CHAPTERI
INTRODUCTION
1. Short title and commencement. (1) These rules may be cited as the Lahore Development Authority Land Use (Classification,
ReclassificationandRedevelopment)Rules,2009.
(2)Theseshallcomeintoforceatonce.
2.Definitions.Intheserulesunlessthereisanythingrepugnantinthesubjectorcontext,
(i)agriculturalareameanslandoutsidetheperiurbanareawhichispredominantlyusedforthecultivationofcropsandincludes
cropland,pastureland,orchards,nurseriesanddairyfarms
(ii)approvedschememeansaschemeapprovedbytheGovernment,Authority,alocalgovernmentoranyotherpublicauthority
(iii)AuthoritymeanstheLahoreDevelopmentAuthorityestablishedundersection4oftheLahoreDevelopmentAuthorityAct1975
(XXXof1975)
(iv)bettermentfeemeansthefeeleviedbytheAuthorityundersection23oftheLahoreDevelopmentAuthorityAct1975(XXXof
1975)
(v)buildinglinemeansthelinebeyondwhichtheouterfaceofabuildingmaynotbeprojectedinthedirectionofanexistingor
proposedroadexceptthecompoundwall
(vi)buildingregulationsmeanthebuildingandzoningregulationsoftheAuthorityasnotifiedfromtimetotime
(vii)commercialareameansanareawhichisdesignatedforcommercialuseasperapprovedschemeormasterplan,orisbeing
usedassuchintheestablishedbuiltuparea
(viii)commercialusemeanslandusewhichispredominantlyconnectedwithsaleanddistributionofgoodsandservices
(ix)competentauthoritymeanstheauthoritycompetenttoapprovelandclassification,reclassificationorredevelopment
(x)commercialcorridormeansaroadorasegmentofaroad,withnotlessthansixtyfeetrightofwayandspecifieddepthofarea,
whichhasbeendesignatedascommercialbyacompetentauthority
(xi) controlledareameansanylocalitywithintheLahoreCityDistrictareanotifiedbytheAuthorityasthecontrolledareaunder
section18oftheLahoreDevelopmentAuthorityAct,1975(XXXof1975)
(xii)DistrictPlanningandDesignCommitteemeansaDistrictPlanningandDesignCommitteeconstitutedbytheGovernmentunder
rule51
(xiii)educationalinstitutionincludesaschool,college,university,researchortrainingcenter,libraryoramadrassah
(xiv)establishedbuiltupareameansbuiltupareaotherthanthebuiltupareainanapprovedscheme
(xv) environmentallysensitiveareameansanareathathasbeendesignatedassuchunderRegulation22ofthePakistan
Environmental Protection Agency ( Review of Initial Environmental Examination and Environmental Impact Assessment)

(xxiii)industrialplotmeansanindustrialplotinanindustrialestate,approvedschemeormasterplan
(xxiv)institutionalusemeanslandusewhichispredominantlyconnectedwitheducation,health,publicorprivateoffice,hotel,theatre
orauditoriumetc
(xxv)intercityserviceareameansanareadesignatedbythecompetentauthorityasserviceareaalongtheintercityroadoutsidethe
periurbanarea
(xxvi)katchiabadimeansanareadeclaredbytheGovernmentasakatchiabadiunderthePunjabKatchiAbadisAct1992(VIIIof
1992)
(xxvii)landuseplanmeansaplanapprovedbyacompetentauthorityforreclassification,developmentorredevelopmentofanarea
(xxviii)masterplanmeansalanduseplanofanareaandincludesastructureplan,anoutlinedevelopmentplan,aspatialplan,peri
urbanstructureplanandametropolitanplan
(xxix)nonconformingusemeansthelandusethatdoesnotconformtothepermittedorpermissiblelandusebutisexistingatsite
(xxx)notifiedareameansanareainwhichspecialrestrictionsregardingitsdevelopmentorredevelopmenthavebeenimposedunder
anylawforthetimebeinginforce
(xxxi)otherrestrictedareameansanareainwhichtheFederalGovernment,theGovernment,theAuthority,alocalgovernmentorany
otherpublicbodyhasimposedcertainbuildingorareadevelopmentrestrictions
(xxxii)periurbanareameansanareathatspansthelandscapebetweencontiguousurbandevelopmentandruralcountrysidewithlow
populationdensityandispredominantlybeingusedforagriculturalactivityandislikelytobeurbanizedinthenexttwentyyears
(xxxiii)projectareameansanareaselectedbytheAuthoritytopreparealandusereclassificationscheme.

