I. PRESIDENTIALDECREENo.532ortheANTIPIRACYANDANTIHIGHWAYROBBERY
LAWOF1974

Section3.Penalties.Anypersonwhocommitspiracyorhighwayrobbery/brigandageashereindefined,
shall,uponconvictionbycompetentscourtbepunishedby:
a.Piracy.Thepenaltyofreclusiontemporalinitsmediumandmaximumperiodsshallbeimposed.If
physicalinjuriesorothercrimesarecommittedasaresultorontheoccasionthereof,thepenaltyof
reclusionperpetuashallbeimposed.Ifrape,murderorhomicideiscommittedasaresultoronthe
occasionofpiracy,orwhentheoffendersabandonedthevictimswithoutmeansofsavingthemselves,or
whentheseizureisaccomplishedbyfiringuponorboardingavessel,themandatorypenaltyofdeath
shallbeimposed.
b. Highway Robbery/Brigandage. The penalty of reclusion temporal in its minimum period shall be
imposed.Ifphysicalinjuriesorothercrimesarecommittedduringorontheoccasionofthecommission
ofrobberyorbrigandage,thepenaltyofreclusiontemporalinitsmediumandmaximumperiodsshallbe
imposed.Ifkidnappingforransomorextortion,ormurderorhomicide,orrapeiscommittedasaresultor
ontheoccasionthereof,thepenaltyofdeathshallbeimposed.

Section 4. Aiding pirates or highway robbers/brigands or abetting piracy or highway


robbery/brigandage.Anypersonwhoknowinglyandinanymanneraidsorprotectspiratesorhighway
robbers/brigands,suchasgivingtheminformationaboutthemovementofpoliceorotherpeaceofficers
ofthegovernment,oracquiresorreceivespropertytakenbysuchpiratesorbrigandsorinanymanner
derivesanybenefittherefrom;oranypersonwhodirectlyorindirectlyabetsthecommissionofpiracyor
highwayrobberyorbrigandage,shallbeconsideredasanaccompliceoftheprincipaloffendersandbe
punishedinaccordancewiththeRulesprescribedbytheRevisedPenalCode.
ItshallbepresumedthatanypersonwhodoesanyoftheactsprovidedinthisSectionhasperformed
knowingly,unlessthecontraryisproven.

II. REPUBLICACTNo.6235orANACTPROHIBITINGCERTAINACTSINIMICALTOCIVIL
AVIATION,ANDFOROTHERPURPOSES.

Section1. Itshallbeunlawfulforanypersontocompelachangeinthecourseordestinationofan
aircraftofPhilippineregistry,ortoseizeorusurpthecontrolthereof,whileitisinflight.Anaircraftisin
flightfromthemomentallitsexternaldoorsareclosedfollowingembarkationuntilanyofsuchdoorsis
openedfordisembarkation.
ItshalllikewisebeunlawfulforanypersontocompelanaircraftofforeignregistrytolandinPhilippine
territoryortoseizeorusurpthecontrolthereofwhileitiswithinthesaidterritory.

Section 2. Any person violating any provision of the foregoing section shall be punished by an
imprisonmentofnotlessthantwelveyearsbutnotmorethantwentyyears,orbyafineofnotlessthan
twentythousandpesosbutnotmorethanfortythousandpesos.
Thepenaltyofimprisonmentoffifteenyearstodeath,orafineofnotlessthantwentyfivethousand
pesosbutnotmorethanfiftythousandpesosshallbeimposeduponanypersoncommittingsuchviolation
underanyofthefollowingcircumstances:
1.Wheneverhehasfireduponthepilot,memberofthecreworpassengeroftheaircraft;
2.Wheneverhehasexplodedorattemptedtoexplodeanybomborexplosivetodestroytheaircraft;or
3.Wheneverthecrimeisaccompaniedbymurder,homicide,seriousphysicalinjuriesorrape.

Section3.Itshallbeunlawfulforanyperson,naturalorjuridical,toship,loadorcarryinanypassenger
aircraft operating as a public utility within the Philippines, and explosive, flammable, corrosive or
poisonoussubstanceormaterial.

