PRELIMINARIES AND GENERAL
A GENERAL
All items shall be at the cost of the Contractor, except where

specifically stated.
B PRELIMINARY ITEMS
The Preliminary items included hereunder apply to the whole of the

works contained in this document and the Contractor must allow for
complying with same and for any cost incurred in connection therewith.
The rates inserted by the Contractor for Preliminary items shall be
deemed to apply to the whole of the works carried out under this
Contract.
The Contractor is deemed to have included or allowed for compliance

with all requirement in these General Conditions and Preliminaries in
the Contract Sum, regardless of whether or not specific stipulations on
such inclusion have been made in the Clause herein.
The Contractor is required to insert the cost amounts in the monetary
columns against such Item I Clauses of the Preliminaries and the General
Conditions of Contract where such Item I Clauses are of monetary
significance to the Contractor.
Each Preliminary Item or Clause shall be individually price. Bulk

pricing for sections, trades, groups or pages of Preliminary Items or
Clauses shall not be accepted and no subsequent claims for loss or
expenses and I or profit shall be entertained for failure to comply with
this clauses.
Where any Preliminary Item or Clause is left unpriced, it shall be

deemed that the cost of such Preliminary Items or Clauses have been
allowed for elsewhere within these Tender Documents. No subsequent
claims arising out of expenses and I or loss incurred against such
unprices Preliminary Item or Clauses shall be entertained.
The Superintending Officer and I or the Quantity Surveyor reserves the

right to request from the Contractor detailed breakdown of pricing for
Preliminaries items or any particular rates in the Bills of Quantities or
Clauses (including quotations) for examination, approval and I or
rationalisation. The examined, approved and I or rationalised detailed
breakdown pricing of which shall then be used as a basis for the
preparation of monthly interim valuation including variations that may
be issued from time to time by the S.O (the Pegawai Penguasa).
Should the Contractor fail or refuse to submit the breakdown of the

pricing and rates, etc. as described above to the Superintending Officer
and I or the Quantity Surveyor after adequate notice have been given to
him, they shall then reserves the rights to determine a value for such
affected Preliminaries items, pricing, rates or clauses which shall then be
deemed to be the accepted basis for the preparation of monthly interim
valuation and I or variations instructed and to this end, no claims and
disputes whatsoever arising thereof shall be entertained in view of the
Contractor's failure or refusal to comply with the above said request.
Headings are not comprehensive and do not modify the meaning of the
items or clauses in the Preliminary Items and Bills of Quantities.
Where Preliminary Items or Clauses or items in the Bills of Quantities

are priced but have not been executed on site by the Contractor, the cost
of such priced items or clauses or items in the Bill of Quantities shall
accordingly be deducted from the Contract Sum when so instructed by
the s.o.

PRELIMINARIES AND GENERAL (CONT'D)
1.00 THE SITE AND SCOPE OF WORK
The Works in this Contract comprises the construction and completion

of 'CADANGAN PEMBINAAN BANGUNAN KEKAL GIATMARA MUKAH, LOT 1507,
BLOCK 48, MUKAH LAND DISTRICT, MUKAH, SARAWAK.' all as shown
in Drawings and as described in the Bill of Quantities and
Specifications and other drawings and documents which may be
issued from time to time during the course of the Contract.
1.01 SCOPE OF WORK
The Works covered in this Contract comprises but not limited to

the provision by the Contractor at his own risk and cost of all
materials, scaffolding, tools, plants, labour, transport, water and
light and everything else necessary for the construction and
completion of the work :-

1.02 SEQUENCE OF WORK
The Contractor shall plan and sequence his works in relation to

any special site arrangements and shall be detailed in the
programme of work so as to complete the works in the time as
stated in the Form of Tender.
However the Superintending Officer may, at his discretion,

direct the Contractor to give priority to certain works or order
the Contractor to do certain work first at no additional cost to
the Employer. Such completion will not be regarded as partial
possession I sectional completion under the terms of the
Contract.

1.03 THE SITE
The Site for the Proposed Works is located at Lot 1507,

Block 48, Mukah L.D., Mukah, Sarawak.
The Contractor is to refer to the Site Plan for the exact location,
dimension and area of the site, and he must accept the site "as
found" on the Date of Possession.
The Contractor shall confine his workmen and operations within

the allocated site boundaries only unless otherwise instructed.
The site shall only be used for the purposes of carrying out the
Contract.
1.04 VISIT THE SITE
The Contractor shall be deemed to have attended the Tender

Site Briefing and Visits arranged by the Employer or obtained
permission from the respective authorities to visit the site and its
surroundings as stated in clause 11 of the Conditions of
Contract, and to have ascertained for himself before submitting
his tender all details appertaining thereto.
a) the nature, character and conditions of the site and the

sub-soil upon which the works are to be carried out;
b) local conditions;
c) river current, tides, tidal flood and local drainage
problem;
d) the extent of working space available;
e) conditions affecting labour and materials, the storage of
materials, positioning of sheds, stores, site offices and
plant;
f) Assess to the site and transportation of construction
materials;
g) the location of existing services as described;
h) the nearest point from which electricity and water can
be connected; and any other information
necessary for computing the tenders.
Any claim on the grounds of lack of knowledge of any such

matters will not be considered.
1.05 SITE SURVEYS
1.05.1 Verification of Levels Etc.

It shall be the Contractor's responsibility to verify the existing
earthworks levels against the S.O.'s proposed earthworks and
building platform levels, and notify the 8.0. within two (2)
weeks from the issue of the Letter of Acceptance should there be
any discrepancies found. If the 8.0. or his representatives do not
receive any notice from the Contractor within these two weeks,
it shall be deemed that there is no discrepancies and I or that the
Contractor have deemed bear all responsibilities regarding
earthwork levels, and the levels found and their dimensions are
deemed to be corrected as shown. No claim for extra payment in
this connection will be later entertained.
1.05.2 Initial Survey
The Contractor shall employ a licensed Land Surveyor to can)'

out a site survey before work commences, and to assist in
establishing boundaries and setting out the works. Details of
grid lines, setting out stations, bench marks, profiles, etc. shall
be recorded on a setting out drawing.

1.05.3 Survey on Completion
Immediately on completion of the works, the Contractor shall

employ a licensed Land Surveyor to cal1)' out a further site
survey and produce as-built drawings showing the levels,
position of buildings, etc. The drawings are to be submitted to
the Superintending Officer for verification. After verification,
two (2) copies shall be provided for the Superintending
Officer's use.
1.05.4 Licensed Land Surveyor
The Contractor shall allow here for the services of an approved

licensed Land Surveyor to carry out the site survey throughout
the Contract Period, and to assist in establishing boundaries and
setting out the works and other survey works as required by the
Superintending Officer.
1.06 EXISTING SERVICES
The Contractor shall ascertain the exact positions of existing

cables, pipes, ducts, sewers, surface water drains, service mains
and the like, under or over the site and other areas affected by
the works, whether indicated on the drawings or not. He shall
uphold, protect and maintain the same during the execution of
the works to the satisfaction of the Superintending Officer and
make good or pay for making good all damage thereto and any
consequential damage or loss arising out of such damage.
The Contractor shall not interfere with the operation of services

without the consent of service authorities, or private owners, or
the Superintending Officer as appropriate.
If services have to be temporarily terminated or diverted, the

Contractor shall give the necessary notices to the appropriate
Authorities, arrange for the work to be carried out and pay all
charges in connection therewith.
The Contractor shall divert, any drains and waterways

encountered during the progress of the works and subsequently
reinstate to the Superintending Officer's approval, if diversion is
temporary.
1.07 ANTIQUITIES
Where such articles are found and the Contractor is involved in

additional work, such work will be evaluated under Clause 64.
1.08 MATERlALS FOUND ON SITE
Any usable sand, gravel, or other building material, which may

be found on the site shall remain the property of the Employer.
If the use of any such material is approved by the
Superintending Officer for the works, the Contractor shall allow
to the Employer the fair market value of the said materials and
the Contract Sum shall be adjusted accordingly.

1.09 SITE INVESTIGATION / BORELOG
A copy of the soil investigation report is available for inspection

at the office of the Civil and Structural Engineer.
The Borelog supplied by the Employer to the Contractor is to be
the best of the Employer's knowledge and for Contractor's
information. The Employer does not accept any liability
whatsoever for any error, inaccuracy, insufficiently, omissions
or error of judgment contained therein. It shall be the
Contractor's sole responsibility to verify their accuracy and
sufficiency before submitting his tender.
With the prior written permission of the Employer, the

Contractor may carry out his own site and sub-surface
investigations. Provide the Superintending Officer with two (2)
copies of the results of any such investigation.
1.10 EXISTING VEGETATION
The Contractor shall not cany out his works in any manner that
will cause harm or destroy existing trees and vegetation within
and surrounding the site not affected by his construction works.
It shall be the Contractor's responsibility to protect these
vegetations and shall reimburse the Employer for any damage
done.
2.00 DOCUMENTATION
2.01 TENDERING PROCEDURE
These conditions are supplementary to or amplify those stated in

the Instruction to Tenderers, Conditions of Tendering and
Form of Tender.
The Bills of Quantities are numbered in sequence and the

Contractor shall check his copy. He shall notify the
Superintending Officer in writing at once of any mistakes and
have them rectified. No claim for loss consequent upon failure
to comply with this clause will be entertained.
No alteration shall be made by the Contractor to the Tender
Documents. The printed text shall be rigidly adhered to.
Except where expressly stated, any offers of alternatives will
render the tender liable to disqualification.
The Contractor shall be deemed to have fully understood the

work to be carried out under the Contract. Refer any query, in
writing, to the Superintending Officer on Instructions to
Tenderers or any other parts of the Tender Document and have
it settled prior to the submission of the tender. No consideration
will be given to any query raised by the Contractor after the date
of tender indicating lack of comprehension at tender stage of the
work to be done.
2.02 TYPE OF CONTRACT
The Contract is based on a firm price lump sum tender, subject

only to the Special Provisions To The Conditions of Contract
For Building Works, which appears as a Special Provisions to
the Conditions of Contract.
2.03 FORM OF CONTRACT
The Form of Contract will be The Standard Form of Contract to

be Used Where Bills of Quantities Form Part of The Contract
P.W.D. 203A (Rev. 1/2010).

