PROCEEDINGS OF THE COUNTY BOARD OF JACKSON COUNTY, MINNESOTA

September 6, 2016
The County Board of Jackson County, Minnesota met in regular session, in the Jackson County
Courthouse Board Room, 405 Fourth Street, City of Jackson, Minnesota, on September 6, 2016.
The following County Board members were present: William Tusa, Kim Hummel, David Henkels,
Rosemary Schultz and Don Wachal, Commissioners. County Coordinator Steven Duncan and Trish
Schulz, Human Resources Technician, were also in attendance.
CALL TO ORDER
Chair Schultz called the meeting to order at approximately 9:00 a.m. and led the Pledge of
Allegiance.
Motion was made by Commissioner Hummel and seconded by Commissioner Wachal to adopt
the agenda. Motion carried unanimously.
CONSENT AGENDA
Motion was made by Commissioner Henkels and seconded by Commissioner Tusa to approve
the Consent Agenda. The motion carried unanimously.
Board Action 16 - 192: Approve the August 16, 2016 Board of Commissioner meeting minutes.
Board Action 16 - 193: Approve all Commissioners disbursements in accordance with Minnesota
Statutes 130.01, subd. 4(b), recorded on warrants numbered 79214 through 79375 in the amount of
$1,092,793.73 - for Revenue Fund, $97,703.99; Road and Bridge, $639,583.44; Ditch Funds,
$325,155.39; Health Insurance, $2,968.00; Insurance Trust, $2,500; Septic, $16,000.00; Agency,
$2,783.00 and Library, $6,099.91.
A detailed list of claims paid is available at the
Auditor/Treasurers Office upon request.
Board Action 16 - 194: Approve the following utility permits:
South West Minnesota Broadband - bore fiber CSAH 1 - Ewington Township
Red Rock Rural Water water hookups Wisconsin Township
Irv Sether/Nichol Construction bore tile CR 84 Kimball Township
Board Action 16 195: Approve directing Southern Prairie Community Care (SPCC) to issue
current and future Jackson County settlement distributions directly to Des Moines Valley Health and
Human Services.
Board Action 16 - 196: Approve Appropriation - The County Board finds that according to MS
138.052 the County Board is authorized and empowered to appropriate, out of the revenue fund of
such county or out of the proceeds from a special tax levy upon all the taxable property in the
county, such sum as it may deem advisable, to be paid to the historical society of such county, to be
used for the promotion of historical work within the borders thereof, and for the collection,
preservation and publication of historical material, and to disseminate historical information of the
county, and in general to defray the expense of carrying on the historical work in such county, and

as such the Jackson County Historical Society is an appropriate recipient of County funds. Chair
Schultz directs the Auditor/Treasurer to pay $24,500 to the Jackson County Historical Society.
Board Action 16 - 197: Set Final Public Hearing for Judicial Ditch 45 on Monday, October 3, 2016
at 10:00 a.m. in the Heron Lake Community Center.
Board Action 16 - 198: Approve the classification of tax forfeited parcels R22.641.0080,
R25.443.0080, and R26.200.1120 as non-conservation land and request from the Minnesota
Department of Natural Resources approval of the classification and the sale of said land.
Board Action 16 - 199: Approved the basic sale prices and authorize for Public Sale of Tax Forfeited
Land on list of Tax Forfeited Land 2016 on Thursday, October 20, 2016 at 10:00 am in the County
Commissioners Board Room of the Jackson County Courthouse, 405 4th Street, Jackson,
Minnesota.
Pursuant to law, I present below, a statement showing the amount of taxes levied for County
Purposes for the current year, the amounts collected and apportioned to date, and the balances
uncollected, together with the actual cash balances remaining to the credit of each County Fund at
the close of business on the 30th day of June, 2016.

LAND MANAGEMENT
Motion was made by Commissioner Hummel and seconded by Commissioner Schultz to table
action on the Conditional Use Permit request by Precision Capital LLC to establish a campground.
Motion carried unanimously.
PUBLIC WORKS

Motion was made by Commissioner Wachal and seconded by Commissioner Tusa to approve
Board Action 16 - 200: Approve the Public Works Director to set a date for a public auction, to be
held in September, October, or November 2016, and declaring property and equipment as surplus as
approved by the County Coordinator or Public Works Director. Motion carried unanimously.
Motion was made by Commissioner Henkels and seconded by Commissioner Wachal to
approve Board Action 16 - 201: Approve the purchase of three seats of Softree software; a civil
design software at a cost of $7,110.00. Motion carried unanimously.
Motion was made by Commissioner Henkels and seconded by Commissioner Hummel to
approve Board Action 16 - 202: authorizing the County Coordinator to advertise and hire a single
intern postion in the Public Works Department, not to exceed six months. Motion carried
unanimously.
Motion was made by Commissioner Tusa and seconded by Commissioner Wachal to adopt
County Resolution 16 - 182 approving final payment for SAP 032-599-100 (related to bridge
removal in Round Lake Township). Motion carried unanimously.

RESOLUTION 16 183 FOR AGREEMENT TO STATE


TRANSPORTATION FUND LOCAL BRIDGE REPLACEMENT PROGRAM
GRANT TERMS AND CONDITIONS
SAP 032-629-039
WHEREAS, Jackson County has applied to the Commissioner of Transportation for a grant from
the Minnesota State Transportation Fund for construction of Bridge No. 32J47; and
WHEREAS, the Commissioner of Transportation has given notice that funding for this bridge is
available; and
WHEREAS, the amount of the grant has been determined to be $80,831.00 by reason of the lowest
responsible bid;
NOW THEREFORE, be it resolved that Jackson County does hereby agree to the terms and
conditions of the grant consistent with Minnesota Statutues, section 174.50, subdivision 5, clause
(3), and will pay any additional amount by which the cost exceeds the estimate, and will return to
the Minnesota State Transportation Fund any amount appropriated for the bridge but not required.
The proper county officers are authorized to execute a grant agreement with the Commissioner of
Transportation concerning the above referenced grant.

