IwritetoyouasaformerViceChairoftheLondonPoliceServicesBoard,andpassalongmyviews,forwhattheymaybeworth.

Inanutshell,theLondonPoliceAssociation,which,asyouknow,istheunionforLondon'spoliceofficers,hasmadean
inappropriaterequesttoyouanditisyourresponsibilitytorefuseit.Istronglyadviseyoutogetcomprehensiveadvice
fromtheCitySolicitorsofficebeforeproceedinganyfurtheronthismatter.

YoushouldbeawarethattheAssociationisnotaskingyoutorequestaroutineinvestigationintothereasonfortheallegeddelayin
yourgrantingtheLondonPoliceServicethebudgetincreaseitwasdemanding.TheOCPChasnopowertoundertakesuchan
investigation.

RathertheyarereallyaskingyoutorequestaninvestigationofMayorBrowninrelationtotheiraccusationofimproprietyonhispart.
TheyhavenolegalrighttoseeksuchaninvestigationsotheyhaverequestedthattheLondonPoliceServicesBoardoryourselves
requestit(whichtheBoardproperlywillnotdo).TherequestisnotonbehalfoftheAssociation,butratherwouldbethatLondon
CityCouncilsuspectswrongdoingonbehalfofMayorBrown.

UnlessyoubelievethatMayorBrownactedimproperly inamannercontrarytothebestinterestsofLondonCityCouncilthenit
wouldbefrivolousofyoutorequestsuchaninvestigation.TheinvestigationprocessexistsonlyforgenuineconcernsofMunicipal
CouncilsorPoliceServicesBoards.

ThemainthingtheAssociationhastogainfromtheirdemandisthatforthedurationofanyinvestigationMayorBrownwouldbe
automaticallysuspendedfromthePoliceServicesBoard.This,amongotherthings,wouldcausethelossofyouradvocateontheBoard
forthecardingbanwhichyoucalledforandwhichtheAssociationhascategoricallyopposed.Thishandsthemasubstantialtactical
advantage.

ThiswouldalsosendastrongmessagetoanyPoliceServicesBoardmemberthatiftheydaretoquestionordelaygivingthePolice
Serviceanybudgetincreaseitseeks,thentheAssociationmaypersuadeCounciltohavethemsuffertheembarrassmentof
investigation.Thiswouldprovidethemwithasubstantialtacticaladvantageinthenextnegotiations.

specialconstable,amunicipallawenforcementofficeroramemberofaboard
(a.1)theperformanceofdutiesofanappointingofficialundertheInterprovincialPolicingAct,2009
(b)theadministrationofamunicipalpoliceforce
(c)themannerinwhichpoliceservicesareprovidedforamunicipality

MEMBERSOFPOLICESERVICESBOARDSCODEOFCONDUCT
14.(1)AboardmemberwhoseconductorperformanceisbeinginvestigatedorinquiredintobytheCommissionunder
section25oftheActoristhesubjectofahearingbeforetheCommissionunderthatsectionshalldeclinetoexercisehisorher
dutiesasamemberoftheboardforthedurationoftheinvestigationorinquiryandhearing.

TheAssociationexecutivehasoneduty.Thatistogetitsmembersasmuchsalary,benefitsandimprovedworkingconditionsas
possible.(IthappensthatIorganizedthefirstlawyerstounionizeinOntariohistory,soIhavesomefamiliaritywiththedutiesofunion
executives.)TheAssociationexecutives,unlikeyou,havenoobligationtotheCitizensofLondon,tobalanceprovidingeffective
municipalservices(includingpolicing)withminimizingthetaxburdenofLondoners.TheAssociationsrequesttoyou,asidefrom
seekingrevengeagainstMayorBrownforhisrecognizingthathisdutyasamemberofthePoliceServicesBoardisnottoautomatically
supporteveryfundingincreasethePolicewouldlike,ortostandwiththePoliceagainstpolicingreformssuchasaroundcarding.Rather
itistorepresentthebestinterestsofthecitizensofLondon.

ThisiswhytheAssociationexecutivesareangrywiththeMayor.YetallhehasdoneisadvanceyourinterestsontheBoard.Itwouldbe
theheightofironyforyounowtopermityourselvestobeusedasavehiclefortheAssociationtopunishtheMayorforadvancingyour
interests.

Yourrequestinganinvestigationwouldgreatlystrengthentheirbargainingpositionagainstyouinthenextnegotiations.Theyspeakof
improvingrelations,yetwontbudgeaninchtowardsyourpositiononcarding.YourrelationshipwiththePoliceServiceandthe
Associationisnotasfriends,butratherasopponentsinnegotiations.Yougavethemeverythingtheyaskedforinnegotiationsthisyear,
yettheydemandmore.Thatistheroleoftheunionexecutive.Yourroleistosaynomore.Iftheywanttosaythatdoingsoprevents
improvingrelationsthentheycanhardlyclaimtobecomingtoyouingoodfaith.

Theirroleistoalwaysdemandmore.Yourroleistosayno.Pleasedosohere.Dontunwittinglyhelpthemtoembarrassyouby
pursuingafrivolousrequesttotheOCPC,andcausingtheremovalofyourstrongestadvocateonthePoliceServicesBoardatacritical
time.
