CONSTITUTION PRINCIPLES
RepublicofSerbia

RepublicofSerbiaisastateofSerbianpeopleandallcitizenswholiveinit,basedontheruleoflawandsocial
justice,principlesofcivildemocracy,humanandminorityrightsandfreedoms,andcommitmenttoEuropean
principlesandvalues.

Sovereigntyholders
Article2
Sovereigntyisvestedincitizenswhoexerciseitthroughreferendums,people'sinitiativeandfreelyelected
representatives.
Nostatebody,politicalorganization,grouporindividualmayusurpthesovereigntyfromthecitizens,nor
establishgovernmentagainstfreelyexpressedwillofthecitizens.

Ruleoflaw
Article3
RuleoflawisafundamentalprerequisitefortheConstitutionwhichisbasedoninalienablehumanrights.
Theruleoflawshallbeexercisedthroughfreeanddirectelections,constitutionalguaranteesofhumanand
minorityrights,separationofpower,independentjudiciaryandobservanceofConstitutionandLawbythe
authorities.

Divisionofpower

Thelegalsystemisunique.
Governmentsystemshallbebasedonthedivisionofpowerintolegislative,executiveandjudiciary.
Relationbetweenthreebranchesofpowershallbebasedonbalanceandmutualcontrol.
Judiciarypowershallbeindependent.

Politicalparties

Theroleofpoliticalpartiesindemocraticshapingofthepoliticalwillofthecitizensshallbeguaranteedand
recognized.
Politicalpartiesmaybeestablishedfreely.
Activitiesofpoliticalpartiesaimingatforcedoverthrowofconstitutionalsystem,violationofguaranteedhuman
orminorityrights,incitingracial,nationalorreligioushatred,shallbeprohibited.
Politicalpartiesmaynotexercisepowerdirectlyorsubmitittotheircontrol.

TheRepublicofSerbiashallhavecoatofarms,flagandnationalanthem.
ThecoatofarmsoftheRepublicofSerbiashallbeusedintheformoftheLargeCoatofArmsandSmallCoat
ofArms.
TheflagoftheRepublicofSerbiashallexistandbeusedastheNationalFlagandStateFlag.
NationalanthemoftheRepublicofSerbiashallbeofficialsong"Boepravde".
Appearanceanduseofthecoatofarms,flagandnationalanthemshallberegulatedbylaw.

TheStateshallguaranteespecialprotectiontonationalminoritiesforthepurposeofexercisingfullequalityand
preservingtheiridentity.

Genderequality

TheStateshallguaranteetheequalityofwomenandmenanddevelopequalopportunitiespolicy.

Internationalrelations

TheforeignpolicyoftheRepublicofSerbiashallbebasedongenerallyacceptedprinciplesandrulesof
internationallaw.
Generallyacceptedrulesofinternationallawandratifiedinternationaltreatiesshallbeanintegralpartofthe
legalsystemintheRepublicofSerbiaandapplieddirectly.
RatifiedinternationaltreatiesmustbeinaccordancewiththeConstitution.

Statusofforeignnationals

Pursuanttointernationaltreaties,foreignnationalsintheRepublicofSerbiashallhaveallrightsguaranteedby
theConstitutionandlawwiththeexceptionofrightstowhichonlythecitizensoftheRepublicofSerbiaare
entitledundertheConstitutionandlaw.

SECTION TWO

HUMAN AND MINORITY RIGHTS AND FREEDOMS


1.FundamentalPrinciples
Directimplementationofguaranteedrights
Article18

HumanandminorityrightsguaranteedbytheConstitutionshallbeimplementeddirectly.
TheConstitutionshallguarantee,andassuch,directlyimplementhumanandminorityrightsguaranteedbythe
generallyacceptedrulesofinternationallaw,ratifiedinternationaltreatiesandlaws.Thelawmayprescribe
mannerofexercisingtheserightsonlyifexplicitlystipulatedintheConstitutionornecessarytoexercisea
specificrightowingtoitsnature,wherebythelawmaynotunderanycircumstancesinfluencethesubstanceof
therelevantguaranteedright.
Provisionsonhumanandminorityrightsshallbeinterpretedtothebenefitofpromotingvaluesofademocratic
society,pursuanttovalidinternationalstandardsinhumanandminorityrights,aswellasthepracticeof
internationalinstitutionswhichsupervisetheirimplementation.

Purposeofconstitutionalguarantees

Article19
GuaranteesforinalienablehumanandminorityrightsintheConstitutionhavethepurposeofpreservinghuman
dignityandexercisingfullfreedomandequalityofeachindividualinajust,open,anddemocraticsocietybased
ontheprincipleoftheruleoflaw.

Restrictionofhumanandminorityrights
Article20
HumanandminorityrightsguaranteedbytheConstitutionmayberestrictedbythelawiftheConstitution
permitssuchrestrictionandforthepurposeallowedbytheConstitution,totheextentnecessarytomeetthe
constitutionalpurposeofrestrictioninademocraticsocietyandwithoutencroachinguponthesubstanceofthe
relevantguaranteedright.
Attainedlevelofhumanandminorityrightsmaynotbelowered.
Whenrestrictinghumanandminorityrights,allstatebodies,particularlythecourts,shallbeobligedtoconsider
thesubstanceoftherestrictedright,pertinenceofrestriction,natureandextentofrestriction,relationof
restrictionanditspurposeandpossibilitytoachievethepurposeoftherestrictionwithlessrestrictivemeans.

Prohibitionofdiscrimination
Article21
AllareequalbeforetheConstitutionandlaw.
Everyoneshallhavetherighttoequallegalprotection,withoutdiscrimination.
Alldirectorindirectdiscriminationbasedonanygrounds,particularlyonrace,sex,nationalorigin,socialorigin,
birth,religion,politicalorotheropinion,propertystatus,culture,language,age,mentalorphysicaldisability
shallbeprohibited.
SpecialmeasureswhichtheRepublicofSerbiamayintroducetoachievefullequalityofindividualsorgroupof
individualsinasubstantiallyunequalpositioncomparedtoothercitizensshallnotbedeemeddiscrimination.

Protectionofhumanandminorityrightsandfreedoms

Everyoneshallhavetherighttojudicialprotectionwhenanyoftheirhumanorminorityrightsguaranteedby
theConstitutionhavebeenviolatedordenied,theyshallalsohavetherighttoeliminationofconsequences
arisingfromtheviolation.
Thecitizensshallhavetherighttoaddressinternationalinstitutionsinordertoprotecttheirfreedomsandrights
guaranteedbytheConstitution.

2.HumanRightsandFreedoms
Dignityandfreedevelopmentofindividuals
Article23
Humandignityisinviolableandeveryoneshallbeobligedtorespectandprotectit.
Everyoneshallhavetherighttofreedevelopmentofhispersonalityifthisdoesnotviolatetherightsofothers
guaranteedbytheConstitution.

Righttolife
Article24
Humanlifeisinviolable.
ThereshallbenodeathpenaltyintheRepublicofSerbia.
Cloningofhumanbeingsshallbeprohibited.

Inviolabilityofphysicalandmentalintegrity
Article25
Physicalandmentalintegrityisinviolable.
Nobodymaybesubjectedtotorture,inhumanordegradingtreatmentorpunishment,norsubjectedtomedical
andotherexperimentswithouttheirfreeconsent.

Prohibitionofslavery,servitudeandforcedlabour
Article26
Nopersonmaybekeptinslaveryorservitude.
Allformsofhumantraffickingareprohibited.
Forcedlabourisprohibited.Sexualorfinancialexploitationofpersoninunfavourablepositionshallbedeemed
forcedlabour.
Labourorserviceofpersonsservingsentenceofimprisonmentiftheirlabourisbasedontheprincipleof
voluntaritywithfinancialcompensation,labourorserviceofmilitarypersons,norlabourorservicesduringwar
orstateofemergencyinaccordancewithmeasuresprescribedonthedeclarationofwarorstateofemergency,
shallnotbeconsideredforcedlabour.

