YOURPROMISETOPAY:YoupromisetopayustheAmountFinancedandfinancechargesaccordingtothepayment
scheduleintheTruthinLendingDisclosuresplusallotheramountsowedtousunderthisLoanAgreement.Youwillpay
usasyouchoseinyourPaymentChoiceAuthorization.Allpaymentswillbeappliedfirsttofinancechargesandfeesand
thentoprincipal.

DISBURSEMENT:IfyourLoanisapproved,wewillprocessdisbursementofyourloanproceedswithin1businessdaysof
thedayyourloanisapproved.AbusinessdayisaregularworkdayanddoesnotincludeSaturday,Sundayorholidays.
Youauthorizeustousecommerciallyreasonableeffortstoinitiateacreditentrybydepositingtheproceedsofyourloan
intoYourBankAccountdescribedinyourDisbursementandPaymentChoiceAuthorization.Thedatethatyourloan
proceedsaredepositedtoYourBankAccountisthe"DisbursementDate".Unavoidabledelaysasaresultofbank
holidays,theprocessingscheduleofyourindividualbank,inadvertentprocessingerrors,"actsofgod",or"actsof
terror"mayextendthetimeforthedeposit.

WHENYOUBEGINPAYINGFINANCECHARGE(S):Youbegintoaccruefinancecharge(s)fortheloanonthe
DisbursementDate.ThefirstInstallmentPeriodontheloanbeginsontheDisbursementDateandendsonthefirst

PAYMENTS:YouarerequiredtomakethepaymentsforeachInstallmentPeriodonorbeforethepaymentduedatesin
Yourpaymentschedule(PaymentDueDates).IfYouwouldliketorepayYourloanaccordingtoapaymentplanother
thanassetforthherein,Youmustcontactacustomerservicerepresentativenolaterthanthree(3)dayspriortoYour
nextscheduledPaymentDueDatetomakethosepaymentschedulemodificationsifyouwouldlikethemineffectforthe
nextPaymentDueDate.YouwillmakeYourpaymentsonorbeforeeveryPaymentDueDateuntilYouhavepaidthe
entireprincipalandaccruedfinancecharge(s)andanyotherchargesasdescribedinthisAgreement.Ifonthefinal
scheduledPaymentDueDate(MaturityDate),YoustilloweamountsunderthisAgreement,Youwillpaythoseamounts

RefusedInstrumentChargefeesduetoUs,ifapplicable,willbedebitedelectronicallyfromYourBankAccountoneach
PaymentDueDateassetforthinyourpaymentschedulebelow.Youmayrevokeyourpaymentsbycontactingcustomer
serviceat(888)667-8499oremailingusatcustomersupport@northernplainsfunding.comPleasenote,ifyourscheduled
paymenthasalreadybeensubmittedtoyourfinancialinstitutionatthetimeofrevocation,itmaybenecessaryforUsto
waituntilthatpaymentpostsbeforewecanrefundyouthatpaymentamount.However,whenpossible,atthetimeof
revocation,wewillvoidanypendingpayment(s).

PAYMENTBYCHECK:IfYouelecttopaybycheck,thenyouagreetorepayallamountsduepursuanttothisAgreement
viacheck.AllmailedpaymentsmustreachUsby4:00pmMSTonorbeforethePaymentDueDate.IfYouprovidea
checkasapayment,YouauthorizeUseithertouseinformationfromYourchecktomakeaone-timeelectronicfund
transferfromYouraccountortoprocessthepaymentasachecktransaction.WhenWeuseinformationfromYourcheck
tomakeanelectronicfundstransfer,fundsmaybewithdrawnfromyouraccountassoonasthesamedaythatWe
receiveYourpayment,andYouwillnotreceiveYourcheckbackfromYourfinancialinstitution.

