DECISION

INTRODUCTION

A. SUMMARY

In this Decision, the Department of Public Utility Control determines that the Ztek
CTU2SE Dinosaur State Park Fuel Cell generating facility qualifies as a Class I
renewable energy source as a fuel cell and assigns it Connecticut Renewable Portfolio
Standard (RPS) Registration Number CT00195-05.

B. BACKGROUND OF THE PROCEEDING

By application dated November 29, 2005, Ztek Corporation (Ztek) requested that
the Department of Public Utility Control (Department) determine that the Ztek CTU2SE
Dinosaur State Park Fuel Cell (Ztek Dinosaur State Park Fuel Cell) generation facility
qualifies as a Class I renewable energy source.

Ztek Dinosaur State Park Fuel Cell is a fuel cell located in Rocky Hill,
Connecticut. Ztek Dinosaur State Park Fuel Cell began commercial operation on
January 1, 2005, and has a nameplate capacity of .25MW.

C. CONDUCT OF THE PROCEEDING

There is no statutory requirement for a hearing, no person requested a hearing,


and none was held.

D. PARTICIPANTS IN THE PROCEEDING

The Department recognized Ztek Corporation, 300 West Cummings Park,


Woburn, MA 01801, Jan Pepper, Clean Power Markets, Inc., P.O. Box 3206, Los Altos,
CA 94024, and the Office of Consumer Counsel, Ten Franklin Square, New Britain,
Connecticut 06051, as participants in this proceeding.

II. DEPARTMENT ANALYSIS

Pursuant to Connecticut General Statutes (C.G.S.) 16-1(a)(26), Class I


renewable energy source includes energy derived from a fuel cell.

As provided in the application, Ztek Dinosaur State Park Fuel Cell is a fuel cell
facility located at 400 West Street, Rocky Hill, CT 06067. Ztek Dinosaur State Park Fuel
Cell is currently owned by Ztek Corporation. Ztek Dinosaur State Park Fuel Cell is
registered in the New England Power Pools Generation Information System. Ztek
Dinosaur State Park Fuel Cell is a behind-the-meter generation facility. As a behind-the-
meter generating facility located in Connecticut, FWPC Fuel Cell shall be subject to
audits by the Department. See DPUC Docket No. 04-05-13.

Based on the foregoing, the Department determines that Ztek Dinosaur State
Park Fuel Cell qualifies as a Class I renewable energy facility.

FINDINGS OF FACT

1. Ztek Dinosaur State Park Fuel Cell is a fuel cell located in Rocky Hill, Connecticut.

2. Ztek Dinosaur State Park Fuel Cell is currently owned by Ztek Corporation.

3. Ztek Dinosaur State Park Fuel Cell began operation on January 1, 2005.

4. Ztek Dinosaur State Park Fuel Cell has a total combined nameplate capacity of .25
MW.

5. Ztek Dinosaur State Park Fuel Cell is registered in the New England Power Pools
Generation Information System.

CONCLUSION

Based on the evidence submitted, the Department finds that Ztek Dinosaur State
Park Fuel Cell qualifies as a Class I renewable generation source pursuant to C.G.S.
16-1(a)(26).

The Department assigns each renewable generation source a unique


Connecticut RPS registration number. Ztek Dinosaur State Park Fuel Cells Connecticut
RPS registration number is CT00195-05.

The Departments determination in this docket is based on the information


submitted by the Ztek Corporation. The Department may reverse its ruling or revoke
the Applicants registration if any material information provided by the Applicant proves
to be false or misleading. The Department reminds the Ztek Corporation that it is
obligated to notify the Department within 10 days of any changes to any of the
information it has provided to the Department.
