JOINT AFFIDAVIT
(RE: CHANGE OF VENUE OF MARRIAGE SOLEMNIZATION)

We, ANDREW FRANCIS ENGLAND and CHERRY LEA D. GONZAGA, both of legal
age, Australian and Filipino, respectively, and residents of Ormoc City, Leyte, Philippines, after
having been duly sworn to in accordance with law, hereby depose and say:

1. That we are the contracting parties who requested for marriage solemnization
with the RTC, Ormoc City;

2. That we intend to be wed this April 28, 2017, Thursday, at 9 o'clock in the
morning;

3. That we, further, intend to have our wedding be solemnized by Hon. James
Clinton R.C. Nuevo at Sabin Resort Hotel, Brgy. Bantigue, Ormoc City on the
aforecited date and time;

4. That we are executing this Affidavit to attest to all the truth of the facts
aforestated for the purpose of compliance as regards changes of venues for
marriage solemnization as required pursuant to Article 8 of the Family Code of
the Philippines and for whatever legal purose this foregoing document may
serve.

IN WITNESS WHEREOF, we hereby fixed our signatures on the 26 th day of April 2017 in the
City of Ormoc, Philippines.

Article 15 of the Family Code of the Philippines states:

Any contracting party between the ages of TWENTY ONE (21) and TWENTY
FIVE (25) shall be obliged to as their PARENTS or guardian upon intended marriage. If they
do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till
after three (3) months following the completion of the publication of the application therefor.

This is our basis why we ask contracting parties who ARE STILL 25 years of age at the
time of their application of marriage in your good office AND request for marriage
solemnization in the RTC of their Parental Consent. The law is perfectly CLEAR and it
demands full compliance.

Article 16 of the Family Code, more particularly the last sentence of said article provides
administrative sanctions to both ISSUING OFFICER and SOLEMNIZING OFFICER who
fails to observe both articles.

Another error which the court always find is that your good office often issues Marriage
Licenses WITHIN 10 days from receipt which is still covered by the 10 day posting as required
by law.

Again, the Family Code provides a 10 days posting pursuant to Article 17 of the Family
Code. The said article requires that a Marriage License SHALL be issued AFTER (not within
the period) the completion of the period of the publication.
