Review of Market Leading Family and Matrimonial Law Competitors
The following solo and multi-attorney firms represent the primary competition in the Binghamton market with
respect to family and matrimonial law for Peter and the firm. These are the firms that are actively marketing to
potential new clients online and are ranking on the first page of Google for strategic divorce and family and
matrimonial law terms in the Binghamton area. Included in Appendix A is an overview of the competition, outlining
the online marketing, structure, practice areas, value proposition, consult fee, client phone response time, and office
address for each.
In summary, the competition is primarily deploying a mix of client-focused websites (all firms, with one deploying a
responsive site and two deploying mobile site versions), Pay-Per-Click campaigns (two firms), Search Engine
Optimization techniques (four firms), and completed Justia.com profiles (one attorney) and Avvo.com profiles (two
attorneys). The primary value proposition these competing firms are employing to brand themselves above all others
in the Binghamton market centers on years of experience, capacity to provide personal attention to the client, and
local roots. One firm Levene Gouldin & Thompson, LLP is an outlier, pointing out the substantial size of its
team and office footprint as a selling point for potential clients.
Given the competitions focus on years of experience, capacity to provide personal attention to the client, local roots
and, to a lesser extent, number of attorneys, Peter and the firm are well positioned to compete in and effectively
communicate the firms value proposition to potential new clients in the Binghamton market.
3
We will stand out in the marketplace by branding ourselves as the firm that places the former Broome
County Family Court Judge on our clients side of the argument working for them rather than against them.
No other firm in the market can claim this ability.
Suggested copy summarizing accolades identified below: Divorce and Custody Lawyers you can trust - Over 30
years of experience resolving 25,000 cases as a former Broome County Judge, backed by a statewide firm
We will further differentiate ourselves in the marketplace by ethically emphasizing the following in our marketing
and advertising:
Experience
o Peter Charnetsky has 30 years of legal experience, including 10 years of judicial experience and 20
years of experience in private practice.
o He has nine years of experience as an acting Supreme Court Justice and a decade of experience as a
Broome County Family Court Judge.
o During his judicial career, Peter resolved over 25,000 cases, and the Broome County Bar Association
and Independent Judicial Election Qualification Commission both rated him as highly qualified.
Local roots:
o Peter is a Binghamton native and a third generation Broome County resident.
o Before joining Tully Rinckey PLLC, he operated a solo law practice in Binghamton, where he
practiced family and matrimonial law, including contested and uncontested divorce, child custody,
child support, and adoption.
o Peter is highly involved in the local community, serving as a coach for boys and girls teams for
recreational soccer, T-Ball, the Kids Night Out League, and junior and senior baseball leagues. He
has also served as a volunteer Judge for local high school mock trial competitions and the American
Legion Oratorical Contest.
4
o The firms full team of 15 family and matrimonial law attorneys (including Peter) serves Binghamton
clients in a personal, professional and affordable manner with more than 100 years of collective legal
experience.
The firms Binghamton marketing mix consists of a focus on four central elements: services, place, price, and
promotion. Each is outlined in more depth below:
Services and Price The following are the legal services Peter and the firm will initially provide to
Binghamton clients. Included below is the proposed pricing structure for each service. The below pricing is
going rate, based on the average hourly rate ($250.00) quoted by the firms central competitors in the
Binghamton market, outlined on page 3 of this plan. The below pricing for uncontested and contested
divorce retainers is likewise going rate, based on the average quoted by the firms primary Binghamton
competitors.
Place This involves the location, distribution, and methods of providing the above services to
Binghamton clients. Tully Rinckey PLLCs Binghamton office will be principally located at 4100 Vestal
Road, Suite 104, Vestal, NY 13850.
The legal services Peter provides to Tully Rinckey PLLC clients will primarily emanate and be distributed
from the firms 4100 Vestal Road location, with legal support provided by Binghamton Legal Secretary
Sherry Holland and additional, firm-wide legal support staff as necessary.
Primary marketing, client relations, information technology, finance, and other support staff will be
provided to Peter and the Binghamton office location from Tully Rinckey PLLCs corporate headquarters at
441 New Karner Road, Albany, NY 12205.
Intake for clients referred to Tully Rinckey PLLC via firm marketing, referrals, or other means will be
executed by client relations associates in the Albany office. The associates will collect information from the
potential client regarding their stated legal matter, develop a summary call sheet outlining the legal matter
discussed, and schedule the potential client, as soon as possible, for a consult with Peter via his Time
Matters calendar and based upon the availability shown by said calendar.
5
Following client intake, Peter will be provided with the aforementioned call sheet detailing the client
matter. He will then consult with the client from the Binghamton office or by phone as circumstances
dictate. His goal will be to leverage the consult training he received from the firms Client Relations
Department to convert the potential client into a paying client by convincing them to retain the firms
services. Once this has occurred, Peter will collaborate with firm support staff to draft and approve an
appropriate retainer for the new client. Once approved by Peter, firm support staff will issue the retainer to
