumcareandcaution.Here,thebankerisanAdvisor,and
thecustomerisaClient.

intheaccountofthecustomer,thebankermusthonourallhischeques.
Thechequesmustbecompleteandinproperorder.Theymustbe
presentedwithinsixmonthsfromthedateofissue.However,thebanker
canrefusetohonourthechequesonlyincertaincases.
Secrecyofcustomer'saccount:Whenacustomeropensanaccount
inabank,thebankermustnotgiveinformationaboutthecustomer's
accounttoothers.
Banker'srighttoclaimincidentalcharges:Abankerhasarightto
chargeacommission,interestorotherchargesforthevariousservices
givenbyhimtothecustomer.Fore.g.anoverdraftfacility.
Lawoflimitationonbankdeposits:Underthelawoflimitation,
generally,acustomergivesuptherighttorecovertheamountdueata
bankerifhehasnotoperatedhisaccountsincelast10years.