2.04 THE CONDITIONS OF CONTRACT
The Contractor is referred to the full text of the under mentioned

clauses of the General Conditions of Contract, and he shall
allow here or in his rates for all expenses involved in complying
with the terms of these clauses.
The Contractor is to note that additional conditions, if any,

stipulated in this Section and in this Bill shall be read in
conjunction with the general clauses provided for in Standard
Form of Contract.
Appendix to the Conditions of Contract
The Appendix to the Conditions of Contract shall be completed

as follows:

Special Provisions To The Conditions Of Contract
The Contractor's attention is drawn to the Special Provisions to

the Conditions of Contract for:-
(a) Variation in price of materials for Building Works and
Mechanical and Electrical Works.
2.05 NAME AND ADDRESS:

2.06 PERFORMANCE BOND
A Performance Bond in the form of Bank Guarantee on an

approved form amounting to Five Percent (5%) of the Contract
Sum shall be deposited with the Employer as required by Clause
13 of the Condition of Contract.
The Performance Bond shall be in force and effective until

being the end of a period of Twelve (12) Calendar Months after
the expiry date of the Defects Liability Period; likewise it shall
be released to the Contractor upon its expiry.
2.07 LANGUAGE AND LAW
The Contract is subject to the laws for the time being in force in
Malaysia. The Contractor hereby submits to the jurisdiction of
the Malaysian courts to hear and determine any actions or
proceedings arising out of the Contract.

The Contractor shall accept as final in all respects within his

country of domicile or elsewhere any decision or award of an
arbitrator or judgement in any Malaysian court in relation to any
dispute between the parties under the Contract.
2.08 TIME FOR COMPLETION
The Time for Completion stated on the Tender Form is the gross
time available for completion of the Works including all
reasonable allowances for anticipated delays through difficulties
in obtaining labour or materials, transport problems, inclement
weather, conditions and statutory, and other holidays.
Before granting any extension of time, the Superintending
Officer must be satisfied that the Contractor has shown due
diligence and taken all reasonable steps to avoid or reduce
delay.
2.09 BILLS OF QUANTITIES
2.09.1 Generally
The descriptions of measured work are not intended to be

comprehensive and shall be read in conjunction with the
Specifications and Preambles.
The term "as described" and "as specified" as used in the Bills
of Quantities shall respectively mean "as described and as
specified in the Specifications and I or Preambles to all Trades
and I or Drawings". Where so described, items of measured
work shall be read in conjunction with the relevant items in the
Specifications and I or Preambles and I or Drawings.
The term "allow" shall mean the cost of the item shall be
entirely at the risk of the Contractor.
The Bills of Quantities are to be read as a continuous document,

ditto's and associated items are carried to the next page without
repetition of items, headings, etc.
2.09.2 Abbreviations
The following abbreviations shall be read as:

2.09.3 Rates
The rates inserted by the Contractor shall include for supplying

and delivering materials to site, unloading, storing, distributing,
hoisting, all labour, setting, fitting and fixing in position, all
cutting and waste, return of packings, use of plant and
equipment, supervision, establishment charges and profit, and
any other expenditure for the due and proper execution of the
work.
The rates shall be inclusive of all ancillary work and

expenditure indispensably necessary to carry out and bring the
Works to completion.

All items shall be realistically priced. The Contractor shall

substantiate and I or breakdown any rates required by the
Superintending Officer prior to the signing of the Contract and
during the course of the Works. It shall be the Contractor's duty
to do so, falling which he shall be considered as not having
submitted a bona fide tender.
Like items shall be priced the same. In valuing variations, the

lowest rate for any individual item will be applied if unit rates
vary from Bill to Bill, or Section to Section.
The value of any item unpriced shall be deemed to be included

in the prices or rates of other items in the Bills of Quantities.
Each item shall be priced individually, lump sums or percentage
additions will not be accepted.
2.09.4 Adjustment of Errors, Etc.
Should any error be made in the rates, extensions or totals, all

such errors shall be corrected and adjusted as hereunder
specified, save that the tendered figure shall remain unchanged.
The amount of the errors can be calculated as a percentage of the
total, after deduction of all Provisional and Prime Cost Sums,
Dayworks and Preliminaries and Generally, and such a
percentage shall be applied to all rates in the Bills of Quantities
as adjustment for valuing interim payment and variations.
Alternatively, the correction can be made by adjusting one or
more items in this Bill.
2.09.5 Method of Measurement
The Bills of Quantities have been prepared generally in

accordance with the general principles of the 'Malaysian
Standard Method of Measurement of Building Works Second
Edition' as published by The Royal Institute of Surveyors,
Malaysia for use in Malaysia.
Minor departures from the Standard Method of Measurement

have however been adopted in certain measurement and in the
detail compilation of these Bills of Quantities, and such
departures shall be accepted as amended variations to the
Standard Method of Measurement for these particular Bills of
Quantities. Any minor departure shall in no way vitiate the
Contract.
2.1 SPECIFICAnONS AND PREAMBLES
The rates for each item of measured work In the Bills of

Quantities shall be held to include for all costs, expenses
charges and expenditure arising out of the complying with the
Specification and Preambles to all Trades.
Should the Contractor considers that any items of the said

Specifications and Preambles have any monetary significance,
the Contractor can also and shall provide for the pricing here for
such items. No claim for extra payment shall be entertained at a
later date.
Any schedule given at the end of sections is a brief statement of

requirements. The schedule shall be read in conjunction with
the appropriate section of the Specifications.

2.11 SHOP DRAWINGS, CALCULATIONS, ETC.
The Contractor shall allow for the preparation of any shop

drawings, calculations, etc. either directly or through the
Nominated Sub-Contractors concern with comprehensive
installation or shop drawings for timber and steel roof trusses,
structural steel, metal works, glazing installation, M & E work
and any other special installations to the Works required by the
Contract. Allow for checking and inspection by the
Superintending Officer and any subsequent amendment,
resubmission and re-inspection. Inspection and any comments
made by the Superintending Officer will not relieve the
Contractor of responsibility for compliance with the Contract's
requirements. Shop drawings shall include sufficient
information and data to permit a detailed study of the product or
system submitted. Unless otherwise stated, provided four (4)
copies of each shop drawing.
The Contractor shall not stock pile, manufacture, assemble or

supply anything affected by such drawings until he has obtained
the Superintending Officer's approval. Claim for extension of
time due to delays caused by the late submission of shop
drawings or by inadequate drawings will not be entertained.
Where so required by the Superintending Officer, the Contractor
shall submit for approval of the Superintending Officer, shop
drawings or drawings of proposed installations of pipe works,
conduits, ducts, etc., and shall not proceed with any such work
until approval has been given.
2.12 AS-BUILT DRAWINGS
The Contractor shall allow for the preparation of any as-built

drawings required by the Contract Documents. During the
course of the Contract, prepare and keep up to date as-built
drawings to show each change from the Contract Drawings.
The drawings shall be kept on site and used only for record
purposes. Obtain the Superintending Officer's approval as the
size of drawings, quality of transparent sheets, method of
drawing and in general the format required prior to the
preparation of the drawings.
(~ The Contractor shall submit within Three (3) Months after

practical completion, two (2) complete set of CD and two (2)
complete sets of print of As-built Drawings (minimum Al size)
to the Superintending Officer for his approval and retention.
The Contractor shall price here the cost of producing these CD
and drawings, and no claim will be entertained at a later date.
3.00 STATUTORY AND GENERAL OBLIGATIONS
3.01 GENERALLY
The Contractor shall comply with all statutory obligations

concerning the Works.
3.02 USE OF SITE
The Contractor shall confine his workmen and operations within

the site boundaries and working areas, and the site shall only be
used for the purpose of carrying out the Contract.
3.03 WORKING HOURS
The Contractor shall comply with any restrictions on working

hours stated in the Contract.

