PETITION

Petitioner, states that:

1. He is a Filipino citizen, married, forty-five years of
age, and a resident in the Philippines since birth and
holding office at DOJ Agencies Bldg. NIA Road cor
East Ave, Diliman Quezon City.

2. He was admitted to the Philippines Bar on April 7,

2000 with Roll of Attorneys 287686. A copy of
Petitioners Certificate of Membership in the
Philippine Bar issued by the Office of the Bar
Confidant is attached as annex A.
3. He has not applied for commission before any other
jurisdiction.
4. He possess all the qualification and none of
disqualification of a Notary Public
5. He is a lawyer in good standing with clearances from
the Office of the Bar Confidant of the Supreme Court
and the Integrated Bar of the Philippines, attached as
Annexes B and C.
6. He has not been convicted in the first instance of any
crime involving moral turpitude, nor charged in any
administrative case in connection with her present
profession.
7. He has paid his Professional Tax Receipt for the year
2015 under Professional Tax receipt 94743, a copy is
attached as Annex D.
8. He is a bona fide member in good standing of the
Integrated Bar of the Philippines as supported by a
photocopy of the Official Receipt of yearly dues as of
2015, attached Annex E
9. He has attached a facsimile of his notarial seal,
together his specimen signature, attached as Annex
F.

Accordingly, it is asks that after due notice, publication

and hearing to grant this Petition for Appointment of Notarial
Commission for and in the city of Quezon.

COMPLAINT
Plaintiffs by counsel, states;
1. Jerry and Daisy is a resident of 1253 Vicente Cruz St.,
Sampaloc Manila.
2. Rodolfo, on the other hand is a Filipino, married and
residing at 123 Dapitan St., Sampaloc, Manila where he
may be served with summons and other court
processes.

CAUSE/S OF ACTION
3. Spouses Jerry and Daisy commissioned Rodolfo to draw
in charcoal their family portrait. Part of their agreement
is the payment of Php 500,000 for the family portrait.

4. Rodolfo breached his undertaking by not doing the

portrait. Written demand for the completion and
delivery of the portrait was instituted by Spouses
Manuel. Rodolfo simply ignored the demand and has
not been heard since then.
RELIEF
Accordingly, Jerry and Daisy asks that judgment be
rendered ordering Rodolfo and all other person acting
on his behalf to:
1. Return the Php 500,000 that has been given to
Rodolfo for the payment of the portrait
2. Pay him litigation expenses and attorneys fee of
50,000 and other remedies as may be just and
equitable in the premises.