Section6.AnyviolationofSectionthreehereofshallbepunishablebyanimprisonmentofatleastfive
yearsbutnotmorethantenyearsorbyafineofnotlessthantenthousandpesosbutnotmorethantwenty
thousandpesos:Provided,Thatiftheviolationiscommittedbyajuridicalperson,thepenaltyshallbe
imposeduponthemanager,representative,director,agentoremployeewhoviolated,orcaused,directed,
cooperated or participated in the violation thereof: Provided, further, That in case the violation is
committedintheinterestofaforeigncorporationlegallydoingbusinessinthePhilippines,thepenalty
shallbeimposeduponitsresidentagent,manager,representativeordirectorresponsibleforsuchviolation
andinadditionthereto,thelicenseofsaidcorporationtodobusinessinthePhilippinesshallberevoked.
AnyviolationofSectionfourhereofshallbeanoffensepunishablewiththeminimumofthepenalty
providedinthenextprecedingparagraph.

Section7.ForanydeathorinjurytopersonsordamagetopropertyresultingfromaviolationofSections
threeandfourhereof,thepersonresponsiblethereformaybeheldliableinaccordancewiththeapplicable
provisionsoftheRevisedPenalCode.

III. RepublicActNo.9372orANACTTOSECURETHESTATEANDPROTECTOURPEOPLE
FROMTERRORISM

SEC.3.Terrorism.Anypersonwhocommitsanactpunishableunderanyofthefollowingprovisionsof
theRevisedPenalCode:
a.Article122(PiracyinGeneralandMutinyintheHighSeasorinthePhilippineWaters);
b.Article134(RebellionorInsurrection);
c.Article134a(Coupd'Etat),includingactscommittedbyprivatepersons;
d.Article248(Murder);
e.Article267(KidnappingandSeriousIllegalDetention);
f.Article324(CrimesInvolvingDestruction),orunder
1.PresidentialDecreeNo.1613(TheLawonArson);
2.RepublicActNo.6969(ToxicSubstancesandHazardousandNuclearWasteControlActof1990);
3.RepublicActNo.5207,(AtomicEnergyRegulatoryandLiabilityActof1968);
4.RepublicActNo.6235(AntiHijackingLaw);
5.PresidentialDecreeNo.532(AntiPiracyandAntiHighwayRobberyLawof1974);and,
6. Presidential Decree No. 1866, as amended (Decree Codifying the Laws on Illegal and Unlawful
Possession, Manufacture, Dealing in, Acquisition or Disposition of Firearms, Ammunitions or
Explosives)
thereby sowing and creating a condition of widespread and extraordinary fear and panic among the
populace,inordertocoercethegovernmenttogiveintoanunlawfuldemandshallbeguiltyofthecrime
ofterrorismandshallsufferthepenaltyofforty(40)yearsofimprisonment,withoutthebenefitofparole
asprovidedforunderActNo.4103,otherwiseknownastheIndeterminateSentenceLaw,asamended.

SEC.7.SurveillanceofSuspectsandInterceptionandRecordingofCommunications.Theprovisions
ofRepublicActNo.4200(AntiWireTappingLaw)tothecontrarynotwithstanding,apoliceorlaw
enforcementofficialandthemembersofhisteammay,uponawrittenorderoftheCourtofAppeals,
listen to, intercept and record, with the use of any mode, form, kind or type of electronic or other
surveillanceequipmentorinterceptingandtrackingdevices,orwiththeuseofanyothersuitableways
andmeansforthatpurpose,anycommunication,message,conversation,discussion,orspokenorwritten
wordsbetweenmembersofajudiciallydeclaredandoutlawedterroristorganization,association,orgroup
ofpersonsorofanypersonchargedwithorsuspectedofthecrimeofterrorismorconspiracytocommit
terrorism.
Provided,Thatsurveillance,interceptionandrecordingofcommunicationsbetweenlawyersandclients,
doctorsandpatients,journalistsandtheirsourcesandconfidentialbusinesscorrespondenceshallnotbe
authorized.

SEC. 17. Proscription of Terrorist Organizations, Association, or Group of Persons. Any


organization,association,orgroupofpersonsorganizedforthepurposeofengaginginterrorism,or
which,althoughnotorganizedforthatpurpose,actuallyusestheactstoterrorizementionedinthisActor
tosowandcreateaconditionofwidespreadandextraordinaryfearandpanicamongthepopulaceinorder
tocoercethegovernmenttogiveintoanunlawfuldemandshall,uponapplicationoftheDepartmentof
JusticebeforeacompetentRegionalTrialCourt,withduenoticeandopportunitytobeheardgiventothe
organization, association, or group of persons concerned, be declared as a terrorist and outlawed
organization,association,orgroupofpersonsbythesaidRegionalTrialCourt.

