STIPULATED ORDER OF DISMISSAL WITHOUT PREJUDICE

Whereby the Court previously granted Defendant NY Holdings, Inc.s

motion to dismiss based on personal jurisdiction and dismissed all claims against

Defendant NY Holding, Inc. without prejudice, and Plaintiff Dr. Robert Huizenga

intends to re-file his claims against NY Holdings, Inc. in New York.

Whereby Defendant Joelle Gwynn has confirmed that if Plaintiff Huizenga

elects to dismiss the current case in its entirety without prejudice and re-file in

New York, Defendant Gwynn will not contest personal jurisdiction in New York.

The parties therefore stipulate and agree, by and through their respective

counsel, and pursuant to Federal Rule of Civil Procedure 41(a)(1), the Court shall

dismiss this action, without prejudice, the parties to bear their own costs and

attorneys fees.
