HEPATY Tate Sanborn, being first duly sworn, deposes and says: That he is a Detective with the Las Vegas Metropolitan Police Department, being so employed for a period of 19 years, assigned to investigate the crime(s) of Murder with a Deadly Weapon, Battery with a Deadly Weapon, Burglary with a Firearm, and Possession of Firearm by Prohibited Person, committed on or about 1-21-17, which investigation has developed Joe! Nunoz Cruz as the perpetrator thereof. ‘THAT DECLARANT DEVELOPED THE FOLLOWING FACTS IN THE COURSE OF THE INVESTIGATION OF SAID CRIME, To wit: (On 1-21-17 at approximately 0705 hours, a shooting was reported at the OK Corral Bar and Nightclub located at 1602 N. Nellis Boulevard. Witnesses reported two people were shot and the suspect fled the scene on foot. The suspect was described as a Hispanic male in dark clothing with a pony tail and prescription glasses. Medical personnel and patrol officers were dispatched to the crime scene under LVMPD event number 170121-0883. Patrol Officers arrived on the crime scene and located Waitress Jhoslyn Gonzalez inside the business suffering from a gunshot wound to her left thigh. Officers also located Alberto Sanchez-Delatorre lying on the ground in the ‘west doorway of the business suffering from multiple gunshot wounds. Gonzalez was transported to University Medical Center (UMC) for treatment and survived her injuries, while Sanchez-Delatorre was pronounced deceased at the crime scene. Patrol detectives responded to the crime scene and determined further investigation from the homicide section was. warranted, Homicide Sergeant Scott arrived on the scene with Homicide Detectives Sanborn, Mauch, Reatz, and Grimmett. Homicide Detective Kisner responded to follow-up at UMC, Homicide Detectives received an investigative briefing from Patrol Detective Belmont; Homicide Detectives Sanborn and Mauch were assigned the follow-up investigation into Alberto Sanchez-Delatorre's shooting death. ravoox gon of Wart Summon (A eae NN eo ae 00) WORD 2010 LAS VEGAS METROPOLITAN POLICE DEPARTMENT . CONTINUATION Event#: __ 170121-0883 Homicide Detective Kisner responded to UMC and interviewed victim Gonzalez. Gonzalez was a waitress at the (OK Corral Bar and Nightclub. She was working her shift on January 21, 2017. The night was uneventful, with no fights or arguments. Prior to the shooting, she had her back to the front door and was dealing with some customers when she heard about five (5) gunshots and got shot in the upper left leg. She did not see who was shooting, nor did she hear or see any fight or argument before the shooting Homicide Detective Sanborn examined the crime scene with crime scene analysts. The owners of the OK Corral Bar and Nightclub, Crisanto Alvarado-Herrera and his wife Azucena Mier-Favala, responded to the scene and signed a consent-to-search card, which allowed investigators to process the crime scene for evidence. Investigators processed the interior crime scene and recovered three (3) .32 caliber cartridge cases and several small caliber bullets and bullet fragments. 1eras mounted on the interior and exterior of the business. Investigators noted numerous video surveillance Forensic Multimedia Analyst Wyche responded to the crime scene and recovered the OK Corral's Digital Video Recorder (DVR) for processing. Homicide Detective Sanborn reviewed the available video surveillance footage and determined the suspect was a Hispanic male adult in his twenties, last seen wearing a dark shirt and pants with a white belt and white cowboy boots. The male had long black hair, which was kept in a bun on his head, and he wore prescription glasses. The male appeared to be approximately 5'8"-6'0" feet tall, with a thin build. The suspect arrived at the bar driving a white Mercury Grand Marquis, with an unknown Hispanic female adult in a red dress, The two sat down at a table in the southeast comer of the bar, next to the victim and his group of friends. The Hispanic male suspect approached the bar to order beers and tattoos were visible across the knuckles on his left hand; however, the actual letters or designs of the tattoos were not discernable on the video footage. Later in the night, the suspect and the female returned to their table after dancing and it appeared the suspect and victim exchanged words. The suspect then walked out of the bar to the Grand Marquis. The female in the red dress followed the male out a short time later and the two left in the white Grand Marquis. The Grand Marquis had distinct areas of damage on the hood, which consisted of two spots where the white paint had flaked off. Approximately thirteen (13) minutes later, the Hispanic male suspect returned on foot and walked directly over to the victim and shot him several times before fieeing the ‘scene on foot. On 1-22-17, a complete autopsy was performed on the body of Alberto Sanchez-Delatorre at the Clark County Office of the Coroner/Medical Examiner. Doctor Simms determined Sanchez-Delatorre died from