(xxxiv)publicsectorinstitutionalareameansanareareservedfortheFederalGovernment,theGovernment,theAuthority,alocal
governmentoranyotherpublicbody

3.Termsnotdefined.AwordortermusedintheserulesbutnotdefinedshallhavethesamemeaningasintheLahoreDevelopmentAuthority
Act1975(XXXof1975).

CHAPTERII
LANDUSECLASSIFICATION
4.Landuseclasses.(1)TheAuthorityshallclassifylandinthecontrolledareaintothefollowinglanduseclasses:
(a)residential
(b)commercial(includinginstitutional)
(c)industrial
(d)periurban
(e)agriculturaland
(f)notifiedarea.
(2)TheAuthorityshallsubclassifythelanduseclassesaccordingtothecharacteristicsasprovidedintheTableA.
5.Residentialarea.TheAuthorityshallsubclassifyaresidentialareaasfollows:

(a)approvedscheme:
(i)RA1:meansaresidentialareawithsizeofplotsbeingmorethantwokanalandrightofwayofroadsrangingfromfiftyfeettotwo
hundredandtwentyfeetandatypicalrightofwayofsixtyfeet
(ii)RA2:meansaresidentialareawithsizeofplotsbeingonekanaltotwokanalandrightofwayofroadsrangingfromthirtyfeetto
onehundredandeightyfeetandatypicalrightofwayofthirtyfeet

(iii)RA3:meansaresidentialareawithsizeofplotsbeingtenmarlatoonekanalandrightofwayofroadsrangingfromthirtyfeetto
onehundredandtwentyfeetandatypicalrightofwayofthirtyfeetand
(iv)RA4:meansaresidentialareawithsizeofplotsbeinglessthantenmarlaandrightofwayofroadsrangingfromtwentyfeetto

6.Landuseofresidentialarea.TheAuthorityshallensurethatthefollowinglanduseprovisionsunderpermitted,permissibleandprohibited
usesarestrictlyfollowedinaresidentialarea:
(a)permitteduses:
theAuthorityshallpermitfollowingusesinaresidentialarea:
(i)detachedhouse
(ii)semidetachedhouse
(iii)townhouse

(iv)residentialapartment
(v)neighborhoodlevelparkandplayground
(vi)placeofworshiporprayer

(vii)placeofburialorcremationand
(viii)horticulturalnursery:
(b)permissibleuses:

facilityshallbeavailabletoaresidentholdingbothaprofessionaldegree,diplomaorcertificateandaregistrationwithastatutory
bodyestablishedunderalawforthetimebeinginforce:

7.Commercialarea.TheAuthorityshallsubclassifyacommercialareaasfollows:

9.Industrialarea.TheAuthorityshallsubclassifyanindustrialareaasfollows:

hundredfeet
(ii)IA2:meansindustrialareawithsizeofplotsbeingoneacretolessthanfiveacreandrightofwayofroadrangingfromsixtyfeet
toonehundredfortyfeet
(iii)IA3:meansindustrialareawithsizeofplotsbeingfourkanaltolessthanoneacreandrightofwayofroadrangingfromfiftyfeet

(iv)IA4:meansindustrialareawithsizeofplotsbeinglessthanfourkanalandrightofwayofroaduptoeightyfeet:

10.Landuseofindustrialarea.TheAuthorityshallensurethatthefollowinglanduseprovisionsunderpermitted,permissibleandprohibited
usesarestrictlyfollowedinanindustrialarea:

(1)approvedindustrialarea:
thepermitted,permissibleandprohibitedlandusesshallbeinaccordancewiththeapprovedschemeofanindustrialarea
(2)establishedbuiltupareaandindustrialcorridor(IC2):
(a)permitteduses:
theAuthorityshallpermitfollowingusesinaestablishedbuiltupareaandIC2area:
(i)cottageorlightindustry
(ii)constructionequipment
(iii)warehouse,storageordistributioncentre
(iv)buildingmaterialstore

(v)firestationand
(vi)loadingandunloadingplace:
(b)permissibleuses:

subjecttorule18,acompetentauthoritymaygrantpermissionforanyofthefollowinguses:
(i)mediumindustry
(ii)petrolpumporgasstation

(iii)essentialresidential,commercialoreducationalfacilityforlaborersoremployeesand
(iv)policestation,postoffice:
(c)prohibiteduses:
the Authority shall not allow a person to use a property in an industrial area for a purpose which is neither permitted nor
permissible.Notwithstndingtheprovisionsunder(a)&(b)above,followingactsshallalsonotbepermittedinanestablishedbuiltup
areaandIC2:

(i)storing,packing,pursing,cleaning,preparing,andmanufacturingofblastingpowder,ammunition,fireworks,gunpowder,
sulphur,mercury,gases,nitrocompounds,phosphorous,dynamite
(ii)storingexplosives,petrol,oil,lubricants,andotherinflammablematerialsincludingcoal,chemicals,liquidsorotherwise
cleaningdying,preparingandmanufacturingofclothoryarninindigoorothercolour
(iii)storing,processing,cleaning,crushing,melting,preparingormanufacturinganddealinginbombs,tallow,offal,fatblood,
soap,rawordryhideorskin,washingordyingwoolorhairand

(iv)castingofheavymetals,electroplating,welding,marblecuttingandpolishing,manufacturingofcementorpipes,burningor
grindingoflimestone,metaloruseofanyotherobnoxiousorhazardousmaterial:
the Authority shall not allow a person to use a property in an industrial area for a purpose which is neither permitted nor
permissible.
(3)industrialcorridor(IC1):
(a)permitteduses:
theAuthorityshallpermitfollowingusesinanindustrialcorridor:
(i)light,mediumorheavyindustryincludingmanufacturing,production,processing,cleaning,servicingandrepairofmaterials,
goodsorproducts

(ii)ancillaryofficeorplaceforindustry
(iii)petrolpumporgasstation
(iv)essentialresidential,commercialoreducationalfacilityforemployees

(v)policestation,postofficeorfirestation
(vi)loadingandunloadingplace
(vii)constructionequipments

11. Periurban area.The Authority shall ensure that the area that spans the landscape between contiguous urban development and rural
countrysidewithlowpopulationdensityandispredominantlybeingusedforagriculturalactivityandislikelytobeurbanizedinthenexttwenty
yearsisnotifiedasperiurbanarea.

12.Landuseinperiurbanarea.TheAuthorityshallensurethatthelanduseprovisionsunderpermitted,permissibleandprohibiteduses
prescribedforresidential,commercial,institutional,industrialandnotifiedarealandusesarestrictlyfollowedintheperiurbanareaasfollows:
(a)permitteduse:
theAuthorityshallpermitlandusesintheperiurbanareasinaccordancewiththeapprovedperiurbanstructureplan:
(b)permissibleuse:
theAuthority,subjecttorule18,maygrantanyofthepermissibleusesinaccordancewiththeapprovedperiurbanstructureplan:
(c)prohibiteduse:
theAuthorityshallnotallowapersontouseapropertyinaperiurbanareaforapurposewhichisneitherpermittednorpermissible
intheapprovedperiurbanstructureplan.
13.Agriculturalarea.TheAuthorityshallensurethatareafallingoutsidetheperiurbanareaisnotifiedasagriculturearea.
14.Landuseinagriculturalarea.TheAuthorityshallensurethatthefollowinglanduseprovisionsunderpermitted,permissibleandprohibited
usesarestrictlyfollowedinanagriculturalarea:
(a)permitteduse:
theAuthorityshallpermitfollowinglanduseinanagriculturalarea:
(i)crop
(ii)orchard
(iii)pastureland
(iv)livestocksuchasdairyorpoultryfarm

