workingonthebiannualbudgetinearlyFebruary,andbythetimethat
wrappedupwewerealreadywellintotherenewalseason.Wenowturnourattentiontothe
daytodaybusinessoftheBoard,asweconstantlystrivetofindnewwaystooperatemore
efficiently,andserveyoubetter.

InthisNewsletteryouwillfindvariousarticlesdesignedtokeepyouuptodateonthelatest
informationaswellainformedabouttheBoard.Pleasenotethefinancialstatementforthe
Auctioneer'sEducation,Research,andRecoveryFund.Evenwiththefinal$50,000.00sweep,
leftoverfromGovernorBeshear'sbudget,wearenearlybacktothestatutoryminimuminthat
account.GovernorBevin'sbudgetdidnotincludeanytransferstothegeneralfund,sowe

fundsonhandtosurviveasuddendownturninlicensees,orotherunforeseeableemergency,is

OverthepasteightyearsIhavewrittennumerousarticles,answered
hundredsofquestions,andtraveledacrossthestateteachingathreehour
courseonsellingfirearms,butstill,firearmssalescontinuetobeoneofmostmisunderstoodareasin
auctioneering.Manyquestionsstillremain.Tobeclear,thereisnotasinglementionoffirearmsinKRS
330,orinanyofouradministrativeregulations.Firearmssalesaregovernedpredominantlybyfederal
law,andbyafewadditionalstateandlocalregulations.So,doesthatmeanthatourBoardhasnostake
inthematter?Ofcourseitdoesn't!Asaregulatoryagency,whosemissionispublicprotection,itisour
dutytoensurethatauctioneersfollowALLrulesandregulations,notjustthosecontainedinourown
statutes.Thereiscertainlyanelementof"publicprotection"inmakingsurefirearmssalesareproperly
conducted.

ThepositionoftheKentuckyBoardofAuctioneersisquiteclear,andremainsunchanged;wefully
supportthe2ndAmendmenttotheU.S.Constitution,butwealsohaveadutytoensurethatauctioneers
conformtoexistingfederallawswhenauctioningfirearms.ViolationoflawsoutsideKRS330is
addressedinthefollowingsubsectionsofKRS330.110(10)Anyconductofalicenseewhichdemonstrates
badfaith,dishonesty,incompetence,oruntruthfulness;(11)Anyotherconductthatconstitutes
improper,fraudulent,dishonest,ornegligentdealings.TheBoardhasconcludedthattheimpropersale
offirearms,inviolationoffederallaw,demonstratesimproper,incompetent,ornegligentdealings.

Therules,astheyhaveexistedformanyyears,areasfollows.

Auctioneers,withoutaFederalFirearmsLicensemayassistanestateindisposingoffirearms
throughtheauctionprocess.
Auctioneersshouldnottakepossessionofthesefirearms.
Auctioneers,withoutaFederalFirearmsLicenseshouldnotacceptfirearmsonconsignment.
Auctioneers,whosellfirearmsthroughtheirauctionsonaregularbasisarepresumedbyFederal

Generallyspeaking,therearetwotypesofauctions:estatetypeauctionsandconsignmentauctions.
Inestatetypeauctions,thearticlestobeauctioned(includingfirearms)arebeingsoldbytheexecutorof
theestateofanindividual.Thefirearmsbelongtoandarepossessedbytheexecutor.Thefirearmsare
controlledbytheestate,andthesalesoffirearmsarebeingmadebytheestate.Theauctioneerisacting
asanagentoftheexecutorandassistingtheexecutorinfindingbuyersforthefirearms.Inthesecases,
theauctioneerdoesnotmeetthedefinitionofengaginginbusinessasadealerinfirearmsandwouldnot
needalicense.Anauctioneerwhodoeshavealicensemayperformthisfunctionawayfromhisorher
licensedpremises.

Inconsignmenttypeauctions,anauctioneeroftentakespossessionoffirearmsinadvanceofthe
auction.Thesefirearmsaregenerallyinventoried,evaluated,andtaggedforidentification.Thefirearms
belongtoindividualswhohaveenteredintoaconsignmentagreementwiththeauctioneergivingthat
auctioneerauthoritytosellthefirearms.Theauctioneerthereforehaspossessionandcontrolofthe
firearms.Underthesecircumstances,anauctioneerwouldgenerallyneedalicense.Ifyouarenotsureif

Thisstatementalsoappearstodefinean"estate"asbeingsoldbyanexecutor,whichwouldruleoutso
called"livingestate"sales,whicharelittlemorethanconsignmentsinthefirstplace.