the new client, get it executed, and collect payment. Peter will work with his support staff and client
relations team to obtain same day payment and send out same day retainers. At this point, Peter will begin
collaborating with firm support staff to progress the clients legal matter and provide them with outstanding
personal, professional and affordable legal services. The end result should be a satisfied client who then
turns into a referral source for the Binghamton office and the firm.
Promotion This involves communication of the benefits and value of our services to potential, current,
and past clients. It also involves persuading potential clients to become active clients of the firm by utilizing
strategic marketing, advertising, and referral generation methods. To persuade potential clients in the
Binghamton market to become active clients of the firm, we will emphasize the branding elements outlined
on page 4 of this plan in all promotional efforts, which are designed to counteract the manner in which
competitors are branding themselves in the market. Again, these elements include the following:
o Experience
o Personal client attention
o Local roots
o Size of our team
We will utilize the following marketing, advertising, and referral generation methods to communicate the
benefits and value of our services to potential, current, and past clients in the Binghamton market. We will
promote Tully Rinckey PLLC as the firm that places the former Broome County Family Court Judge on our
clients side of the argument working for them rather than against them:
o Dual pay per click campaigns that include display and remarketing components;
o Television advertising blitz in the Binghamton market;
o Social media visibility: Targeted Facebook, Twitter, and YouTube ad campaigns;
o Dedicated Binghamton Family and Matrimonial Law blog meant to increase rankings;
o Continued Jusita.com and Avvo.com sponsored profiles;
o Print advertising in the Binghamton Press and Sun-Bulletin;
o A prominent billboard placement in the Binghamton market;
o Radio ads on WBNW-FM (NOW 105.7) and WSKG-FM (NPR affiliate); and
o A strategic public relations campaign.
The Pay-Per-Click campaign focusing on family and matrimonial law that is currently geo-targeting Binghamton,
NY and the 50 mile radius surrounding it will remain in play. A Binghamton general practice campaign will also be
built out and deployed effective November 1, 2015, targeting the same geographic region.
The composition of the general practice campaign will be similar to that of the one currently active for the Albany
market, which continues to provide incremental lead increases for the offices family and matrimonial law
department, as well as other practice areas, by targeting general legal search terms that are not practice area specific.
Display and remarketing campaigns will also be deployed to further support and flow leads to the Binghamton
family and matrimonial PPC campaign. The display campaign will serve divorce ads to potential Binghamton clients
via relevant sites across the thousands included in the Google Display Network. The sites where the ads are served
6
will be included in the Display Network categories of People & Society Family & Relationships Troubled
Relationships Divorce & Separation.
The remarketing campaign will serve divorce ads to potential Binghamton clients who have already visited any page
of the Binghamton microsite, and have therefore had a piece of specialized code placed in their browser which will
trigger the firms ads to be served when they visit any other site included in the Google Display Network.
Below are representative proofs of the Binghamton divorce display and remarketing ads:
Below is a deployment timeline for the Binghamton family and matrimonial law and general practice PPC
campaigns with associated budgets.
7
General Practice Law Campaign
o Deployed as of January 1, 2016.
o Monthly budget of $2,000.00.
In partnership with Desmond Media, the firm will progress a six month TV advertising blitz (running from Monday,
November 2, 2015 through Saturday, April 30, 2016) on the Binghamton market, focusing on market-leading
stations with the lions share of local viewership. This blitz will prioritize ad frequency and duration on the most
watched stations in the market during key morning and evening viewership times.
Four versions of firm advertisements will be deployed according to the formats available on each station, drafts of
which can be viewed at the below links.
The latest breakdown of the first month of the advertising blitz is shown in Appendix B, and is representative of
subsequent months understanding that monthly budget adjustments will be made based upon expected viewership.
Utilizing Facebook advertising and sponsored posts is a strategic and cost effective means of reaching
potential new clients in the Binghamton market. Facebook offers powerful and unique ways to serve online
advertisements to the individuals in Binghamton most likely to care about and have a need for divorce and
family law services.
With Facebook ads, the firm is able to reach potential new clients based on location, age, gender, interests
and other strategic factors. The firm is also able to utilize strategic tools to discern how Binghamton
Facebook ads are performing and make adjustments to increase their ability to generate clients and new
business.
When the firm runs divorce law advertisements on Facebook, the Marketing Department will be able to
choose the traits of the audience the firm would like to serve ads to. The firm is able to reach desired target
audiences based on location, demographics, and other strategic factors. This level of granular targeting
makes Facebook advertising a highly cost-effective advertising medium.
For the purposes of the firms divorce law client generation and new business goals, the firm will emphasize
the below factors when serving Binghamton divorce law ads on Facebook, which are meant to zero in on
clients who are most likely to require divorce law services and also bring higher end, complex divorce
matters to the firm:

