AnOrdinancetoregulatetheimport,manufacture,formulation,sale,distributionanduseof
pesticides.
WHEREASitisexpedienttoregulatetheimport,manufacture,formulation,sale,distributionand
useofpesticidesandformattersancillarythereto
AND WHEREAS the national interest of Pakistan in relation to the achievement of uniformity
requiresCentrallegislationinthematter
NOW, THEREFORE, in pursuance of the Proclamation of the 25th day of March, 1969, read
withtheProvisionalConstitutionOrder,andinexerciseofallpowersenablinghiminthatbehalf,the
PresidentispleasedtomakeandpromulgatethefollowingOrdinance:

(b) "advertise" means to make known by publication or distribution of any advertisement,

underthisOrdinance
(e)"formulation"meanstheprocessbywhichapesticideisconverted,bymixingwithother

(f) "fungi" means all rusts, smuts, mildews, moulds, yeasts, and similar forms of plant life

(g)"GovernmentAnalyst"meansaGovernmentAnalystappointedunderthisOrdinance
(h)"guarantee"meansthestatementindicatingthestrength,effectivenessandotherqualities

(k) "insect" means any of the small invertebrate animals commonly known as insects and
includessuchformsofanimallifeasmaybeprescribed
(l)"label"meansthewritten,printedorgraphicmatteron,orattachedto,apesticideorthe
immediatecontainerthereof,andtheoutsidecontainerorwrapperoftheretailpackage,if
any,ofthepesticide
(m)"package"includeseverycontainer
(n)"pesticide"meansanysubstanceormixtureofsubstancesusedorrepresentedasameans
forpreventing,

destroying, repelling, mitigating or controlling, directly or indirectly, any insect, fungus,
bacterial organism, nematodes, virus, weed, rodent, or other plant or animal pest but
does not include a substance which is a 'drug' within the meaning of the 1[Drug Act,
1976].
(o)"prescribed"meansprescribedbyrulesmadeunderthisOrdinance
(p)"registered"meansregisteredunderthisOrdinance
(q)"registrationnumber"meansaspecificnumberassignedbythe2[FederalGovernment]to

6[4.Pesticidestoberegistered.Nopersonshallimport,manufacture,formulate,sell,offerfor
sale,holdanystockforsaleorinanymanneradvertisedanypesticidewhichhasnotbeenregistered
inthemannerprovidedbythisActortherulesframedthereunder:
ProvidedthattheFederalGovernmentmay,bynotificationintheofficialgazettedirectedthatthe
pesticidespecifiedinthenotificationandnothavingatradenamewillbeimportedonlybyaclassor
classesofimportersasspecifiedexceptapesticidehavingatradenameandregisteredinthecountry
ofmanufacturewhichmaybeimprovedwithoutundergoingtheregistrationprocessbutsubjecttothe
conditionsnotifiedfromtimetotimebytheFederalGovernment.]

5.Applicationforregistrationofpesticide.(1)Anypersonintendingtoimport,manufacture,
formulate,sell,offerforsale,holdinstockforsaleoradvertiseany1***pesticidemayapplytothe
2[FederalGovernment]fortheregistrationofthe 3[pesticide]undersuchnameashemayindicatein
theapplication.
(2)Anapplicationundersubsection(1)shallbeinsuchform,beaccompaniedbysuchfeeand
containsuchstatementsandinformationasmaybeprescribed.
(3)Wherethepersonmakinganapplicationundersubsection(1)isnotdomiciledinPakistan,
theapplicationshall,besidessuchperson,besignedbyhisagentorrepresentativeinPakistan.
(4) Upon the receipt of an application under subsection (1), the 2[Federal Government] may
register1***pesticidebythenameindicatedintheapplication,ifitissatisfiedthat
(a) the 4["name of the pesticide"] is not such as would tend to deceive or mislead the
purchaserwithrespecttotheguaranteerelatingtothepesticideoritsingredientsorthe
methodofitspreparationor
(b)theguaranteerelatingtothepesticideoritsingredientsisnotthesameasthatofanother
registered 3[pesticide] 5[by the same manufacturer] or is not so similar thereto as to be
likelytodeceiveor
(c)itiseffectiveforthepurposeforwhichitissoldorrepresentedtobeeffectiveor
(5) When it registers a 1* * * pesticide on the application of any person, the 2[Federal
Government]shallgranttohimacertificateofregistrationinsuchformasmaybeprescribed.
6.Periodforwhichregistrationshallbeeffective.Theregistrationofa6***pesticideshallbe
effectivefromthedateofitsregistrationuntilthethirtiethdayofJuneofthethirdyearfollowingthe
yearofregistration.