SEC.18.PeriodofDetentionWithoutJudicialWarrantofArrest.TheprovisionsofArticle125ofthe
RevisedPenalCodetothecontrarynotwithstanding,anypoliceorlaw enforcementpersonnel,who,
havingbeendulyauthorizedinwritingbytheAntiTerrorismCouncilhastakencustodyofaperson
chargedwithorsuspectedofthecrimeofterrorismorthecrimeofconspiracytocommitterrorismshall,
withoutincurringanycriminalliabilityfordelayinthedeliveryofdetainedpersonstotheproperjudicial
authorities,deliversaidchargedorsuspectedpersontotheproperjudicialauthoritywithinaperiodof
threedayscountedfromthemomentthesaidchargedorsuspectedpersonhasbeenapprehendedor
arrested,detained,andtakenintocustodybythesaidpolice,orlawenforcementpersonnel:Provided,
Thatthearrestofthosesuspectedofthecrimeofterrorismorconspiracytocommitterrorismmustresult
fromthesurveillanceunderSection7andexaminationofbankdepositsunderSection27ofthisAct.
Thepoliceorlawenforcementpersonnelconcernedshall,beforedetainingthepersonsuspectedofthe
crimeofterrorism,presenthimorherbeforeanyjudgeatthelatter'sresidenceorofficenearesttheplace
wherethearresttookplaceatanytimeofthedayornight.Itshallbethedutyofthejudge,amongother
things,toascertaintheidentityofthepoliceorlawenforcementpersonnelandthepersonorpersonsthey
havearrestedandpresentedbeforehimorher,toinquireofthemthereasonswhytheyhavearrestedthe
person and determine by questioning and personal observation whether or not the suspect has been
subjectedtoanyphysical,moralorpsychologicaltorturebywhomandwhy.Thejudgeshallthensubmit
awrittenreportofwhathe/shehadobservedwhenthesubjectwasbroughtbeforehimtothepropercourt
thathasjurisdictionoverthecaseofthepersonthusarrested.Thejudgeshallforthwithsubmithis/her
reportwithinthreecalendardaysfromthetimethesuspectwasbroughttohis/herresidenceoroffice.
Immediatelyaftertakingcustodyofapersonchargedwithorsuspectedofthecrimeofterrorismor
conspiracytocommitterrorism,thepoliceorlawenforcementpersonnelshallnotifyinwritingthejudge
ofthecourtnearesttheplaceofapprehensionorarrest:Provided,Thatwherethearrestismadeduring
Saturdays,Sundays,holidaysorafterofficehours,thewrittennoticeshallbeservedattheresidenceof
thejudgenearesttheplacewheretheaccusedwasarrested.
Thepenaltyoften(10)yearsandonedaytotwelve(12)yearsofimprisonmentshallbeimposeduponthe
policeorlawenforcementpersonnelwhofailstonotifyandjudgeasProvidedintheprecedingparagraph.

SEC.19.PeriodofDetentionintheEventofanActualorImminentTerroristAttack.Intheeventof
anactualorimminentterroristattack,suspectsmaynotbedetainedformorethanthreedayswithoutthe
writtenapprovalofamunicipal,city,provincialorregionalofficialofaHumanRightsCommissionor
judgeofthemunicipal,regionaltrialcourt,theSandiganbayanorajusticeoftheCourtofAppealsnearest
theplaceofthearrest.IfthearrestismadeduringSaturdays,Sundays,holidaysorafterofficehours,the
arrestingpoliceorlawenforcementpersonnelshallbringthepersonthusarrestedtotheresidenceofany
oftheofficialsmentionedabovethatisnearesttheplacewheretheaccusedwasarrested.Theapprovalin
writingofanyofthesaidofficialsshallbesecuredbythepoliceorlawenforcementpersonnelconcerned
withinfivedaysafterthedateofthedetentionofthepersonsconcerned:Provided,however,Thatwithin
three days after the detention the suspects, whose connection with the terror attack or threat is not
established,shallbereleasedimmediately.