3.04 TAXATION
The Contractor shall pay tax on profits made by him and due in
accordance with any tax laws which are in force or which may
come into force, and the Contractor's employees shall be liable
to pay income tax in respect of their salaries chargeable in
accordance with any tax laws as aforesaid. The Contract Sum
shall be deemed to include for complying with all such tax laws
in force in Malaysia.
This clause shall be deemed to cover any particular

requirements applicable to joint-venture Contractors.
3.05 POLICE REGULATIONS
The Contractor shall ascertain and comply with any police

regulations concerning the carrying out of the Works.
3.06 TRAFFIC CONTROL
The Contractor shall ascertain and comply with all regulations

concerning the carrying out of the Works in both public roads
and roads within the site, and give the necessary notices. No
road shall be temporarily or permanently closed except for
which the Contractor has obtained the necessary permission
from the Authorities.
The Contractor shall apply the necessary traffic control in

private and public roads for carrying out the Works, together
with any necessary diversions to maintain traffic flow.
Diversions shall be suitable for the type of traffic to be expected
and shall be properly reinstated on completion of the Works to
the satisfaction of the Superintending Officer and I or Local
Authority concerned.
3.07 EXISTING ROADS
3.07.1 Obstruction
The Contractor shall not unnecessarily obstruct any private and I

or public road by reason of carrying out of the Works.
3.07.2 Damage
The Contractor will be responsible for making good any damage

to existing private and I or public roads, kerbs, crossings, etc.
caused by the carrying out of the Works, and shall maintain the
aforesaid in their original condition to the satisfaction of the
Contractor shall do all repair and rectification work to the

satisfaction of the Superintending Officer and the relevant
authority.
3.07.3 Reinstatement
Reinstatement of roads affected by the Works and I or damaged

by canying out of the Works shall be backfilled, and
temporarily and permanently reinstated to the satisfaction of the
Superintending Offic,er and the relevant authority.

3.07.4 Restriction of Use
The Contractor shall ascertain and comply with any restrictions

on the free passage of vehicles, plant or workmen to or from
the site, and other areas in which work will be executed, and
shall allow for any such limitations. Comply with traffic
regulations and pay parking fees (if any) levied in and around
the vicinity ofthe Works.
3.07.5 Cleanliness of Access Roads
The Contractor shall ensure at all times that all wheels of

vehicles leaving the site are hosed free from earth, mud,
aggregate, cement droppings, etc., so as not to cause littering on
public road. The Contractor shall clean any roads or highways
including existing roads within the site, and immediately
adjacent to the Works affected by the carrying out of the Works
and I or by his construction vehicle, free from surplus materials,
mud, dirt or rubbish. The Contractor shall comply with the
requirements and directions of the Local Authority.
3.08 SAFETY MEASURES
Allow for complying with Acts of Parliament, Statutory

Regulations, etc. relating to safety of persons on or about the
site.
The Contractor is responsible for the adequacy of safety

provisions throughout the Contract period. The Superintending
Officer's approval of any safety measures shall not relieve the
Contractor from this responsibility.
Provide sufficient safety helmets, rubber boots, safety shoes,
etc. for the use of the Consultants and other authorised persons
visiting the site.
Ensure that all tools, tackle, gear, staging, scaffolding, ladders,

equipment, etc. used in connection with the works are adequate
and safe for use.
Constructional plant where applicable shall have a Certificate of

Fitness issued by relevant authority. The Contractor shall
ensure that constructional plant is in good working condition,
safe for use and suitable for the Works.
Provide and maintain all warning notices, signs, danger plates,

instruction charts, etc., and all other necessary signs and notices
for work outside the site, in public roads and for existing roads
within the site in order to provide a smooth flow of public traffic
during the duration of the Contract.
3.09 WATCHING AND LIGHTING
The Contractor shall provide watchmen, protective lighting,

warning lamps, etc. as necessary for carrying out the Works to
the approval of the Superintending Officer., Statutory or other
Authorities to prevent injury to persons and property including
the Works, the workmen and the public.
The Contractor shall provide warning lights, traffic lights and

watching particularly for work in public roads.
Take all precautions to prevent theft, and damage or

unauthorised access to the Works, existing and adjoining
property.

3.10 SITE FIRE PREVENTION
The Contractor shall be responsible for fire prevention

procedures and fire fighting facilities on the site. He shall
ascertain the requirements of the local Fire Authority, take and
provide equipment in accordance with their requirements and to
the satisfaction of the Superintending Officer.
The Contractor shall install a suitable temporary fire alarm

system, operated from the site office and with siren units placed
at strategic locations.
3.11 POLLUTION, NOISE AND VIBRATION CONTROL
The Contractor shall take adequate precautions (spraying,

hosing, erecting screens, provision of covers to loaded lorries
and other suitable methods) to avoid any nuisance or damage by
dust or other pollution by the Works to persons or properties on
the site and in the vicinity, and he will be held responsible for
any complaint, damage or claim in this connection.
The Contractor shall maintain and keep all drains, streams and
waterways on or adjacent to the site free from mud, silt and any
other obstruction or pollution caused by the Works and make
good where necessary.
The Contractor shall prevent nuisance from noise. AU plant and

equipment shall be fitted with noise suppressors recommended
by the manufacturer.
3.12 MOSQUITO PREVENTION
Water shall not be allowed to accumulate and stagnate on the

site. The site shall be kept dry by pumping, baling and
temporary drainage.
Allow for taking such precautions as may be deemed necessary

or desirable by the Superintending Officer and Local Authority
for the prevention of breeding of mosquitoes and pay any
charges in connection with any anti-malarial and anti-dengue
measure taken.
The Contractor must not deposit on site any rubbish, spoil,

unused materials, or empty containers which may afford
breeding places for mosquitoes. He will be held responsible for
mosquito nuisance at the site and surroundings, and will be
required to employ whatever mosquito destructive measures that
are required.
3.13 ADJOINING PROPERTIES
The Contractor shall carry out the Works in such a manner to

avoid causing interference or damage to existing, adjoining,
adjacent and subjacent properties. He will be liable for and
must indemnify the Employer against any claims, proceedings
and damages arising out of his neglect in this respect.
Obtain permission as necessary from owners of adjoining
property if requiring to erect scaffolding or otherwise use
adjoining property, pay any charges and indemnify the
Employer against any claim, proceedings and damages resulting
therefrom.

3.14 SITE SECURITY
The Contractor shall be responsible for security on site

including the Works on site. The Contractor shall take all
reasonable security precautions including the use of watchmen
and / or security guards to prevent damage and losses
attributable to pilferage, vandalism, theft, etc.
The Contractor shall provide at his own cost and agree with the
Superintending Officer on the security procedure to be adopted
during the Contract period, and once agreed such procedures
shall not be varied without clearance from the Superintending
Officer. The Contractor are to allow under this item for the
issuing of identification passes to the workmen and any other
security measures that may be required.
The Contractor shall be responsible for security on site including

the Works on site. The Contractor shall take all reasonable
security precautions including the use of watchmen and I or
security guards to prevent damage and losses attributable to
pilferage, vandalism, theft, etc. No claims on time and costs by
the Contractor for any loss due to lack of security will be
entertained.
3.15 LIABILITY FOR NUISANCE
The Contractor shall be solely responsible for any damage,

accident, annoyance, nuisance or disturbance arising from the
carrying out of the Works. Indemnify the Employer against all
claims, proceedings and damages arising out of, or in relation
to, any such matters.
The Contractor shall be responsible for restricting his workmen

only to the areas of the Works, and shall prevent trespass into
existing and adjoining properties.
3.16 STRUCTURAL SUPPORT
Provide and maintain all shoring, strutting, and other supports as

may be necessary to preserve the stability of the buildings,
whether new or existing, on the site or adjoining, that may be
endangered or affected by the Works.
3.17 RELEASE OF INFORMATION
The Contractor, his staff or workmen shall not make any public
or press statement, nor divulge any information to the public or
any other party conceming this Contract without the express
written permission of the Employer (through the Superintending
Officer).
3.18 CONSTRUCTION INDUSTRY DEVELOPMENT BOARD (CIDB)
The Contractor shall comply to Part VlIl of the Lembaga

Pembangunan Industri Pembinaan Malaysia Act 1994 and the
Construction Industry (Levy Collection) Regulations 1996, and
shall submit a notification on Form CIDB L1I96 to the Lembaga
not later than Fourteen (14) Days after the issuance of the Letter
of Acceptance / Letter of Award / or any document that
constitutes acceptance of a Contract of the Works, or not less
than Fourteen (14) Days before the commencement of the
Works, whichever is earlier.