(v)forest
(vi)nurseryoragreenhouse
(vii)tubewell
(viii)ruralsettlementorvillage
(ix)placeofworshiporprayer

The Authority shall not allow a person to use a property in a agricultural area for a purpose which is neither permitted nor
permissible.
15. Notified area. The Authority shall ensure that the notifications issued for the historically significant area, environmentally sensitive area,
publicsectorinstitutionalarea,otherrestrictedareaoranintercityserviceareaarestrictlycompliedwith.
16.Land use in notified area. The Authority shall ensure that the following land use provisions under permitted, permissible and prohibited
usesarestrictlyfollowedaspermasterplan,periurbanstructureplanorapprovedscheme,inanotifiedarea:
(1)historicallysignificantarea:
(a)permitteduse:

17. Clarifications. (1) If TheAuthority finds any ambiguity in the classification of land use or its permissibility (permitted, permissible or

(2)TheGovernmentshall,withinthirtydays,decidethereferenceandthedecisionoftheGovernmentonsuchreferenceshallbefinal.
(3)TheGovernmentmaypermitalanduseinanyareawhichisnotprovidedinanyoftheclassificationsbutsuchlanduseshallbenearto
thelandusepermittedorpermissibleinthearea.
(4)Subjecttotheserules,variousclassifiedlandusesaresummarizedintheTableB.
18.Approvalofpermissibleuse.TheAuthorityshallnotgrantpermissiontoapersonforapermissiblelanduseunlesstheDistrictPlanning
andDesignCommitteehasexaminedandrecommendedsuchpermission.

19.Landuseclassificationmap.TheAuthorityshall,withinsixmonthsfromthenotificationoftheserules:

35.Periodicreview.SubjecttoageneraloraspecialorderoftheGovernment,theAuthorityshallperiodicallyreviewandrevisethenotified
landuseclassificationmap,notifiedperiurbanstructureplananddistrictplanningmapatleastonceeveryfiveyears.
CHAPTERIV
LANDUSERECLASSIFICATION
36.Landusereclassification.TheAuthoritymaypreparealandusereclassificationschemeforanarea,tobeknownasaprojectarea,after
thenotificationoflanduseclassificationmap.
37.Selectionofprojectarea.(1)TheAuthorityshallselecttheprojectareabyidentifyingandprioritizinganurbanblockorgroupofurban
blocksproposedforreclassificationinaccordancewiththefollowingcriteria:
(a)trendofchangesintheexistinglanduses
(b)marketdemandforthechangeoflanduseinthearea
(c)compatibilitywithadjoininguses

(d)potentialforupgradationofservingroadnetworkand
(e)prospectsforredevelopment.
(2)Notwithstandinganythingcontainedintheserules,theAuthorityshallnotselectaplannedindustrialareaasaprojectareaunlessthe
sameisscrutinizedandrecommendedbytheIndustrialAreaScrutinyCommitteeasperrule52.
38.Preparationofreclassificationscheme.(1)AftertheselectionoftheprojectareatheAuthorityshallprepareareclassificationscheme
by:
(a)demarcatingtheboundariesoftheprojectarea
(b)undertakingsurveyoftheprojectareaincluding:
(i)atopographicsurvey
(ii)landusesurvey
(iii)documentationoftheexistinginfrastructureanddesigncapacities

CHAPTERVII

DirectionsbytheGovernment
54. Directions.(1)An aggrieved person may, within thirty days of the issuance of a notification under these rules by the Authority, file a
complaintbeforetheGovernment.
(2)AcomplaintundertheserulesmaybeaddressedtotheSecretarytotheGovernment,HousingUrbanDevelopmentandPublicHealth
EngineeringDepartment.
(3) The Secretary to the Government, Housing Urban Development and Public Health Engineering Department. or any other officer
nominated by the Government for hearing of the complaint shall, within ninety days from the date of filing of the complaint, issue necessary
directionstotheAuthority.
(4)Acomplaintundertheserulesshallinclude:
(a)anapplicationsignedbytheaggrievedperson