SEC.27. JudicialAuthorizationRequiredtoExamineBankDeposits,Accounts,andRecords. The


provisionsofRepublicActNo.1405asamended,tothecontrarynotwithstanding,thejusticesofthe
CourtofAppealsdesignatedasaspecialcourttohandleantiterrorismcasesaftersatisfyingthemselvesof
theexistenceofprobablecauseinahearingcalledforthatpurposethat:(1)apersonchargedwithor
suspectedofthecrimeofterrorismor,conspiracytocommitterrorism,(2)ofajudiciallydeclaredand
outlawedterroristorganization,association,orgroupofpersons;and(3)ofamemberofsuchjudicially
declaredandoutlawedorganization,association,orgroupofpersons,mayauthorizeinwritinganypolice
orlaw enforcementofficerandthemembersofhis/herteamdulyauthorizedinwritingbytheanti
terrorismcouncilto:(a)examine,orcausetheexaminationof,thedeposits,placements,trustaccounts,
assetsandrecordsinabankorfinancialinstitution;and(b)gatherorcausethegatheringofanyrelevant
informationaboutsuchdeposits,placements,trustaccounts,assets,andrecordsfromabankorfinancial
institution.Thebankorfinancialinstitutionconcerned,shallnotrefusetoallowsuchexaminationorto
providethedesiredinformation,whenso,orderedbyandservedwiththewrittenorderoftheCourtof
Appeals

SEC.49.ProsecutionUnderThisActShallbeaBartoAnotherProsecutionundertheRevisedPenal
CodeoranySpecialPenalLaws. WhenapersonhasbeenprosecutedunderaprovisionofthisAct,
uponavalidcomplaintorinformationorotherformalchargesufficientinformandsubstancetosustaina
convictionandaftertheaccusedhadpleadedtothecharge,theacquittaloftheaccusedorthedismissalof
thecaseshallbeabartoanotherprosecutionforanyoffenseorfelonywhichisnecessarilyincludedin
theoffensechargedunderthisAct.

IV. PresidentialDecreeNo.1866orCODIFYINGTHELAWSONILLEGAL/UNLAWFUL
POSSESSION,MANUFACTURE,DEALINGIN,ACQUISITIONORDISPOSITION,OFFIREARMS,
AMMUNITIONOREXPLOSIVESORINSTRUMENTSUSEDINTHEMANUFACTUREOF
FIREARMS,AMMUNITIONOREXPLOSIVES,ANDIMPOSINGSTIFFERPENALTIESFOR
CERTAINVIOLATIONSTHEREOFANDFORRELEVANTPURPOSES"
Section4.PresumptionofUnlawfulManufacture.Thepossessionofanymachinery,toolorinstrument
directlyusedinthemanufactureofexplosives,byanypersonwhosebusinessoremploymentdoesnot
lawfully deal with the manufacture of explosives shall be prima facie evidence that such article is
intendedtobeusedintheunlawful/illegalmanufactureofexplosives.

IV. RepublicActNo.8294orANACTAMENDINGTHEPROVISIONSOFPRESIDENTIAL
DECREENO.1866,ASAMENDED,ENTITLED"CODIFYINGTHELAWSON
ILLEGAL/UNLAWFULPOSSESSION,MANUFACTURE,DEALINGIN,ACQUISITIONOR
DISPOSITIONOFFIREARMS,AMMUNITIONOREXPLOSIVESORINSTRUMENTSUSEDIN
THEMANUFACTUREOFFIREARMS,AMMUNITIONOREXPLOSIVES,ANDIMPOSING
STIFFERPENALTIESFORCERTAINVIOLATIONSTHEREOF,ANDFORRELEVANT
PURPOSES."