The Contractor shall also comply with CIDB's requirements in

respect of registration, payment of fees, levy, training of staffs,
'Green Card' applications, submission of notification, etc. He
shall be solely responsible for such compliance and shall
indemnify the Employer in the event of his failure to comply
accordingly. Allow herein for all fees, levies, etc. as required.
4.00 MANAGEMENT AND ADMINISTRATION
4.01 GENERALLY
The Contractor is responsible for the coordination, supervision

and administration of the Works, including all Sub-Contracts.
He shall arrange and monitor a programme with each Sub-
Contractor, supplier, Local Authority and statutory undertaker,
and obtain and supply information as necessary for coordination
of the Works.
4.02 PROGRAMME OF WORK
4.02.1 Generally
Before commencing the Works, the Contractor shall submit to

the Superintending Officer for his approval a fully detailed
programme showing the order of procedure in which he
proposes to carry out the Works, and the anticipated time for
completion of the Works including that covered by Prime Cost
and Provisional Sums.
The submission to and approval by the S.O. of such Work

Programme or the furnishing of any related particulars shall not
relieve the Contractor of any of his duties or responsibilities
under this Contract. If the Contractor fails to carry out the
works in accordance with the programme due to his own delays,
then he is not entitled to any claim for costs and time. Allow for
any re-submission to obtain approval, and when approved,
provide three (3) copies for the Superintending Officer's use.
The approved programme shall only be amended / expanded as
further information becomes available, and the Contractor shall
not depart from the approved programme.
The Contractor shall also provide details of his proposed site

layout, organization, together with all labour, plant and
equipment which he proposes to employ on the Works.
One (1) copy of the approved programme shall be retained on

site, and the progress of the Works constantly monitored and
updated thereon by the Contractor.
4.02.2 Progress of the Works
If at any time, it should appear to the Superintending Officer

that the actual progress of the Works does not conform to the
approved programme, the Contractor shall produce, when
instructed by the Superintending Officer, a revised programme
showing the modifications to the approved programme
necessary to ensure completion of the Works within the time for
completion defined in the Contract.
If the Superintending Officer so instructs, the Contractor shall

arrange at no extra cost for work to be done on overtime basis
and / or by increasing manpower, plant and equipment to
accelerate the progress of the Works in accordance with the
revised programme.

4.02.3 Approval by the Superintending Officer
Submission to and approval by the Superintending Officer of

such programmes or giving of such details will not relieve the
Contractor of his duties or responsibilities under the Contract.
4.02.4 Result of Failure to Prepare Programme
Should the Contractor fail to submit or subsequently to revise or

keep up to date the programmes of work, the Employer may
employ and pay other persons to do so, and all expenses thereon
or incidental thereto shall be recoverable from the Contractor by
the Employer, and will be deducted from any monies due or
which may become due to the Contractor.
4.03 PROGRESS REPORT
4.03.1 Weekly Report
The Contractor shall prepare daily progress reports for the

Works and submit to the Superintending Officer at weekly
intervals. The report shall include the work of Nominated Sub-
Contractors, and indicate the number and description of
workmen employed, materials and goods delivered, the extent
and type of plant employed, weather conditions, visitors to the
site, and generally the progress of the Works.
4.03.2 Monthly Status Report
The Contractor shall further submit at monthly intervals a full

status report on the progress of the Works in a form to be agreed
with the Superintending Officer.
4.04 PROGRESS PHOTOGRAPHS
The Contractor shall allow for the costs of providing minimum

eight (8) sets of monthly progress photographs of postcard size
print in colour of the various views, buildings and sections of
the Works as selected by the S.O., before the commencement of
the Works and during the currency of the Contract.
Each set shall consist of a minimum of Twenty-Four (24)

photographs, and shall be dated and signed by the Contractor.
4.05 SITE SUPERVISORY STAFF
4.05.1 Generally
The Contractor shall provide all on and off site management and
supervisory staff for the proper coordination, supervision and
administration ofthe Works.
The Contractor's site management and supervisory staff must be

constantly on site during the execution of the Works, and as
long thereafter as the Superintending Officer may consider
necessary for the proper fulfillment of the Contractor's
obligations under the Contract.
Should the Superintending Officer consider the site staff

inadequate or unsuitable, he may instruct the Contractor to
increase his staff or to remove the unsuitable staff. Should the
Contractor fail to comply with the Superintending Officer's
instructions in this respect, the Employer may engage adequate
site staff and shall deduct their salaries including overtime pay
and expenses incurred from any monies due or which may
become due to the Contractor.

4.05.2 Foreman / Site Agent
The Contractor shall appoint a Foreman / Site Agent together

with the necessary assistants as required by the Contract.
The Site Agent shall be approved m writing by the
Superintending Officer, and shall be a member of a professional
group (viz. Engineer, Architect or Quantity Surveyor) having a
comprehensive theoretical background, suitable qualifications
and relevant practical experience.
Once appointed and approved, the Site Agent shall not be
changed without giving ample notice to the Superintending
Officer.
Should the Superintending Officer have any reasonable

objection to the Site Agent, the Contractor shall, on written
instruction from the Superintending Officer, remove the Agent
from the site and shall thereafter employ another to the
satisfaction of the Superintending Officer.
4.05.3 M&E Coordinator
The Contractor shall also employ competent experienced M&E

Coordinator to realize his coordination and implementation of
the whole project.
4.06 LABOUR, SUB-CONTRACTORS AND SUPPLIERS
Subject to any requirements stated III the Contract, the

Contractor shall make his own arrangements for engagement of
labour and payment thereof, comply with all statutory
requirements appertaining thereto and pay all contributions in
relation to such employment.
4.07 FOREIGN WORKERS AND SPECIALISTS
The Contractor shall be responsible for the entry of foreign

workers and specialists into Malaysia. Their entry shall
conform to the rules and requirements of the immigration laws
of the country. He shall be responsible for obtaining the
necessary work permits from the relevant authorities. The
Employer absolves himself from all responsibility pertaining to
this matter.
4.08 SITE MEETINGS
The Contractor shall attend all site meetings as required by the

Superintending Officer. Senior members of his staff and the site
agent shall attend to bring about the proper management and
coordination of the Contract, as well as to report the progress of
the Works and resolve any problems. The Contractor shall
inform Nominated Sub-Contractors when their presence at
meetings is required and, if necessary, shall hold meetings with
them prior to the main site meeting to facilitate accurate
reporting of progress.
The Superintending Officer or his authorised representative will

chair the meetings, and take and distribute the minutes.
Persons designated by the Contractor to attend and participate in
site meetings shall have the required authority to commit the
Contractor to solutions agreed upon at the meetings.

4.09 WORKSHOPS AND SITE MANUFACTURE
Fabricated items such as metalwork, steelwork, joinery, ducting,

switch boards, hydraulic systems and the like shall be
manufactured off site in factory conditions, except where
approved otherwise by the Superintending Officer.
All such items shall be delivered to site in a finished condition,
such that only 'special' and make-up pieces are actually
manufactured on site.
Notwithstanding anything stated above, the Contractor shall

apply for approval from the Superintending Officer to
manufacture any fabricated item on site.
4.10. INSURANCES
All insurances required to be taken out by the Contractor shall

be through insurance companies registered in Malaysia and
approved by the Government.
If any event occurs which may give rise to any claim or

proceeding in respect of loss or damage to the Works, or injury
or damage to persons or property arising out of the Works, the
Contractor shall forthwith glVe notice m writing to the
Employer (through the Superintending Officer) and his Insurers.
The Contractor shall indemnify the Employer against any loss
caused by the Contractor's failure to give such notice.
The insurance shall be in the form of a Contractor's All Risk

Policy, if so required by the Superintending Officer instead of
providing separate insurance policies for each individual
insurance risk.
4.11 COVER-UP
The Contractor shall afford full opportunity for the

Superintending Officer to examine and I or measure any work
which is about to be covered up. The Contractor shall give due
notice to the Superintending Officer whenever such work is
ready or about to be ready for examination, and the
Superintending Officer shall without unreasonable delay, unless
it is considered unnecessary, and the Contractor is informed
accordingly, examine and I or measure such work.
5.00. TEMPORARY WORKS AND SERVICES
5.01 GENERALLY
Temporary works and services shall comply with any relevant

Local Authority requirements, and the Contractor shall give all
notices and pay all fees in respect of such works and services.
The Contractor shall provide, maintain, alter, adapt as required
and move as necessary all temporary works and services, and
shall clear away when no longer required and make good upon
completion.
The Contractor shall inform the Superintending Officer of the

intended siting of all spoil heaps, temporary works and services,
plant, etc., and obtain approval before commencing the work.

5.02 TEMPORARY ROADS, ETC.
Provide as necessary all temporary roads, tracks, crossings,

vehicle and footplates, hardstandings, walkways, road and
pavement diversions, etc. for the construction of the Works,
including requirements for the Nominated Sub-Contractors.
5.03 TEMPORARY OPENINGS FOR ACCESS
Provide as necessary any temporary openings for access.

Obtain the Superintending Officer's approval to proposals
before forming openings.
5.04 TEMPORARY SITE OFFICES AND FACILITIES
5.04.1 Generally
Temporary buildings together with contents shall be maintained

in a clean and orderly condition, and in a good state of repair.
The Contractor shall provide all necessary attendance.
The Contractor shall comply all requirement as specified in this
clause within Two (2) Weeks of the commence date.
Temporary building shall be constructed to the Superintending

Officer's design and I or approval, and shall be erected within
Fourteen (14) Days of the possession of the site.
The Contractor shall pay any costs in connection with services

installations from the commencement of this Contract, arrange
disconnection upon completion and remove.
The Contractor is to allow for altering, shifting and adapting the

temporary buildings from time to time as required by the
5.04.2 Employer's Representatives' Site Office
Erect within Two (2) Weeks of the Date of Possession of Site

and in a position to be decided by the S.O, a secure and
watertight site office for the use of the Government's
Supervisory Staff. The site office shall complete with antitermite
treatment, piling works, sanitary and plumbing
installation, fully air conditioners, light fittings and electrical
installation including adequate fumiture, office stationery, white
board and metal cabinets, etc.
The site office shall be sufficiently furnished with office desks

with lockable drawers, drafting tables complete with drafting
equipments and stools, all facilities for storage of plans and
inspection of plans, tables, benches, chairs, stainless steel sink
with double drainers and cupboards, bookcase, shelves, white
boards, pin up boards, light fittings, lights and power points,
airconditioning, sample display cabinet, curtains, sufficient supply
of paper and ink, electric kettle, including keys to all doors,
sufficient stationeries like staplers, paper punches, toner, letter
trays, waste paper baskets, etc. for the duration of the Contract.
Maintain the site office in a good, clean and tidy condition for
the whole period of the Works is in hand, including paying all
water, electricity and other charges.
Upon completion of the whole Works, take down and remove

the site office including all fittings and equipment therein.
After removal of the S.O's site office, all furniture and fittings
shall remain the property of the Contractor, and the Contractor
shall reflect the repossession of these items in his pricing for site
office.

