REGULATION ORDINANCE NO. 2011- 786


AN ORDINANCE PROHIBITING THE DRINKING OF LIQUORS AND
OTHER ALCOHOLIC BEVERAGES ALONGSIDE THE STREETS,
ROADS, SIDEWALKS, ALLEYS AND OPEN PU:81.:IC PLACES WITHIN
THE CITY OF ILOILO FROM 11:00 O'CLOCK IN THE EVENING
UNTIL 4:00 O'CLOCK IN THE MORNING

Councilor Plaridel C. Nava II, seconded by Councilors Rodel F.
Agado and Lyndon V. Acap

WHEREAS, Republic Act 7160, otherwise known as the Local Government Code of
1991, empowers the Sangguniang Panlungsod to enact ordinances to promote and maintain
peace and order within its exclusive jurisdiction;

WHEREAS, there is a cogent and justifiable reason to strictly regulate the drinking of
alcoholic beverages along the streets, roads, sidewalks, alleys and open public places within the
City of Iloilo;

WHEREAS, the proposed ordinance is in harmony with the policy of the State to protect
its citizens from acts inimical to their welfare and interest. This proposed ordinance is neither
unfair, oppressive, discriminatory nor unreasonable.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of


Iloilo, that:

Section 1. - TITLE - This ordinance shall be known as "PROHIBITING THE


DRINKING OF LIQUORS AND OTHER ALCOHOLIC BEVERAGES ALONGSIDE
THE PUBLIC STREETS, ROADS, SIDEWALKS, ALLEYS AND OPEN PUBLIC
PLACES WITHIN THE CITY OF ILOILO".

Section 2. - DEFINITION OF TERMS. - For purpose of this ordinance, the following


terms are hereby defined, as follows:

2.1 LIQUOR - any liquid substance distilled or fermented such as wine, whisky, brandy,
vodka, run, gin or any similar drinks with alcohol content of a least 9%

2.2 ALCOHOLIC BEVERAGES - any distilled or undistilled, fermented or brewed


liquid substance with at least 4% alcohol content which include beer, coconut wine or tuba and
the likes.

2.3 ROADS - is an open, wide public way leading from one place to another for the
passage of vehicles and people.

2.4 STREETS - is a public way or thoroughfare usually paved with a sidewalk that is
wider than an alley or lane.

2.5 ALLEYS - a narrow street or passageway between or behind structures, houses or


buildings such as eskinitas.

2.6 SIDEWALKS - a raised paved or asphalted path for pedestrians at the side of the
road.

2.7 OPEN PUBLIC PLACES - an area or point of convergence of people whether


regular or occasional, including but not limited to the following: public markets, parks or plaza,
public playgrounds, public parking lots and public avenues.

Section 3. - PROHIBITED ACTS.

a) It shall be unlawful for any person to drink any kind of liquor or alcoholic beverage
alongside the public streets, roads, sidewalks, alleys and open public places in the
City of Iloilo from 11 :00 o'clock in the evening until 4:00 o'clock in the morning;
b) It shall be unlawful for any person l> loiter, wander or saunter in public places or
within public view while carrying and drinking alcoholic beverage on the aforesaid
time.

Section 4. - EXEMPTIONS.

Drinking of liquor or alcoholic drinks in the herein enumerated prohibited areas during
the highlights of city festivals, events and celebrations, such as but not limited to the following is
hereby exempted: Dinagyang Festival, Paraw Regatta, Charter Day Celebration and Celebration
of the Chinese New Year, however, alcohol consumption beyond the 11:00 o'clock limit during
these events , festivals and celebrations shall be permitted only until such time as may be
specified or determined by the City Mayor.

Section 5. - PENALTIES.

a) Any person found guilty violating this ordinance shall be penalized, as follows:

FIRST OFFENSE - a fine of FIVE HUNDRED PESOS (P500.00) or


imprisonment of not more than thirty (30) days or
both fine and imprisonment upon the discretion of
the court.

SECOND OFFENSE - a fine of ONE THOUSAND PESOS (Pl,000.00) or


imprisonment of not less than sixty (60) days and
not more than six (6) months or both fine and
imprisonment upon the discretion of the court.

THIRD OFFENSE AND


SUCCEEDING OFFENSES - a fine of FIVE THOUSAND PESOS (5,000.00) or
imprisonment of not less than six (6) months and
one (1) day but not more than one (1) year or both
fine and imprisonment upon the discretion of the court.

b) If the offense is committed by a minor, appropriate action shall be made in


accordance with the provisions of Republic Act 9344.

f) Section 6. - SEPARABILITY CLAUSE. - If any provisions of this ordinance shall be

Section 7. -EFFECTIVITY CLAUSE. -This ordinance upon approval shall take effect
immediately after ten (10) days from publication in a local newspaper of general circulation.