Section 1. Sec.1PresidentialDecreeNo.9866,asamended,isherebyfurtheramendedtoreadas
follows:
"Sec.1.Unlawfulmanufacture,sale,acquisition,dispositionorpossessionoffirearmsorammunitionor
instrumentsusedorintendedtobeusedinthemanufactureoffirearmsorammunition.Thepenaltyof
prisioncorreccionalinitsmaximumperiodandafineofnotlessthanFifteenthousandpesos(P15,000)
shallbeimposeduponanypersonwhoshallunlawfullymanufacture,dealin,acquire,dispose,orpossess
anylowpoweredfirearm,suchasrimfirehandgun,.380or.32andotherfirearmofsimilarfirepower,part
offirearm,ammunition,ormachinery,toolorinstrumentusedorintendedtobeusedinthemanufacture
ofanyfirearmorammunition:Provided,Thatnoothercrimewascommitted.
"ThepenaltyofprisionmayorinitsminimumperiodandafineofThirtythousandpesos(P30,000)shall
beimposedifthefirearmisclassifiedashighpoweredfirearmwhichincludesthosewithboresbiggerin
diameterthan.38caliberand9millimetersuchascaliber.40,.41,.44,.45andalsolessercalibered
firearms butconsideredpowerfulsuchas caliber .357andcaliber.22centerfiremagnum andother
firearmswithfiringcapabilityoffullautomaticandbyburstoftwoorthree:Provided,however,Thatno
othercrimewascommittedbythepersonarrested.
"Ifhomicideormurderiscommittedwiththeuseofanunlicensedfirearm,suchuseofanunlicensed
firearmshallbeconsideredasanaggravatingcircumstance.
"IftheviolationofthisSec.isinfurtheranceoforincidentto,orinconnectionwiththecrimeofrebellion
orinsurrection,sedition,orattemptedcoupd'etat,suchviolationshallbeabsorbedasanelementofthe
crimeofrebellion,orinsurrection,sedition,orattemptedcoupd'etat.
"Thesamepenaltyshallbeimposedupontheowner,president,manager,directororotherresponsible
officerofanypublicorprivatefirm,company,corporationorentity,whoshallwillfullyorknowingly
allowanyofthefirearmsownedbysuchfirm,company,corporationorentitytobeusedbyanypersonor
personsfoundguiltyofviolatingtheprovisionsoftheprecedingparagraphsorwillfullyorknowingly
allowanyofthemtouseunlicensedfirearmsorfirearmswithoutanylegalauthoritytobecarriedoutside
oftheirresidenceinthecourseoftheiremployment.
"Thepenaltyofarrestomayorshallbeimposeduponanypersonwhoshallcarryanylicensedfirearm
outsidehisresidencewithoutlegalauthoritytherefor."

Section2. Sec.3ofPresidentialDecreeNo.1866,asamended,isherebyfurtheramendedtoreadas
follows:
"Sec.3.Unlawfulmanufacture,sale,acquisition,dispositionorpossessionofexplosives.Thepenaltyof
prisionmayorinitsmaximumperiodtoreclusiontemporalandafineofnotlessthanFiftythousand
pesos(P50,000)shallbeimposeduponanypersonwhoshallunlawfullymanufacture,assemble,dealin,
acquire,disposeorpossesshandgrenade(s),riflegrenade(s),andotherexplosives,includingbutnot
limited to 'pillbox,' 'molotov cocktail bombs,' 'fire bombs,' or other incendiary devices capable of
producingdestructiveeffectoncontiguousobjectsorcausinginjuryordeathtoanyperson.
"WhenapersoncommitsanyofthecrimesdefinedintheRevisedPenalCodeorspeciallawswiththeuse
oftheaforementionedexplosives,detonationagentsorincendiarydevices,whichresultsinthedeathof
any person or persons, the use of such explosives, detonation agents or incendiary devices shall be
consideredasanaggravatingcircumstance.
"IftheviolationofthisSec.is infurtheranceof,orincidentto,orinconnectionwiththecrimeof
rebellion,insurrection,seditionorattemptedcoupd'etat,suchviolationshallbeabsorbedasanelementof
thecrimesofrebellion,insurrection,seditionorattemptedcoupd'etat.
"Thesamepenaltyshallbeimposedupontheowner,president,manager,directororotherresponsible
officerofanypublicorprivatefirm,company,corporationorentity,whoshallwillfullyorknowingly
allowanyoftheexplosivesownedbysuchfirm,company,corporationorentity,tobeusedbyanyperson
orpersonsfoundguiltyofviolatingtheprovisionsoftheprecedingparagraphs."

Section3. Sec.5ofPresidentialDecreeNo.1866,asamended,isherebyfurtheramendedtoreadas
follows:
"Sec.5.Tamperingoffirearm'sserialnumber.Thepenaltyofprisioncorreccionalshallbeimposed
uponanypersonwhoshallunlawfullytamper,change,defaceorerasetheserialnumberofanyfirearm."

Section4. Sec.6ofPresidentialDecreeNo.1866,asamended,isherebyfurtheramendedtoreadas
follows:
"Sec.6.Repackingoralteringthecompositionoflawfullymanufacturedexplosives.Thepenaltyof
prisioncorreccionalshallbeimposeduponanypersonwhoshallunlawfullyrepack,alterormodifythe
compositionofanylawfullymanufacturedexplosives."