multiple gunshot wounds, and his death was ruled a homicide. Page 2 of LAS VEGAS METROPOLITAN POLICE DEPARTMENT CONTINUATION Event # _170121-0863_ (On 1-22-17, Homicide Detective Sanborn created an internal LVMPD electronic briefing, which was sent out department wide. The briefing sheet provided department members with the preliminary information regarding the murder investigation, the suspect description, and the suspect vehicle description. Homicide Detective Sanborn attached four (4) still photographs from the crime scene to the electronic briefing for reference. (On 1-23-17 at approximately 1500 hours, LVMPD staff conducted a press conference with several local media outlets and released surveillance video recovered from the night of the murder at the OK Corral Bar and Nightclub. Department members requested the public's assistance with identifying and locating the Hispanic male suspect, the Hispanic female with him, and the suspect vehicle. On 1-23-17 at approximately 2000 hours, detectives assigned to the VIPER Auto Theft Task Force located the suspects’ white Mercury Grand Marquis parked on the street in the 4100 block of East Odgen Avenue. The vehicle was unoccupied and bore Nevada license plate [NN Nevada DMV records revealed the registered owner of the suspect vehicle was a Flor Esther Cruz-Cerresco (dob. I >t IMI in Las vegas Detectives’ maintained physical surveillance on the suspect vehicle until relieved later in the investigation by homicide detectives On 1-24-17, Homicide Detective Sanborn received information from NWAC Patrol Officer Marty-Pagan, who believed he recognized the murder suspect from the patrol briefing from a December 28, 2016 police contact with him, Patrol Officer Marty-Pagan identified the possible suspect as Joel Nunoz Cruz under LVMPD ID# 2678900. Homicide Detective Sanborn viewed a database photograph of Joel Nunoz Cruz under LVMPD ID# 2678900 and ‘was able to positively identify him as the suspect captured on video surveillance at the OK Corral who was responsible for the shooting death of Alberto Sanchez-Delatorre. Joel Nunoz Cruz was described further as a 24 year old Hispanic male with long black hair and prescription glasses. Police records listed Cruz as §'10" inches tall ‘who weighed 140 pounds. Police records also indicated Cruz had the letters "CALI" tattooed across his left knuckles, Homicide Detective Sanborn conducted a police records check of Joel Nunoz Cruz, which revealed he was a two time convicted felon in the State of Nevada; Attempt Battery by Prisoner in 2008 (Case#t 244214), and Attempt Possession of Dangerous Weapon by Prisoner in 2010 (Case#265842). (On 1-24-17 at approximately 1230 hours, Homicide Detective Sanborn was contacted via telephone by Sandra Enrique-Cruz for her aunt Flor Cruz, who saw her picture on the news reference the shooting which took place at the OK Corral Bar and Nightclub. Cruz agreed to come to the LVMPD Homicide Office to be interviewed. Page 30f4 LAS VEGAS METROPOLITAN POLICE DEPARTMENT a CONTINUATION Event 17012-0883 On 1-24-17 at approximately 1352 hours, Homicide Detectives Sanborn and Mauch interviewed Flor Ester Cruz with the assistance of Spanish Interpreter Maria Jimenez (PN 13257). Flor confirmed she was the Hispanic female inthe red dress depicted onthe survelance video with the Hispanic male at the OK Corral Bar and Nightclub on the night of the murder. Flor went to the club late that night with the Hispanic male, she knew as “Tir,” She recently met Tigrillo and agreed to go dancing with him. The two arrived in Flor's white Grand Marquis, which was parked infront of her house tI Fr viewed a database photograph of Joel Nunoz Cruz ID# 2678900 and confirmed he was Tigrillo. During the night at the club, Flor and Joel returned to their table. Flor sat down inher seat, but a Hispanic male was seated in Jet's seat. Joel asked the male to getup, but the male ignored him. Joe! immediately welked away. Flor believed he was going tothe bathroom, but then saw him walk out the oor tothe club. Flor folowed him outside and go into the passenger sea of her vehicle, Joel was upset and told her the male inside had disrespected her and him. Joe! drove out of the parking lot and stopped on a street near the club. Joel got out ofthe car and told Flr to get out of there. Flor attempted to get Joel to get back in the car, but he continued walking back toward the club. For told him not to go back because the male who took his seat had several friends with him. Flor did not see Joel with a gun and did not know wat he was going to do, Flor relumed home and has not seen or spoken to Joe since On 1-24-17 at approximately 1600 hours, Homicide Sergeant Scott obtained a Search Warrant for Flor Cruz residence 21 IIE and ner Grand Marquis (NVI The warrant was approved by District Court Judge Miley. Homicide Detectives documented the residence and suspect vehicle with photographs and ‘searched both for evidence. No items of evidence were recovered during the search.
