REGULATION ORDINANCE NO. 2016-283


AN ORDINANCE REQUIRING ACCOMMODATION BUSINESSES,
RESTAURANTS AND OTHER SIMILAR ESTABLISHMENTS TO
DISPLAY PICTURES OR IMAGES DEPICTING THE RICH CULTURAL
HERITAGE OF ILOILO CITY

WHEREAS, Sec. 14, Art. IVX of the 1987 Philippine Constitution states that "The State
shall foster the preservation, emichment and dynamic devolution of a Filipino national culture
based on the principle of unity in diversity in a climate of free artistic and intellectual expression;

WHEREAS, Sec. 458 (4) (iv) of Local Government Code empowers the Sangguniang
Panlungsod to approve ordinances and resolutions, hence it has the power to "Regulate the
establishment, operation and maintenance of cafes, restaurants, beerhouses, hotels, motels, inns,
pension houses, lodging houses, and other similar establishments, including tourist guides and
transport";

WHEREAS, Iloilo City is known for its colorful history and rich cultural heritage way back
from pre-Spanish era to the present that can be easily seen on the structural designs of various
infrastructures and landmarks around the City, food, clothing and the like;

WHEREAS, for the young generation and the tourists alike, appreciation of Ilonggo culture
and history may be obtained through the medium of photos, pictures, food, culture and other audio-
visual documents;

WHEREAS, by displaying these work/medium of arts oflloilo City, the tourists and youth
can likewise easily understand the significance of the Ilonggo culture to society, thus, imbibing
the true spirit of the Ilonggo;

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of Iloilo City in


session duly assembled that:

Section 1. Short title. This ordinance shall be known as "Cultural Image Preservation
Ordinance."

Section 2. Purpose. To increase awareness of the rich cultural history of Iloilo City to
the minds of our young generation who are now more conscious in giving priority to modem
technology and infrastructure as well as to impart to the minds of the tourists the significance of
our history and culture to the present Iloilo City.

Section 3. Coverage and Application. This ordinance shall apply and cover the
following establishments within the City oflloilo and are required to post, display work of arts not
limited to pictures, paintings, or photos depicting the history and cultural heritage of Iloilo City
and other landmarks or tourist attractions within the City:

a) Hotels, pension houses, tourists inns, apartelles and the like;


b) Restaurants, Coffee shops
c) Resorts
d) Ticketing & travel agencies

Section 4. Minimum Requirement. The covered establishments shall be required to post,


hang or display work of art, but not limited to, at least 2 photos or pictures depicting the rich cultural
heritage of Iloilo City or any tourist attractions and landmarks of Iloilo City. These must be
strategically located and easily visible for the customers inside their establishment, with a minimum
dimension of 2 x 3 ft. These works of art must have a short introduction or description.

Section 5. Monitoring and inspection. A Tourism Inspector from the Iloilo City Tourism
and Development Office and a representative from the Business Permit and Licensing Office
(BPLO) shall be tasked to monitor and inspect covered establishments for purposes of granting their
tourism license and business permits.

Section 6. Penalties. Establishments found violating this ordinance shall be liable as


follows:

a) 1st Offense and 2d Offense written warning


b) 3rd and succeeding offenses non-issuance of tourism
license/business permit upon
renewal

Section 7. Implementing Rules and Regulations. The City Tourism and Development
Office (CTDO) shall formulate the Implementing Rules and Regulations within 90 days after the
effectivity of this ordinance for an effective implementation of the same.

Section 8. Separability Clause. Should any Section or Provision of this Ordinance be


declared by any court to be unconstitutional or invalid, such decision shall not affect the validity
of this Ordinance as a whole or any part thereof other than the part so declared to be
unconstitutional or invalid.

Section 9. Repealing Clause. All ordinances or parts thereof which are in conflict with
the provisions of this Ordinance are hereby repealed, modified or amended accordingly.

Section 10. Effectivity Clause. This Ordinance shall take effect fifteen (15) days after its
publication in a newspaper of general circulation in the City of Iloilo.