CONVERSIONANDBETTERMENTFEE
55.Feeforconversionoflanduse.(1)TheAuthorityshalllevyfollowingfeeforconversionoflanduse:
(a) theconversionfeefortheconversionofresidential,industrial,periurbanareaorintercityserviceareatocommercialuseshallbe
twentypercentofthevalueofthecommerciallandaspervaluationtable,ortwentypercentoftheaveragesalepriceofpreceding
twelvemonthsofcommerciallandinthevicinity,ifvaluationtableisnotavailable
(b)theconversionfeefortheconversionofindustrialareatoresidentialuseshallbefivepercentofthevalueofthecommerciallandas
pervaluationtableorfivepercentoftheaveragesalepriceofprecedingtwelvemonthsofcommerciallandinthevicinity,ifvaluation
tableisnotavailable
(c)theconversionfeefortheconversionofperiurbanareaorintercityserviceareatoresidentialuseshallbeonepercentofthevalue
ofthecommerciallandaspervaluationtableoronepercentoftheaveragesalepriceofprecedingtwelvemonthsofcommercial
landinthevicinity,ifvaluationtableisnotavailable
(d)theconversionfeefortheconversionofperiurbanareaorintercityserviceareatoindustrialuseshallbefivepercentofthevalueof

thecommerciallandaspervaluationtableortenpercentoftheaveragesalepriceofprecedingtwelvemonthsofcommerciallandin
thevicinity,ifvaluationtableisnotavailable.
(2)TheAuthorityshallnotlevyconversionfeefortheconversionoflandusetoaneducationalorahealthcareinstitutionaluseifthe
proposededucationalinstitutionorhealthcareinstitutionis:
(a)ownedbyaphilanthropic,charitableornonprofitorganization
(b)aninstitutionexemptfromthepaymentofincometax
(c)aninstitutionlocatedinalowincomeareaasmaybedeterminedbytheAuthority.
56.Bettermentfee.(1)TheAuthoritymay,withthepriorapprovaloftheGovernment,levybettermentfeeinanareaunderSection23ofthe
LahoreDevelopmentAuthorityAct1975(XXXof1975).
(2)TheAuthorityshallassessthebettermentfeekeepinginviewthefollowingcriteria:

(a)totalcoveredareaoftheproposedcommercialbuildingand
(b)typology(proposeduse)ofthebuilding.

CHAPTERIX
REVIEWOFDECLAREDROADS&TEMPORARYCOMMERCIALIZATION
57.Enlistmentandsurveyofdeclaredroads.(1)TheAuthorityshall,withinthirtydaysfromthenotificationoftheserules,preparealistof
roads or segment of roads declared as commercial under any law for the time being in force in consultation with the District Officer (Spatial
Planning),CityDistrictLahore.
(2)TheAuthorityshallconductsurveyofthelistedroadsandidentifythepropertieslegallyorillegallyconvertedtocommercialuse.
(3)TheDistrictPlanningandDesignCommitteeshallreviewthelistedroadsandshall:
(a)assessthefeasibilityforcontinuationoftheroadascommercial.

(b)assessanddecidethesuitabilityforplacingtheroadinanotifiedcategoryoflanduseand
(c) identify any restrictions to be imposed on any of the selected road regarding minimum size of plot, type of commercial activity,
buildingheight,buildinglineoranyotherdesignparameters.
(4)TheDistrictPlanningandDesignCommitteemaykeepinviewthefollowingfactorsfordecidingthefutureuseofthelistedroads:
(a)potentialforupgradationofservingroadnetwork
(b)potentialforupgradationofexistinginfrastructure
(c)trafficimpactassessment
(d)trendofchangesintheexistinglanduses
(e)marketdemandforchangeoflanduseinthearea
(f)compatibilitywithadjoininglandusesand
(g)consultationwiththestakeholders.
(5)TheAuthorityshallprepareontherecommendationoftheDistrictPlanningandDesignCommittee:
(a)ListAonformA1ofthelistedroadswhicharepermittedforfuturecommercialusewithorwithoutanyrestrictionsand
(b)ListBonformB1ofthelistedroadswhicharefreezedandnotallowedforanyfuturecommercialuse.

