COMESNOW,theplaintiff,throughtheundersignedcounseland
untothisHonorableCourt,mostrespectfullyaversthat:

1. Plaintiff,JENNIFERPAGODA,isoflegalage,Filipino,single,with
residenceandpostaladdressat1234MagandaStreet,Manila;

2. Defendant,DAVIDBECKHAMMER,isoflegalage,Filipino,single,
withresidenceandpostaladdressat5678MayamanStreet,Manila,
wheretheymaybeservedwithsummonsandothercourtprocesses;

3. JENNIFERPAGODAistheownerofalandoverwhichanapartment
hadbeenconstructedandlocatedat654MayumiStreet,Manila;

4. Byvirtueofacontractoflease,executedonMay28,2016andherein
attachedasAnnexA,JENNIFERPAGODAleaseduntoDAVID
BECKHAMMERtheaforesaidapartmentforaconsiderationofP15,
000.00amonthasrentaltobepaidwithinthefirstten(10)daysof
eachmonthstartingJune3,2016;

5. DAVIDBECKHAMMERfailedtopaytheagreedrentalforseveral
monthsstartingOctober11,2016uptothepresent;

6. OnDecember3,2016,JENNIFERPAGODAsentaletterofdemand
to vacate the apartment which was received by the defendant as
shownintheregistryreturnreceiptheretoattachedasAnnexB;

7. Despitesaidletterofdemandwhichwasrepeatedbyoraldemands,
DAVIDBECKHAMMERfailedandstillrefusedtopaytheagreed
amountofrentalsandtovacatedtheapartment;

8. By reason of failure of DAVID BECKHAMMER to vacate the


premisesandtopaytheunpaidrentals,theplaintiffwascompelledto
filethiscomplaintengagingtheservicesofcounselintheamountof
P10,000.00.

WHEREFORE,premisesconsidered,itismostrespectfullyprayed
untothisHonorableCourtthat,afterhearing,judgmentberenderedordering
thedefendant:

1. Tovacatethesubjectpremises;
2. TopaytheamountofP15,000.00permonthascompensationfor
thereasonableuseofthesubjectpremisesuntiltheyfinallyvacate
thesaidpremises;
3. Topaytheplaintiffthecostofthesuit.

Otherjustandequitablereliefsareprayedfor.

ANSWER

COMESNOW,thedefendant,DAVIDBECKHAMMER,through
theundersignedcounselanduntothisHonorableCourt,mostrespectfully
aversthat:

1. DAVIDBECKHAMMERadmitsthecontentsofparagraphs2,3,4,
and 6 of the complaint but specifically denies the contents of
paragraphs5and7thereof;

AFFIRMATIVEDEFENSE

2. Hisspecificdenialsareduetothefollowingaffirmativedefenses:

2.1.Therewasacompensationbetweenthedefendantandplaintiff,
which extinguishes defendants obligation over the lease contract
(Annex A), when the defendant executed a contract of lease
(attachedasAnnex1),on10September2016,overthehismango
farm located at 0123 Malinaw, San Mateo Rizal, in favor of the
plaintiff;

2.2. The contract of lease provides for the following terms of


payment:

2.2.a.JenniferPagoda,shallhereinpaythesumofP15,000.00
amonthlyrentaltobepaidwithinthefirstten(10)daysofeach
monthstartingOctober10,2016untilOctober10,2017;

2.2.b.JenniferPagodashallbeentitledtothefruitsoftheland
byvirtueofherrentalfees.
2.3.OnOctober10,2016,whentherentalfeesweredueandwhen
JenniferPagodaharvestedthefruitsfromtheland,Jenniferdidnot
payanyrentalfees;
2.4.Nonetheless,theplaintiffsentaletter(AttachedasAnnex2)
requestingtooffsetherobligation,upondefendantsland,byvirtue
ofdefendantsobligationtopaytherentoverplaintiffsapartment;

2.5. The defendant accepted the plaintiffs request through a letter


(Attached as Annex 3), which was received by the plaintiff as
shownintheregistryreturnreceiptheretoattachedasAnnex4;

2.6. By virtue of the compensation between the plaintiff and


defendants,whoaremutuallycreditorsanddebtorsintheirownright
asrespectiveprincipals,thedefendantdidnotpaytherentalsoverthe
plaintiffsapartment,astheobligationofthedefendanthasalready
beenextinguished.