Provide within One (1) Month of the Date of Possession of Site

two (2) sets of brand new Dell Vostro Desktop or approved
equivalent (complete with warranties and maintenance throughout
the Contract Period) with at least the following configurations

5.04.3 Contractor's TemporalY Buildings and Facilities
The Contractor shall provide, maintain and remove upon

completion his own site offices, sheds, workshops, material
stores, latrine, accommodation, etc. complete with lighting,
attendance and welfare facilities. Allow use of such facilities
by workmen of the Nominated Sub-Contractors.
The Contractor shall note that no accommodation is allowed to

be built within the site and within the school boundary.
5.04.4 Sanitary and First Aid Facilities
Sufficient sanitary convenience shall be provided, having

concrete floors and complete with water, drainage and disposal
facilities. Separate facilities shall be provided for the use of the
Superintending Officer and other Employer's representatives.
Suitable first-aid facilities and equipment is to be kept at the
site, and the Contractor is to arrange any necessary medical
attention.
5.04.5 Accommodation for Workmen
The Contractor shall provide accommodation outside the site

boundary for his workmen, including that of Nominated Sub-
Contractors, with adequate lighting and ventilation, cooking
facilities, etc., where accommodation for workmen is required.
The Contractor is to allow for altering, shifting and adapting the
temporary buildings from time to time as required by the
5.05 SITE EQUIPMENT, ETC. FOR THE s.o.
The Contractor shall provide the following items, of a standard

Staff and Official visitors throughout the duration of the
Contract:-

The Contractor shall provide for the sale use of the s.o. and his
staff all such instruments, equipment and chainmen as may be
required to check the accuracy of the setting out. The
Contractor shall be responsible throughout the construction
period of the Works for all such instruments, equipment and
chainmen, and shall ensure that all instruments and equipment
are at all times maintained in a good working condition.
5.06 TELEPHONE AND FACSIMILE FOR THE SOLE USE OF THE S.O.
The Contractor shall provide a temporary telephone and

facsimile on the site, and pay all charges and rental 111
connection therewith during the whole Contract period
The Contractor shall provide within Two (2) Weeks after the
Date of Possession of Site and maintain 1 No. single line
telephone and fax machine, and approved plain paper fax
machine including its warranties to be installed at site for the
sole use of the S.O. and his representatives, complete with and
including all necessary papers, toners, etc. throughout the
Contract period or any extended period.

The telephone and fax machine shall be properly registered in

the Contractor's name, and the Contractor shall pay all fees,
taxes, duties and calls charges made during the Contract period
or any extended period until the issuance of Certificate of
Practical Completion.
5.07 CONTRACTOR'S FACILITIES
The Contractor shall provide telephone facilities for his own use,
and that of his Sub-Contractors, Nominated Sub-Contractors and
Suppliers.
5.08 TEMPORARY SIGN BOARD
The Contractor shall provide and maintain a framed and footed

sign board of approved picture, design and wording fixed in a
position to be determined by the Superintending Officer. The
Contractor shall pay all fees as required by the Local Authorities
for putting up the sign board.
No other board or advertisement shall be permitted to be

displayed on or around the Works.
The sign board shall be removed upon completion of the Works.
5.09 TRANSPORTATION SERVICE FOR THE S.O. AND HIS STAFF
5.09.1 General
The Contractor shall provide suitable transportation service by

means of two (2) Nos. locally assembled air-conditioned 4
Wheel Drive (purpose for passenger-carrying, twin cabin pickup
may be provided) of 2500cc complete with competent drivers
for the Superintending Officer (S.O.) and I or his I her staff or
any other persons permitted by the S.O. for the supervision of
the Works and administration of the Contract, as and when
required by the S.O or his staff at all times from the
commencement of the Contract until the issuance of the
Certificate of Practical Completion.
The Contractor shall ensure that the vehicles are accident free
and in a well maintained condition subject to certification from
Puspakom at every six (6) months.
The vehicles shall be in the custody of the Contractor at all

times.
The Contractor shall provide comprehensive insurances to cover

all drivers and passengers, and ensure that all road tax is valid
throughout the Contract period.
5.09.2 Arrangement for Transport and Failure to Provide Transport
The Contractor shall provide the necessary transport for the S.O.
or any other personnel as stated above from designated pick-up
points to the Site (including from Airport to the Site), and vice
versa as requested by the S.O. or his staff. The transport shall at
all times be readily available for the use of the S.O. and his staff.
Replacement vehicles shall be provided when the normal
vehicle is not available, such as during periods of servicing,
maintenance or repair.

The Contractor shall notify the relevant officer should there be

any delay in pick up times. If the Contractor fails to notify the
delay or fails to provide the required transport, the officer shall
have option to arrange alternative transport and the Contractor
shall bear the expenses, and an appropriate adjustment shall be
made to the Contract Sum.
5.10 TEMPORARY SITE DRAINAGE
The Contractor shall ascertain for himself any tidal flood and
local drainage problems associated with the site.
The Contractor shall provide all necessary temporary pumps,
drainage, culverts, etc, within and around the site to keep the
site free from water including flood water.
5.11 TEMPORARY LIGHTING AND POWER
The Contractor shall ascertain for himself the nearest point from
which the temporary electricity supply can be connected.
He shall pay all charges for electricity, including that for
watching purposes, incurred by the foregoing and by subsequent
use of the permanent electrical installation throughout the
duration of the Contract.

5.12 TEMPORARY WATER SUPPLY
The Contractor shall ascertain for himself the nearest point from
which the temporary water supply can be connected.

completion and pay all charges, a temporary mains water supply
as required for the Works including that for Nominated Sub-
Contractors' work. Provide temporary distribution about the
site, tanks, etc. as required.
The Contractor may use existing facilities (if any), or obtain

water from other available sources only if approved by the
Superintending officer.
5.13 METER READINGS
Where charges for services supplied need to be apportioned,

ensure that meter readings are taken by the relevant Authority at
possession and lor completion as appropriate. Supply copies of
readings to interested parties.
5.14 TEMPORARY SCAFFOLDING
Provide temporary scaffolding and staging necessary to carry

out the Works. Allow use of standing scaffolding by the
Nominated Sub-Contractors.
Allow for any modification and I or re-erection of scaffolding,

or special scaffolding as necessary.
The Contractor must ascertain the requirements of the

Nominated Sub-Contractors and give them sufficient notice
before dismantling standing scaffolding. If the Contractor fails
to do so, then he must re-erect the same at his own expense, if
so required.

5.15 TEMPORARY HOARDINGS, ETC.
At the commencement of the Contract, within Three (3) Weeks

from the Date of Prossession of Site, the Contractor shall
provide, erect and maintain to pattern and colour adequate
hoarding and entrance gates to all perimeter of site; also
construct fencing, planked footways, guardrails, gantries, safety
netting, warning lights and signages, and such other
precautionary measures necessary to ensure the safety of the
public and others who may be on or in the vicinity of the site, all
in accordance with the relevant by-laws and to the approval of
the S.O. The Contractor will be held solely responsible for all
accidents arising from any negligence in this respect.
Prior to the construction of the temporary hoarding, the

Contractor shall be required to submit details of the sizes,
numbers and location of gates of the hoarding to the S.O. for his
approval.
The Contractor shall also be deemed to have allowed in his

tender for paying all necessary local Authorities' charges and
fees in connection with the construction and maintenance, for
the duration of the Contract, of the temporary hoarding.
Upon completion of the Contract and within One (1) Week of

the S.O. so instructing, the entire hoarding, fencing, planked
footways, guardrails, gantries, safety netting, warning lights and
signages, and other precautionary measures are to be removed
from the site. All salvage materials shall become the property of
the Government, unless otherwise stated, and shall be stored
away where directed by the S.O.
6.00 THE WORKS GENERALLY
6.01 LABOUR, PLANT AND TOOLS
6.01.1 Generally
The Contractor shall provide all labour, plant, tools and

equipment for the proper and efficient execution of the works.
Provide transport for labour and for the movement of plant and
equipment to and from the site.
The Contractor shall submit with his Tender, a Schedule of

plant and equipment he proposes to use for the Works.
6.01.2 Suitability of Plant
Construction plant shall be of a type and size suitable for the

nature of the Works and the site conditions.
6.02 WORKMANSHIP
6.02.1 Generally
Workmanship shall be of the respect kinds and standards

described in the Bills of Quantities and lor Specifications, to the
satisfaction of the Superintending Officer. The standards shall
be to the requirements of British Standard Codes of Practice,
S.I.R.I.M., or equivalent approved Specifications where
applicable. Works shall be carried out by or under the close
supervision of experienced tradesmen, skilled in the particular
types of work.