Consignmentauctionsareobviouslyprohibited,andtheserecommendationshaveremainedunchanged
formanyyears.

PleasetakenoteFurtherviolationsoftheabovementionedguidelinesmaybeconsideredasPrima
FacieevidenceforaninvestigationbytheBoard,whichmayresultindisciplinaryactionunderKRS330.

WHOHANDLESYOURPAPERWORK?

DuringeachrenewalperiodLavonneandIgettospeakwithagreat
manysecretariesandwivesofauctioneers.Thesedutifulhelpers
oftencalltheBoardtodiscussproblemswiththerenewal
process.Wetrytoprovidethesamehelptothesefolksaswe
wouldifdealingdirectlywiththeLicensee,butweneverdivulge
personaldata.Obviously,anyonewhoknowsyoursocialsecuritynumberandlicensenumber
cancompletetherenewalprocess.
Weknowmostauctioneersleadbusylives,andthosewhoareblessedwithacheerfulsecretary,
oraninvolvedlifepartnerareluckyindeed.Wealsoknowthatmanylicenserenewals
arehandledentirebysomeoneotherthantheactualLicensee.It'stherealworld;weget
it.But,Licenseesareurgedtousegreatcarewhendelegatingthisresponsibility.Keepinmind
thatjustbecauseyourwifeorsecretaryknowsyourlicensenumberandthelastfourdigitsof
yoursocialsecuritynumber,thatdoesnotmeantheyknowenoughaboutyoutocorrectly
completethistask.Duringtherenewalprocesssomeoneisgoingtobeaskedto"sign"the
Licensee'sname.Thatisdonewithakeyboardinsteadofarecognizablesignature,butYOU,
theLicensee,willberesponsibleforeverythingenteredonyourbehalf.Whendelegatingthis
responsibility,ifyoufailedtodiscloseanactionthatwastakenagainstanotherprofessional
license,orthatyouforgottopayafewinstallmentsonyourstudentloandebt,the
consequencescouldbequiteseriousifdiscovered.Wehighlyrecommendtakingafewminutes
tocompletetherenewalprocessyourself,ortoatleastbelookingovertheshoulderofthe
persontowhomtheresponsibilityisentrusted.

AstheChairmanoftheBoardIpresideoverthemeetingsasthe
Boardreviewscomplaintsfiledagainstauctioneers.Forsomereasonit
seemsthatsimilarcomplaintsseemtocomeindroves.Lately,severalcomplaintshavebeenfiledthat
involveauctioneersaddingitemstoauctions.Thispracticeisnothingnew,anditisnotillegal,ifsome
basicguidelinesarefollowed.Belowarealistofthingsthatshouldbeconsidered:

Hastheadditionbeenapprovedbytheseller,towhoseauctiontheitemswillbeadded?This
shouldbethefirststep,andtheoriginalcontractshouldbeupdatedtoincludetheclient's
approval.Afulllistingofitemsshouldbeprovidedtotheoriginalclient,andhis/heracceptance
shouldbeclearlystatedinthecontract.Theoriginalclientshouldalsobetoldiftheadded
seller(s)willbepayingaportionoftheadvertisingorotherassociatedfees.
Doyouhaveaseparatecontractfortheaddeditems?Youmusthaveacontractforanyitems
auctioned,andthatincludesthose3,or4itemsaddedintoanothersale.
Haveyouaddedmorethan25%totheoriginalauction?Ifso,theauctioncannolongerbecalled
"theestateof...,ortheLivingestateof...".Inotherwords,ifyouaddmorethan25%ofitemsto
"TheEstateofJohnDoe",youcannolongeradvertisetheauctionas"theEstateofJohn
Doe".Simple.
FirearmsshouldNEVERbeaddedtoANYauction!UnlessaFederalFirearmsLicenseeisinvolved
inthetransaction,thereisnowaytoaddafirearmtoanauctionwithoutviolatingFederalLaw.
Shouldyouinformthecrowd?KRS330.230(7)(b)requiresthatthewording"WithAdditions"be
addedtoalladvertisingifasingleitemisadded.Althoughitisnotspecificallystatedinthe
statute,itisfraudulenttoadditemstoanauctionwithoutinformingthebuyers.Localresidents
oftenknowwhattheirneighborsown,and"mysteryitems"canhaveachillingeffectonthe
auction.Iftheysaw"FarmerJoe"drivethatsingle,faded,oldFarmallTractordayandnight,
theywilloftensuspectfraudulentactivitywhentheyseeafieldfullofniceequipmenttheyhave
neverbeforeseen.Somebidderswillbeinterestedincertainitemssolelybecauseofafamilialor
friendlyconnection,orbecauseofthepopularityornamerecognitionofthepreviousowner.
Buyerswilloftenpayapremiumpricebasedsolelyonsuchfactors.Imaginetheirsurprisewhen
theylearnthattheitempurchasedat"CousinEddie'sEstateSale"wasactuallyownedby
someonetheydidn'tknow,andhasnoconnectionto"CousinEddie"atall.Suchdiscoveriescan
definitelyaffectyourbusinessandreputation,andwillundoubtedlyleadtocomplaints.
Anotherfactortoconsideriswhethertheaddeditemswilldetractfromyouroriginalclient's
sale?Ifyouareauctioningtwobeatup,fadedoldfarmtractorsforyouroriginalclient,the
additionofashiny,barnkept,JohnDeerewillonlyservetomakehisoldtractorslookworse.
Evenifyourprimarysellerhasgivenhis/herapprovalforadditions,yourfiduciaryresponsibilities
tohim/hermightbeaffected.Weoncehadacomplaintwhereasellerwasnothappywiththe
pricesanauctioneerhadattainedformanyitems.Heparticularlycomplainedthattwopickup
trucks,addedtothesalewithouthispermission,hadmorecrowdinterestandbroughtmore
moneythanhisowntrucks.Hemighthavebeenhappywiththesaleofhisowntrucks,ifhehad
notbeengivensuchanobviousmeansofcomparison.Itdidn'thelpmattersthattheownersof
theaddedtruckspaidnoportionoftheadvertising,andthecomplainantknewnothingoftheir
additionuntiltheyweresittinginhisyardonthemorningofhisonsiteauction.