7. Cancellation of registration. If, at any time after the registration of 1* * * a pesticide, the
2[FederalGovernment]isofopinionthattheregistrationhasbeensecuredinviolationofanyofthe
provisionsofthisOrdinanceortherulesorthatthepesticideisineffectiveagainstpestsofhazardous
to vegetation, other than weeds, or to human or animal life, the 2[Federal Government] may, after
giving to the person on whose application it had been registered an opportunity of being heard,
cancelledtheregistration.
(2)Anapplicationundersubsection(1)shallbeinsuchformandbeaccompaniedbysuchfeeas
maybeprescribedandshallbemadebeforetheexpirationoftheperiodforwhichtheregistrationof
5[pesticide]iseffective.
10.Labellingofpackages. 6[(1)]Nopersonshallsellorofferorexposeforsale,oradvertiseor
holdinstockforsaleanypesticideunlesseachpackagecontainingthepesticide,andeverytageor
labeldurablyattachedtheretois 7**markedinprintedcharactersinsuchformandinsuchmanner
asmaybeprescribed.
8[(2) Any dealer wholeseller, retailer or an agent, who has been convicted of not less than
offences under this Ordinance shall be black listed by the importer, manufacturer, distributor or
formulatorofthepesticideinquestion.].
11. Shortage and use of pesticides. No person shall store or use of any pesticide save in
accordancewithrulesmadeunderthisOrdinance.

12.TheAgriculturePesticideTechnicalAdvisoryCommittee.(1)Assoonasmaybeafter
thecommencementofthisOrdinance,the 1[FederalGovernment]shallconstituteacommittee,tobe
called the Agriculture Pesticides Technical Advisory Committee, to advise the 1[Federal
Government]ontechnicalmattersarisingoutoftheadministrationofthisOrdinanceandtoperform
anyotherfunctionsassignedtoitbyorunderthisOrdinance.
(2) The commitee shall consist of a Chairman and such number of ViceChairman and other
members, being officers of the 1[Federal Government] or a Provincial Government or persons
representing trade and industry engaged in pesticide business, as the 1[Federal Government] may
appoint:
Provided that no officer of a Provincial Government and no person representing trade and
industrysoengagedinaProvinceshallbeappointedotherwisethanontherecommendationofthe
GovernmentoftheProvinceconcerned.
(3) The names of the Chairman, the ViceChairman and the other members of the Committee
shallbepublishedintheofficialGazette.
(4) The 1[Federal Government] shall appoint one of the members of the Committee, being an
officerofthatGovernment,tobetheSecretaryoftheCommitteefortheperiodforwhichheissucha
member.
(5) The nonofficial members of the Committee shall hold office for a term of three years and
shallbeeligibleforreappointment.
(6) A member of the Committee may, at any time, resign his office by writing under his hand
addressedtotheChairmanbuttheseatofsuchmembershallnotbedeemedtohavefallenvacant
unlesstheregistrationhasbeenacceptedbytheChairmanwiththepreviousapprovalofthe1[Federal
Government.]
(7)Apersonappointedtofillavacancycreatedbytheregistrationordeathofamembershall
holdofficefortheresiduceofthetermofhispredecessor.
(8) The Functions of the Committee may be exercised notwithstanding any vacancy in the
membershipthereof.

