LEASE CONTRACT

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT OF LEASE is made and executed at the City of _____, this day of
_______________, 20__, by and between:
(NAME OF LESSOR), of legal age, single/married to (Name of spouse if any),
Filipino, and with residence and postal address at (Address), hereinafter referred to as
the LESSOR.
-AND(NAME OF LESSEE), Filipino and with residence and postal address at
(Address), hereinafter referred to as the LESSEE.
WITNESSETH; That
WHEREAS, the LESSOR is the owner of THE LEASED PREMISES, a residential
property situated at (Address of property to be leased);
WHEREAS, the LESSOR agrees to lease-out the property to the LESSEE and the
LESSEE is willing to lease the same;
NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR
leases unto the LESSEE and the LESSEE hereby accepts from the LESSOR the
LEASED premises, subject to the following:
TERMS AND CONDITIONS
1. PURPOSES: That premises hereby leased shall be used exclusively by the LESSEE
for residential purposes only and shall not be diverted to other uses. It is hereby
expressly agreed that if at any time the premises are used for other purposes, the
LESSOR shall have the right to rescind this contract without prejudice to its other
rights under the law.
2. TERM: This term of lease is for ONE (1) YEAR. from (Date) to (Date) inclusive. Upon
its expiration, this lease may be renewed under such terms and conditions as my be
mutually agreed upon by both parties, written notice of intention to renew the lease
shall be served to the LESSOR not later than seven (7) days prior to the expiry date of
the period herein agreed upon.
3. RENTAL RATE:

The monthly rental rate for the leased premises shall be in

PESOS: AMOUNT IN WORDS (P 00,000.00), Philippine Currency. All rental payments


shall be payable to the LESSOR.

4. DEPOSIT:

That the LESSEE shall deposit to the LESSOR upon signing of this

contract and prior to move-in an amount equivalent to the rent for THREE (3)
MONTHS or the sum of

PESOS: AMOUNT IN WORDS (P 00,000.00), Philippine

Currency. wherein the two (2) months deposit shall be applied as rent for the 11th
and 12th months and the remaining one (1) month deposit shall answer partially for
damages and any other obligations, for utilities such as Water, Electricity, CATV,
Telephone, Association Dues or resulting from violation(s) of any of the provision of
this contract.
5. DEFAULT PAYMENT: In case of default by the LESSEE in the payment of the rent,
such as when the checks are dishonored, the LESSOR at its option may terminate this
contract and eject the LESSEE. The LESSOR has the right to padlock the premises
when the LESSEE is in default of payment for One (1) month and may forfeit whatever
rental deposit or advances have been given by the LESSEE.
6. SUB-LEASE:

The LESSEE shall not directly or indirectly sublet, allow or permit

the leased premises to be occupied in whole or in part by any person, form or


corporation, neither shall the LESSEE assign its rights hereunder to any other person
or entity and no right of interest thereto or therein shall be conferred on or vested in
anyone by the LESSEE without the LESSOR'S written approval.
7. PUBLIC UTILITIES:

The LESSEE shall pay for its telephone, electric, cable TV,

water, Internet, association dues and other public services and utilities during the
duration of the lease.
8. FORCE MAJEURE:

If whole or any part of the leased premises shall be destroyed

or damaged by fire, flood, lightning, typhoon, earthquake, storm, riot or any other
unforeseen disabling cause of acts of God, as to render the leased premises during the
term substantially unfit for use and occupation of the LESSEE, then this lease
contract may be terminated without compensation by the LESSOR or by the LESSEE
by notice in writing to the other.
9. LESSOR'S RIGHT OF ENTRY:

The LESSOR or its authorized agent shall after

giving due notice to the LESSEE shall have the right to enter the premises in the
presence of the LESSEE or its representative at any reasonable hour to examine the
same or make repairs therein or for the operation and maintenance of the building or
to exhibit the leased premises to prospective LESSEE, or for any other lawful purposes
which it may deem necessary.
10. EXPIRATION OF LEASE:

At the expiration of the term of this lease or

cancellation thereof, as herein provided, the LESSEE will promptly deliver to the
LESSOR the leased premises with all corresponding keys and in as good and tenable
condition as the same is now, ordinary wear and tear expected devoid of all occupants,
movable furniture, articles and effects of any kind. Non-compliance with the terms of
this clause by the LESSEE will give the LESSOR the right, at the latter's option, to
refuse to accept the delivery of the premises and compel the LESSEE to pay
renttherefrom at the same rate plus Twenty Five (25) % thereof as penalty until the
LESSEE shall have complied with the terms hereof.

The same penalty shall be

imposed in case the LESSEE fails to leave the premises after the expiration of this
Contract of Lease or termination for any reason whatsoever.
11. JUDICIAL RELIEF:

Should any one of the parties herein be compelled to seek

judicial relief against the other, the losing party shall pay an amount of One Hundred
(100) % of the amount clamed in the complaint as attorney's fees which shall in no
case be less than P50,000.00 pesos in addition to other cost and damages which the
said party may be entitled to under the law.
12. This CONTRACT OF LEASE shall be valid and binding between the parties, their
successors-in-interest and assigns.