Where stated in the Specifications Works shall be executed by

specialists approved by the manufacturer I supplier of the
particular materiaL
6.02.2 Proprietary Products
Proprietary products shall be handled, stored, prepared and

used, or fixed in accordance with Manufacturer's printed
recommendations and instructions. Submit copies of
recommendations if required by the Superintending Officer.
Where necessary in the opinion of the Superintending officer,

the Contractor shall arrange for the attendance of a
Manufacturer's technical representative during the installation
of proprietary items.
6.03 MATERIALS AND GOODS
6.03.1 Generally
The Contractor shall use, where applicable the materials which

stated in the Drawings and the Specifications. If the
Government I Employer found out that the Contractor did not
comply to use the materials of Malaysian Origin after Letter of
Acceptance released, legal action and rejection of materials
supplied to be taken against the Contractor.
All material shall be new, unless otherwise described.

Materials and goods throughout the Works shall be of the
respective kinds and standards described III the Bills of
Quantities and I or drawings andlor Specifications to the
satisfaction of the Superintending Officer. Where not described,
shall be suitable for the purpose of the Works stated in or
reasonably to be inferred from the Contract Documents in the
opinion of the Superintending Officer.
Materials and goods shall comply with British Standards,

S.I.R.I.M., or equivalent approved Specifications wherever
applicable, and shall be approved by the Superintending Officer.
6.03.2 Manufacturers' References
Manufacturers' names and references quoted in the Contract

Documents are indicative of type and quality only. Other
manufacturers' products may be considered provided they are
equal in all respects to those specified, and are approved by the
Superintending Officer. Full details of any proposed substitute
shall be submitted for the Superintending Officer's review.
Where possible, however, the specified proprietary materials or
goods shall be used.
In the event that the Superintending Officer allows the

substitution of any materials during the course of construction,
any cost arising out of the use of the substitute material shall be
borne by the Contractor, and any saving arising therefrom shall
be passed onto the Employer, unless the Superintending Officer
otherwise directs.
6.03.3 Single Source
Where a choice of manufacturer or source of supply is allowed

for any particular product or material, the whole quantity
required to complete the Work must be of the same type,
manufacturer and I or source. Do not change without approval.
Produce written evidence of source of supply when requested by
the Superintending Officer.

6.03.4 Importation of Mild Steel Bars
The importation of mild steel bars is subject to Customs

Prohibitive Order (Import). Approval of import licenses from
the Ministry of Commerce and Industry must be obtained before
placing orders with overseas manufacturers, and the Contractor
will be responsible for complying with this procedure.
6.04 ORDERING OF MATERIALS
The Contractor must not order from the quantities and sizes
stated in the Bills of Quantities, but must calculate and order
from the drawings. All dimensions must be checked and
verified by the Contractor on site before ordering.
The Contractor shall place his orders for materials and goods at
the earliest possible date, and in relation to the approved
programme of work, and will be held responsible for any delay
occasioned through failure to do so.
Copies of orders shall be presented to the Superintending

Officer for inspection if requested.
Materials which require the approval of the Superintending

Officer shall not be ordered until approved. The Contractor
must submit samples in good time for consideration, and allow
reasonable time for Superintending Officer's review.
6.05 SAMPLES
Samples of materials shall be submitted for approval by the

Superintending Officer at the earliest possible date, to suit the
work programme, and before any order is placed.
Approved samples will indicate the standard to be maintained in

the execution of the Works, and shall be so marked and retained
on site by the Superintending officer. Where samples are
rejected, further samples must be provided until approval is
obtained.
Should the Contractor propose an alternative manufacturer's

sample of both the original specified item and the proposed
substitute shall be submitted.
All samples submitted shall remam the properties of the

Employer.
6.06 MOCK-UPS AND CONTROL SAMPLES
Where samples of finished work are specified or ordered, obtain

approval from the Superintending Officer before proceeding
with further work. Retain approved mock-ups on site for
comparison with the work. Remove off the finished works
when no longer required.

6.07 APPROVALS
Where and to the extent that products, materials or work are

specified to be approved, or the Superintending Officer instructs
or requires that they are to be approved, the same must be
supplied and executed to comply with all other requirements
and in respect of the stated or implied characteristic either:
a To the express approval of the Superintending officer; or

b To match a sample expressly approved by the
Superintending officer as a standard for the purpose
Inspection or any other action by the Superintending Officer
must not be taken as approval of materials, products or work,
unless the Superintending Officer so confirms in writing in
express terms referring to:
a) Date of inspection
b) Part of the work inspected
c) Respects or characteristics which are approved
d) Extent and purpose of approval
e) Any associated conditions.
6.08 DEFECTIVE WORK
As soon as possible after any part of the work is known or

suspected to be defective, submit proposals to the
Superintending Officer for further testing, opening up,
inspection, making good or removal and re-execution, and
obtain instructions.
Whenever inspection or testing shows that the work is not in

accordance with the Contract, and measures (e.g. testing,
opening up, experimental making good, etc.) are taken to
establish the acceptability of the Works, such measures:
a) Will be at the expense of the Contractor, and

b) Will not be considered as grounds for extension of time
6.09 ACCURACY / SETTING OUT
Unless otherwise specified, construct the Works to levels of

accuracy so that in relation to B.S. 5606 Tables 2 and 3:
1. all achieved sizes fall within the permissible deviations; and

2. approximately two thirds of achieved sizes fall within
one third of the permissible deviations.
Arrange the setting out, juxta-position of components and

application of finishes (working within the practical limits of the
design and Specifications) to ensure that there is satisfactory fit
at junctions and that the finished work has a well aligned, true
and regular appearance.
Wherever satisfactory accuracy, fit and / or appearance of the

Works are likely to be critical or difficult to achieve, obtain
approval of proposals or of appearance of the relevant aspect of
the partially finished work as soon as possible.
Work which fails to meet the specified levels of accuracy must

not be rectified without approval. Submit proposals for
rectification and meet all costs arising including other affected
work. Allow for the possibility that approval will not be given,
necessitating removal and replacement of work.

Set out the Works using methods and instruments described in

B.S. 5606 "Code of Practice for Accuracy in Building" Section
5 to within the permissible deviations specified. Submit details
of method and equipment to be used in setting out the Works.
The Contractor shall provide a copy of B.S. 5606 which shall be

retained on site.
6.10 INSTRUMENTS
The Contractor shall make available a theodolite (or dumpy

level), leveling staffs, measuring tapes, and such other
equipment for the sole use of the Superintending Officer or his
representative. Maintain in a satisfactory condition on site
throughout the duration of the Contract.
6.11 LOADING IN EXCESS OF DESIGN LOAD
The Contractor will be responsible for the stability and

structural integrity of the Works during construction, and shall
support as necessary and in particular shall prevent overloading.
No load in excess of the design load shall be placed on any
portion of the structure without the written permission of the
Superintending Officer. If such permission is granted, structural
members subjected to excess loading shall be strengthened and
supported to the satisfaction of the Superintending Officer. The
Contractor will bear all additional expenditure, including
making good any damage caused.
6.12 PLANT ATTACHED TO BUILDINGS
If the Contractor proposes to use any type of plant which places

a load on the structure, or is attached to the structure, he must
furnish full details of such plant to the Superintending Officer
before work is commenced.
If necessary, and architecturally and structurally acceptable, the

structure shall be strengthened to carry such loads, and the
Contractor will be responsible for any resulting extra expense.
The Contractor will also be responsible for making good any

damage to the structure to the satisfaction of the Superintending
Officer.
6.13 CRANES AND HOISTS
6.13.1 Generally
It is the Contractor's responsibility to ensure the sufficiency,

inter alia, of all lifting equipment for men and materials to effect
the earliest completion within the time stipulated in the Contract
Documents.
The Contractor shall provide sufficient lifting equipment in the

form of cranes and hoists ~9meet a significant demand in order
to achieve the required completion date.
Day and night time hoisting may be required by the Nominated

and other Sub-Contractors, and it IS the Contractor's
responsibility to organise the hoisting programme to the

The Contractor shall provide for hoisting of all equipment and

materials for ALL Sub-Contractors at his own expense. No
claim for extras in hoisting will be entertained.
The Contractor shall also provide all necessary hoisting for his
own personnel, and personnel of the Nominated Sub-
Contractors at all times.
6.13.2 Safety
Notwithstanding anything contained in any statutory regulations

in force at the time, the Contractor's attention is directed to the
following requirements in respect to the equipment safety which
should be considered as additional to the requirements of
statutory regulations.
a) Cranes
All cranes are to be manned by experienced operators.

