Convict cant be appointed to public office:

SC

Directs NAB to remove employees on deputation;

says if court removes them they will get nothing
ISLAMABAD: While hearing a suo moto case against illegal appointments on deputation
in the National Accountability Bureau (NAB) on Wednesday, the Supreme Court (SC)
remarked that a convict could not be appointed to public office and NAB should itself
remove officers working on deputation, otherwise those officers would get nothing if the
court made them quit.
A three-member bench of the Supreme Court, led by Chief Justice Anwar Zaheer Jamali and
comprising Justice Amir Hani Muslim and Justice Ejazul Hassan, resumed hearing into the suo
moto notice taken against the appointment of six in-service army officers in NAB and their
appointment as acting directors and other such irregularities in the Bureau. The court directed the
NAB chairman to take a decision by himself to remove the illegally-appointed officers and those
working on deputation in NAB. The court adjourned the hearing till November 30.
During the hearing, Justice Amir Hani Muslim said had the NAB performed its duty fairly, the
court would have not to intervene. He said that a convict could not continue to perform duty on
official post, adding the NAB chairman should himself remove them and otherwise these
officials would get nothing if the court removed them and they would have to return all benefits
and perks they used to enjoy. He said that illegible persons were awarded grade 21 and there was
no concept of double promotion in the service rules and the charge of acting should be taken
back from those officers. During the hearing of petition filed by actual NAB officers, the court
asked Khawaja Haris Ahmad advocate, who represented NAB, about service profile of the
employees of NAB. He took the stance that the documents of the service profile of the NABs
employees were ready and this would be submitted today after satisfaction.

Justice Amir Hani remarked that NAB had appointed retired officers again on high posts for
indefinite period and how an officer of a grade-19 would work fairly while sitting on the post of
grade-21. He said that there was no concept of double promotion in the service rules. He said
how a person could sit in the public office who was convicted by a military court.
Chief Justice Anwar Zaheer Jamali remarked that the black sheep approached NAB to avoid
court action and carried out deal and NAB gave them facility to pay plundered amount in
installments and pay first installment and let them go to mint more money.
