This agreement of Sale is made at Rawalpindi on this 20 th day of Jan 2014 BETWEEN
Mrs. TAHIRA SHAHEEN D/o Malik Mehboob Hussain W/o MUHAMMAD NASEEM R/o h.No.534, Sector G-9/3, Islamabad Muslim,
Adult, hereinafter called the Seller party of the ONE PART.
AND
Mr. AMJID ALI MALIK S/o MALIK KHUDA BAKHSH R/o H.No.14, Park View, Jhelum Road, Rawalpindi Cantt, Muslim, Adult,
hereinafter called the Purchaser party of the SECOND PART. (Both expressions shall wherever the context so permits mean and
include their heirs, executors administrators, successors, and assigns
WITNESSETH AS UNDER:-
WHEREAS the aforesaid seller is competent and in possession of a Plot No.313, Measuring 1 Kanal situated at Phase 9, Behria
Town, Islamabad, hereinafter called the said property.
AND WHEREAS the Seller has agreed to sell convey, transfer and assign the said property together with all his rights interests,
estates and entitlements therein to and in favour of the purchaser and the property is free from all encumbrances ,loans
mortgages, claims, debts, charges etc, for a lump sum of Rs.80,00,000/-(Rupees eighty hundred thousand only) on the following
terms and conditions:-
1. That the seller has received a sum of Rs.20,00,000/- (Rupees Twenty hundred thousand only) [Rs.55,000/- (Rupees fifty five
thousand only) as token money and Rs.19,45,000/- as earnest money] from the aforesaid Purchaser as a PART PAYMENT OR
ADVANCE TOWARDS THE ABOVE sale price receipt where of the Seller do hereby fully admits and acknowledges .Balance
amount will be paid by the purchaser to the seller as per following schedule:
a. Rs.8,00,000/- on 24/01/2014.
b. Rs.3,45,000/- on 13/02/2014.
c. Rs.8,00,000/- on 24/03/2014.
in cash if all documents are complete and at the time of peaceful handing over/taking over of the said property in the
concerned transferring office/authority.
2. That the seller covenants with the purchaser that seller is the rightful and exclusive competent/owner of the said property his
title documents are valid and in force and have not become void or avoidable and that the said property is his separate,
exclusive, individual and absolute undisputed property free from all sorts of claims. Liens, charges of whatsoever nature and
that he has good right, full power and lawful authority to sell the same to the aforesaid purchaser. The seller agree to make
good any defect or lacuna in the sellers title or competence.
3. And if due to any circumstances the seller refuses to implement this agreement and fails to hand-over possession on due
date, then he will return double the amount of earnest money received by him, similarly if the purchaser fails to make full
and final payment on due date, then the earnest money paid by him to the seller will be forfeited.
4. That the Seller has not issued /signed any receipt of Token or Biana before signing of this Agreement.
5. That the seller will make himself available and signed all document, which he is called upon to sign, execute and confirm by
the Army Welfare Trust or the purchaser in connection with the transfer of the said plot in favour of the purchaser.
6. That both seller and purchaser hereby undertake to abide by terms and conditions of this agreement of sale.
INWITNESS WHEREOF the parties hereto have hereunto set and subscribed their respective hands at Rawalpindi, the day month
and the year first above mentioned.
AND
Whereas the Second Party, who is the owner of Shop No.57, Middle
Floor Moti Plaza, Murree Road, Rawalpindi do hereby agree to
hire her above said shop to the above said tenant/lessee on the
following
5. That Second part will serve 1 month prior notice to First Part
likewise First Part will serve 1 month prior notice to Second
Part if he vacates the rented House.
6. The tenant will be responsible for the payment of all utility
bills i.e. electricity, telephone, gas etc. during the tenure of
this deed.