Righttofreedomandsecurity
Article27
Everyonehastherighttopersonalfreedomandsecurity.Deprivingoflibertyshallbeallowedonlyonthe
groundsandinaprocedurestipulatedbythelaw.
Anypersondeprivedoflibertybyastatebodyshallbeinformedpromptlyinalanguagetheyunderstandabout
thegroundsforarrestordetention,chargesbroughtagainstthem,andtheirrightstoinformanypersonoftheir
choiceabouttheirarrestordetentionwithoutdelay.
Anypersondeprivedoflibertyshallhavetherighttoinitiateproceedingswherethecourtshallreviewthe
lawfulnessofarrestordetentionandorderthereleaseifthearrestordetentionwasagainstthelaw.
Anysentencewhichincludesdeprivationoflibertymaybeproclaimedsolelybythecourt.

Treatmentofpersonsdeprivedofliberty
Article28
Personsdeprivedoflibertymustbetreatedhumanelyandwithrespecttodignityoftheirperson.
Anyviolencetowardspersonsdeprivedoflibertyshallbeprohibited.
Extortingastatementshallbeprohibited.

SpecialRightsinCaseofArrestandDetentionwithoutDecisionoftheCourt
Article29
Anypersondeprivedoflibertywithoutdecisionofthecourtshallbeinformedpromptlyabouttherightto
remainsilentandabouttherighttobequestionedonlyinthepresenceofadefensecounseltheychoseora
defensecounselwhowillprovidelegalassistancefreeofchargeiftheyareunabletopayforit.
Anypersondeprivedoflibertywithoutadecisionofthecourtmustbebroughtbeforethecompetentcourt
withoutdelayandnotlaterthan48hours,otherwisetheyshallbereleased.

Detention
Article30
Anypersonunderreasonabledoubtofcommittingacrimemayberemandedtodetentiononlyuponthe
decisionofthecourt,shoulddetentionbenecessarytoconductcriminalproceedings.
Ifthedetaineehasnotbeenquestionedwhenmakingadecisionondetentionorifthedecisiononholdingin
detentionhasnotbeencarriedoutimmediatelyafterthepronouncement,thedetaineemustbebroughtbefore
thecompetentcourtwithin48hoursfromthetimeofsendingtodetentionwhichshallreconsiderthedecisionon
detention.
Awrittendecisionofthecourtwithexplanationforreasonsofdetentionshallbedeliveredtothedetaineenot
laterthan12hoursafterpronouncing.Thecourtshalldecideontheappealtodecisiondetentionanddeliverit
tothedetaineewithin48hours.

Durationofdetention
Article31
Thecourtshallreducethedurationofdetentiontotheshortestperiodpossible,keepinginmindthegroundsfor
detention.Sentencingtodetentionunderadecisionofthecourtoffirstinstanceshallnotexceedthreemonths
duringinvestigation,whereashighercourtmayextenditforanotherthreemonths,inaccordancewiththelaw.
Iftheindictmentisnotraisedbytheexpirationofthesaidperiod,thedetaineeshallbereleased.
Thecourtshallreducethedurationofdetentionafterthebringingofchargestotheshortestpossibleperiod,in
accordancewiththelaw.
Detaineeshallbeallowedpretrialreleaseassoonasgroundsforremandingtodetentionceasetoexist.

Righttoafairtrial
Article32
Everyoneshallhavetherighttoapublichearingbeforeanindependentandimpartialtribunalestablishedby
thelawwithinreasonabletimewhichshallpronouncejudgementontheirrightsandobligations,groundsfor
suspicionresultingininitiatedprocedureandaccusationsbroughtagainstthem.
Everyoneshallbeguaranteedtherighttofreeassistanceofaninterpreterifthepersondoesnotspeakor
understandthelanguageofficiallyusedinthecourtandtherighttofreeassistanceofaninterpreterifthe
personisblind,deaf,ordumb.
Thepressandpublicmaybeexcludedfromallorpartofthecourtprocedureonlyintheinterestofprotecting
nationalsecurity,publicorderandmoralsinademocraticsociety,interestsofjuvenilesortheprotectionof
privatelifeoftheparties,inaccordancewiththelaw.

Specialrightsofpersonschargedwithcriminaloffense
Article33
Anypersonchargedwithcriminaloffenseshallhavetherighttobeinformedpromptly,inaccordancewiththe
law,inthelanguagewhichthispersonunderstandsandindetailaboutthenatureandcauseoftheaccusation
againsthim,aswellastheevidenceagainsthim.
Anypersonchargedwithcriminaloffenseshallhavetherighttodefendhimselfpersonallyorthroughlegal
counselofhisownchoosing,tocontacthislegalcounselfreelyandtobeallowedadequatetimeandfacilities
forpreparinghisdefense.
Anypersonchargedwithcriminaloffensewithoutsufficientmeanstopayforlegalcounselshallhavetheright
toafreelegalcounselwhentheinterestsofjusticesorequireandincompliancewiththelaw.
Anypersonchargedwithcriminaloffenseavailabletothecourtshallhavetherighttoatrialinhispresenceand
maynotbesentencedunlesshehasbeengiventheopportunitytoahearinganddefense.
Anypersonprosecutedforcriminaloffenseshallhavetherighttopresentevidenceinhisfavourbyhimselfor
throughhislegalcounsel,toexaminewitnessesagainsthimanddemandthatwitnessesonhisbehalfbe
examinedunderthesameconditionsasthewitnessesagainsthimandinhispresence.
Anypersonprosecutedforcriminaloffenseshallhavetherighttoatrialwithoutunduedelay.
Anypersonchargedorprosecutedforcriminaloffenseshallnotbeobligatedtoprovideselfincriminating
evidenceorevidencetotheprejudiceofpersonsrelatedtohim,norshallhebeobligedtoconfessguilt.
Anyothernaturalpersonprosecutedforotheroffencespunishablebylawshallhavealltherightsofaperson
chargedwithcriminaloffensepursuanttothelawandinaccordancewithit.

Legalcertaintyincriminallaw
Article34
Nopersonmaybeheldguiltyforanyactwhichdidnotconstituteacriminaloffenceunderlaworanyother
regulationbasedonthelawatthetimewhenitwascommitted,norshallapenaltybeimposedwhichwasnot
prescribedforthisact.
Thepenaltiesshallbedeterminedpursuanttoaregulationinforceatthetimewhentheactwascommitted,
savewhensubsequentregulationismorelenientfortheperpetrator.Criminaloffencesandpenaltiesshallbe
laiddownbythelaw.
Everyoneshallbepresumedinnocentforacriminaloffenceuntilconvictedbyafinaljudgementofthecourt.
Nopersonmaybeprosecutedorsentencedforacriminaloffenceforwhichhehasbeenacquittedorconvicted
byafinaljudgement,forwhichthechargeshavebeenrejectedorcriminalproceedingsdismissedbyfinal
judgement,normaycourtrulingbealteredtothedetrimentofapersonchargedwithcriminaloffenceby
extraordinarylegalremedy.Thesameprohibitionsshallbeapplicabletoallotherproceedingsconductedfor
anyotheractpunishablebylaw.
Inspecialcases,reopeningofproceedingsshallbeallowedinaccordancewithcriminallegislationifevidenceis
presentedaboutnewfactswhichcouldhaveinfluencedsignificantlytheoutcomeofproceedingshadtheybeen
disclosedatthetimeofthetrial,orifseriousmiscarriageofjusticeoccurredinthepreviousproceedingswhich
mighthaveinfluenceditsoutcome.
Criminalprosecutionorexecutionofpunishmentforawarcrime,genocide,orcrimeagainsthumanityshallnot
besubjecttostatuteoflimitation.

Righttorehabilitationandcompensation
Article35
Anypersondeprivedofliberty,detainedorconvictedforacriminaloffencewithoutgroundsorunlawfullyshall
havetherighttorehabilitationandcompensationofdamagebytheRepublicofSerbia,aswellasotherrights
stipulatedbythelaw.
Everyoneshallhavetherighttocompensationofmaterialornonmaterialdamageinflictedonhimbyunlawful
orirregularworkofastatebody,entitiesexercisingpublicpowers,bodiesoftheautonomousprovinceorlocal
selfgovernment.
Thelawshallstipulateconditionsunderwhichtheinjuredpartymaydemandcompensationfordamagedirectly

fromthepersonthatinflictedthedamage.

Righttoequalprotectionofrightsandlegalremedy
Article36
Equalprotectionofrightsbeforecourtsandotherstatebodies,entitiesexercisingpublicpowersandbodiesof
theautonomousprovinceorlocalselfgovernmentshallbeguaranteed.
Everyoneshallhavetherighttoanappealorotherlegalremedyagainstanydecisiononhisrights,obligations
orlawfulinterests.