The Google Display Network is comprised of numerous Google properties, such as YouTube, which
currently has over one billion users. On mobile alone, YouTube reaches more 18-34 and 18-49 year-olds
than any cable network in the U.S. The number of hours people spend watching videos on YouTube is up
60% year over year and the number of people watching YouTube per day is up 40% year over year since
March 2014.
Given the above, YouTube is an attractive platform on which to position a component of our online ads
targeting the Binghamton market through the Google Display Network. To take advantage of this
opportunity, the firm will deploy video advertising ahead of YouTube videos included in the Display
Network categories of People & Society Family & Relationships Troubled Relationships Divorce &
Separation. As a rough estimate, it is anticipated that a 10% - 20% lift in incremental leads will result for
the Binghamton family and matrimonial practice area following the launch of YouTube advertising.
13
Our video advertisements will pre-roll prior to the beginning of the video a user has selected to view. Our
rotation of video advertisements will be composed of the below, which run 30 seconds in length and display
a call to action at the opening and closing of the advertisement. YouTube users will have the option to skip
over our video advertisements after five seconds have passed, which is why it is important to display a call to
action within the first five seconds of each ad. The subject matter of each ad will be targeted to align as
closely as possible with the subject matter of the video it appears before.
o Total Binghamton YouTube Advertising Budget, November 2015 April 2016: $5,000.00
Expected Total ROI: $15,000.00
In order to rank competitively from an organic search standpoint in the Binghamton market as quickly and
efficiently as possible, the firm will employ the services of Justia Legal Marketing to build a family and matrimonial
law blog. Four relevant and SEO-optimized blog posts will be published each month from January 2016 April
2016, with December 2015 reserved for setup and deployment of the blog.
Within six months, rank on page one of Google for the following keywords in the Binghamton market:
o Divorce Lawyer
o Family Law
o Child custody
o Child Support
o Spousal Support
o Adoption
Utilize the Binghamton market as a test bed to determine if Justia Legal Marketing has what it takes to
improve organic rankings in our other, more competitive markets and practice areas and, ultimately, to
completely overhaul our mother ship website.
For this marketing initiative, Justia Legal Marketing will build the blog and write the content, attributed to Peter
Charnetsky, adhering to the below editorial calendar:
December 2015 Setup and deployment of the blog will occur this month.
January 2016 Four blog posts focusing on divorce and child custody issues.
February 2016 Four blog posts focusing on child custody and spousal support issues.
March 2016 Four blog posts focusing on spousal support and adoption issues.