(9) The Committee shall have the power to regulate with the prior approval of the 1[Federal
Government]theprocedurefortheconductofitsbusiness.
(10)TheCommitteemayappointsubcommitteesconsistingofspecialistsfortheconsiderationof
particularmattersforsuchperiods,notexceedingthreeyears,asitmayconsidernecessary.
13.PesticideLaboratory.(1)AssoonasmaybeafterthecommencementofthisOrdinance,
the1[FederalGovernment]shallsetupaPesticidelaboratory2[or,inconsultationwiththeProvincial
Government, declare a Provincial laboratory as Pesticide Laboratory which may be] suitably
equippedtocarryoutthefunctionsentrustedtoitbyorunderthisOrdinance.
(2)TheFunctionsofthePesticideLaboratoryandthemodeofsubmissionofsamplesforanalysis
ortesttotheLaboratoryshallbesuchasmaybeprescribed.
(3) The secrecy of the formulae of 3* * pesticides, samples of which are submitted to the
PesticideLaboratoryforanalysisortest,shallbedulysafeguardedinthemannerprescribed.
14. Government Analyst. The 1[Federal Government] may, by notification in the official
Gazette,appointasmanypersonsasitdeemsfittobeGovernmentAnalystsforpesticidesand,where
it appoints more than one persons to be Government Analysts, shall Specify in the notification the
locallimitswithinwhicheachoneofthemshallperformthefunctionsofGovernmentAnalyst.
15.Inspectors.The 1[FederalGovernment]may,bynotificationintheofficialGazette,appoint
from amongst the officers of the '[Federal Government] or a Provincial Government employed for
workrelatingtoplantprotectionsuchnumberasitdeemsfittobeInspectorswithinsuchlocallimits
asmaybespecifiedinthenotification.
16.PowersofInspectors.An Inspector may, within the local limits for which he is appointed,
enteruponanypremiseswherepesticidesarekeptorstored,whetherincontainersorinbulk,byor
on behalf of the owner, including premises belonging to a bailee, such as a railway, a shipping
company or any other carrier, and may take samples therefrom for examination. No compensation
shallbepayableforareasonablequantitytakenasasample.

17. Procedure of Inspectors.(1) Where an Inspector takes a sample of a pesticide for the
purpose of test or analysis under section 16, he shall intimate such purpose in writing in the
prescribedformtothepersonfromwhosepossessionhetakesitand,inthepresenceofsuchperson
(unless he wilfully absents himself), shall divide the sample into three portions and effectively seal
andsuitablymarkthesameandpermitsuchpersontoaddhisownsealandmarktoalloranyofthe
portionssosealedandmarked
Providedthat,wherethepesticideismadeupincontainersofsmallvolume,insteadofdividinga
sampleasaforesaid,theInspectormay,andifthepesticidebesuchthatitislikelytodeteriorateorbe
otherwise damaged by exposure shall, take three of the said containers after suitably marking the
sameand,wherenecessary,sealingthem.
(2)TheInspectorshallrestoreoneportionofasamplesodividedoronecontainer,asthecase
maybe,tothepersonfromWhomhetakesit,andshallretaintheremainderanddisposeofthesame
asfollows:
(i) he shall forthwith send one portion or container to the Government Analyst for test or
analysisand
(ii)heshallsendthesecondportionorcontainertothe1[FederalGovernment].
(2)TheInspectorshalldeliveronecopyofthereportreceivedbyhimtothepersonfromwhose
possessionthesamplewastakenandshallsendonecopytothe1[FederalGovernment].
(3) Any document purporting to be a report signed by the Government Analyst of an analysis
conducted by him under this Chapter shall be conclusive evidence of the particulars stated therein
unless the person to whom the report has been delivered under subsection (2) disputes the
correctness of the analysis conducted by the Government Analyst and, within thirty days of the
deliveryofthereporttohim,placesbeforethe1[FederalGovernment]evidencewhichinhisopinion
controvertsthecorrectnessofsuchanalysis.
(4)Wheretheevidenceplacedbeforethe1[FederalGovernment]undersubsection(3)issuchas
wouldinitsopinionjustifyafurtherinvestigation,itmaycauseasecondpartofthesamesampleto
beanalysedatthePesticideLaboratory.
(5) After the sample forwarded to it by the 1[Federal Government] has been analysed by the
PesticideLaboratory,theLaboratoryshallrecordtheresultoftheanalysisinacertificateofanalysis
andforwardthecertificatetothe1[FederalGovernment].
(6)AcertificateofanalysispreparedbythePesticideLaboratoryshallbeconclusiveevidenceof
thefactsstatedtherein.

