Village of Fleischmanns
Board Meeting
January 11, 2016
The Village of Fleischmanns Board of Trustees held their regular Village Board Meeting
on Monday, January 11, 2016 at the Skene Memorial Library at 6:00 p.m. Present
were Mayor Donald E. Kearney, Harriet L. Grossman, Fred Woller and David Yates. Ben
Fenton was absent.
Delaware Operations, Inc./Jim Buchan
Monthly Report/Dec. 2015
Jim Buchan discussed the repair of nine water leaks over the last summer. Water use
is currently at 25,000 gallons a day.
Jim Buchan distributed the Dec., 2015 monthly Report on the WWTP. The WWTP is
running at a reduced rate of flow and discharges effluent flow from the facility every
day of the week. Operators continue to monitor the pump station and the collection
system on a daily basis. Discussions have been held with the DEP as to problems at
the pump station which must be repaired before next summer; costing anywhere from
$40,000.00 to $100,000.00. DEP will only refund us to replace in kind parts at the
pump station. Mr. Buchan said he had a quote from A-Team Pump dated Nov. 6, 2015
to rebuild the pumps at $4,214.46. A-Team Pump claims they can put our pumps back
to 100% original condition, but warned that it would have to be done every five (5)
years.
A Team Pump/Quote Repair
Motion made by Fred Woller to authorize Jim Buchan to proceed with the quote from
A-Team Pump & Control Service, LLC out of Medusa, NY, for $4,214.46, dated Nov. 6,
2016 and begin work. Motion seconded by David Yates. Fred Woller-Aye. David
Yates-Aye. Donald E. Kearney-Aye. Harriet L. Grossman-Aye. Ben Fenton-Absent.
Motion so carried.
Purchase Orders/January, 2016
Motion made by David Yates to pay the following purchase orders for January, 2016:
Slack Chemical, bulk coagulant (PAC), GAL., 300 GAL. @ $2.85/gal, total cost of
request $855.00, reason for purchase: chemicals used in the treatment process; Slack
Chemical, chlorine bleach, 55 gal. drums, 110 gal., total cost of request $292.00,
reason for purchase: chemicals used in the treatment process; and Slack Chemical,
25% sodium hydroxide, 55 gal. drums, 220 gal. @ $1.66/gal., total cost of request
$365.00, reason for purchase: chemicals used in the treatment process. Motion
seconded by Fred Woller. David Yates-Aye. Fred Woller-Aye. Donald E. Kearney-Aye.

Delaware Engineering/John Brust
New Water Rates
John Brust discussed the composition of a letter to Village residents regarding the
increase in water rates. We want to be sure that the money we are raising is
consistent with the money that we are spending and then noting in a few particular

areas what those costs will be such as turning on or turning off water, installing or
removing meters, late notice fee, mailing fees, water shut off fee, etc.
Mayor Kearney discussed having the tapping fees incorporated into the new water
rate law. Mayor Kearney also said the Board needed to consider a tap in fee for
sewer.

Water Tap in Fee
Motion made by Donald E. Kearney to set $300.00 as the cost for a new water tap in
fee. Motion seconded by Fred Woller. Donald E. Kearney-Aye. Fred Woller-Aye.
Harriet L. Grossman-Aye. David Yates-Aye. Ben Fenton-Absent. Motion so carried.
Further discussion was held as to receipt of FEMA funds to finish the work at the ball
park and 100% grant from the CWC for a Storm water project.
As to the question of the ponding at lower Main St., John Brust advised that the
drainage contract only included very limited paving work. The contractor was
instructed to only patch above the trench across the road because Delaware
Engineering was aware that the road was to be paved by others in the near future. It
appears that it might possibly have been the Town of Middletown that actually paved
the road after the drainage project was complete, but John Brust was not completely
sure who had paved the road.
Override Tax Cap Law
Discussion was held as to adopting a Tax Cap Law. The Village Attorney will prepare
one for the next Village Board meeting.
Tax Foreclosures/Carey Wagner, Esq.
The Village Attorney advised that he was moving on the delinquent tax foreclosures in
order to get it done by next month. The title company is doing their research so they
can look at each of the properties to see who needs to be notified. Carey Wagner,
Esq. is drafting the Petition and notification will be sent by letter to everyone.
Office of the State Comptroller/Town of Middletown Court
Mayor Kearney announced that a letter was received from the Office of the State
Comptrollers Justice Court Fund that the Villages share of funds collected by the
Town of Middletown Court for the month of December 2015 is $250.00.

following resolution was duly adopted:
Whereas, the next General Village Election for officers will be held on March 15,
2015 and

Whereas, the Board of Trustees of the Village of Fleischmanns according to Election
Law Sec. 15-104(3) must designate by resolution the polling place in each district and
the hours the polls will be open,
Now Therefore, Be It Resolved, that the Village Board of Trustees designate the
Skene Memorial Library, 1017 Main Street, Fleischmanns, New York 12430 as the
official polling place in District 1 for voting in the Village of Fleischmanns Election and
designate that the polls be open the hours from 12:00 noon until 9:00 p.m.