PREPAYMENT:YoumayprepayallorpartoftheamountYouoweUsatanytimebeforetheMaturityDatewithout
penalty.IfYouprepayinfull,Youmustpaythefinancecharge(s)accruedonYourLoanandallotheramountsdueupto
thedateofYournextscheduledpayment.IfyouwishtoprepayYourloan,thenYoumustcontactacustomerservice
representativeat(888)667-8499toobtainanaccuratepayoffamountandeitherprovideUswithauthorizationtoeffecta
debitentrytoYourbankaccountfortheprepayment,orotherwiseadviseUsofyourintendedmethodofprepayment.If
YouprepayallorpartoftheprincipalamountdueonYourloan,Yourfinancechargesontheamountprepaidwillbe
calculatedasofthedateofYournextscheduledpayment.

CANCELLATION:YoumaycancelyourpaymentobligationsunderthisLoanAgreement,withoutcostorfinancecharges,
nolaterthan4:00p.m.CentraltimeofthenextbusinessdayimmediatelyfollowingtheDisbursementDate
("CancellationDeadline").Yourrighttocancelyourloanonlyappliesifyourloaneitherhasn'tfundedor,ifithas,
thefundsarereturnedtousasexplainedbelow.Tocancelyourpaymentobligationsonthisloan,youmustinformusin
writing,byorbeforetheCancellationDeadline,eitherbyemailtocustomersupport@northernplainsfunding.comorbyfax
at4062357015,thatyouwanttocancelthefuturepaymentobligationsonthisloan.Ifwetimelyreceiveyourwritten
noticeofcancellationonorbeforetheCancellationDeadlinebutbeforetheloanproceedshavebeendepositedintoYour
BankAccount,thenwewillnotdebitYourBankAccountandbothyourandourobligationsunderthisLoanAgreement
willberescinded.However,ifwetimelyreceiveyourwrittennoticeofcancellationonorbeforetheCancellationDeadline
butaftertheloanproceedshavebeendepositedintoYourBankAccount,thenyouauthorizeustoeffectadebittoYour
BankAccountoryourdebitcardasyouchoseinyourPaymentChoiceAuthorizationfortheprincipalamountofthisLoan
Agreement.Ifwereceivepaymentoftheprincipalamountviathedebit,thenbothyourandourobligationsunderthis
LoanAgreementwillberescinded.IfwedonotreceivepaymentoftheprincipalamountbydebittoYourBankAccountor
yourdebitcard,thenthisLoanAgreementwillremaininfullforceandeffect.

DEFAULT:YouwillbeindefaultunderthisLoanAgreementifyoudonotpayusascheduledpaymentoranyother
amountsyouoweuswhendueoryourchosenpaymentmethodisstopped,deniedorotherwisedishonored.Ifyou
defaultonyourloan,wecanchoosetodeclareallprincipal,earnedfinancechargesandotheramountsthatyouoweus
tobeimmediatelydueandpayableinfull.IfyouareindefaultandyouauthorizeddebitsfromeitherYourBankAccount
oryourdebitcardinyourPaymentChoiceAuthorization,youagreethatwecandebitYourBankAccountordebitcard,as
applicable,forthefullamountthatyouoweus.Additionally,ifyoudonotcooperatewithusonrepayingyourdebttous
wemaysubmityournametoacollectionagencyandwemayalsoreporttheincidenttoaconsumerreportingagency
database.Thismaynegativelyimpactyourabilitytowritechecksortoreceiveloansoradvancesfromothercompanies.

CONSEQUENCESOFDEFAULT:UponadefaultbyYouunderthisAgreement,Wemay,atoursoleoption,takeanyone
ormoreofthefollowingactions:
a)AgreetopermityoutocureapaymentdefaultbeforetheloangoesintocollectionbymodifyingyourLoanSchedule
and/orpaymentamounts(aCurearrangement).Thisoptionisnotavailableforallcustomersand/orallloanproducts.
IfWeagreetoaCurearrangementandyoufailtohonoritsterms,thenwewillhavetheright,atoursolediscretion,to
terminatetheCurearrangementandimmediatelyandwithoutnoticedeclaretheentireunpaidprincipalbalanceandall
accruedunpaidfinancecharge(s)andfeesimmediatelydueunderyourLoan(AccelerateyourLoan)
b)AutomaticallyandwithoutfurtheractionornoticeAccelerateyourLoanandrequireyoutoimmediatelypayusall
amountsdueandowingpursuanttosuchAcceleration
c)IfyouhaveelectedtorepayyourLoanelectronically,wemayautomaticallyandwithoutfurtheractionornotice
withdrawfromyourdesignatedaccount(s)anamountequaltotheamountowedandunpaidasofYourlastscheduled
paymentdateuptoanamountequaltotheamountowedifwehaveAcceleratedyourloanand
d)PursuealllegallyavailablemeanstocollectwhatyouoweUs.

