Rule 21 Subpoena

Sec 1 Subpoena ad testificandum and Subpoena duces tecum


Sec 2 By whom issued

The rule now allows MTC to issue a subpoena for the attendance before it a
prisoner even if he is not confined in the Municipal Jail. Unless the prisoner
has been sentenced to death, reclusion perpetua, or life imprisonment and
the desired appearance has not been authorized by the Supreme Court.

Viatory right of a witness right not to be compelled to attend upon a


subpoena by reason of the distance from the residence of witness to the
place where he is to testify.
The rule does not distinguish whether the witness resides in the same
province as where he is required to go; it is the distance from the place the
witness resides and the place where he is to testify that determines the
exception.
Viatory Right is available only in Civil Cases