How to create an apartment rental contract

An apartment lease is a very important document that will protect both the

owner of the apartment and the one renting it. A lease is a legal contractthat specifies
the responsibilities of the landlord and tenant. It becomes a binding contract upon the
signing of both parties; provided that both are of legal age and competent to enter into
such an agreement. If the lessee is under eighteen years of age, a co-signor is required.
The contract may be witnessed and/or notarized.
As a landlord, it is advisable to create an apartment contract or lease before renting out
an apartment in order to define the rules, obligations, and expectation that should be
followed by tenants while residing in your property. For instance, the lease should
clearly indicate start of tenancy, end of tenancy, total rental costs, due date of rental
payment, amount of security deposit, rules, regulations, policies, etc. The more detailed
the apartment lease, the more terms will likely be understood by both parties. It may
help minimize misunderstandings between the landlord and tenant.
Create a rental agreement using a computer or typewriter with clear font. A hand-write
a lease is discouraged because it appears unprofessional. The contract should be neat
and easy to read. It is advisable to consult a lawyer to review the contract to ensure that
it conforms to local laws and gives the parties full protection.
Avoid forgoing contract signing because the tenant is a friend, former classmate,
relative, etc. Avoid landlord and tenant disputes by making no exemptions. A binding
contract may help ensure orderly and peaceful rental of the property during the duration
of the lease.
The written lease will provide protection for both landlord and tenant especially if either
one fails to abide by what is stipulated on the contract during the timeframe in the lease.
Exhibits or attachments may be added to the lease. For instance, the lessor may attach
photos of the apartment to establish that it is in good condition during the start of the
lease term.

The wording in the lease is very important to make sure that all aspects of renting are
covered. Here are some of the vital elements of an apartment rental contract.
1. The apartment rental contract should begin with a heading that includes the name
and contact information of the landlord, names and contact information of tenants, and
address of the apartment to be rented. Take note that in the contract, the lessor is the
landlord or party granting the lease while the lessee is the tenant/tenants or party
renting the apartment.
2. Provide a section where the tenant shall list the names of all the people who will be
allowed to stay in the apartment such as spouse and children.
3. Add a Rent section in the contract that clearly stipulates all financial responsibilities
of the tenant. This part should include beginning and ending dates of tenancy, amount
of monthly payment, monthly due date of rental payment, address where rent is to be
paid or names of people authorized to collect payment, amount of late charges or
penalties if payments are not given at the exact due date, and amount of penalty for
any returned checks.
4. Create a Security Deposit section that indicates amount of security deposit and
period when the deposit must be returned by the landlord. Provide circumstances
wherein the deposit may be charged and held by the landlord.
5. Label the next section as Utilities. List down the different utilities (electricity, water,
phone, cable, etc.) and indicate which ones will be paid by the landlord and those that
will be shouldered by the tenant. It is advisable to indicate that the lessor is not liable in
case of faulty operation or installation of certain utilizes on the part of the lessee.
6. To protect the property, it is advisable to add a Condition of Premises section
wherein the lessee can attest that the apartment (interior and exterior) is in good
condition at the beginning of the lease term. The contract should stipulate that the
tenant is obligated to immediately report any damages to the landlord especially if it
requires repairs. The tenant is responsible for the ordinary repair and maintenance of
the apartment.
It is advisable to provide policies that define and limit what tenants can do in terms of
altering or making changes in the apartment. This may include painting, decorating,
planting, modifying the apartment interior and exterior, and making repairs.
7. Create a section entitled Access which points out that the lessor shall have the right
to access to the apartment in order to inspect and execute repairs. To protect the
privacy of the tenant, make sure you indicate that an advance notice shall be given by
the lessor to the lessee. Define how maintenance personnel will enter the premises and
who is authorized.
8. Another important section is Liability and Insurance. The landlord is released from
any liability for any damages or injury resulting from an accident, from normal use of
apartment/premises, or repair which the lessee failed to inform the lessor, and similar
conditions claimed by visitors. Outline the types insurance that landlord and tenants are
required to pay.
9. Create a section for Use, Occupancy and Sublet Agreements. Indicate if the
apartment is strictly for residential purposes only. If the lessor agrees to let the lessee
use it as home office, provide conditions pertaining to business type, customer access
to the premises, parking limitations, etc. Specify the number of people that may occupy
the apartment.
Without the prior, express and written consent of the lessor, the lessee may not transfer,
assign, sublet or grant any concession or license to the use of the apartment/premises.

Specify if subletting of the apartment is allowed or not. If yes, provide detailed terms that
should be agreed upon by both parties.
10. Provide additional sections to cover other important conditions that should be
agreed upon.

Indicate if the apartment is partially or fully furnished. Outline the items included in
the apartment during the lease. The lessee is obligated to take care of the said items
during the period of the lease. Specify charges for damaged items.

Point out if pets are allowed or not. If yes, indicate what kind of pets are allowed
and prohibited. Mention rules and obligations such as cleaning up after pets and
ensuring safety of people from pets. This may include requiring tenants to bring their
pet dogs and cats to the vet or local municipality for regular anti-rabies shots. Provide
fees or penalties if pets cause damage to the property.

Outline rules about parking (e.g. number of vehicles that a lessee may park in the
premises). Mention parking rules for guests/visitors.

Indicate if tenants are required to take care of plants on the property.

Specify change of term.

Indicate renewal terms.

Describe move-out and eviction policies.

Mention conditions related to increase in rental fees in accordance to the law.

Specify conditions for smoking especially if there are smoking and non-smoking
areas within the premises.

Clearly indicate that tenants shall not be allowed to engage in any illegal activity
on the property such as using drugs.

Provide strict provisions regarding possession of firearms.