Byelectinganyoneoftheseoptions,wedonotwaiveorreleaseourrighttosubsequentlyelectandapplyanyother
optionstocollecttheamountsdueandowingtoUs.

REFUSEDINSTRUMENTCHARGE:Ifyourpaymentmethodisstopped,deniedorotherwisedishonored,thenyouagree
topayusafeeof$30.IfyouauthorizeddebitsfromYourBankAccountinyourPaymentChoiceAuthorization,youagree
thatwemaydebityourBankAccountforanyrefusedinstrumentcharges.Yourrefusedinstrumentmayalsocauseyour
paymenttobelatewhichcouldresultinyouhavingtoalsopayalatecharge.

VERIFICATION:YouauthorizeUstoverifytheinformationYouprovidedtoUsinconnectionwithYourLoanapplication.
YougiveUsconsenttoobtaininformationaboutYoufromconsumerreportingagenciesorothersourcesatanytime.We
reservetherighttowithholdfundingofthisLoan,atanytimepriortodisbursement,toallowUstoverifythe
informationYouhaveprovidedtoUs.

CREDITREPORTING:WemayreportinformationaboutYourloantoconsumerreportingagencies.Latepayments,
missedpayments,orotherreportableeventsmaybereflectedonYourcreditreport.

GOVERNINGLAW:ThelawsoftheTribewillgovernthisLoanAgreement,withoutregardtothelawsofanystateor
otherjurisdiction,includingtheconflictoflawsrulesofanystate.YouagreetobeboundbyTriballaw,andintheevent
ofabonafidedisputebetweenyouandus,Triballawshallexclusivelyapplytosuchdispute.

SOVEREIGNIMMUNITY:ThisLoanAgreementandallrelateddocumentsarebeingsubmittedbyyoutousasan
economicarm,instrumentality,andlimitedliabilitycompanyoftheTribe.TheTribeisafederally-recognizedAmerican
IndianTribeandenjoysgovernmentalsovereignimmunity.BecauseweandtheTribeareentitledtosovereignimmunity,
youwillbelimitedastowhatclaims,ifany,youmaybeabletoassertagainsttheTribeandus.Toencourageresolution
ofconsumercomplaints,anycomplaintmaybesubmittedbyyouoronyourbehalftotheTribeforreviewasdescribed
below.

PRESERVATIONOFSOVEREIGNIMMUNITY:ItistheexpressintentionoftheTribeandusoperatingasaneconomic
armoftheTribe,tofullypreserve,andnotwaiveeitherinwholeorinpart,exclusivejurisdiction,sovereign
governmentalimmunity,andanyotherrights,titles,privileges,andimmunities,towhichweandtheTribeareentitled.
Toprotectandpreservetherightsoftheparties,nopersonmayassumeawaiverofsovereignimmunity.Nowaiverisor
canbemadeexceptbyexpresswrittendeclarationoftheTribe'sTribalCouncilspecificallyauthorizingawaiverforthe
matterinquestion.NosuchwaiverhasbeenmadewithrespecttoeitheryourLoanAgreementoryourPaymentChoice
Authorization.

byfaxat4062357015.Apersonscomplainttousshallbeconsideredsimilarinnaturetoapetitionforredresssubmitted
toasovereigngovernment,withoutwaiverofsovereignimmunityandexclusivejurisdiction,anddoesnotcreateany
bindingproceduralorsubstantiverights.Intheeventthattheconsumerisdissatisfiedwithourinitialdetermination,
thenheorshemayrequestreviewofourinitialdeterminationbysubmittingsuchrequestinwritingtotheFortBelknap
IndianCommunityTribalCouncil,re:TribalFinancialServicesDisputeResolution,P.O.Box516,Hays,MT59527nolater
than10daysafterreceivingourinitialdetermination.AnydeterminationbyoronbehalfoftheTribe,whetherprocedural
orsubstantive,shallbemadebytheTribeinitssovereigndiscretion.