Righttolegalperson
Article37
Everyoneshallhavelegalcapacity.
Uponbecomingofageallpersonsshallbecomecapableofdecidingindependentlyabouttheirrightsand
obligations.Apersonbecomesofageafterturning18.
Apersonmaychooseandusepersonalnameandnameoftheirchildrenfreely.

Righttocitizenship
Article38
AcquiringandterminatingcitizenshipoftheRepublicofSerbiashallberegulatedbythelaw.
AcitizenoftheRepublicofSerbiamaynotbeexpelledordeprivedofcitizenshiportherighttochangeit.
AnychildbornintheRepublicofSerbiashallhavetherighttocitizenshipoftheRepublicofSerbiaunless
conditionshavebeenmettoacquirecitizenshipofsomeothercountry.

Freedomofmovement
Article39
EveryoneshallhavetherighttofreemovementandresidenceintheRepublicofSerbia,aswellastherightto
leaveandreturn.
Freedomofmovementandresidence,aswellastherighttoleavetheRepublicofSerbiamayberestrictedby
thelawifnecessaryforthepurposeofconductingcriminalproceedings,protectionofpublicorder,prevention
ofspreadingcontagiousdiseasesordefenseoftheRepublicofSerbia.
EntryandstayofforeignnationalsintheRepublicofSerbiashallberegulatedbythelaw.Aforeignnational
maybeexpelledonlyunderdecisionofthecompetentbody,inaprocedurestipulatedbythelawandiftimeto
appealhasbeenprovidedforhimandonlywhenthereisnothreatofpersecutionbasedonhisrace,sex,
religion,nationalorigin,citizenship,associationwithasocialgroup,politicalopinions,orwhenthereisnothreat
ofseriousviolationofrightsguaranteedbythisConstitution.

Inviolabilityofhome
Article40
Aperson'shomeshallbeinviolable.
Noonemayenteraperson'shomeorotherpremisesagainstthewilloftheirtenantnorconductasearchin
them.Thetenantofthehomeorotherpremisesshallhavetherighttobepresentduringthesearchinperson
orthroughhislegalrepresentativetogetherwithtwootherwitnesseswhomaynotbeunderage.
Enteringaperson'shomeorotherpremises,andinspecialcasesconductingsearchwithoutwitnesses,shallbe
allowedwithoutacourtorderifnecessaryforthepurposeofimmediatearrestanddetentionofaperpetratorof
acriminaloffenceortoeliminatedirectandgravedangerforpeopleorpropertyinamannerstipulatedbythe
law.

Confidentialityoflettersandothermeansofcommunication
Article41
Confidentialityoflettersandothermeansofcommunicationshallbeinviolable.
Derogationshallbeallowedonlyforaspecifiedperiodoftimeandbasedondecisionofthecourtifnecessaryto
conductcriminalproceedingsorprotectthesafetyoftheRepublicofSerbia,inamannerstipulatedbythelaw.

Protectionofpersonaldata

Article42
Protectionofpersonaldatashallbeguaranteed.
Collecting,keeping,processingandusingofpersonaldatashallberegulatedbythelaw.
Useofpersonaldataforanythepurposeothertheonewerecollectedforshallbeprohibitedandpunishablein
accordancewiththelaw,unlessthisisnecessarytoconductcriminalproceedingsorprotectsafetyofthe
RepublicofSerbia,inamannerstipulatedbythelaw.
Everyoneshallhavetherighttobeinformedaboutpersonaldatacollectedabouthim,inaccordancewiththe
law,andtherighttocourtprotectionincaseoftheirabuse.

Freedomofthought,conscienceandreligion
Article43
Freedomofthought,conscience,beliefsandreligionshallbeguaranteed,aswellastherighttostandbyone's
belieforreligionorchangethembychoice.
Nopersonshallhavetheobligationtodeclarehisreligiousorotherbeliefs.
Everyoneshallhavethefreedomtomanifesttheirreligionorreligiousbeliefsinworship,observance,practice
andteaching,individuallyorincommunitywithothers,andtomanifestreligiousbeliefsinprivateorpublic.
Freedomofmanifestingreligionorbeliefsmayberestrictedbylawonlyifthatisnecessaryinademocratic
societytoprotectlivesandhealthofpeople,moralsofdemocraticsociety,freedomsandrightsguaranteedby
theConstitution,publicsafetyandorder,ortopreventincitingofreligious,national,andracialhatred.
Parentsandlegalguardiansshallhavetherighttoensurereligiousandmoraleducationoftheirchildrenin
conformitywiththeirownconvictions.

Churchesandreligiouscommunities
Article44
Churchesandreligiouscommunitiesareequalandseparatedfromthestate.
Churchesandreligiouscommunitiesshallbeequalandfreetoorganizeindependentlytheirinternalstructure,
religiousmatters,toperformreligiousritesinpublic,toestablishandmanagereligiousschools,socialand
charityinstitutions,inaccordancewiththelaw.
ConstitutionalCourtmaybanareligiouscommunityonlyifitsactivitiesinfringetherighttolife,righttomental
andphysicalhealth,therightsofchild,righttopersonalandfamilyintegrity,publicsafetyandorder,orifit
incitesreligious,nationalorracialintolerance.

Conscientiousobjection
Article45
Nopersonshallbeobligedtoperformmilitaryoranyotherserviceinvolvingtheuseofweaponsifthisopposes
hisreligionorbeliefs.
Anypersonpleadingconscientiousobjectionmaybecalledupontofulfillmilitarydutywithouttheobligationto
carryweapons,inaccordancewiththelaw.

Freedomofthoughtandexpression
Article46
Thefreedomofthoughtandexpressionshallbeguaranteed,aswellasthefreedomtoseek,receiveandimpart
informationandideasthroughspeech,writing,artorinsomeothermanner.
Freedomofexpressionmayberestrictedbythelawifnecessarytoprotectrightsandreputationofothers,to
upholdtheauthorityandobjectivityofthecourtandtoprotectpublichealth,moralsofademocraticsocietyand
nationalsecurityoftheRepublicofSerbia.

Freedomofexpressingnationalaffiliation
Article47
Nationalaffiliationmaybeexpressedfreely.
Nopersonshallbeobligedtodeclarehisnationalaffiliation.

Promotionofrespectfordiversity

delegatedpublicpowers,bodiesofautonomousprovincesandlocalselfgovernmentunits,inareaswherethey
makeasignificantmajorityofpopulationeducationintheirlanguagesinpublicinstitutionsandinstitutionsof
autonomousprovincesfoundingprivateeducationalinstitutionsuseoftheirnameandfamilynameintheir

3.appointthePresidentoftheSupremeCourtofCassation,presidentsofcourts,RepublicPublicProsecutor,
publicprosecutors,judgesanddeputypublicprosecutors,inaccordancewiththeConstitution,
4.appointanddismisstheGovernoroftheNationalBankofSerbiaandsupervisehis/herwork,
5.appointanddismisstheCivicDefenderandsupervisehis/herwork,
6.appointanddismissotherofficialsstipulatedbytheLaw.
TheNationalAssemblyshallalsoperformotherfunctionsstipulatedbytheConstitutionandLaw.

ConstitutionoftheNationalAssembly
Article100
TheNationalAssemblyshallconsistof250deputies,whoareelectedondirectelectionsbysecretballot,in
accordancewiththeLaw.
IntheNationalAssembly,equalityandrepresentationofdifferentgendersandmembersofnationalminorities
shallbeprovided,inaccordancewithLaw.

ElectionofdeputiesandconstitutionoftheNationalAssembly
Article101
ElectionsfordeputiesshallbecalledbythePresidentoftheRepublic,90daysbeforetheendofthetermof
officeoftheNationalAssembly,sothatelectionsarefinishedwithinthefollowing60days.

ThefirstsessionoftheNationalAssemblyshallbeconvenedbytheChairmanoftheNationalAssemblyfrom
theprevioussession,sothatthesessionisheldnotlaterthan30daysfromthedayofdeclaringthefinal
electionresults.
Atthefirstsession,theNationalAssemblyshallconfirmdeputies'termsofoffice.
TheNationalAssemblyshallbeconstitutedbyconfirmationoftermsofofficeofthetwothirdsofdeputies.
Againstthedecisionmadeinrelationtoconfirmationoftermsofoffice,anappealmaybelodgedbeforethe
ConstitutionalCourt,whichdecidesonitwithin72hours.
Bymeansofconfirmingtermsofofficeofthetwothirdsofdeputies,thetermofofficeoftheprevioussession
oftheNationalAssemblyshallend.