In addition to crane operators, each crane must be
attended by at least one ground attendant at all times
who shall be in constant contact with the crane operator.
A maintenance and inspection schedule shall be

implemented for any major equipment operating on the
site. Such schedules are to be adhered to in respect of
periodic maintenance at all times.
b) Hoists
Each hoist is to be manned by an experienced operator

at all times.
Electrical call buttons are to be provided at all floor

levels.
At each landing, adequately designed handrails with

wire mesh safety netting are to be provided for the
safety of persons entering the hoists.
6.14 SERVICE INSTALLATIONS
The Contractor shall make adequate provision for services,

including unobstructed routes and fixings. Whenever possible,
ducts, chases and holes shall be formed during construction
rather than cut. Any cutting shall be the minimum as necessary,
and the Superintending Officer's prior approval shall be
obtained in regard to the locations and sizes.
To facilitate location for maintenance and repair, clearly mark

positions of concealed services, in unobtrusive locations, to
approval.
6.15 PROTECTION OF THE WORKS
The Contractor shall protect, cover up, and take all reasonable
precautions to prevent loss or damage by weather, accident or
any other cause to the Works (including the Nominated Sub-
Contractor's work).
All finishing, floors, sanitary fittings, glass, tiles, paving and the
like shall be effectively protected from damage to the
Superintending Officer's approval.

Any damaged appliances or surfaces shall be replaced by the

Contractor at his own expense, as directed by the
Superintending Officer. A clean first class finish is required,
and any dirty, stained, indented or scratched fittings or finishes
will be rejected and replaced at the Contractor's own cost.
6.16 PROTECTION OF EARTH SLOPES AND DRAINS
The Contractor shall take all necessary precautions to preserve

all earth slopes, i.e. slope already existing on the site at the same
time of the site being handed over to the Contractor, and new,
i.e. new slopes formed and constructed by the Contractor under
the Contract
He shall construct adequate temporary water courses and drains,

and take other necessary steps to prevent slips from occurring.
Should slips occur due to the Contractor's neglect to take
necessary precautions to preserve the earth slopes, he shall, at
his own expense, make good such slips to the entire satisfaction
of the S.O.
The Contractor shall make daily inspection of the earth slopes,

and more often if he deems it necessary, or it so instructed by
the S.O .. He shall record the results of his inspections in the site
dairy. In the event of the slips occurring, or in the opinion of the
Contractor may possible occur, the Contractor shall
immediately report to the S.O. who shall give necessary
instruction to the Contractor.
The Contractor shall be held solely responsible for the

sufficiency of the precautions taken by him to preserve the earth
slopes, and shall be liable for and shall indemnify the
Government in respect of any claims or preceding arising out of
his neglect of this provision.
6.17 PROTECTION OF ENVIRONMENT
The Contractor shall take necessary precautions to prevent the

deposition of any debris, rubbish, silt, waste materials, foul
water, chemicals, etc. arising from the carrying out of the Works
into the existing river, streams / waterways without a written
approval from the S.O.
The Contractor shall divert existing drains, waterways, etc.

encountered during the progress of the Works without disrupting
its flow system, and subsequent reinstate the same to the S.O.'s
approval if the diversion is temporary.
The Contractor shall take necessary precaution to ensure tyres of

all vehicles leaving the site are free of mud.
The Contractor shall not carry out any open burning on the Site
without written approval of the S.O.
The Contractor shall be held solely responsible for sufficiency

of the precaution taken by him to protect the environment, and
to comply with requirement imposed by the relevant Authorities
at his own expense. The Contractor shall be liable for and shall
indemnify the Government in respect of any claims or
proceeding arising out of his neglect of this provision.

6.18 PERIODICAL CLEANING
During the progress of the Works, the Contractor shall keep the
site and the Works reasonably free from all unnecessary
obstructions, and shall store or dispose off plant and surplus
materials.
All rubbish, debris, waste materials, etc. including that from the
Nominated Sub-Contractor's work shall be cleared from the
site, and the work under construction from time to time as it
accumulates and as the Superintending Officer may direct.
6.19 DRYING THE WORKS
The Contractor shall control the drying and humidity of the

Works to prevent blistering and failure of adhesion, damage due
to trapped moisture and / or excessive movement.
6.20 LEAVE WORKS PERFECT
Upon completion of the Works and before the issue of the

Certificate of Practical Completion, the Contractor shall carry
out the final cleaning and commissioning of the Works to the
satisfaction of the Superintending Officer. Such operations
shall include, but not be limited to, the following:
a) Remove all rubbish from the building and the site, clear
away and remove constructional plant and surplus
materials, and leave the Works clean, tidy and ready for
immediate occupation.
b) Remove any temporary markings, protective covering,

tapes, casings, and clean exposed surfaces.
c) Clean all exposed concrete, brick and timber surfaces.
d) Leave all roofs and gutters watertight and clean.
e) Wash, clean, dry and polish all floor finishes (in

addition to any previous polishing required by the
Specifications).
f) Ease all doors, windows, cupboard doors and drawers,

and leave them free to move.
g) Check, oil and adjust all ironmongery. Leave the

Works secure with all accesses locked. Hand over all
keys with identifying tags and identifying schedule to
the Superintending Officer. Retain duplicate schedule
signed by the Superintending Officer as receipt.
h) Cut out cracks in plaster, etc., and make good.
i) Clean and polish all glass, glazed tiles, stainless steel

surfaces. etc ..
j) Touch up all minor faults in paint finishes, or repaint

badly marked areas back to suitable breaks. Remove all
paint sports from floors, walls, hardware, glass, etc ..
k) Ensure that all services and equipment are tested,

commissioned and functioning efficiently, and that all
sanitary fittings are cleaned.

1) Rod drains, clear any obstructions, and flush out.
m) Reinstate to original condition any area disturbed by

sheds, materials, access roads, diversion roads, etc. not
subsequently covered up by the Works.
6.21 MAKING GOOD DEFECTS
The Contractor shall make arrangements with the Employer

(through the Superintending Officer) and give reasonable notice
of the precise dates of access to the various parts of the Works
for purposes of making good defects. Inform the
Superintending Officer when remedial works to the various
parts of the Works are completed and ready for inspection.
6.22 OPERATION AND MAINTENANCE INSTRUCTIONS
The Contractor shall provide complete operation and maintain

instructions covenng all items of equipment, and, when
approved, submit four (4) copies suitably bound.
6.23 INSPECTION DURlNG MAINTENANCE PERIOD
The Superintending Officer will give the Contractor due notice

of his intentions to carry out any inspection during the period of
maintenance, and the Contractor shall thereupon arrange for a
responsible representative to be present at the time and dates
nominated by the Superintending Officer. This representative
shall render all necessary assistance, and take note of all matters
and things to which his attention IS directed by the
6.24 WARRANTY
The Contractor shall, jointly with the Manufacturer and

Specialist Applicator, provide warranty to the Employer for the
following works for a period as stated against defective
materials and workmanship. These warranties shall commence
from the Practical Completion of the Works.
The Final Payment will not be released to the Contractor unless

and until the following warranties have been received by the
Employer.
a) Waterproofing system (To provide five (5) years

warranty),
b) Anti-termite treatment (to provide five (5) years

warranty).
c) All painting system including protective system (to

provide five (5) years warranty).
d) All aluminium and glazing products (To provide five

(5) years warranty).
(e) Roofing sheets (To provide five (5), ten (10), fifteen
(15) and twenty-five (25) years warranty - refer
Specifications for details).
f) Septic tanks (To provide five (5) years warranty)


g) Any other new works and scope of works which are

stated in the Specifications.
Any changes to or substitution of any of the above products

shall not relieve the Contractor from his obligation to provide
similar warranties for the period as stated above.
The Contractor shall also refer to the Specifications for exact

scope I items of the works for which he should warrant against.
6.25 TEST
Contractor shall provide for the following tests including the

supply of all related materials, equipments, monitoring and
result analysis, water, electricity, etc. all to the satisfaction of
the Superintending Officer all at his own cost.
a) Ponding Test
Contractor shall also carry out at his own cost all

subsequent tests should the initial test fail to meet the
Superintending Officer's requirement.
7.00. PRIME COST SUMS, PROVISIONAL SUMS AND CONTINGENCY
7.01 GENERALLY
To be read in conjunction with Clauses 34, 60 and 63 of the

Conditions of Contract.
Such sums shall be expended at the discretion of the

Superintending Officer, or deducted in whole or in part if not
used.
7.02 NOMINATED SUB-CONTRACTORS
7.02.1 Generally
The Contractor will be responsible for the supervision,

administration and coordination of all the Nominated Sub-
Contractors' work.
Arrange a programme of work with each of the nominated

firms, subject to the approval of the Superintending Officer.
Ascertain particulars of chases, holes, mortices and similar
items required to be formed or left.
Ascertain and supply information, dimensions, etc. necessary to

enable the work to be set out and executed correctly,
The Contractor shall bear any additional cost incurred as a result
of any omission on his part in this respect.
7.02.2 Attendance by Contractor
The Contractor shall allow for attendance on the Nominated

Sub-Contractors where stated III the Bills of Quantities.
Attendance shall include the following:
1. Affording free and full use of scaffolding and hoisting

tackle, already erected messrooms, sanitary
accommodation and welfare facilities, temporary roads
and hardstandings.
2. Providing separate hoisting facilities for their exclusive
use.
3. Providing space only for their temporary office and
storage accommodation.