THISDISPUTERESOLUTIONOPPORTUNITYISINTENDEDASTHESOLEDISPUTERESOLUTIONMECHANISMFOR

Thewords"dispute"and"disputes"aregiventhebroadestpossiblemeaningandinclude,withoutlimitation(a)all
claims,disputes,orcontroversiesarisingfromorrelatingdirectlyorindirectlytothisTribalDisputeResolutionProvision,
(thisProvision),thevalidityandscopeofthisProvisionandanyclaimorattempttosetasidethisProvision(b)all
U.S.federalorstatelawclaims,disputesorcontroversies,arisingfromorrelatingdirectlyorindirectlytothisLoan
Agreement,theinformationyougaveusbeforeenteringintothisLoanAgreement,includingthecustomerinformation
application,and/oranypastLoanAgreementorAgreementsbetweenyouandus(c)allcounterclaims,cross-claimsand
third-partyclaims(d)allcommonlawclaims,baseduponcontract,tort,fraud,orotherintentionaltorts(e)allclaims
baseduponaviolationofanystateorfederalconstitution,statuteorregulation(f)allclaimsassertedbyusagainst
you,includingclaimsformoneydamagestocollectanysumweclaimyouoweus(g)allclaimsassertedbyyou
individuallyagainsttheTribe,usand/oranyofouremployees,agents,directors,officers,governors,managers,
members,parentcompanyoraffiliatedentities(collectively,"relatedthirdparties"),includingclaimsformoneydamages
and/orequitableorinjunctiverelief(h)allclaimsassertedonyourbehalfbyanotherperson(i)allclaimsassertedby
youasaprivateattorneygeneral,asarepresentativeandmemberofaclassofpersons,orinanyotherrepresentative
capacity,againstusand/orrelatedthirdparties("RepresentativeClaims")and/or(j)allclaimsarisingfromorrelating
directlyorindirectlytothedisclosurebyusorrelatedthirdpartiesofanynon-publicpersonalinformationaboutyou.

AlldisputesincludinganyRepresentativeClaimsagainstusand/orrelatedthirdpartiesshallberesolvedbytheTribal
DisputeResolutionProcedureinthisProvisiononlyonanindividualbasiswithyou.Anypartytoadispute,including
relatedthirdparties,maysendtheotherpartywrittennoticebycertifiedmailreturnreceiptrequestedoftheirdispute
andsettingforththesubjectofthedisputealongwiththereliefrequested

ThisProvisionisbindinguponandbenefitsyou,yourrespectiveheirs,successorsandassigns.ThisProvisionisbinding
uponandbenefitstheTribe,us,oursuccessorsandassigns,andrelatedthirdparties.ThisProvisioncontinuesinfull
forceandeffect,evenifyourobligationshavebeenpaidordischargedthroughbankruptcy.ThisProvisionsurvivesany
cancellation,termination,amendment,expirationorperformanceofanytransactionbetweenyouandusandcontinuesin
fullforceandeffectunlessyouandweotherwiseagreeinwriting.

ConsentandthatyouhavetheabilitytodownloadorprintacopyofthisConsentforyourrecords.Youagreethat:

Anydisclosure,notice,recordorothertypeofinformationthatisprovidedtoyouinconnectionwithyourtransaction
withus,includingbutnotlimitedto,thisLoanAgreement,thisConsent,disclosures,change-in-termnotices,feeand
transactioninformation,statements,delayeddisbursementletters,noticesofadverseaction,andtransaction
information(collectively,Communications),maybesenttoyouelectronicallybysendingittoyoubye-mailorbyposting
theinformationatourwebsite,www.NorthernPlainsFunding.com.

WewillnotbeobligatedtoprovideanyCommunicationtoyouinpaperformunlessyouspecificallyrequestustodo
