In New South Wealth State, the Holiday Rental Industry Association consider that the
occupancy is short term should less than 3 months but usually less than 10 days.Airbnb are
actually undefined and vary from council to council, councils had the power to set their own
rules about short- term rental in the Local Environmental Plans.
In Vitoria, government are clamp down on landlords who allow short-term tenants to
damage property or make loud noise. Neighbours or owners allowed take an action landlord
to Council. From 2016, South Australians can rent their home without permission.
In Australian Capital Territory, the property owners can rent their home from time to time
that is on safe legal ground. But if the rented very often, they may breach the Building law.
In Perth, it is illegal to rent home out for short-stay accommodation without council approval
and may face fines of up to $200,000 if they listing their homes on Airbnb as nightly rentals
without permission.
Under existing Hobart City Council regulation, it is similar to Perth. Property owner need to
apply for approval before leasing. There is no such regulation in other states of Australian.
We also noticed that home-sharing has been hotly debated in many cities. Here are some
places with very strict regulation on Airbnb.
New York is Airbnbs the largest market. But under the New York State Multiple
Dwelling Law rentals of less than 30 days is illegal, with a fine up to $2,500 per day. Only
permanent residents are allowed to do short-term rentals. There is a new bill on its way to
give more pressure on Airbnb, but Governor is still deciding whether or not to sign it into
law. However, landlord still needs to pay tax to Taxation Office.
Airbnb also face heavy pressure in some US cities. From 1st February 2015, short-term
rentals in San Francisco should less than 30 days and entire houses rental should be less 90
days. Renters must be permanent residents with official names on the record, and also
have to pay a $50 registration fee and pay tax on rentals.
In New Orleans, the voted on changing legislation and regulations of Airbnb has been failed,
that means the law is still seldom.
City of Santa Monica reported the 9011 regulation on April 9th 2015 to require landlords to
file "buyout agreements" with the Rent Control Board. Property owners are required to pay
an annual registration fee of business licenses for every unit, and visitor also need to pay
additional $7.29 per month.
In, Barcelona, owner must have business license as well under Tourism Act of 2012. As
Business Insider (2014) reported that Airbnb in Barcelona was fined up to $40,000 in July
2014 for allowing homeowners to rent out rooms to travellers for under 30 days, which was
technically in breach of laws.
Paris city government always crackdowns on secondary rental apartments, specifically the
short-term rental units, fining up to 25,000 euros. Only the property owners are allowed to
rent out their home in which they live in for more than 120 days a year with approval. Rent
price cannot be more than 20% above the median rent price.
In Berlin, landlords who rent out homes without approval may facing penalty up to $113,000.
Rental room cover should less than 50% of the entire floor space. However, in Hamburg, it
is absolutely free and legal to rent.
In Singapore, Housing and Development Board do not allowed short-term rental for tourists.