StatusofDeputies
Article102
ThetermofofficeofthedeputyshallbeginonthedayofconfirmationoftermsofofficeintheNational
Assemblyandlastfouryears,thatisuntiltheexpiryoftermsofofficeofdeputiesofthatsessionoftheNational
Assembly.
UnderthetermsstipulatedbytheLaw,adeputyshallbefreetoirrevocablyputhis/hertermofofficeat
disposaltothepoliticalpartyuponwhichproposalheorshehasbeenelectedadeputy.
DeputymaynotbeadeputyintheAssemblyoftheautonomousprovince,noranofficialinbodiesofexecutive
governmentandjudiciary,normayheorsheperformotherfunctions,affairsandduties,whichrepresenta
conflictofinterest,accordingtotheLaw.
Election,expiryofthetermofofficeandstatusofdeputiesshallbestipulatedbytheLaw.

Immunityofdeputies
Article103
Deputiesshallenjoyimmunity.
Deputiesmaynotacceptcriminalorotherliabilityfortheexpressedopinionorcastvoteinperformingthe
deputy'sfunction.
Deputywhouseshis/herimmunitymaynotbedetained,normayheorshebeinvolvedincriminalorother
proceedingsinwhichprisonsentencemaybepronounced,withoutpreviousapprovalbytheNationalAssembly.
Deputyfoundintheactofcommittinganycriminaloffenceforwhichtheprisonsentencelongerthanfiveyears
isnotenvisaged,maybedetainedwithoutpreviousapprovalbytheNationalAssembly.
Thereshallbenodeadlinesstipulatedforthecriminalorotherproceedingsinwhichtheimmunityis
established.
FailuretousetheimmunityshallnotexcludetherightoftheNationalAssemblytoestablishtheimmunity.

PresidentandVicePresidentsoftheNationalAssembly
Article104
Bymeansofmajorityvotesofalldeputies,theNationalAssemblyshallelectthePresidentandoneormore
VicePresidentsoftheNationalAssembly.
ThePresidentoftheNationalAssemblyshallrepresenttheNationalAssembly,convokeitssessions,preside
overthemandperformotheractivitiesstipulatedbytheConstitution,LawandRulesofProcedureofthe
NationalAssembly.

MethodofdecisionmakingintheNationalAssembly
Article105
TheNationalAssemblyshalladoptdecisionsbymajorityvoteofdeputiesatthesessionatwhichmajorityof
deputiesarepresent.
BymeansofmajorityvoteofalldeputiestheNationalAssemblyshall:
1.grantamnestyforcriminaloffences,
2.declareandcalloffthestateofemergency,
3.ordermeasuresofdeparturefromhumanandminorityrightsinthestateofwarandemergency,
4.enacttheLawbywhichtheRepublicofSerbiadelegatesparticularissuesfallingwithinitscompetenceto
autonomousprovincesandlocalselfgovernmentunits,
5.givepreviousapprovalfortheStatuteoftheautonomousprovince,
6.decideontheRulesofProcedurepertainingtoitswork,

Sessions

TheNationalAssemblyshallbeconvokedfortworegularsessionsperyear.
ThefirstregularsessionshallstartonthefirstweekdayofMarch,whilethesecondregularsessionshallstart
onthefirstweekdayofOctober.Regularsessionsmaynotlastlongerthan90days.
TheNationalAssemblyshallbeconvokedforextraordinarysessionupontherequestofatleastonethirdof
deputiesorupontherequestoftheGovernment,withpreviouslydeterminedagenda.
TheNationalAssemblyshallbeconvokedwithoutannouncementuponthedeclarationofthestateofwaror
emergency.

Righttoproposelaws
Article107
Arighttoproposelaws,otherregulationsandgeneralactsshallbelongtoeverydeputy,theGovernment,
assembliesofautonomousprovincesoratleast30,000voters.
TheCivicDefenderandNationalBankofSerbiashallhavearighttoproposelawsfallingwithintheir
competence.

Referendum
Article108
Upontherequestofthemajorityofalldeputiesoratleast100,000voters,theNationalAssemblyshallcallthe
referendumonissuesfallingwithinitscompetence,inaccordancewiththeConstitutionandLaw.
Thesubjectofthereferendummaynotincludedutiesderivingfrominternationalcontracts,lawspertainingto
humanandminorityrightsandfreedoms,fiscalandotherfinanciallaws,thebudgetandfinancialstatement,
introductionofthestateofemergencyandamnesty,aswellasissuespertainingtoelectioncompetencesofthe
NationalAssembly.

DissolutionoftheNationalAssembly
Article109
ThePresidentoftheRepublicmaydissolvetheNationalAssembly,upontheelaboratedproposalofthe
Government.
TheGovernmentmaynotproposedissolutionoftheNationalAssembly,ifaproposalhasbeensubmittedfor
thevoteofnoconfidenceintheGovernmentoriftheissueofitsconfidencehasbeenraised.
TheNationalAssemblyshallbedissolvedifitfailstoelecttheGovernmentwithin90daysfromthedayofits
constitution.
TheNationalAssemblymaynotbedissolvedduringthestateofwarandemergency.
ThePresidentoftheRepublicshallbeobligedtodissolvetheNationalAssemblyuponhis/herdecree,incases
stipulatedbytheConstitution.
SimultaneouslywiththedissolutionoftheNationalAssembly,thePresidentoftheRepublicshallschedule
electionsfordeputies,sothatelectionsfinishnotlaterthan60daysfromthedayoftheirannouncement.
TheNationalAssembly,whichhasbeendissolved,shallonlyperformcurrentorurgenttasks,stipulatedbythe
Law.Incaseofdeclarationofthestateofwaroremergency,itsfullcompetenceshallbereestablishedandlast

ThePresidentoftheRepublicshallbeobligedtoissueadecreeonpromulgationoflawsortoreturnthelawfor
reconsiderationwithawrittenexplanationtotheNationalAssembly,withinmaximum15daysfromthedayof
adoptionofthelaw,thatis,notlaterthanwithinsevendays,ifthelawhasbeenadoptedbyemergency
procedure.
IftheNationalAssemblydecidestovoteagainonthelaw,whichhasbeenreturnedforreconsiderationbythe
PresidentoftheRepublic,thelawshallbeadoptedbythemajorityvotefromthetotalnumberofdeputies.
ThePresidentoftheRepublicshallbeobligedtopromulgatethenewlyadoptedLaw.
IfthePresidentoftheRepublicfailstoissueadecreeonpromulgationofthelawwithinthedeadlinestipulated
bytheConstitution,thedecreeshallbeissuedbytheChairmanoftheNationalAssembly.

Election
Article114
ThePresidentoftheRepublicshallbeelectedondirectelections,bysecretballot,inaccordancewiththeLaw.
ElectionsforthePresidentoftheRepublicshallbescheduledbytheChairmanoftheNationalAssembly,90
daysbeforetheendoftermofofficeofthePresidentoftheRepublic,sothatelectionsfinishwithinthefollowing
60days,inaccordancewiththeLaw.

Termofoffice

ThetermofofficeofthePresidentoftheRepublicshalllastfiveyearsandbeginfromthedayoftakingofthe
oathbeforetheNationalAssembly.
IfthetermofofficeofthePresidentoftheRepublicexpiresduringthestateofwaroremergency,itshallbe
extendedsothatitlastsuntiltheexpiryofthreemonthsfromthedayoftheendofthestateofwar,thatis,of
emergency.
NooneshallbeelectedtoapositionofthePresidentoftheRepublicmorethantwice.