Section5.CoverageoftheTermUnlicensedFirearm.Thetermunlicensedfirearmshallinclude:
1)firearmswithexpiredlicense;or
2)unauthorizeduseoflicensedfirearminthecommissionofthecrime.

V. REPUBLICACTNO.10591orANACTPROVIDINGFORACOMPREHENSIVELAWON
FIREARMSANDAMMUNITIONANDPROVIDINGPENALTIESFORVIOLATIONSTHEREOF

SEC.2.DeclarationofStatePolicy.ItisthepolicyoftheStatetomaintainpeaceandorderandprotect
thepeopleagainstviolence.TheStatealsorecognizestherightofitsqualifiedcitizenstoselfdefense
through,whenitisthereasonablemeanstorepeltheunlawfulaggressionunderthecircumstances,theuse
offirearms.Towardsthisend,theStateshallprovideforacomprehensivelawregulatingtheownership,
possession,carrying,manufacture,dealinginandimportationoffirearms,ammunition,orpartsthereof,in
ordertoprovidelegalsupporttolawenforcementagenciesintheircampaignagainstcrime,stopthe
proliferation of illegal firearms or weapons and the illegal manufacture of firearms or weapons,
ammunitionandpartsthereof.

SEC.4.StandardsandRequisitesforIssuanceofandObtainingaLicensetoOwnandPossessFirearms.
Inordertoqualifyandacquirealicensetoownandpossessafirearmorfirearmsandammunition,the
applicantmustbeaFilipinocitizen,atleasttwentyone(21)yearsoldandhasgainfulwork,occupationor
businessorhasfiledanIncomeTaxReturn(ITR)fortheprecedingyearasproofofincome,profession,
businessoroccupation.
In addition, the applicant shall submit the following certification issued by appropriate authorities
attestingthefollowing:
(a)Theapplicanthasnotbeenconvictedofanycrimeinvolvingmoralturpitude:
(b) The applicant has passed the psychiatric test administered by a PNPaccredited psychologist or
psychiatrist;
(c) The applicant has passed the drug test conducted by an accredited and authorized drug testing
laboratoryorclinic;
(d)TheapplicanthaspassedagunsafetyseminarwhichisadministeredbythePNPoraregisteredand
authorizedgunclub;
(e)Theapplicanthasfiledinwritingtheapplicationtopossessaregisteredfirearmwhichshallstatethe
personalcircumstancesoftheapplicant;
(f)Theapplicantmustpresentapoliceclearancefromthecityormunicipalitypoliceoffice;and
(g)Theapplicanthasnotbeenconvictedoriscurrentlyanaccusedinapendingcriminalcasebeforeany
courtoflawforacrimethatispunishablewithapenaltyofmorethantwo(2)years.
ForpurposesofthisAct,anacquittalorpermanentdismissalofacriminalcasebeforethecourtsoflaw
shallqualifytheaccusedthereoftoqualifyandacquirealicense.
Theapplicantshallpaythereasonablelicensingfeesasmaybeprovidedintheimplementingrulesand
regulationsofthisAct.
Anapplicantwhointendstopossessafirearmownedbyajuridicalentityshallsubmithis/herdutydetail
ordertotheFEOofthePNP.

SEC.5.OwnershipofFirearmsandAmmunitionbyaJuridicalEntity.Ajuridicalpersonmaintaining
itsownsecurityforcemaybeissuedaregularlicensetoownandpossessfirearmsandammunitionunder
thefollowingconditions:
(a)ItmustbeFilipinoownedanddulyregisteredwiththeSecuritiesandExchangeCommission(SEC);
(b)Itiscurrent,operationalandacontinuingconcern;
(c)IthascompletedandsubmittedallitsreportorialrequirementstotheSEC;and
(d)Ithaspaidallitsincometaxesfortheyear,asdulycertifiedbytheBureauofInternalRevenue.
TheapplicationshallbemadeinthenameofthejuridicalpersonrepresentedbyitsPresidentoranyofits
officersmentionedbelowasdulyauthorizedinaboardresolutiontothateffect:Provided,Thattheofficer
applyingforthejuridicalentity,shallpossessallthequalificationsrequiredofacitizenapplyingfora
licensetopossessfirearms.
Othercorporateofficerseligibletorepresentthejuridicalpersonare:thevicepresident,treasurer,and
boardsecretary.
SecurityagenciesandLGUsshallbeincludedinthiscategoryoflicensedholdersbutshallbesubjectto
additionalrequirementsasmayberequiredbytheChiefofthePNP.