In addition to the above and as a part of this initiative, Justia Legal Marketing will also provide:

Justia.com and Legal Information Institute Lawyer Directories help several million visitors find lawyers each year.
Their online lawyer directories, in conjunction with their website and blog solutions, offer services that assist
attorneys in reaching and retaining clients.
In order to enhance the visibility of Peters current Justia.com profile and because the Justia.com website
consistently ranks well organically for key, strategic divorce terms (i.e. second organic ranking on page one of
Google for search term Binghamton Divorce Lawyer), a gold-level, premium featured placement will continue to
be deployed for Peters profile from November 2015 through November 2016.
The premium featured placement upgrades Peters profile with a contact form to promote client conversions, a
Google Map with location pin, and additional contact information. The gold-level, premium featured placement will
be active for the below terms, geographic area, budget level, and timeframe.
Divorce in Binghamton, NY Metro Area $56.25 per month November 2015 through November 2016
Family Law in Binghamton, NY Metro Area $56.25 per month November 2015 through November 2016

Peter/the Binghamton office, and a sponsorship for this practice area is provided free by Justia.com
with the purchase of the Divorce and Family Law sponsorships.
Avvo.com is an online legal services marketplace. The services lawyer directory provides Avvo-rated profiles,

Print Advertising
To enhance the branding and visibility of Peter and the firm in the Binghamton market, print advertisements will be
deployed in the market leading Binghamton Press and Sun-Bulletin. The aforementioned print advertisements will
brand Peter as the go-to divorce/family and matrimonial attorney in the Binghamton market, focusing on the
expertise of the family court process gleaned from his time as a Broome County Family Court Judge.
Our print strategy will focus on the below three elements, which will cause our advertisements to stand out in the
Binghamton marketplace:
Premium placement (i.e. days and sections with the highest circulation and anticipated frequency) in
Binghamtons market leading publication.
An attention-grabbing headline that causes potential divorce and criminal defense clients to sit up and take
notice.
Body copy that ethically communicates the value of Peters extensive legal experience.
The aforementioned print advertisement will be deployed within each of the below print outlets according the below
specifications, pricing, and timelines:
Outdoor advertising via a prominent billboard is a tried and true way to generate a needed uptick in brand awareness
among both potential new clients and potential attorney hires when entering a new market. As such, the firm will
work with Park Outdoor Advertising, the dominant outdoor advertising provider in Broome County, to design and
deploy a standard size 105 x 228 billboard in the Binghamton market.
The billboard will expose potential new clients in the market to the firms Law For Life branding, statewide
footprint, and interest in welcoming talented and driven attorneys to its expanding Binghamton team. The billboard
will be placed at the below best available locations among the highest trafficked roadways in the Binghamton area.
February 2016 50 Brandywine S/O I-81 Entrance (Daily Effective Circulation of 35.7)

second radio ads will be purchased for a 30 business day period beginning the week following the Binghamton office
ribbon cutting at the market-leading radio station in the Binghamton area according to the below Spring 2015
Nielson report (WBNW-FM NOW 105.7 operated by iHeartMedia) as well as the Binghamton National Public
Radio affiliate (WSKG 89.3 FM). This will further complement the branding that will be progressed by the firms

Given the fact that the firm is a relative newcomer to the Binghamton market, it will be critical to strategically utilize
earned media to position Binghamton Managing Partner Peter Charnetsky as the go-to family and divorce attorney in
the Binghamton area. It will be equally critical to position the firm as an alternative to the good old boys club of
Binghamton law firms that collude to water down competition in the market and keep legal fees high for