Thereismuchtobeconsideredbeforeadecisionismadetoadditemstoanyauction.Therearelegal
requirementsthatMUSTbemet,aswellaspracticalmattersthatshouldbecarefullyweighed.Thereare
plentyofproblemsjustwaitingtohappen,don'tcreateextraproblemsforyourself.Giveitsome
thought,anddotherightthingeverytime.

CoreCourseCompletes1stCycleOnlyCycleforSome

TheKentuckyCoreCoursehascompletedits'firstfouryearcycle,andbyanymeasureithasbeenagreat
success.Servingasa"refresher"courseonKentuckyauctionlaw,regulations,ethics,contracts,and
generalknowledge,theCoreCoursehasalittlesomethingforeveryone.

Duringthefirsttwoyearsofthecycle,ItaughttheCoreCourseinliveclasses,andoftenborethebrunt
ofcomplaintsfrom"seasoned"auctioneers,someofwhomhadneverbeforetakenasingleeducation
class.Ilistenedintentlytotheirpleadings,andthenaskedeachtofairlyevaluatethecoursethroughout
theday,andtotellmelateriftheypickedupanyusefulinformation.Almostwithout
exception,everyonelearnedsomethinguseful,ortheyrememberedsomethingtheyhadpreviously
learned,andthenforgotten.

ForauctioneerslicensedbeforeJanuary01,1980,therewillbenorepeatofthefouryearcycle.When
KRS330wasrefittedin2014theGeneralAssemblyaddedlanguagethatexemptedLicenseeswith25
yearsofcontinuousservicefromtheCoreCourse.Thischangewillreturnthosepre1980Licenseesto
fullyexemptstatus.EVERYONE,licensedafterJanuary01,1980,willstillberequiredtoattendCE,but
theBoardcannotrequiretheyattendtheCoreCourse.MostwillstillchoosetoattendtheCoreCourse,
sinceitissomeofthebesttrainingavailable,anditwillbeupdatedbeforethenextrenewalperiod.

Noneofusaresosmart,orsowellaccomplishedthatthereisn'troomforgrowthandimprovement.The
CoreCoursechallengedeachofustogivealittleofourselves,inorderthatwemightgainmuchin
return.Anoccasionalreminderofthepropermethodsofdoingbusiness,andagentlenudgeintheright
directionisgoodforthisindustry,andgreatforConsumers.TheCoreCoursehasnowservedasthat
"nudgingreminder"forfouryears,andwelookforwardtothenextfourforMOSTLicensees.