4. Providing adequate artificial lighting and water for their

work.
5. Providing adequate electrical power supplies required
for the execution of their work, see the following Item c.
6. Making available and arranging for any special power
supplies for their work.
7. Clearing away their rubbish from site.
8. Covering and protecting their executed and part
executed work, materials and goods against loss or
damage (whether or not included in any certificate),
including keeping and ratifying necessary joint records
thereof.
7.02.3 Inclusions by Sub-Contractors
The Nominated Sub-Contractors will include in their Sub-

Contract Sums, inter alia, the costs in connection with the
following:
a. The unloading, getting in, storing and handling of their

materials, plant and tools.
b. The provision, erection, maintenance and removal of
their temporary office and storage accommodation,
including paying all assessment and other charges.
c. Connecting to temporary power supplies made available
by the Contractor, supplying and running distribution
cables, leads and electrical gear required.
d. Where test, running and commissioning of installations
require current from the permanent electricity supply,
the Nominated Sub-Contractors concerned will provide
sub-meters to register the current consumed, and
reimburse the Employer the cost of the power through
the Contractor or such cost to be set off from any
payments due or to become due, and for the credit of
Employer. Where the temporary supply is sufficient
and adequate, the Sub-Contractor will reimburse the
Contractor for power used for testing and
commissioning. The Sub-Contractor will provide fuel,
gas or steam supplies, and other services that may be
required for the test, running, testing and balancing of
installations.
e. Taking full responsibility for any loss or damage to
their own plant, tools and equipment, and other property
on the site.
f. Effecting relevant insurance policies as required under
the Conditions of Contract, except insurance against
loss or damage by fire of their executed work, materials
or goods on site which is the responsibility of the
Contractor.
7.03 NOMINATED SUPPLIERS
7.03.1 Generally
The Contractor shall enter into a Contract of Sale with all the
Nominated Suppliers based on the Conditions of the Main
Contract relevant to the Nominated Suppliers.

7.03.2 Fix Only
The term 'FIX ONLY' shall include for taking delivery,

unloading, carrying in, sorting, removing protection, checking,
assembling, retuming packages, handling, hoisting and fixing
materials in position, waste, any cutting away and making good,
packing, grouting, etc., and overheads and profit all III
accordance with the generally accepted requirements for fixing
the specific item.
7.03.3 Compliance with Specifications Etc.
The Contractor will be responsible for checking deliveries, the

accuracy of sizes, and compliance with Specifications. Once
items are accepted by him, the Contractor will be responsible
for any discrepancy, loss or damage to the materials.
7.03.4 Calculation of Payment
The amount payable by the Employer to the Contractor in

respect of Nominated Suppliers will be based on the actual
materials and goods incorporated in the finished work.
Wastage, breakages, damages, losses and replacements shall be
settled between the Contractor and the Supplier concemed,
neither of whom shall have any claim against the Employer.
7.04 EMPLOYER'S DIRECT CONTRACTS
7.04.1 Artists and Tradesman
The Employer reserves the right to let separate Contracts for the
work on site. Such persons so employed shall not take
instructions from the Contractor.
The Contractor shall liaise with and allow such persons

unrestricted access during reasonable working hours, allow use
of temporary roads and hardstandings, provide space for storage
of their materials, and give every reasonable facility for the
execution of their work without additional cost to the Employer.
Should the Superintending Officer require the Contractor to

provide any labour, materials or other services in respect of such
persons, the cost of same shall be valued and added to the
Contract Sum as a variation.
7.05 OCCUPATIONAL SAFETY AND HEALTH MANAGEMENT
The Contractor shall carry out all Occupational Health and

Safety measures on site In strict accordance with latest
Occupational Safety and Health (Safety and Health Officer)
Regulations 1997, Factory and Machinery (Building Operations
and Works of Engineering Construction) Regulation 1986
throughout the entire Contract period. Works shall also include
the preparation and submission of Safety and Health Plan,
Hazard Identification Risk Assessment and Risk Control
(HIRARC) for the activities carried out on site and Safety
Reports.
The Contractor shall also at all timers comply to all latest

regulations and requirements of NREB and other local

The Contractor shall engage a competent and qualified person as

Safety and Health Officer (SHO) to be approved by the
Superintending Officer, and to be stationed full time on site
throughout the entire Contract duration of the project.

7.06 ENVIRONMENTAL MANAGEMENT
The Contractor shall allow for in his tender to engage an

environmental specialist approved / registered with the Natural
Resources and Environment Board (NREB), Sarawak to prepare
the Environmental Management and Monitoring Plan, and to
carry out supervision and monitoring including submission of
quarterly reports during the Contract period. The
Environmental Specialist is also required to attend the monthly
site meetings and brief the S.O. regarding matters related to
environmental management. The Environmental Management
and Monitoring Plan are to include all the mitigation measures
to be carried out.
The Contractor shall within Thirty (30) Days after the receipt of
the Letter of Acceptance of Tender submit to the S.O. an outline
of the Contractor's Environment Management and Monitoring
Plan for complying with the Environmental Management's
requirements as stipulated below. Within Thirty (30) Days of
such submittal, the Contractor shall submit to the Controller of
Natural Resources and Environment Board (NREB), Sarawak
for approval of its detailed Environmental. Management and.
Monitoring Plan which shall take into account of all comments
made by the S.O. on the said outline, and thereafter the
Contractor shall amend or supplement the Environmental
Management and Monitoring Plan as may reasonably be
required by the Controller of NREB. The submission and
subsequent approval of such system shall not relieve the
Contractor of any of his duties or responsibilities under the
Contract.
Without limiting his obligations under the Contract, the

Contractor shall adhere to the principles and procedures
contained in the approved Environmental Management and
Monitoring Plan, and any amendment or supplement thereof.
The Contractor shall provide all access, assistance and facilities
to enable the Controller of NREB or his representative(s) to
verify the implementation of the Environmental Management
and Monitoring Plan.
This Standard Specification covers, m general, mitigation

measures of environmental impact arising from all construction
works. The following conditions of environmental impact
mitigation measures amplify further requirements, which are to
be met by the Contractor during construction.
I Health and Safety
1. Medically screen all workers prior to employment and carry

out medical examinations regularly.
2. Construct toilets at work camps III accordance with the
guideline of Ministry of Health.
3. Implement a hygienic solid waste disposal system where
garbage pits are covered with earth daily.
4. Restrict entry by public to quarry.
5. Strictly enforce all health and safety guidelines.
6. Workers exposed to dust to use masks.
7. First aid facilities and regular health inspection to be
provided

II Social Conflict
1. Priority for employment should be given to the local people

who are affected by the project.
2. Employ workers with good behavior track record.
3. Isolate work camps from local settlements.
III Protection of Air Quality
1. To obtain permit from Natural Resources and Environment

Board (NREB), Sarawak before carrying out any open
burning.
2. All buming activities are to be carried out in strict
accordance with the guidelines stipulated by NREB.
3. Carry out blasting only when rock cannot be ripped out
economically with conventional equipment.
4. No burning in peat areas.
5. Air quality monitoring shall be carried out immediately and
regularly during the period of construction. Under normal
conditions the suspended particulate matter shall be
a) Along river settlements, 9-15M/m3; and
b) Other residential areas, IO-I8M/m3
IV Control of Soil Erosion and Sedimentation of Water Bodies
1. Minimize clearing to within 3m from the top of cut batters

and within Sm of the bottom of the road.
2. Carry out directional felling so that trees fall into the road
clearing area to minimize damage to adjacent vegetation.
3. Stockpile topsoil for later use in revegetation.
4. Carry out progressive revegetation of exposed area 10
tandem with slope stabilization works.
5. Retain a SOmbuffer strip of vegetation fringing rivers
within which borrow areas, spoil dumpsites and clearing
(except at stream crossings), or dumping of vegetation is
prohibited.
6. During cut and fill operation, all fill areas must be firmly
consolidated and compacted.
7. Both cut and fill batters should be turfed or hydroseeded as
soon as possible.
8. Larger and / or steeper cut or fill batters must be terraced
and provided with appropriate drainage installation to
discharge surface runoff.
9. Suitable sediment traps must be constructed and
maintained to filter polluted surface runoff before being
discharge into the natural watercourses downstream.
10.Locate spoil dumps at suitable sites away from surface
water bodies.
11.Avoid spoil dumps sites in virgm dipterocarp forest,
riparian forest or within SOm buffer strip retained along
rivers.
12.Utilize as much material as possible for the road
construction works.
13.Terrace spoil heaps, where slope angles, batter height and
drainage are to be designed for road fill batters.
14.Compact spoil dumps, turf and replant with indigenous tree
species.
15.Construct and maintain adequately designed sedimentation
ponds to prevent surface runoff from the quarry from
polluting surface water bodies.
16.River water quality monitoring shall be carried out
immediately and regularly throughout the road
construction. The suspended solids (SS) content shall be
maintained at levels not exceeding 150mg/l for any
streams or rivers traveled by the proposed road.

V Protection of Flora and Fauna
1. Posters of protected species should be put In all camp

canteens, long houses, etc.
2. All existing wildlife protection laws must be implemented.
VI Control of Traffic Accidents
1. Maintain existing road within the Site for road user's safety.
2. Control the crossing junctions between existing roads and
the proposed road by suitable traffic signs.
3. Maintain all vehicles regularly to minimize accidents due to
mechanical failure. All vehicles should also be equipped
with first aid kits.
4. Patrolling of existing road within the Site to detect
breakdowns, accidents or damaged road that required
repairs.