19.Publicationofresultsoftestandanalysis.The1[FederalGovernment]maypublishinsuch
mannerasitmaydeemfittheresultofthetestandanalysisofapesticidemadebyaGovernment
Analyst or the Pesticide Laboratory under section 18 together with such other information relating
theretoifanyasitmayconsidernecessary.
20.Purchaserofpesticidemayhaveittestedoranalysed.(1)Anypersonwhohaspurchased
apesticidemayapplytoaGovernmentAnalysttoconductatestoranalysisofthepesticide.
(2) An application under subsection (1) shall be made in such form and manner and be
accompaniedbysuchfeeasmaybeprescribed.
(3)TheGovernmentAnalysttowhomanapplicationismadeinaccordancewithsubsection(2)
shall conduct the test or analysis and issue to the applicant a report signed by him .of the test or
analysis.

CHAPTERIV
MISCELLANEOUS.
2[21. Offences and Penalties.(1) Any person who imports, manufactures, formulates, sells,
offersorexposesforsale,holdsinstockforsaleoradvertisesforsaleanadulteratedorsubstandard
pesticideshallbeguiltyofanoffence.
(2)Thepersonguiltyofanoffenceundersubsection(1)shallbepunished,
(a)inthecaseofanadulteratedpesticide,inrelationtoafirstoffencewithimprisonmentfor
a term which shall not be less than one year or more than three years and with fine
amounting to five hundred thousand rupees and for every subsequent offence with
imprisonmentforatermwhichshallnotbelessthantwoyearsormorethanthreeyears
andwithfinewhichshallnotbelessthanfivehundredthousandrupeesormorethanone
millionrupeesand
(b)inthecaseofasubstandardpesticide,inrelationtoafirstoffencewithimprisonmentfor
atermwhichshallnotbelessthansixmonthsormorethantwoyearsandwithfinewhich
may extend to five hundred thousand rupees and for every subsequent offence with
imprisonmentwhichmayextendtothreeyearsandwithfinebutshallnotbelessthanthe
punishmentgivenforthefirstoffence.]

1[21A. Punishment for offences not provided for in section 2. Any person who contravenes
any of the provisions of this Ordinance or the rules for the contravention of which no other
punishment is provided in this Ordinance, shall be punishable with fine which may extend to one
hundredthousandrupees].
2[22.Manufacturerswarrantytodealers.Whoevergivesafalsewarrantytoadealerorpur
chaserinrespectofadulteratedorsubstandardpesticideshall,unlessheprovesthatwhenhegave
thewarrantyhehadgoodreasontobelievethesametobetrue,beguiltyofanoffencepunishablein
thesamemannerandtothesameextentasprovidedforundersection21.]
23. Unlawful use of registration number lowering of pesticidal value or hindering the
Inspectorfromperforminghisduty.Anypersonwho
(a)unlawfullyusesanyregistrationnumberassignedorasifithadbeenassignedunderthis
Ordinance,or
(b) wilfully alters the composition of a pesticide by mixing any other substance therewith
afterthesaidpesticidehasbeenplacedonthemarketbythemanufacturer,importeror
vendor,or
(c)wilfullyobstructs,hinders,resists,orinanywayopposesanyInspectorinperforminghis
dutiesunderthisOrdinance,
3[shallbepunishable,
(i)inthecaseofanoffenceunderclause(a)or(b)withimprisonmentforatermwhichshallnot
belessthantwoyearsormorethanthreeyearsandwithfinewhichmayextendtoonemillionrupees
and
(ii)inthecaseofanoffenceunderclause(c)withimprisonmentforatermwhichmayextendto
sixmonthsandwithfinewhichmayextendtoonehundredthousandrupees]:
24. Entry and seizure.(1) If an Inspector has reason to believe that an offence punishable
underthisOrdinanceortherulesmadethereunderhasbeen,isbeingorisabouttobecommittedat
any time or place, he may enter and search such place and seize any pesticide, article or thing to
whichtheoffencerelatesfoundtherein.
(2)Anypesticide,articleorthingseizedundersubsection(1)shallbedisposedofinaccordance
withthedecisionoftheCourtbeforewhichtheoffenderisprosecutedforacontraventionofanyof
theprovisionsofthisOrdinanceortherules.