On Monday, Jan. 11, 2016 and
Upon motion made by David Yates and seconded by Fred Woller, the following
resolution was duly adopted:
Whereas, the Village of Fleischmanns will be holding a General Village election on
March 15, 2016 and;
Whereas, Election Law Sec. 15-116-1 states the Village Board of Trustees shall adopt
a resolution appointing Election Inspectors and

Whereas, the Village Board must appoint Inspectors to be present and work on the
designated Village Registration Day, March 5, 2016 and Village Election Day, March
15, 2016 and
Whereas, the Village Board must set the salary of the Village Inspectors;
Now Therefore, Be It Resolved, that the Village Board of Trustees appoints Sandra
Roberts as Chairwoman of the Village Election, Patricia Maxim as Election Inspector,
and Dorothy Minion as Alternative Election Inspector who shall assume the office of
Inspector upon the inability or refusal of an Inspector to assume or perform their
duties and for any clerical help which may be deemed necessary and sets their salary
at $10.00 an hour.

BBQ Fest/Aug. 27, 2016
Mayor Kearney advised that Kim OBrien of the Fleischmanns Alliance for Business
has scheduled a BBQ Fest for Aug. 27, 2016 at the Fleischmanns Park which is fully

sanctioned by Kansas City Barbeque Society. They have already confirmed over 15
KCBS certified judges. Discussion was held with the Village Attorney as to liability
coverage and the naming of the Village as additionally insured. There are also
concerns and discussion about electric, water & lighting. Mayor Kearney also
mentioned that he thought the Village of Fleischmanns should have the right to take
and/or keep pictures of the event to use on the Villages website. Village Trustee
David Yates will attend the next FAB meeting Jan. 21, 2016 at 5:30 p.m. as a liaison
for the Village.
Skene Memorial Library/Roy Todd, President
Roy Todd, President of the Skene Memorial Library, approached the Village Board
about needed upgrades to the Skene Library Building replacing the inefficient and/or
non-functioning lighting, potentially re-finishing the floors and/or area carpeting or
wall to wall carpeting. The ceiling needs repair & is a unique ceiling with an odd
structure behind the plaster. Mr. Todd inquired if the Village Board would like him to
look into grant funding for these projects either collectively or individually & once that
is done, report back to the Village Board. Roy also advised that he understood that
the OConnor Foundation has monies

& they do their funding in April and September. He understands that OConnor insists
on matching funds & that the Mark Project, Inc. might possibly be able to come up
with matching funds.
The Village Board agreed to have Roy Todd move forward with the above.
DOT/Shared Services Agreement
The Village Attorney, Carey Wagner, pointed out that the Shared Services Agreement
from DOT did not include the listing of detailed equipment in Schedule A, most
shared service agreements are open-ended and this agreement is for one year. This
agreement also states that the Village will indemnify the state for any municipal
damages to state property and typically that would be a mutual indemnification.
Motion made by Harriet L. Grossman to table any decision on the Shared Services
Agreement from DOT. Motion seconded by Fred Woller. Harriet L. Grossman-Aye.

National Flood Insurance Program
Mayor Kearney announced that a letter was received from FEMA advising they had
received no appeals of the proposed flood hazard determinations from the Village of
Fleischmanns. Any comments received have been resolved. The determination of
the Agency as to the flood hazard information our community is considered final.
FEMA will publish a notice of final flood hazard determinations in the Federal Register
as soon as possible. The FIRM for our community will become effective on June 16,
2016, and will revise the FIS report and FIRM which were in effect prior to that date.
The Village of Fleischmanns also has to pass a Local Law accepting the new flood rate
maps.
Traffic Signs/Harriet L. Grossman, Deputy Mayor
Harriet Grossman spoke with Wayne Reynolds of Delaware County DPW, who
confirmed that a long study was not required to install traffic signs in a Village.

Harriet would like to see a Stop Ahead sign by the Old Fire Hall. The Village
Attorney will check on the appropriate set back distance for the installation.
Public Input
Discussion was held as to dogs at large, garbage receptacles, the Village pool, bridges
at Lake St. & Bridge St., Scenic By-Way, Maple Fest, etc.
Vouchers/January 2016
Motion made by Fred Woller to pay the following vouchers for the month of January,
2016: Capital Reserve Fire Fighting Equipment Fund, Abstract # 1, Vouchers 1
through 2 totaling $17,681.22; General Fund, Abstract # 12, Vouchers # 193 through
212 totaling $29,647.59; Water Department Fund, Abstract # 8, Vouchers # 48
through 51 totaling $2,710.70; and the Sewer Department Fund, Abstract # 8,
Vouchers # 72 through 78 totaling $24,760.16. Motion seconded by David Yates.
