ACCUSED-Appellant, thru counsel respectfully states :

That on December 14, 2016 he received his copy of the ORDER of

the Honorable Court directing him to file his on January 13, 2017;

That he could not possibly comply with the ORDER considering

the following:

His complete file of the case is missing and despite diligent

efforts the same could not be found;

He has to secure copies of the record of the case from the

Honorable Court since the court of origin, RTC 9 of La Trinidad, Benguet

forwarded the same to the Honorable Court;

Undersigned counsel was not the accuseds counsel in the

lower court which necessitates more time for him to study the case to be

able to file appellants brief .

It is, therefore, respectfully prayed that, considering the foregoing

circumstances, the accused-appellant be given an extension of sixty (60)

days from January 13, 2017 within which to file his appellants brief.
