Santarosa, P# 6930, responded to the residence, Detective Santarossa requested a search warrant of the residence. The warrant was approved by the Honorable Judge Saragosa at approximately 1710 hours and served by Detective Santarossa, ‘A body exam was conducted by Coroner Investigator T. Brown and photographs taken by L.V.M.P.D. Orime ‘Scene Analyst Vaandering, P# 13575. The body exam was witnessed by Abuse Neglect Specialist T. Tavarez, Detective Emery, and Sgt. Miton. (RINNE) body had numerous bruises and lacerations, in ‘multite stages of heating, covering the majorly of his body. There ware bruises tothe lorehead, let er, left cheek, under the chin, and neck. [MIEN had numerous bruises on both the lett and right arm, They were tocated on the upper and lower arms; front and back. There was bruising to his fingers on both hands. Located on the stomach was two lacerations along with bruises in a linear pattern, There Wore bl-ateral bruises just above the hip area, Bruising tothe penis, thighs, knees, shins and fect. The left foot was almost entirely encased in a sold bruise with the big toe split open. EERE hac lacerations on his upper baok and ‘bruising on the backside of both thighs, His buttocks were a solid reo bruise with the top layers of skin missing ‘onthe right buttock. On the fet buttock thin strips of flesh were missing. There was blood in the crevica of the ‘outtocks with the skin being split around the anus, Tavarez, Emery, and Milon responded tothe residence located «| ISI HERI apartment ay ‘Upon artival, Detective Emery and | made contact with Brandon Nicholson, Introduced ourselves, and ‘explained that we would like to speak with him, however, we first needed to take a look at the apartment. 1 asked Nicholson If he was agreeable with this and he stated he was. Entry was made into the residence by Crime Scene Analyst Vaandering, P# 18575, which was processed and ‘photographed. Detective Emery and Coroner Investigator Brown asked Nicholson if he was wiling todo a video re-enactment ofthe incident which lead upto him calling 911 for his son. Nicholson was agreeable and a video re-enactment was conducted. Nicholson explained he left the residence et approximately 0800 houre to take his gitlriond, Jaime MoBride, to work, After cropping McBride off at work, he and his son completed numerous errands. Neholsen stated while completing the errands his son stated throwing a temper tanum and kicking the back of his seat. At one point his son road down the window of the vehiele and threw a toy ‘out the window. He stated he advised his son that he was going fo be putin time out when they arrived ome, Nicholson stated after arriving home he took his son tothe restroom, pulled off his pants and pull-up, at which Point he discovered his son had soaked through the pull-up and his black swealpante were all wot. Nicholson stated he then took his son out to the living room and placed him against the wal to be in timeout. Nichelson stated his son began to kick the wall and act out. He stated ha picked up a dog toy and began to spank iim on the buttocks with the dog tey. Nicholson demonstrated forcetuly iting his son on the buttocks withthe toy. He stated he did not remember how many times he struck IEEE however it was “fast and hard.” He stated HERES wes stil acting out at which point he demonstrated turing his son around and hiting him with the toy Con the arms, legs, and foot. He stated it was possibie he hit him in the stomach as well, He then took him by the arm and pulled him to the bathroom to put him in the bathtub, Nicholson stated he placed him in the tub in a siting position, plugged up the tub and turned on the water. He then left the bathroom to go outside and ‘vape” in order to calm down. He was gone for approximately ten ‘minutes. When he returned to the bathroom he saw his son laying in the tub on his cide, Nicholson then sald he grabbed his son out of the tub, wrapped him in a towel, and lald him down on the bedroom floor. Mercato, P# 15902, for the purposes of an interview. Upon arrival at Headquarters, Nicholson was interviewed by Detective Emery and mysell. | read Nicholson his Miranda rights from my L.V.M.P.D. issued Miranda Card. Nicholson stated he understood his rights and was willng to speak with us. Nicholson stated he gained custody of his son in May 2018. He described his son as being grouchy and a mean child. He stated his son cusses, tells him to shut up and calls him a bitch. Nicholson stated his son's behavior has become increasingly bad over the past year, Ho stated that his son will engage in a gag reflex and spit his food out of his mouth. He believes for the most part this is Intentional and not a medical issue. Nicholson stated this behavior is very frustrating for him because he is concerned his son is not getting the proper nutition. He ciscussed It withthe Pediatrician and it was recommended he glve him Ensure, ‘On today’s date, May 12°, 2017, Nicholson stated he got up at approximately 6:30 or 7 a.m. When BEI ‘woke up he took him to the restroom to go to the bathroom and then gave him Captain Crunch and chocolate milk for breakfast, (REMI did not eat the food or drink the milk, He began to gag and then spitit out of his mouth. Nicholson said he gave [RERIM 2 "pop" on the butt and they then left the house by approximately 8 ‘um, to take MoBride to work. After dropping MoBride off, he and JERR then ran errands. He stated ne ‘went fo the “vape" store, got gas, and went to the bank. He reported this took approximately one and a halt hours. Ouring this time REI fel asleep for approximately 10 to 16 minutos and when he woke up he was mad, He started kicking the seat and wouldr' stop. Nicholson told I he would be put in time out when they got home, Nicholson stated the same explanation of events as he had demonstrated in the video re-enactment. Nicholson further stated that he knew he had broken skin on the buttocks because he saw the blood alter he finished whipping him, He elaborated on the CPR stating as he was in the bedroom pushing on his son's chest he said his son's eyes were flickering open and closed and his head was roling forward and backward, At this Point is when ne went to the living room and placed his son on the floor, on a T-shic, and called 911. Nicholson stated he is the prithary caretaker for his son, He stated he Is not employed outside the homo, He stated he fought hard to get his child, he gave up hs job, and he is a "bad kid.” He stated he is responsible for "90% of the bruises” on his son. He stated he disciplines his son by flicking him with his fingers, looking him in his room, ‘popping him in the face", pinching him, and spanking him. He stated he has spanked him with his hand, belts, ly swatter, phone charger cord, and the dog toy. The dog toy is a "Chuckit! Classi Ball Launcher" itis epproximately 24 inches long and made of hiard plastic. It's used to row “taunch” tennis balls a greater distance for a dag to chase. Nicholson stated approximately 4 days to one week ago he pinched | ear which is how he sustained the brulsing tothe ear, He stated the bruising on the forehead Is trom him ticking’ him. Based on the above facts and circumstances, Nicholson was placed uncer arrest for Murder, Child Abuse With Substantial Bodily Mental Harm, and Child Abuse, Autopsy will be conducted on August 13", 2017, at which time further charges may be considered.