RESOLUTION 16 184 FOR AGREEMENT TO STATE

SAP 032-629-041
WHEREAS, Jackson County has applied to the Commissioner of Transportation for a grant from
the Minnesota State Transportation Fund for construction of Bridge No. 32J48; and
WHEREAS, the Commissioner of Transportation has given notice that funding for this bridge is
available; and
WHEREAS, the amount of the grant has been determined to be $56,802.50 by reason of the lowest
responsible bid;
NOW THEREFORE, be it resolved that Jackson County does hereby agree to the terms and
conditions of the grant consistent with Minnesota Statutues, section 174.50, subdivision 5, clause
(3), and will pay any additional amount by which the cost exceeds the estimate, and will return to
the Minnesota State Transportation Fund any amount appropriated for the bridge but not required.

Motion was made by Commissioner Henkels and seconded by Commissioner Wachal to
approve Board Action 16 - 203 approving the Contract and Bond with M & K Bridge Construction,
Inc. for SAP 032-599-095 for replacement of bridge #2809 in Kimball Township. Motion carried
unanimously.

CLOSED MEETING
Motion was made by Commissioner Tusa and seconded by Commissioner Wachal closing the
meeting as permitted by Minnesota Statutes Section 13D.05, under attorney-client privilege,
regarding potential litigation. Motion carried unanimously.
Motion was made by Commissioner Wachal and seconded by Commissioner Hummel reopening the meeting. Motion carried unanimously.
Motion was made by Commissioner Hummel and seconded by Commissioner Wachal to
approve Board Action 16 - 204 authorizing the County Attorney to proceed as directed. Motion
carried unanimously.
CLOSED MEETING
Motion was made by Commissioner Hummel and seconded by Commissioner Wachal
closing the meeting as permitted by Minnesota Statutes Section 13D.05, under attorney-client
privilege, regarding potential litigation. Motion carried unanimously.
Motion was made by Commissioner Henkels and seconded by Commissioner Tusa re-opening
the meeting. Motion carried unanimously.
Motion was made by Commissioner Hummel and seconded by Commissioner Wachal to
approve Board Action 16 - 205 authorizing the County Attorney to proceed as directed. Motion
carried unanimously.
COUNTY COORDINATOR
Motion was made by Commissioner Tusa and seconded by Commissioner Wachal to approve
Board Resolution 16 185, approving fairgrounds storage leases and associated revenues be
administered, collected and utilized by the Jackson County Fair Association, primarily for building
and fairgrounds repairs, maintenance and projects. Motion carried unanimously.

Resolution No. 16-185

Resolved by the Board of Commissioners, County of Jackson, and State of Minnesota:


WHEREAS, the County of Jackson, Minnesota and the Jackson County Fair Association have
shared the revenues associated with fairgrounds storage leases; and
WHEREAS, the Jackson County Fair Association is requesting that all such fairgrounds storage
leases and associated revenues be administered, collected and utilized by the Jackson County Fair
Association, primarily for building and fairground repairs, maintenance and projects; and

WHEREAS, the County of Jackson, Minnesota Board of Commissioners believes that it is in the
interest of the County of Jackson and the Jackson County Fair Association that all such revenues be
dedicated to the Jackson County Fair Association, now, therefore;
BE IT RESOLVED, that until further resolution, the County of Jackson, Minnesota Board of
Commissioners does hereby authorize the Jackson County Fair Association to lease the interior of
the buildings at the Jackson County Fairgrounds for seasonal storage and directs that all such
fairgrounds storage leases and associated revenues be administered, collected and utilized by the
Jackson County Fair Association, primarily for building and fairground repairs, maintenance and
projects.

Motion was made by Commissioner Wachal and seconded by Commissioner Tusa to approve
Board Action 16 - 206, accepting Blue Cross/ Blue Shield of Minnesota Health Insurance premium
rates for 2017. Motion carried uananimously.
Motion was made by Commissioner Hummel and seconded by Commissioner Wachal to
approve Board Action 16 - 207, accepting County/employee Health Insurance contribution rates and
VEBA contribution amounts for 2017, as proposed. Motion carried unanimously.
Motion was made by Commissioner Hummel and seconded by Commissioner Tusa to approve
Board Action 16 208, accepting the 2017 renewal of ancillary benefits rates, as proposed. Motion
carried unanimously.
COMMITTEE AND BOARD REPORTS
Commissioner Wachal reported on meetings involving the Budget and Comprehensive Water
Management Advisory Committees.
Commissioner Tusa reported on two meetings involving the Fair Board and a Western Community
Action meeting.
Commissioner Hummel reported on meetings involving the Personnel and Budget Committees, Fair
Board, and Fort Belmont/JCT, Inc.

Commissioner Henkels reported on meetings involving the Personnel Committee, Area


Transportation Region 7, and Heron Lake Watershed District.
Commissioner Schultz reported on meetings involving the Heron Lake Watershed District,
Southwest Minnesota Housing Partnership, Planning & Zoning Commission, Southern Prairie
Community Care, Law Library, and State-wide Community Health Services Advisory Committee.

Motion was made by Commissioner Tusa and seconded by Commissioner Henkels to adjourn
the meeting. Motion carried unanimously.