2.7.Withthesaidobligationbeingextinguished,thedefendantthen
hasarighttothepossessionofthesubjectapartmentuntilOctober10,
2017,oruntiltheplaintiffanddefendantsceasetobecomemutual
creditorsanddebtorsofeachother.

2.8.Therefore,hereincaseshouldbedismissedsincethedefendantis
stillinlawfulpossessionofthepropertywhichnegatestheactionfor
unlawfuldetainer.

COUNTERCLAIM

3. Defendant reiterates,repleadsandincorporatesbyreferenceallthe
foregoinginsofarastheyarematerialandadditionallysubmitthathe
is entitled to relief arising from the filing of this malicious and
baselesssuit,asfollows:

3.1. Moral Damages amounting to Fifty Thousand Pesos (P50,


000.00),becausehisnameandreputation,whoiswellknown
teacherinMayamanSchool,Manila,werebesmirchedbythis
maliciousandbaselesssuit.
3.2. AttorneysFeesamountingtoTenThousandPesos(P10,000.
00),becausehewascompelledtosecureservicesofcounselto
vindicatehislegalrights.

WHEREFORE, Defendant respectfully prays that judgment be


renderedinhisfavorbydismissingtheComplaintandgrantingdefendants
counterclaim by awarding defendant: (a) Fifty Thousand Pesos (P50,
000.00)asMoralDamages,and(b)TenThousandPesos(P10,000.00)as
AttorneysFees.

COMES NOW, Defendant, through the undersigned counsel unto


thisHonorableCourtmostrespectfullysubmitshispositionpaper:

BRIEFSTATEMENTOFTHECASE

ThisacivilcaseforUNLAWFULDETAINERfiledbythePlaintiff
againsttheDefendantforoccupying anapartmentlocatedat654Mayumi
Street,Manila.AllegedlyownedbythePlaintiffbyvirtueofaLeaseof
Contract.

FACTSOFTHECASE

DefendantisalesseeofJENNIFERPAGODA,theknownownerof
an apartment located at 654 Mayumi Street, Manila, by virtue of the
ContractofLeaseexecutedbythepartiesonMay28,2016.

Thecontractofleaseprovidesthat,plaintiff,JENNIFERPAGODA,
leasedtheaforesaidapartmenttothedefendant,DAVIDBECKHAMMER,
foraconsiderationofP15,000.00amonthasrentaltobepaidwithinthe
firstten(10)daysofeachmonthstartingJune3,2016.

OnSeptember10,2016, thedefendantexecutedacontractoflease
overdefendantsmangofarmlocatedat0123Malinaw,SanMateoRizal,in
favoroftheplaintiff,whereintheplaintiffshallpaythedefendantthesumof
P15,000.00asmonthlyrentaltobepaidwithinthefirstten(10)daysof
eachmonthstartingOctober10,2016untilOctober10,2017.Theplaintiff
shallalsobeentitledtothefruitsofthelandbyvirtueofherrentalfees.

On October 10, 2016, when the rental fees were due and when
JenniferPagodaharvestedthefruitsfromtheland,Jenniferdidnotpayany
rentalfees.Nonetheless,theplaintiffsentaletterrequestingtooffsether
obligation,upondefendantsland,byvirtueofdefendantsobligationtopay
therentoverplaintiffsapartment.

Thedefendantacceptedtheplaintiffsrequestthroughaletter,which
wasreceivedbytheplaintiffasshownintheregistryreturnreceipt.

