agree to abide by following terms and conditions
1.
That the project Gala Villa is Situated in Moza Mohra Noor, popularly known as Bani Gala, ( North ), Islamabad being developed by
MANUAL Builders a part of MANUAL (Pvt.) Ltd. Company (Hereinafter called the Company ) and the project location is described and illustrated in
the LOCATION MAP given on Page No. .
2. Booking Procedure: The Plots are offered to individuals on ownership basis and the allotment shall be subject to approval of application and
payment of all dues.
3. That the Plot price is fixed and is on no escalation basis. This price includes all services as specified in the specifications and shall neither be
increased nor escalated except under force circumstances till completion and handing over the physical possession of the Plot.
4. Confirmation of the Assignment/Allotment: The Assignment/Allotment and terms and conditions of the Assignment/allotment shall be
confirmed through provisional Allotment letter, which shall be issued after the acceptance of application for booking and receipt of the down
payment by the applicant as per schedule.
5. Plot Size; Plots size is 500 Sq. Yds. And amalgamation of 2 plots are allowed making the size upto 1000 Sq. Yds, whereas bifurcation of 500
Sq. Yds is not allowed.
6. Payment Schedule: The Payment Schedule is illustrated in FORM B whereas can be changed by the Company at any time without any prior
notice for further bookings, although the payment schedule will remain same through out the period for the booking which applied for at that time.
Each installment shall be made by the applicant by due date according to the schedule in case of failure a demand notice of 15 days shall be issued
on Company Management discretion. If the applicant fails to make the payment within the specified period up to 30 days from the date of issue of
the demand notice then a final notice shall be issued and his/her Plot shall be cancelled under intimation to the applicant and the amount paid by
the Allottee shall be refunded to him/ her by the company as per terms of clause 8, hereinunder
7. Transfer of Allotment: An applicant may decide to surrender the Plot to anyone before taking possession, with prior written permission of
Company However, the Company may allow such transfer on receipt of payment of all outstanding dues upto that time and transfer fee as per
Company Schedule, in lieu of expenses incurred. The Plot neither be subdivided nor may any amalgamation of 3 or more plots will be permitted.
8. Surrender of Allotment: If an applicant subsequently decides to surrender the Plot or fails to pay the installment as per clause 6 above , he /she
shall lose all rights and the entitlement to Assignment/Allotment and the enlistment shall stand cancelled under intimation to the Assignee/ Allottee
and he/ she will be allowed
9. Final Allotment and Handing over of possession: The Company after completing the development and construction work and receiving
payment of Plot and any other dues, if any, receivable from the Assignee/ Allottee will serve a notice to the Assignee/ Allottee to take possession of
the Plot within 15 days of the receipt of notice and issue a final Assignment/allotment letter in the name of Assignee/ Allottee

10. Delay in Taking over possession: The buyer shall take over the possession of the Plot s within 15 days of the receipt of notice from the Company.
In case of delay in taking over the possession, the company shall charge Rs. 2000 per month from the notified date. After proper handing over of
the Plot to the Assignee/ Allottee, he/she shall be responsible of safety of Plot. However, the company shall be responsible for maintenance of the
services up to 12 months from completion of development and all defects shall be rectified to the satisfaction of the Assignee/ Allottee as per
warrantee terms for such items.
11. Arbitration: In case of any dispute may arise between COMPANY and Assignee/ Allottee the seat of the arbitration shall be Islamabad and the
matter shall be referred to sole arbitrator to be appointed by Chief Executive officer of the company whose decision shall be final and binding upon
the both parties.
12. Payment: All payments shall be made by the Assignee/ Allottee by pay order/bank draft/crossed cheques, in the name of MANUAL (Pvt.) Ltd. to
be deposited at its office, mentioned in the title.
13. Payments of Taxes: The Assignee/ Allottee shall pay all taxes levied by federal/Provincial/District Government/Local Bodies/Municipal Bodies,
etc. these taxes will include those existing at present and which will be levied by the above mentioned and/or ay other Authorities in future. All duties,
Registration fee and legal expenses for the transfer of Plot in the name of Assignee/ Allottee shall be payable by the assignee/ Allottee.
14. Membership of the Residents Society: The company will form a society of the residents and transfer the management and maintenance of the
project in the name of the society to maintain, upkeep and deal with the subsequent sale/transfer of the Plot s and houses of the project.
15. Availability of the Services: the company will develop the project, build roads and provide water, sewerage services as per custom of area and
electricity sub-station. although the company would make every effort to obtain permanent domestic electric connection assignee(s)/ Allottee(s), the
availability of the above mentioned services are depend on the authorities and the company accepts no responsibility if the availability of these
services are delayed in case company decides to install any further facility or service for the enhancement of the Plot s the cost of said facility shall be
borne by Assignee(s)/ Allottee(s).
16. Progress of Work: The company shall maintain steady progress of the work subject to the payment by the Allottees. The company will fulfill its
obligation of timely completion of development of the project subject to the fulfillment of the Allottees commitments.
17. The Bungalow on the Plot shall be constructed strictly in accordance with approved layout plans and specification.