(6)TheAuthorityshallensurethatpreparationoflistAandlistBisonlyaonetimeactivityafternotificationoftheseRules.
58.Scrutiny.TheDirectorGeneralshall,afterscrutiny,submittheliststotheDistrictPlanningandDesignCommitteeforapproval.
59.Approval.TheDistrictPlanningandDesignCommitteeshallapprovethelistswithorwithoutconditions.
60.Notification.(1)TheChiefMetropolitanPlannershallsignandcertifytheapprovedlists,intriplicate.
(2)TheAuthorityshall,withinsevendaysfromthedateofapproval,notifytheapprovedlists.
61.Circulation.(1)TheChiefMetropolitanPlannershallretainacopyofthenotifiedlistsintheofficeforrecordanddisplayonthenotice
board.
(2)TheChiefMetropolitanPlannershallforwardtheothercopiesofthenotifiedliststotheGovernmentandtheCityDistrictGovernment
Lahore.
(3)TheAuthorityshallpublishthenotifiedlistsonitswebsite.
(4)Apersonmay,subjecttopaymentoffee,obtainacertifiedcopyofanotifiedlistfromtheAuthority.
62.Conversionstatus.(1)TheAuthorityshalldeemabuilding,plotorlandfacingtheroadmentionedinthenotifiedlistAasconvertedto
thecommercialuse.

(2)Subjecttoanylegalrestrictionsimposedunderanylawforthetimebeinginforce,anoccupantofabuilding,plotorlandfacingtheroad
mentionedinanotifiedlistA,mayusethebuilding,plotorlandforacommercialpurposeonpaymentofconversionfee.

convertedtocommercialoranyotherusealongtheroadsincludedinListA.

(5)Nothingintheserulesshallaffectthestatusofabuilding,plotorlandwhichhasbeenconvertedonpaymentoftheconversionfee
underanylawforthetimebeinginforce.
63.Prohibition.TheAuthorityshallnotallowconversionofabuilding,plotorlandreservedforeducationalinstitution,healthcareinstitution,
postoffice,policestation,placeofworshiporanyotherplotsoldbyapublicauthorityatreservepriceforaspecificuse.
64.Enlistmentoftemporarycommercialization.(1)TheAuthorityshall,withinthirtydaysfromthenotificationoftheserules,preparealist
ofbuildingswhichhavebeengrantedpermissionfortemporarycommercialuseunderanylawforthetimebeinginforceinconsultationwiththe
DistrictOfficer(SpatialPlanning),CityDistrictLahore.

(2)TheAuthorityshallpreparelistCandlistDofthebuildingsinthefollowingmanner:
(a)listConFormC1:wherethetemporarycommercializationfeehasbeendepositedpriortothenotificationoftheserulesand
(b)listDonFormD1:wherethetemporarycommercializationfeewasduebutthesamehasnotbeendepositedpriortothenotification
oftheserules.
65.Scrutiny.TheDirectorGeneralshall,afterscrutiny,submittheliststotheDistrictPlanningandDesignCommitteeforapproval.
66.Approval.TheDistrictPlanningandDesignCommitteeshallapprovethelists.
67.Notification.(1)TheChiefMetropolitanPlannershallsignandcertifytheapprovedlists,intriplicate.
(2)TheAuthorityshall,withinsevendaysfromthedateofapproval,notifytheapprovedlists.
68.Circulation.(1)TheChiefMetropolitanPlannershallretainacopyofthenotifiedlistsintheofficeforrecordanddisplayonthenotice
board.
(2)TheChiefMetropolitanPlannershallforwardtheothercopiesofthenotifiedliststotheGovernmentandtheCityDistrictGovernment

69.Conversionstatus.(1)Subjecttothelanduseclassificationofanarea,theAuthorityshall,withinthreeyears,phaseoutthepermission
fortemporarycommercializationofabuilding.
(2)TheAuthorityshall,withintwomonthsfromthenotificationofthelistD,issuedemandnoticetodefaulterforpaymentofoutstanding
duesoftemporarycommercialization.