SEC.7.CarryingofFirearmsOutsideofResidenceorPlaceofBusiness.Apermittocarryfirearms
outsideofresidenceshallbeissuedbytheChiefofthePNPorhis/herdulyauthorizedrepresentativeto
anyqualifiedpersonwhoselifeisunderactualthreatorhis/herlifeisinimminentdangerduetothe
natureofhis/herprofession,occupationorbusiness.
Itshallbetheburdenoftheapplicanttoprovethathis/herlifeisunderactualthreatbysubmittingathreat
assessmentcertificatefromthePNP.
ForpurposesofthisAct,thefollowingprofessionalsareconsideredtobeinimminentdangerduetothe
natureoftheirprofession,occupationorbusiness:
(a)MembersofthePhilippineBar;
(b)CertifiedPublicAccountants;
(c)AccreditedMediaPractitioners;
(d)Cashiers,BankTellers;
(e)Priests,Ministers,Rabbi,Imams;
(f)PhysiciansandNurses;
(g)Engineers;and
(h)Businessmen,whobythenatureoftheirbusinessorundertaking,areexposedtohighriskofbeing
targetsofcriminalelements.

SEC.9.LicensesIssuedtoIndividuals.SubjecttotherequirementssetforthinthisActandpaymentof
required fees to be determined by the Chief of the PNP, a qualified individual may be issued the
appropriatelicenseunderthefollowingcategories;
Type1licenseallowsacitizentoownandpossessamaximumoftwo(2)registeredfirearms;
Type2licenseallowsacitizentoownandpossessamaximumoffive(5)registeredfirearms;
Type3licenseallowsacitizentoownandpossessamaximumoften(10)registeredfirearms;
Type4licenseallowsacitizentoownandpossessamaximumoffifteen(15)registeredfirearms;and
Type5licenseallowsacitizen,whoisacertifiedguncollector,toownandpossessmorethanfifteen
(15)registeredfirearms.
ForTypes1to5licenses,avaultoracontainersecuredbylockandkeyorothersecuritymeasuresforthe
safekeepingoffirearmsshallberequired.
ForTypes3to5licenses,thecitizenmustcomplywiththeinspectionandbondrequirements.

SEC.14. ScopeofLicensetoManufactureFirearmsandAmmunition. ThescopeoftheLicenseto


Manufacturefirearmsandammunitionshallalsoincludethefollowing:
(a) The authority to manufacture and assemble firearms, ammunition, spare parts and accessories,
ammunitioncomponents,andreloadingofammunitions,withinsites,areas,andfactoriesstatedtherein.
TheSecretaryoftheDILGshallapprovesuchlicense;
(b)ThelicensetodealinorsellalltheitemscoveredbytheLicensetoManufacture,suchasparts,
firearmsorammunitionandcomponents;
(c)Theauthoritytosubcontractthemanufacturingofpartsandaccessoriesnecessaryforthefirearms
whichthemanufacturerislicensedtomanufacture: Provided, Thatthesubcontractorofmajorpartsor
majorcomponentsisalsolicensedtomanufacturefirearmsandammunition;and
(d)Theauthoritytoimportmachinery,equipment,andfirearmpartsandammunitioncomponentsforthe
manufacturethereof.Firearmpartsandammunitioncomponentstobeimportedshall,however,belimited
tothoseauthorizedtobemanufacturedasreflectedintheapprovedLicensetoManufacture.TheImport
PermitshallbeundertheadministrationofthePNP.
Alicensedmanufacturerofammunitionisalsoentitledtoimportvariousreferencefirearmsneededtotest
theammunitionmanufacturedundertheLicensetoManufacture.Alicensedmanufactureroffirearms,on
theotherhand,isentitledtoimportvariousfirearmsforreference,testandevaluationformanufactureof
similar,typesoffirearmscoveredbytheLicensetoManufacture.
An export permit shall, however, be necessary to export manufactured parts or finished products of
firearms and ammunition. The Export Permit of firearms and ammunition shall be under the
administrationofthePNP.
SEC.19. RenewalofLicensesandRegistration. Alltypesoflicensestopossessafirearmshallbe
renewedeverytwo(2)years.Failuretorenewthelicenseonorbeforethedateofitsexpirationshall
causetherevocationofthelicenseandoftheregistrationofthefirearm/sundersaidlicensee.