TheConstitutionalCourtshallhavetheobligationtodecideontheviolationoftheConstitution,upontheinitiated

MinistersshallaccountfortheirworkandsituationwithinthecompetenceoftheirministriestothePrime

MemberoftheGovernmentmaynotbeadeputyintheNationalAssembly,deputyintheAssemblyofthe

ThetermofofficeoftheGovernmentshalllastuntiltheexpiryofthetermofofficeoftheNationalAssembly
whichelectedit.
ThetermofofficeoftheGovernmentshallcommenceonthedayoftakinganoathbeforetheNational
Assembly.
ThetermofofficeoftheGovernmentshallterminatebeforetheperiodoftimeforwhichithasbeenelected,by
thevoteofnoconfidence,dissolutionoftheNationalAssembly,resignationofthePresidentoftheRepublicand
inothercasesstipulatedbytheConstitution.
TheGovernmentwhosetermofofficehasexpiredmayonlyperformaffairsstipulatedbytheLaw,untilthe

Interpellation
Article129
Atleast50deputiesmayproposeinterpellationinrelationtotheworkoftheGovernmentorparticularmember
oftheGovernment.
TheGovernmentshallhavetheobligationtorespondtointerpellationwithin30days.
TheNationalAssemblyshalldiscussandvoteontheresponsetointerpellationsubmittedbytheGovernmentor
memberoftheGovernmenttowhomtheinterpellationisdirected.
Aftervotingfortheendorsementoftheresponse,theNationalAssemblycontinuestoworkaccordingtothe
adoptedagenda.
IftheNationalAssemblyfailstoendorsetheresponseoftheGovernmentorthememberoftheGovernmentby
voting,itshallinitiateavoteofnoconfidenceintheGovernmentoramemberoftheGovernment,unlessthe
PrimeMinister,thatisamemberoftheGovernmentresignbeforehand,aftertherejectionoftheresponseto
theinterpellation.
Theissuewhichwasasubjectofinterpellation,maynotbediscussedagainbeforetheexpiryofthe90day
deadline.

VoteofnoconfidenceintheGovernmentorthememberoftheGovernment
Article130
AvoteofnoconfidenceintheGovernmentortheparticularmemberoftheGovernmentmayberequestedby
atleast60deputies.
TheproposalforthevoteofnoconfidenceintheGovernmentortheparticularmemberoftheGovernment
shallbediscussedbytheNationalAssemblyatthenextfirstsession,notlaterthanfivedaysafterthe
submissionoftheproposal.Afterthediscussionisconcluded,theyshallvoteontheproposal.
TheproposalforthevoteofnoconfidenceintheGovernmentorthememberoftheGovernmentshallbe
acceptedbytheNationalAssembly,ifmorethanahalfofthetotalnumberofdeputiesvotesforit.
IftheNationalAssemblypassesavoteofnoconfidenceintheGovernment,thePresidentoftheRepublicshall
beobligedtoinitiateproceedingsforelectionofthenewGovernment.IftheNationalAssemblyfailstoelectthe
newGovernmentwithin30daysfromthepassingofavoteofnoconfidence,thePresidentoftheRepublicshall
beobligedtodissolvetheNationalAssemblyandscheduleelections.
IftheNationalAssemblypassesavoteofnoconfidenceinthememberoftheGovernment,thePresidentofthe
RepublicshallbeobligedtoinitiateproceedingsforelectionofanewmemberoftheGovernment,inaccordance
withtheLaw.
IftheNationalAssemblyfailstopassavoteofnoconfidenceintheGovernmentorthememberofthe
Government,signatoriesoftheproposalmaynotsubmitanewproposalforavoteofnoconfidencebeforethe
expiryofthe180daydeadline.

VoteofconfidenceintheGovernment
Article131
TheGovernmentmayrequireavoteofitsconfidence.
UpontherequestoftheGovernment,proposalforavoteofconfidenceintheGovernmentmaybediscussedat
thecurrentsessionoftheNationalAssembly,andiftheGovernmenthasfailedtosubmitsuchaproposal,the
proposalshallbediscussedonthenextfirstsession,notlaterthanfivedaysfromitssubmission.Afterthe
discussionisconcluded,theyshallvoteontheproposal.
TheproposalforthevoteofconfidenceintheGovernmentorthememberoftheGovernmentshallbeaccepted
bytheNationalAssembly,ifmorethanahalfofthetotalnumberofdeputiesvotesforit.
IftheNationalAssemblyfailstopassavoteofconfidenceintheGovernment,thetermofofficeofthe
GovernmentendsandthePresidentoftheRepublicshallbeobligedtoinitiateproceedingsforelectionofthe
newGovernment.IftheNationalAssemblyfailstoelectthenewGovernmentwithin30daysfromthedayof
passingofvoteofnoconfidence,thePresidentoftheRepublicshallbeobligedtodissolvetheNational
Assemblyandscheduleelections.

ResignationofthePrimeMinister

ThePrimeMinistermaytenderhis/herresignationtotheNationalAssembly.
ThePrimeMinistershalltenderhis/herresignationtotheChairmanoftheNationalAssemblyand,atthesame
time,informthePresidentoftheRepublicandgeneralpublic.

Atthenextfirstsession,theNationalAssemblyshallconfirmtheresignationofthePrimeMinister.
ThetermofofficeoftheGovernmentshallterminateonthedayofconfirmationoftheresignationofthePrime
Minister.
AftertheNationalAssemblyconfirmstheresignationofthePrimeMinister,thePresidentoftheRepublicshallbe
obligedtoinitiatetheproceedingsforelectionofthenewGovernment.IftheNationalAssemblyfailstoelectthe
newGovernmentwithin30daysfromthedayofconfirmationoftheresignationofthePrimeMinister,the
PresidentoftheRepublicshallbeobligedtodissolvetheNationalAssemblyandscheduleelections.

ResignationanddismissalofthememberoftheGovernment

ThememberoftheGovernmentmaytenderhis/herresignationtothePrimeMinister.
ThePrimeMinistershallsubmittheresignationofthememberoftheGovernmenttotheChairmanofthe
NationalAssemblyandtheNationalAssemblyshallconfirmtheresignationatthenextfirstsession.
ThePrimeMinistermayproposetotheNationalAssemblyadismissalofparticularmemberoftheGovernment.
TheNationalAssemblyshalldiscussandvoteontheproposalfordismissalofthememberoftheGovernment
atthenextfirstsession.
DecisiononDismissaloftheMemberoftheGovernmentshallbeadoptedifthemajorityofthetotalnumberof
deputiesvotesforit.

Assessmentofconstitutionalityandlegality

Aproceedingsofassessingtheconstitutionalitymaybeinstitutedbystatebodies,bodiesofterritorialautonomy
orlocalselfgovernment,aswellasatleast25deputies.Theproceduremayalsobeinstitutedbythe
ConstitutionalCourt.
Anylegalornaturalpersonshallhavetherighttoaninitiativetoinstituteaproceedingsofassessingthe
constitutionalityandlegality.
TheLaworothergeneralactswhichisnotincompliancewiththeConstitutionortheLawshallceasetobe
effectiveonthedayofpublicationoftheConstitutionalCourtdecisionintheofficialjournal.
BeforepassingthefinaldecisionandunderthetermsspecifiedbytheLaw,theConstitutionalCourtmay
suspendtheenforcementofanindividualgeneralactoractionundertakenonthegroundsoftheLaworother

FivejusticesoftheConstitutionalCourtshallbeappointedbytheNationalAssembly,anotherfivebythe
PresidentoftheRepublic,andanotherfiveatthegeneralsessionoftheSupremeCourtofCassation.
TheNationalAssemblyshallappointfivejusticesoftheConstitutionalCourtformamongtencandidates
proposedbythePresidentoftheRepublic,thePresidentoftheRepublicshallappointfivejusticesofthe
ConstitutionalCourtfromamongtencandidatesproposedbytheNationalAssembly,andthegeneralsessionof
theSupremeCourtofCassationshallappointfivejusticesfromamongtencandidatesproposedatageneral
sessionbytheHighJudicialCourtandtheStateProsecutorCouncil.
Oneachoftheproposedlistsofcandidates,oneoftheappointedcandidatesmustcomefromtheterritoryof
autonomousprovinces.
AjusticeoftheConstitutionalCourtshallbeelectedandappointedfromamongtheprominentlawyerswho
haveatleast40yearsofexperienceinpracticingthelaw.
OnepersonmaybeelectedorappointedajusticeoftheConstitutionalCourtontwooccasionsatthemost.
JusticesoftheConstitutionalCourtshallelectthepresidentfromamongtheirrepresentativesfortheperiodof
threeyears,inasecretballot.