(3)Incaseadefaulterfailstodeposittheoutstandingdueswithinthirtydaysfromthedateofissuanceofthedemandnotice,theAuthority
shallcancelthepermissionfortemporarycommercializationandshalltakeactioninaccordancewiththelawforthetimebeinginforce.
(4)Subjecttoanylegalrestrictionsimposedunderanylawforthetimebeinginforce,anoccupantofabuildinginlistCmayusethe
buildingonpaymentoftemporaryconversionfee,withoutanystructuralchange,forapurposepermittedunderthetemporarycommercialization.

70.Feefortemporaryconversionoflanduse.TheAuthorityshalllevytheconversionfeeatthefollowingratesfortemporaryconversionof
landuse:
(a)sixpercentoftheconversionfeefortheperiodtill31stDecember2009
(b)ninepercentoftheconversionfeefortheperiodfrom1st
January2010till31stDecember2010and
(c)twelvepercentoftheconversionfeefortheperiodfrom1st
January2011till31stDecember2011.
71.Prohibition.TheAuthorityshallnotentertainorapproveanyapplicationfortemporarycommercialization.
72.Reclassification.NothingcontainedinthischaptershalllimittheauthorityoftheAuthoritytoreclassifyanareaincludingalistedroadin
accordancewiththeserules.

CHAPTERX
MISCELLANEOUS

73. Payment of conversion fee. (1) The Authority shall deem a building, plot or land in a notified land use reclassification scheme as
convertedtothelanduseasperthenotifiedscheme.
(2)Subjecttoanylegalrestrictionsimposedunderanylawforthetimebeinginforce,anoccupantofabuilding,plotorlandmayusethe
building,plotorlandforapurposepermittedunderthenotifiedlandusereclassificationschemeonpaymentoftheconversionfee
(3)Subjecttosubrule(4),apersonshallapplytotheappropriateauthorityforconstruction,alterationorreconstructionofabuilding,plotor
landinaccordancewithnotifiedlandusereclassificationscheme.
(4)Theappropriateauthorityshallnotentertainanapplicationforconstruction,reconstructionoralterationofabuilding,plotorlandina
notifiedlandusereclassificationschemeunlesstheapplicanthaspaidtheconversionfeeinaccordancewiththeserulesasapplicableonthe
dateofsubmissionoftheapplication.
74. Income from conversion. The Authority shall keep income from conversion of land use and the betterment fee in a separate head of
accountandshallspendtheincomeontheprovisionordevelopmentofinfrastructure.
75.Buildingline.TheAuthorityshallfixabuildinglineinalandusereclassificationschemewhichshallnotbelessthan:
(a)thebuildinglinespecifiedinthebuildingregulations

(b)thirtyfeetalongaroadwithrightofwayofeightyfeetandaboveand
(c)tenfeetalonganyotherroad.
76.Masterplan.TheAuthorityshallprepareamasterplanorzoningplaninaccordancewiththeserules.
77.Conversionofcinemasite.TheAuthoritymayallowconversionofacinemasite:
(a)inanapprovedschemeoronlandallottedonreservedpricesubjecttothefollowingconditions:
(i)conversionfeeshallbechargedasapplicabletoconversionofaresidentialplottocommercialuseand
(ii)acinemaoraprojectiontheaterwithatleastonethirdseatingcapacityoftheexistingcinemashallbeprovidedinthenew
building:
(b)onprivatelandotherthanthesiteonlandspecifiedinclause(a),subjecttothefollowingconditions:
(i)ifthecinemaislocatedinanareawhichisnotacommercialareathanitshallnotbeallowedtobeconvertedtoanyother

78.Administrationandenforcement.ThevariousprovisionsoftheserulesshallbeadministeredandenforcedinaccordancewiththeTable

79.Relaxationofrules.Noprovisionoftheserulesshallberelaxedinanycircumstances.

80.Repeal.TheLahoreDevelopmentAuthorityLandUseConversionRules,2008madevidenotificationno.SO(HII)52/81/VOLII,are
herebyrepealed.