MostContractsareInsufficient

WehavenowcompletedonefullcycleoftheCoreCourse,soevery
licenseeintheCommonwealthhasbeeninstructedthatall"absolute"
auctioncontractsmustincludeabindingrequirementasstatedinKRS330.220(3)(c).Thatsectionstates:
"Noauctionshallbeadvertisedas"absolute"...unless...theauctionlistingcontractcontainsabinding

requirementthattheseller,oranyoneactinguponbehalfoftheseller,shallnotbidattheabsolute
auction,orotherwiseparticipateinthebiddingprocess."Thissectionofthestatuteisclear,and
unambiguous;theacknowledgementmustbeinthecontract.Sowhyhavethelastfive(5)written
complaintsrevealedabsoluteauctioncontractswithouttheacknowledgement?

Allauctioneersshouldimmediatelyreviewtheirlistingcontracts,andincludethislanguageintothe
contract.Thiscanbedoneasanaddendum,untilnewcontractscanbeprinted,butitmustbe
done.Thisacknowledgementshouldincludeappropriatespaceforthesellertosignanddate,indicating
theirunderstandingandacceptanceoftheabsoluteauctionacknowledgement.
Nothavingaproper"absolute"auctioncontractisgroundsfordisciplinaryaction,evenifthecomplaint
whichledtothediscoveryisdismissed.

TheInformationGap

Letmebeginbysaying,"thankstoeveryone,whotakesthetimetoopen,
andreadthisnewsletter".TheBoardbelievesstronglythatkeepingyou
informedisoneofthemostimportantfunctionsofthisagency,andIfully
agree.

Duringarecentconversation,anauctioneeractuallysaid,inexplainingwhyhedidnotattendcontinuing
educationbeforetheendofthelicensingyear,"youknowaswellasIdothatemails,newslettersand
correspondenceareseldomread..."Unfortunately,heisright'but,asItoldhim,thatdoesnotrelieve
oneoftheresponsibilitytofollowsuchdirectives.IhadtoalsotellhimthatthelateCEpenaltyis
$300.00.

Withthepriceofpostagerisingallthetime,thedaysofpapernewslettersarebehindus.Infact,asa
governmentagencywearerequiredtoreduceprintingandmailingcoststhroughthedigitaldistribution
ofmostwrittentext.ForthatreasonweurgeallLicenseestokeeptheiremailaddressesupdatedwith
ourOffice.Thereisnochargetochangeanemailaddress.Wellinformedauctioneersarehappy
auctioneers,especiallywhentheyaresavingmoneyandstayingoutoftrouble.Stayinformed!

ConvertingAuctionsinMidstream

Recently,Ihadarequestfromanauctioneerforanarticleexplaining
theprosandconsofauctionsbeingchangedto"absolute"inthe
middleoftheevent.

Mostofuswhohavebeenaroundauctionsforanytimehaveheardanauctioneerinterrupthis

normalbidcallingtoannouncetothecrowdthatwe"nowhaveourselvesanabsoluteauction".
Someauctioneersdothiswhenareservepriceisreached,orthesellercommunicateshis/her
intenttosellthepropertyatthecurrentbid.Isthislegal?Isitadvisable?Well,theanswer,
quitesimply,is"no"and"no".HerearejustafewreasonswhytheBoardrecommends
auctioneersavoidsuchactions.

1. Doyouhaveapropercontractforanabsoluteauction?Iftheoriginalcontractcalledfor
areserve,sellerconfirmation,oranythingotherthansellingtothehighestbid,oddsare
thatsamecontractisinsufficienttoallowanauctioneertoevenuttertheword
"absolute"fromthepodium.
2. Beforemakingthatstatementfromthepodiumdidyoutakethetimetoexplaintoyour
sellerthathe,nornooneonhis/herbehalfcanbidontheproperty?Didyouobtainthe
seller'ssignaturethathewasawareoftherequirementsofanabsoluteauction,andthat
he/shefullyunderstoodthoserequirements?
3. Didyourselleralreadybidontheproperty?Thatcouldopenallsortsofnewproblems.
4. Whatifthelastbiddersuddenlyretractshis/herbid?
5. Isthebidderacceptabletoyourbuyer?Allabsoluteauctionsmustbesold,regardlessof
thebidamount,ortheidentityofthebidder.Itisrarethatasellerwouldrefuseasale
basedsolelyontheidentityofthebidder,butoncetheauctionisconverted,yourseller
nolongerhasanoptiontorefuseforanyreason.
Asyoucansee,therearemanypotentialproblemsthatarecreatedoncetheword"absolute"is
introduced,andthereislittletobegainedatthatpointintheauction.Ifyoursellerhasagreed,
youcanannouncewhenthereservepricehasbeenmet,whichwillhavethesameeffect
withoutalltheadditionalrequirementshavingtobemet.Thereis;however,norequirement
thatanythingbeannouncedwhenareservepriceisreached.