Hence,OnOctober10,2016onwards,thedefendantdidnotpaythe
contractoflease(AnnexA)overtheapartmentoftheplaintiffbyvirtueof
theextinguishmentofitsobligationthroughcompensation.

ISSUES

Whetherornottheplaintiffhastherighttocompelthedefendanthis
rentaldues.

DISCUSSIONANDARGUMENTS

Theplaintiffhasnosufficientcauseofactionagainstthedefendant
becauseunderSection1,Rule70oftheRulesofCourt,anunlawfuldetainer
case can only be maintained against a person or persons unlawfully
withholfingordeprivingthepossessionofaland.

Inthiscase,therewasalawfulpossessionofthedefendantoverthe
property of the plaintiff by virture of the compensation between the
defendantandplaintiff,whichextinguishesdefendantsobligationoverthe
contract of lease of the plaintiffs apartment (Annex A), when the
defendant executed a contract of lease (attached as Annex 1), on 10
September2016,overthehismangofarmlocatedat0123Malinaw,San
MateoRizal,infavoroftheplaintiff.

Compensationistheoffsettingoftwoobligationsthatarereciprocally
extinguishediftheyareofsamevalue,orextinguishedtotheconcurrent
amountifofdifferentvalues.1 UnderArticle1279oftheNewCivilCode,
compensationexistwheneachobligorisboundprincipally,andatthesame
timeaprincipalcreditoroftheother;Bothdebtsmustconsistinasumof
money,orifthethingsdueareFUNGIBLE,ofthesamekind&quality;
Bothdebtsaredue;Debtsareliquidatedanddemandable;Theremustbeno
retention or controversy over either of the debts, commenced by third
personsandcommunicatedinduetimetothedebtor;andCompensationis
notprohibitedbylaw.

TowarranttheapplicationofsetoffunderArticle1278oftheCivilCode,
thedebtorsadmissionofhisobligationmustbeclearandcategoricaland
notonewhichmerelyarisebyinferenceorimplicationfromthecustomary
execution of official documents in assuming the responsibilities of a
predecessor.2

Thehereincasehasmettherequisitesforcompensationasfollows

(2) Bothdebtsconsistinasumofmoney;
(3) Bothdebtsaredue(October10,2016);

(5) There was no retention or controversy over either of the debts,
commencedbythirdpersonsandcommunicatedinduetimetothe
debtor;and
(6) Compensationisnotprohibitedbylaw

Hence, thedefendantsobligationtopayrentalstotheplaintiffwas
alreadyextinguishedandheremainshisrighttothepossessionofthesubject
apartmentuntilOctober10,2017,oruntiltheplaintiffanddefendantscease
tobecomemutualcreditorsanddebtorsofeachother.

PRAYER

WHEREFORE, Defendant respectfully prays that judgment be


renderedinhisfavorbydismissingtheComplaintandgrantingdefendants
counterclaim by awarding defendant: (a) Fifty Thousand Pesos (P50,

E1), defendant failed and refused to pay said obligation,

5. ThedefendantisabouttodepartfromthePhilippineswithintentto
defraudhiscreditors;

6. Thereisnosufficientsecurityfortheclaimsoughttoberecovered
fromdefendant,andtheamountduetotheplaintiffisasmuchasthe
sumforwhichtheorderofattachmentmaybegrantedabovealllegal
counterclaims;

7. Plaintiffiswillingtoputupabondfortheissuanceofapreliminary
attachmentintheamounttobefixedbythecourt,notexceedingthe

TheundersignedCityProsecutor,uponsworncomplaintfiledbythe
offendedparty,accuses JENNIFERPAGODA ofthecrimeofadultery,

ThatinoraboutandduringthemonthsofNovemberandDecember
2016 and for some time prior thereto in Maganda Street, Manila City,
Philippines, within the jurisdiction of the court, the said JENNIFER
PAGODA, wilfully and feloniously had sexual intercourse with her co
accused EPHRAEL DATA, who is not her husband, while the latter,
