NOTIFICATION
New Delhi, the 19th December, 2005 ,

G.S.R727@).- In exercise of the powers conferred by sub-


section (1) read with sub-section (1A) of section 3 of the All India
Services Act, 1951 (61 of 195I), the Central Government, after
consultation with the Governments of the States concerned, hereby
makes the following rules further to amend the All India Services
(Death-cum-Retirement Benefits) Rules, 1958, namely:-

1 (1) These rules may be called the All India Services


(Death-cum-Retirement Benefits) Third Amendment
Rules, 2005.
(2) They shall be deemed to have come into force with effect
from the 30thAugust, 2004.

2. In the All India Services (Death-cum-Retirement Benefits)


Rules, 1958 in Rule 22(B)for clause (ii) of sub-rule 3, the following
shall be substituted, namely:-

'(ii) in the case of a son or unmarried daughter till such son or


daughter attains the age of 25 or upto the date of his/her
marriage, whichever is earlier;

(ii a) in the case of a widowed/divorced daughter till her re-


marriage, subject to the income criterion as prescribed by the
Central Government from time to time."

Explanatory Memorandum

The Central G v ~ c ~ c ~ mhas ~ n t ciedd~r! to remove the


condition of age limit for payment of family pension in the case of
the divorced/widowed daughter making such family pensioners
eligible for family pension even after attaining the age of 25 years
with effect from 30th August 2004. It is certified that none will be
adversely affected by the retrospective operation of the proposed
amendment.