Conflictofinterest.Immunity
Article173
AjusticeoftheConstitutionalCourtmaynotengageinanotherpublicorprofessionalfunctionoraction,except
fortheprofessorshipalawfacultyintheRepublicofSerbia,inaccordancewiththeLaw.
AjusticeoftheConstitutionalCourtshallenjoyimmunityasadeputy.TheConstitutionalCourtshalldecideon
itsimmunity.

TerminationofthetenureofofficeoftheConstitutionalCourtjustice
Article174
TenureofofficeoftheConstitutionalCourtjusticeshallterminateuponexpiryoftheperiodforwhichhe/she
hadbeenelectedorappointed,athis/herownrequest,aftermeetingtherequirementsregulatedbytheLawfor
obtainingtheoldagepensionorbyreliefofduty.
AjusticeoftheConstitutionalCourtshallberelievedofdutyifhe/sheviolatestheprohibitionoftheconflictof
interest,permanentlylosestheabilitytodischargethefunctionofajusticeoftheConstitutionalCourt,oris
convictedofapenaltyofimprisonmentorcriminaloffencewhichmakeshim/herineligibleforthepostofthe
ConstitutionalCourtjustice.
TheNationalAssemblyshalldecideontheterminationofajustice'stenureofoffice,onrequestofmovers
authorisedforelection,aswellasonappointmentforelectionofajusticeoftheConstitutionalCourt.An
initiativetoinstitutetheproceedingsofrelievingofdutymaybesubmittedbytheConstitutionalCourt.

TheConstitutionalCourtshalladjudicatebythemajorityofvotescastbyalljusticesoftheConstitutionalCourt.
Adecisiontoautonomouslyinstitutetheproceedingsofassessingtheconstitutionalityorlegalityshallbepasses
bytheConstitutionalCourtbytwothirdsofthemajorityvotescastbyalljustices.
OrganisationoftheConstitutionalCourtandtheproceedingsbeforetheConstitutionalCourt,aswellasthelegal
effectofitsdecisionsshallberegulatedbytheLaw.

PART SEVEN

TERRITORIAL ORGANISATION
1.Provincialautonomyandlocalselfgovernment

Citizensshallhavetherighttotheprovincialautonomyandlocalselfgovernment,whichtheyshallexercise
directlyorthroughtheirfreelyelectedrepresentatives.
Autonomousprovincesandlocalselfgovernmentunitsshallhavethestatusoflegalentities.

Definitionthecompetences

Localselfgovernmentunitsshallbecompetentinthosematterswhichmayberealised,inaneffectiveway,
withinalocalselfgovernmentunit,andautonomousprovincesinthosematterswhichmayberealised,inan
effectiveway,withinanautonomousprovince,whichshallnotbethecompetenceoftheRepublicofSerbia.
Whatmattersshallbeofrepublic,provincialorlocalinterestshallbespecifiedbytheLaw.

Delegationofcompetences
Article178
TheRepublicofSerbiamay,inaccordancewiththelaw,delegateparticularmatterswithinitscompetenceto
autonomousprovincesandlocalselfgovernmentunits.
Accordingtoitsdecision,anautonomousprovincemaydelegateparticularmatterswithinitscompetenceto
localselfgovernmentunits.
ResourcestoexecutethedelegatedcompetencesshallbeprovidedforbytheRepublicofSerbiaoran
autonomousprovince,dependingonwhothecompetencesweredelegatedby.
RightanddutiesofautonomousprovincesandlocalselfgovernmentunitsandpowersoftheRepublicofSerbia
andautonomousprovincesintheprocessofmonitoringtheexecutionofdelegatedcompetencesshallbe
regulatedbytheLaw.

Therighttoautonomousorganisationofbodies
Article179
Autonomousprovinces,inaccordancewiththeConstitutionandtheStatute,andlocalselfgovernmentunits,in
accordancewiththeConstitutionandtheLaw,shallautonomouslyregulatetheorganisationandcompetencesof
itsbodiesandpublicservices.

TheAssemblyofanautonomousprovinceandlocalselfgovernmentunit
Article180
TheAssemblyshallbethesupremebodyoftheautonomousprovinceandalocalselfgovernmentunit.
TheAssemblyshallbeconstitutesofdeputies,andtheassemblyofalocalselfgovernmentunitofcouncilors.
Deputiesandcouncilorsshallbeelectedfortheperiodoffouryears,indirectelectionsbysecretballot,namely,
deputiesinaccordancewiththedecisionoftheAssemblyoftheautonomousprovince,andcouncilorsin
accordancewiththeLaw.
Inthoseautonomousprovincesandlocalselfgovernmentunitswiththepopulationofmixednationalities,a
proportionalrepresentationofnationalminoritiesinassembliesshallbeprovidedfor,inaccordancewiththe
Law.

Cooperationofautonomousprovincesandlocalselfgovernmentunits
Article181

Autonomousprovincesandlocalselfgovernmentunitsshallcooperatewiththecorrespondingterritorial
communitiesandlocalselfgovernmentunitsfromothercountries,withintheforeignpolicyoftheRepublicof
Serbia,observingtheterritorialintegrityandlegalsystemoftheRepublicofSerbia.

2.Autonomousprovinces
Concept,establishmentandterritoryofautonomousprovince
Article182
AutonomousprovincesshallbeautonomousterritorialcommunitiesestablishedbytheConstitution,inwhich
citizensexercisetherighttotheprovincialautonomy.
IntheRepublicofSerbia,therearetheAutonomousProvinceofVojvodinaandtheAutonomousProvinceof
KosovoandMetohija.ThesubstantialautonomyoftheAutonomousprovinceofKosovoandMetohijashallbe
regulatedbythespeciallawwhichshallbeadoptedinaccordancewiththeproceedingsenvisagedforamending
theConstitution.
Newautonomousprovincesmaybeestablished,andalreadyestablishedonesmayberevokedormerged
followingtheproceedingsenvisagedforamendingtheConstitution.Theproposaltoestablishnew,orrevokeor
mergetheexistingautonomousprovincesshallbeestablishedbycitizensinareferendum,inaccordancewith
theLaw.
Territoryofautonomousprovincesandthetermsunderwhichbordersbetweenautonomousprovincesmaybe
alteredshallberegulatedbytheLaw.Territoryofautonomousprovincesmaynotbealteredwithoutthe
consentofitscitizensgiveninareferendum,inaccordancewiththeLaw.

Competencesofautonomousprovinces
Article183
Autonomousprovincesshall,inaccordancewiththeConstitutionandtheirStatutes,regulatethecompetences,
election,organisationandworkofbodiesandservicestheyestablish.
Autonomousprovincesshall,inaccordancewiththeLaw,regulatethemattersofprovincialinterestinthe
followingfields:
1.urbanplanninganddevelopment,
2.agriculture,watereconomy,forestry,hunting,fishery,tourism,catering,spasandhealthresorts,
environmentalprotection,industryandcraftsmanship,road,riverandrailwaytransportandroadrepairs,
organisingfairsandothereconomicevents,
3.education,sport,culture,healthcareandsocialwelfareandpublicinformingattheprovinciallevel.
Autonomousprovincesshallseetoexercisinghumanandminorityrights,inaccordancewiththeLaw.
Autonomousprovincesshallestablishtheirsymbols,aswellasthemannerinwhichtheyshallbeputtouse.
AutonomousprovincesshallmanagetheprovincialassetsinthemannerstipulatedbytheLaw.
Autonomousprovincesshall,inaccordancewiththeConstitutionandtheLaw,havedirectrevenues,providethe
resourcesforlocalselfgovernmentunitsforperformingthedelegatedaffairsandadopttheirbudgetand
annualbalancesheet.

Financialautonomyofautonomousprovinces
Article184
Anautonomousprovinceshallhavedirectrevenuesforfinancingitscompetences.
AkindandamountofdirectrevenuesshallbestipulatedbytheLaw.
TheLawshallspecifytheshareofautonomousprovincesinthepartofrevenueoftheRepublicofSerbia.
ThebudgetoftheAutonomousProvinceofVojvodinashallamounttoatleast7%inrelationtothebudgetof
theRepublicofSerbia,bearinginmindthatthreeseventhsofthebudgetoftheAutonomousProvinceof
Vojvodinashallbeusedforfinancingthecapitalexpenditures.