1[(3) An Inspector may apply to the District Magistrate, Additional District Magistrate, Sub
Divisional Magistrate of the District or SubDivision or Tehsil or Taluka, as the case may be, for
policeassistanceandsuchMagistratemaydirectthatanexecutiveMagistrateshallaccompanythe
Inspectoralongwithapolicepartyforthepurposeofcollectingsampleforexamination.].
25. Power of Court to order forfeiture. If any person is convicted of an offence punishable
under this Ordinance committed by him in respect of any pesticide, article or thing, the Court
convictinghimmayfurtherdirectthatthepesticide,articleorthingshallbeforfeitedtothe2[Federal
Government.]
26.Cognizanceofoffences,etc.(1)NocourtinferiortothatofaMagistrateofthefirstclass
shalltryanoffencepunishableunderthisOrdinance.
(2) Notwithstanding anything contained in section 32 of the Code of Criminal Procedure, 1898
(ActVof1898),itshallbelawfulforanyMagistrateofthefirstclasstopassanysentenceauthorised
bythisOrdinanceevenifsuchsentenceexceedshispowersunderthesaidsection32.
3[26A.Cognizanceandprosecutionofoffences.TheoffencespunishableunderthisOrdinance
shallbecognizableandnonbailablebutapoliceofficershallnotregisterorinvestigateacaserelating

shallberesponsibleforconductingprosecutionofoffencesunderthisOrdinance.]
27. Power to try offences summarily. Any Magistrate of the first class or any bench of
MagistratesinvestedwiththepowersofaMagistrateofthefirstclassempoweredforthetimebeing
to try in a summary way the offences specified in subsection (1) of section 260 of the Code of
Criminal procedure, 1898 (Act V of 1898), may, on application, in this behalf being made by the
prosecution,tryinaccordancewiththeprovisionscontainedinsections262to265ofthatCode,any
offencepunishableundersection21.
28. Indemnity. No suit, prosecution or other legal proceeding shall lie against any person for
anythingwhichisingoodfaithdoneorintendedtobedoneunderthisOrdinanceortherules.
29. Power to make rules.(1) The 2[Federal Government] may, in consultation with the
Agriculture Pesticide Technical Advisory Committee and after previous publication in the official
Gazette,makerules4forcarryingtheprovisionsofthisOrdinanceintoeffect.
(2)Inparticularandwithoutprejudicetothegeneralityoftheforegoingpower,suchrulesmay
provideforalloranyofthefollowingmatters,namely:

(a)thenomenclatureofeveryformofplantandanimallifethatshallbedeemedtobeinsects,
fungiorotherplantoranimalpests
(b) the form in which an application for the registration of a 1* * * pesticide or for the
renewal of registration shall be made, the, information that shall be furnished therewith
andthefeethatshallaccompanyit
(c)theprocedureforthegrantofcertificatesofregistrationof2[pesticidesnothavingatrade
nameorotherwise]andrenewalofsuchregistrationandtheformofsuchcertificates
(d)thelanguageofthetagsorlabeltobeattachedtothecontainersandpackagescontaining
pesticidesandthecharacterandlocationoftheprintingtobemarkedonsuchtags,labels
andcontainers
(e)thefunctionsofthePesticidesLaboratoryandtheprocedurestobefollowedbyitinthe
performanceofsuchfunctions,including
(i)safeguardingofthesecrecyoftheformulaeofany3**pesticidesdisclosedtoit
(ii)collectionofsamplesofpesticidesfortestoranalysisand
(iii)theforminwhichitsreportsoftestsoranalysisshallbewritten
(f)themethodsofanalysistobefollowed,andthelimitsofvariabilitytobeallowed,bythe
Government Analyst as between the information marked on the container or on a label
attached thereto or supplied to the purchaser when sold in bulk, and the results of the
analysis
(g)thequalificationsanddutiesoftheGovernmentAnalysts
(h) the form in which an intimation of the purpose for which a sample is taken by an
Inspectorshallbegivenbyhimtothepersonfromwhosepossessionthesampleistaken,
the instruments to be employed, and the quantities to be taken, by an Inspector while
takingsamplesfortestoranalysisandthemannerinwhichtheyshouldbepreservedand
senttotheGovernmentAnalystandthe4[FederalGovernment]
(i) the form in which an application shall be made by the purchaser of a pesticide to a
GovernmentAnalystfortestoranalysisofthepesticide,themannerinwhichapurchaser
maysendapesticidefortestoranalysistotheGovernmentAnalyst,theinformationthat
shallbefurnishedwithsuchapplicationandthefeethatshallaccompanyit

(j)thepesticidesthataregenerallydetrimentalorinjurioustovegetation,domesticanimalsor
publichealthevenwhenusedaccordingtodirections
(k)thepesticidesthataretobelabelled"Poison"andtheirantidotes
(l)therequirementsforthesafestorageofpesticides
(m)thequantitiesofdifferent 1**pesticideswhichapersonmayholdinstockatanyone
timeandthepremisesinwhich,andtheconditionssubjecttowhich,hemayholdthemin
stock
(n)theprecautionsfortheprotectionofworkersagainstriskofpoisoningbypesticidesarising
fromtheirworking
(i)inconnectionwiththeuseofsuchpesticidesinagricultureor
(ii)onlandonwhichsuchpesticidesarebeingorhavebeenusedinagriculture
(o)therestrictionsorconditionsastothepurposesforwhich,thecircumstancesinwhich,or
themethodsormeansbywhich,apesticidemaybeused
(p)therestrictionsorconditionsinvolvingageneralpreventionorlimitationoftheuseofany
pesticideinagriculture
(q) the provision, and keeping available and in good order, of facilities for washing and
cleaning and of other things needed for protecting persons, clothing, equipment and
appliancesfromcontaminationwithpesticidesorforremovingsourcesofcontamination
therefrom
(r)theobservanceofprecautionsagainstpoisoningbypesticidesincludingtheuseofthings
providedinpursuanceoftherules,andabstentionsfromeating,drinkingandsmokingin
circumstancesinvolvingriskofpoisoningbypesticides
(s)intervalsbetween,orlimitationsof,periodsofexposuretoriskofpoisoningbypesticides
(t)theobservanceofspecialprecautionsinthecaseofpersonswho,byreasonoftheirstate
of health, age, or other circumstances, are subject to particular risk of poisoning by
pesticidesorofinjurytherefrom,orimposing,incaseofpersonssosubject,prohibitions
orrestrictionsonemploymentofworkers
(u)themeasuresfordetectingandinvestigatingcasesinwhichpoisoningbypesticideshas
occurred

(v)theprovisionsofeffectivefacilitiesforpreventionofpoisoningbypesticidesandfirstaid
treatmentand
(w)theprovisionofinstructionandtrainingintheuseofthingsprovidedinpursuanceofthe
rulesandintheobservanceofprecautionsagainstpoisoningbypesticides.
30. Delegation of Powers. The 1[Federal Government] may, by notification in the official
Gazette, direct that all or any of its powers under this Ordinance or the rules shall in such
circumstances,andundersuchconditions,ifany,asmaybespecifiedinthedirection,beexercised

(a)byanyofficerorauthoritysubordinatetothe1[FederalGovernment],or