SEC.21. AcquisitionorPurchaseandSaleofFirearmsandAmmunition. Firearmsandammunition


mayonlybeacquiredorpurchasedfromauthorizeddealers,importersorlocalmanufacturersandmaybe
transferredorsoldonlyfromalicensedcitizenorlicensedjuridicalentitytoanotherlicensedcitizenor
licensedjuridicalentity:Provided,That,duringelectionperiods,thesaleandregistrationoffirearmsand
ammunitionandtheissuanceofthecorrespondinglicensestocitizensshallbeallowedonthecondition
that the transport or delivery thereof shall strictly comply with the issuances, resolutions, rules and
regulationspromulgatedbytheCommissiononElections.

SEC.28.UnlawfulAcquisition,orPossessionofFirearmsandAmmunition.Theunlawfulacquisition,
possessionoffirearmsandammunitionshallbepenalizedasfollows:
(a)Thepenaltyof prisionmayor initsmediumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessasmallarm;
(b)Thepenaltyofreclusiontemporaltoreclusionperpetuashallbeimposedifthree(3)ormoresmall
armsorClassAlightweaponsareunlawfullyacquiredorpossessedbyanyperson;
(c)Thepenaltyof prisionmayor initsmaximumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessaClassAlightweapon;
(d)Thepenaltyofreclusionperpetuashallbeimposeduponanypersonwhoshall,unlawfullyacquireor
possessaClassBlightweapon;
(e)Thepenaltyofone(1)degreehigherthanthatprovidedinparagraphs(a)to(c)inthissectionshallbe
imposeduponanypersonwhoshallunlawfullypossessanyfirearmunderanyorcombinationofthe
followingconditions:
(1)Loadedwithammunitionorinsertedwithaloadedmagazine;
(2)Fittedormountedwithlaseroranygadgetusedtoguidetheshootertohitthetargetsuchasthermal
weaponsight(TWS)andthelike;
(3)Fittedormountedwithsniperscopes,firearmmufflerorfirearmsilencer;
(4)Accompaniedwithanextrabarrel;and
(5)Convertedtobecapableoffiringfullautomaticbursts.
(f)Thepenaltyof prisionmayor initsminimumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessamajorpartofasmallarm;
(g)Thepenalty ofprisionmayor initsminimumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessammunitionforasmallarmorClassAlightweapon.Iftheviolationofthis
paragraphiscommittedbythesamepersonchargedwiththeunlawfulacquisitionorpossessionofasmall
arm,theformerviolationshallbeabsorbedbythelatter;
(h)Thepenaltyof prisionmayor initsmediumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessamajorpartofaClassAlightweapon;
(i)Thepenaltyof prisionmayor initsmediumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessammunitionforaClassAlightweapon.Iftheviolationofthisparagraphis
committedbythesamepersonchargedwiththeunlawfulacquisitionorpossessionofaClassAlight
weapon,theformerviolationshallbeabsorbedbythelatter;
(j)Thepenaltyof prisionmayor initsmaximumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessamajorpartofaClassBlightweapon;and
(k)Thepenaltyof prisionmayor initsmaximumperiodshallbeimposeduponanypersonwhoshall
unlawfullyacquireorpossessammunitionforaClassBlightweapon.Iftheviolationofthisparagraphis
committedbythesamepersonchargedwiththeunlawfulacquisitionorpossessionofaClassBlight
weapon,theformerviolationshallbeabsorbedbythelatter.

SEC.42.FirearmsRepository.TheFEOofthePNPshallbethesolerepositoryofallfirearmsrecords
to include imported and locally manufactured firearms and ammunition. Within one (1) year upon
approval of this Act, all military and law enforcement agencies, government agencies, LGUs and
governmentowned or controlled corporations shall submit an inventory of all their firearms and
ammunitiontothePNP.

SEC.43.FinalAmnesty.Personsinpossessionofunregisteredfirearmsandholdersofexpiredlicense
orunregisteredfirearmsshallregisterandrenewthesamethroughtheFinalGeneralAmnestywithinsix
(6)monthsfromthepromulgationoftheimplementingrulesandregulationsofthisAct.Duringthe
interimperiodofsix(6)months,nopersonapplyingforlicenseshallbechargedofanydelinquent
paymentaccruingtothefirearmsubjectforregistration.ThePNPshallconductanintensivenationwide
campaigntoensurethatthegeneralpublicisproperlyinformedoftheprovisionsofthisAct.