Legalactsofautonomousprovince
Article185
TheStatuteshallbethesupremelegalactoftheautonomousprovince.
TheStatuteoftheAutonomousProvinceofVojvodinashallbeadoptedbyitsAssembly,subjecttoprior
approvaloftheNationalAssembly.
Theautonomousprovinceshallenactotherdecisionsandgeneralactspertainingtomatterswithinits
competences.

Monitoringtheworkofbodiesofautonomousprovince

Article186
TheGovernmentmayinstitute,beforetheConstitutionalCourt,theproceedingsofassessingthe
constitutionalityandlegalityofadecisionadoptedbytheautonomousprovince,priortoitscomingintoforce.In
thatsense,priortopassingitsdecision,theConstitutionalCourtmaydefercomingintoforceofthechallenged
decisionoftheautonomousprovince.

Protectionoftheprovincialautonomy
Article187
AbodydesignatedbytheStatuteoftheautonomousprovinceshallhavearighttolodgeanappealwiththe
ConstitutionalCourt,ifanindividuallegalactoractionofastatebodyorbodyoflocalselfgovernmentunit
obstructsperformingthecompetencesoftheautonomousprovince.
AbodydesignatedbytheStatuteoftheautonomousprovincemayinstitutetheproceedingsofassessingthe
constitutionalityorlegalityofthelawandotherlegalactoftheRepublicofSerbiaorthelegalactofthelocal
selfgovernmentunitwhichviolatestherighttotheprovincialautonomy.

3.Localselfgovernment
Generalprovisions
Article188
Localselfgovernmentunitsshallbemunicipalities,townsandtheCityofBelgrade.
TheterritoryandseatofalocalselfgovernmentunitshallbespecifiedbytheLaw.
Establishment,revocationoralterationoftheterritoryofalocalselfgovernmentunitshallbeprecededbya
referendumontheterritoryofthatlocalselfgovernmentunit.
Affairsofalocalselfgovernmentunitshallbefinancedformthedirectrevenuesofthelocalselfgovernment
unit,thebudgetoftheRepublicofSerbia,inaccordancewiththeLaw,andthebudgetoftheautonomous
province,incaseswhentheautonomousprovincedelegatedtheperformingofaffairswithinitscompetences,in
accordancewiththedecisionoftheAssemblyoftheAutonomousProvince.

Statusoflocalselfgovernmentunits
Article189
MunicipalitiesshallbeestablishedandrevokedbytheLaw.
AtownshallbeestablishedbytheLaw,inaccordancewiththecriteriastipulatedbytheLawregulatinglocal
selfgovernment.
AtownshallhavecompetencesdelegatedtothemunicipalitybytheConstitution,whereasothercompetences
maybedelegatedtoitbytheLaw.
ItmaybeenvisagedintheStatuteofthetowntoestablishtwoormoretownmunicipalitiesontheterritoryof
thetown.TheStatuteofthetownshallregulatetheaffairsfallingwithinthetowncompetenceperformedby
townmunicipalities.
ThestatusoftheCityofBelgrade,thecapitaloftheRepublicofSerbia,shallberegulatedbytheLawonthe
CapitalandtheStatuteoftheCityofBelgrade.TheCityofBelgradeshallhavecompetencesdelegatedtothe
municipalityandcitybytheConstitutionandtheLaw,andothercompetencesmaybedelegatedtoitin
accordancewiththeLawontheCapital.

Competenceofmunicipality
Article190
Themunicipalityshall,throughitsbodies,andinaccordancewiththeLaw:
1.regulateandprovidefortheperforminganddevelopmentofmunicipalactivities
2.regulateandprovidefortheuseofurbanconstructionsitesandbusinesspremises
3.beresponsibleforconstruction,reconstruction,maintenanceanduseoflocalnetworkofroadsandstreets
andotherpublicfacilitiesofmunicipalinterestregulateandprovideforthelocaltransport
4.beresponsibleformeetingtheneedsofcitizensinthefieldofeducation,culture,healthcareandsocial
welfare,childwelfare,sportandphysicalculture
5.beresponsiblefordevelopmentandimprovementoftourism,craftsmanship,cateringandcommerce
6.beresponsibleforenvironmentalprotection,protectionagainstnaturalandotherdisastersprotectionof
culturalheritageofthemunicipalinterest
7.protection,improvementanduseofagriculturalland
8.performotherdutiesspecifiedbytheLaw.
Themunicipalityshallautonomously,inaccordancewiththeLaw,adoptitsbudgetandannualbalancesheet,
theurbandevelopmentplanandmunicipaldevelopmentprogramme,establishthesymbolsofthemunicipality,
aswellastheiruse.

Themunicipalityshallseetoexercising,protectionandimprovementofhumanandminorityrights,aswellasto
publicinforminginthemunicipality.
Themunicipalityshallautonomouslymanagethemunicipalassets,inaccordancewiththeLaw.
Themunicipalityshall,inaccordancewiththeLaw,prescribeoffencesrelatedtoviolationofmunicipal
regulations.

Municipallegalactsandbodies
Article191
TheStatuteshallbethesupremelegalactofthemunicipality.TheStatuteshallbeadoptedbytheMunicipal
Assembly.
TheMunicipalAssemblyshallpassgeneralactswithinitscompetences,adoptthebudgetandannualbalance
sheet,adoptthedevelopmentplanandthemunicipalspatialplan,schedulethemunicipalreferendumand
performotherdutiesspecifiedbytheLawandtheStatute.
MunicipalbodiesshallbetheMunicipalAssemblyandotherbodiesdesignatedbytheStatute,inaccordancewith
theLaw.
TheMunicipalAssemblyshalldecideontheelectionofmunicipalexecutivebodies,inaccordancewiththeLaw
andtheStatute.
ElectionofexecutivebodiesofthetownandtheCityofBelgradeshallberegulatedbytheLaw.

Monitoringtheworkofmunicipality
Article192
TheGovernmentshallbeobligedtocanceltheenforcementofthemunicipalgeneralactwhichitconsiderstobe
innoncompliancewiththeConstitutionortheLaw,andinstitutetheproceedingsofassessingitsconstitutionality
orlegalitywithinfivedays.
TheGovernmentmay,underthetermsspecifiedbytheLaw,dismisstheMunicipalAssembly.
SimultaneouslywiththedismissaloftheMunicipalAssembly,theGovernmentshallappointatemporarybody
whichshallperformdutieswithinthecompetencesoftheAssembly,takingintoconsiderationthepoliticaland
nationalcompositionofthedismissedMunicipalAssembly.

Protectionoflocalselfgovernment
Article193
ThebodydesignatedbytheStatuteofthemunicipalityshallhavetherighttolodgeanappealwiththe
ConstitutionalCourtifanindividuallegalactoractionbyastatebodyorbodyoflocalselfgovernmentunit
obstructsperformingthecompetencesofthemunicipality.
ThebodydesignatedbytheStatuteofthemunicipalitymayinstitutetheproceedingsofassessingthe
constitutionalityorlegalityoftheLaworotherlegalactoftheRepublicofSerbiaorautonomousprovincewhich
violatestherighttolocalselfgovernment.

PART EIGHT

CONSTITUTIONALITY AND LEGALITY


Hierarchyofdomesticandinternationalgenerallegalacts
Article194

ThelegalsystemoftheRepublicofSerbiashallbeunique.
TheConstitutionshallbethesupremelegalactoftheRepublicofSerbia.
AlllawsandothergeneralactsenactedintheRepublicofSerbiamustbeincompliancewiththeConstitution.
Ratifiedinternationaltreatiesandgenerallyacceptedrulesofitheinternationallawshallbepartofthelegal
systemoftheRepublicofSerbia.Ratifiedinternationaltreatiesmaynotbeinnoncompliancewiththe
Constitution.
LawsandothergeneralactsenactedintheRepublicofSerbiamaynotbeinnoncompliancewiththeratified
internationaltreatiesandgenerallyacceptedrulesoftheInternationalLaw.

Lawsandallothergeneralactsshallbepublishedpriortocomingintoforce.
TheConstitution,lawsandbylawsoftheRepublicofSerbiashallbepublishedintherepublicofficialjournal,
andstatutes,decisionsandothergeneralactsofautonomousprovincesshallbepublishedinprovincialofficial
journals.
Statutesandgeneralactsoflocalselfgovernmentunitsshallbepublishedinlocalofficialjournals.
Lawsandothergeneralactsshallcomeintoforcenoearlierthanontheeighthdayfromthedayofpublication
andmaycomeintoforceearlieronlyifthereareparticularlyjustifiedgroundsforthat,specifiedatthetimeof
theiradoption.

