2) principle the person having the first hand information about a particular matter however due to death or any kind of disability is unable to appear before
court then his information should be transmitted to the court through some other person

3) the statement made should be connected to the cicumstances which lead to the death

4) if the declare and survives after making statements then it is inadmussiabls as dying declaration but statement can be used in corroboration or contradict
,impeach or confirm the credit of the person to whom it is made in section 157

5)dying declaration based on Latin maxim nemo morture praesumntur mentri which means the person who is about to die would not tell lie .