Prohibitionofretroactiveeffectoflawsandothergeneralacts
Article197
Lawsandothergeneralactsmaynothavearetroactiveeffect.
Exceptionally,onlysomeofthelawprovisionsmayhavearetroactiveeffect,ifsorequiredbygeneralpublic
interestasestablishedintheprocedureofadoptingtheLaw.
AprovisionofthePenalCodemayhavearetroactiveeffectonlyifitshallbemorefavourableforthe
perpetrator.

Legalityofadministration
Article198
Individualactsandactionsofstatebodies,organisationswithdelegatedpublicpowers,bodiesofautonomous
provincesandlocalselfgovernmentunitsmustbebasedontheLaw.
Legalityoffinalindividualactsdecidingonaright,dutyorlegallygroundedinterestshallbesubjectto
reassessingbeforethecourtinanadministrativeproceedings,ifotherformofcourtprotectionhasnotbeen
stipulatedbytheLaw.

Languageofproceedings
Article199
Everyoneshallhavetherighttousehis/herlanguageintheproceedingsbeforethecourt,otherstatebodyor
organisationperformingpublicpowers,whenhis/herrightordutyisdecidedon.
Unfamiliaritywiththelanguageoftheproceedingsmaynotbeanimpedimentfortheexerciseandprotectionof
humanandminorityrights.

Stateofemergency
Article200
Whenthesurvivalofthestateoritscitizensisthreatenedbyapublicdanger,theNationalAssemblyshall
proclaimthestateofemergency.
Thedecisiononthestateofemergencyshallbeeffective90daysatthemost.Uponexpiryofthisperiod,the
NationalAssemblymayextendthedecisiononthestateofemergencyforanother90days,bythemajority
votesofthetotalnumberofdeputies.
Duringthestateofemergency,theNationalAssemblyshallconvenewithoutanyspecialcallforassemblyandit
maynotbedismissed.
Whenproclaimingthestateofemergency,theNationalAssemblymayprescribethemeasureswhichshall
provideforderogationfromhumanandminorityrightsguaranteedbytheConstitution.
WhentheNationalAssemblyisnotinapositiontoconvene,thedecisionproclaimingthestateofemergency
shallbeadoptedbythePresidentoftheRepublictogetherwiththePresidentoftheNationalAssemblyandthe
PrimeMinister,underthesametermsasbytheNationalAssembly.
WhentheNationalAssemblyisnotinapositiontoconvene,themeasureswhichprovideforderogationfrom
humanandminorityrightsmaybeprescribedbytheGovernment,inadecree,withthePresidentofthe

Republicasacosignatory.
MeasuresprovidingforderogationfromhumanandminorityrightsprescribedbytheNationalAssemblyor
Governmentshallbeeffective90daysatthemost,anduponexpiryofthatperiodmaybeextendedunderthe
sameterms.
WhenthedecisiononthestateofemergencyhasnotbeenpassedbytheNationalAssembly,theNational
Assemblyshallverifyitwithin48hoursfromitspassing,thatis,assoonasitisinapositiontoconvene.Ifthe
NationalAssemblydoesnotverifythisdecision,itshallceasetobeeffectiveupontheendofthefirstsessionof
theNationalAssemblyheldaftertheproclamationofthestateofemergency.
Incaseswhenthemeasuresprovidingforderogationfromhumanandminorityrightshavenotbeenprescribed
bytheNationalAssembly,theGovernmentshallbeobligedtosubmitthedecreeonmeasuresprovidingfor
derogationfromhumanandminorityrightstobeverifiedbytheNationalAssemblywithin48hoursfromits
passing,thatis,assoonastheNationalAssemblyisinapositiontoconvene.Inotherrespects,themeasures
providingforderogationshallceasetobeeffective24hourspriortothebeginningofthefirstsessionofthe
NationalAssemblyheldaftertheproclamationofthestateofemergency.

Thestateofwar

TheNationalAssemblyshallproclaimthestateofwar.
WhentheNationalAssemblyisnotinapositiontoconvene,thedecisiononproclamationofthestateofwar
shallbepassedbythePresidentoftheRepublictogetherwiththePresidentoftheNationalAssemblyandthe
PrimeMinister.
Whenproclaimingthestateofwar,theNationalAssemblymayprescribethemeasureswhichshallprovidefor
derogationfromhumanandminorityrightsguaranteedbytheConstitution.
WhentheNationalAssemblyisnotinapositiontoconvene,themeasureswhichprovideforderogationfrom
humanandminorityrightsguaranteedbytheConstitutionshallbedecidedonbythePresidentoftheRepublic
togetherwiththePresidentoftheNationalAssemblyandthePrimeMinister.
AllmeasuresprescribedintheperiodofthestateofwarshallbeverifiedbytheNationalAssemblywhenina
positiontoconvene.

Derogationformhumanandminorityrightsinthestateofemergencyandwar

Uponproclamationofthestateofemergencyorwar,derogationsfromhumanandminorityrightsguaranteed
bytheConstitutionshallbepermittedonlytotheextentdeemednecessary.
Measuresprovidingforderogationshallnotbringaboutdifferencesbasedonrace,sex,language,religion,
nationalaffiliationorsocialorigin.
Measuresprovidingforderogationfromhumanandminorityrightsshallceasetobeeffectiveuponendingof
thestateofemergencyorwar.
Measuresprovidingforderogationshallbynomeansbepermittedintermsoftherightsguaranteedpursuantto
Articles23,24,25,26,28,32,34,37,38,43,45,47,49,62,63,64and78oftheConstitution.

PART NINE

AMENDING THE CONSTITUTION


ProposaltoamendtheConstitutionandadoptionoftheamendmenttotheConstitution
Article203

AproposaltoamendtheConstitutionmaybesubmittedbyatleastonethirdofthetotalnumberofdeputies,
thePresidentoftheRepublic,theGovernmentandatleast150,000voters.
TheNationalAssemblyshalldecideonamendingtheConstitution.
AproposaltoamendtheConstitutionshallbeadoptedbyatwothirdmajorityofthetotalnumberofdeputies.
Iftherequiredmajorityofvoteshasnotbeenachieved,theamendingoftheConstitutionaccordingtothe
issuescontainedinthesubmittedproposalwhichhasnotbeenadoptedshallnotbeconsideredinthefollowing
twelvemonths.
IncasetheNationalAssemblyadoptstheproposalforamendingtheConstitution,anactonamendingthe
Constitutionshallbedrafted,thatis,considered.
TheNationalAssemblyshalladoptanactonamendingtheConstitutionbyatwothirdmajorityofthetotal
numberofdeputiesandmaydecidetohaveitendorsedintherepublicreferendumbythecitizens.
TheNationalAssemblyshallbeobligedtoputforwardtheactonamendingtheConstitutionintherepublic
referendumtohaveitendorsed,incaseswhentheamendmentoftheConstitutionpertainstothepreambleof
theConstitution,principlesoftheConstitution,humanandminorityrightsandfreedoms,thesystemof

authority,proclamationthestateofwarandemergency,derogationfromhumanandminorityrightsinthestate
ofemergencyorwarortheproceedingsofamendingtheConstitution.
WhentheactonamendingtheConstitutionisputforwardforendorsement,thecitizensshallvoteinthe
referendumwithinnolaterthan60daysfromthedayofadoptingtheactonamendingtheConstitution.The
amendmenttotheConstitutionshallbeadoptedifthemajorityofvoterswhoparticipatedinthereferendum
votedinfavouroftheamendment.
TheactonamendingtheConstitutionendorsedintherepublicreferendumshallcomeintoforceonce
promulgatedbytheNationalAssembly.
IftheNationalAssemblydoesnotdecidetoputforwardtheactonamendingtheConstitutionforendorsement,
theamendmentoftheConstitutionshallbeadoptedbyvotingintheNationalAssembly,andtheacton
amendingtheConstitutionshallcomeintoforceoncepromulgatedbytheNationalAssembly.

ThisConstitutionshallcomeintoforceonthedayofitspromulgationintheNationalAssembly.
