4. You may also be sent on deputation to any other organisation under the same management or
under different management any where in the country.

4a. You will keep us informed of any change in your residential address.

5. On Expiry of period of temporary employment your services will automatically come to our end.

5a. During the tenure of temporary employment, your services are liable to be terminated without any
notice if found unsuitable for the job.

6. On termination of your employment you will immediately hand over any property or article or
document entrusted to you by the Company to enable the company to settle your accounts and the
company reserves its right to deduct from the dues payable to you for any loss or damage caused
to the companys property on account of any act or negligence on your part, in addition to any
other methods of recovery.

7. You are not entitled for claiming absorption against regular vacancy.

8. During the tenure of your service, you will not, without our consent, allow yourself to be
employed by any one or carry on any business or trade.
9. You will be bound by the Standing Orders / Rules or Regulation of the company.

your employment.
(8) The management has right to depute you to any other unit/establishment of the company or rotate
you among various jobs as required by the administrative exigencies.

(9) As a part-time employee, you are not entitled to the status of a workman within the meaning of
the Industrial Disputes Act, 1947.

(10) As a part-time employee, you are not entitled to any rights benefits, or privileges like bonus or any
other allowances etc. admissible to whole-time employees of the establishment.

(11) The Management reserves its right to terminate your services at any time without assigning any
reasons thereof at (indicate the paid of notice) notice or wages in lieu thereof.

(12) That your employment in the establishment shall be at the sole discretion of the management.

Covenant assignment, job or any other kind of vocation or business, part-time or full time,
non disclosure without written permission of the management. Membership of Local/public
bodies without management permission.
9. Scope of On successful completion of training and on obtaining Certificate of Training you
Employment may apply for employment in the Company provided there exists a vacancy. The
above training will neither create any right of employment or right of preference
in the Company.

4. Supervision and : While on deputation, although you will be working at the

supervision and control of our company for the purpose of your
transfer, promotion, revision in service conditions, overall performance
of your work and termination from service etc. and the same will be
decided by our company. However you will receive instructions for
day to day performance of your duties from companys client and you
will abide by such instructions given by them.
5 Responsibilities 5.1 While rendering __________ services, you must effectively, diligently
and to the best of your ability perform all responsibilities implicit in the
_________ job and you will ensure results. You will be expected to
work extra hours to achieve the results whenever the job so requires.

5.2 You will be required to engage yourself exclusively in the work


assigned by our client while you are on deputation and you will not
take up any independent or individual assignment (whether same is
part time or full time, in an advisory capacity or otherwise) directly or
indirectly without the express written consent from our company.

5.3 You will ensure that you will not directly or indirectly engage in any
activity or have any interest in or perform any service for any person
who is involved in activities which are or shall be in conflict with the
interest of our company or interest of our client where you are deputed.
6. Compensation : While in employment of our company, you will be eligible to receive
the following:
(a) Consolidated salary of Rs. _____per month.

7. Confidentiality : The nature of your job demands highest level of honesty, integrity,
secrecy and confidentiality and you will maintain the same and you
will not use or divulge or disclose any such confidential information

client in the course of your deputation. This covenant shall endure
during your employment and for a period of one year from the
cessation of your employment on deputation (irrespective of the
circumstances or the reasons for the cessation)
8. General 8.1 We trust that you have not provided us with any false declaration or
willfully suppressed any material information. If you have, you will be
liable for removal from services without notice.
8.2 Please note that you are required to inform us if there are any
agreement oral or written which you have entered into and which relate
to your commitment under this agreement.
8.3 While in employment if you indulge in any act of misconduct, you may
be suspended pending enquiry without salary and the matter will be
dealt with as per the relevant standing orders/ Rules/Regulations.
8.4 If during the tenure of your employment, while on deputation or
otherwise, if no work is available for any reason whatsoever you may
be laid off without any salary or compensation.
8.5 During the tenure you may be sent on deputation to any other client of
the company located anywhere in India.
8.6 You will not be entitled to any salary if you refuse to do any work
assigned to you or refuse to join duty when sent on deputation. You
shall also work on shifts if so required.
9. Separation : Notwithstanding what is stated hereinabove, if during the period of
deputation, your services are not found satisfactory, the same may be
terminated with 24 hours notice and without any extra compensation.
Similarly you will be at liberty to resign from services by giving 24
hours notice.
10. Handing Over of : On cessation of your employment at the clients establishment, you
charge will hand over charge to the client truthfully and sincerely and return
all the documents or properties of client in your possession. In
discharge of the above obligation, you will obtain a No-objection
certificate from the client company. On receipt of the above No-
objection certificate, your full and final dues will be settled.

VI) Unskilled contract worker

3. You will abide by the shift timings and other regulatory procedure in force at clients Establishment
where you will be posted including operating and safety procedures applicable to such
Establishments.

4. Since our Company is undertaking jobs in various Establishments on contract, your services can
be transferred from one Establishment to other anywhere in the Country, where our Company has
the contract or may have the contract in future.

5. Subject to clause No. 6 herein below, your appointment is only for a period of _____ months and
on the expiry of ____ months, it will automatically come to an end without any notice unless
renewed in writing.

6. Notwithstanding anything contained in the above terms, your services can also be terminated
without any notice or compensation in lieu of notice in the following contingencies:

b) On your being found medically unfit or suffering from continuous ill-health.

You can resign by giving one month notice or the company will have the right to deduct one

8. While on duty you will not indulge in any act adversely affecting our rendering of services to our
client or by any other acts of misconduct.

9. You will not seek employment in our Principals Establishment in which you are deputed.

Dear Sir,

Your appointment has been made for a period of ______ months from the date of joining, purely on
probation and the probationary period may be extended from time to time at the discretion of the company.
If found necessary probationary period may be extended at the discretion of the Management or may be
dispensed with earlier either during the probation or the extended period of probation. Unless confirmed in
writing, you will be deemed as a probationer after the expiry of the probationary period or the extended

1. You are aware that the Company is taking contract at different places and you can be deputed to

certain jobs whether it is in town/out of town, whether in city/outside to city and/or any where in
India and hence your services will be at the assigned place for stipulated period and thereafter if
there is any requirement, you can be assigned job with new firm/company/factory and in event
when there is no work, your services are not required. In other words, you will be assigned work
for stipulated period only.

2. You will act within the frame-work of organisational structure and policies and directions as may
be laid down by the management from time to time. During your tenure of employment, you will
be governed by the Standing Orders / Rules or Regulations of the company.

3. You will be awhole time employee and will not undertake any other business, work or public
office on payment or otherwise except with the written permission of the Management.

4. The management may transfer you for work in any section/department assigned from time to time
with different establishment/companies where it has undertaken contract work in any part of India
as it may consider necessary in its discretion from time to time.

5. In the event of any misconduct committed by you, you are liable to be suspended from service
without pay pending inquiry into any charges of misconduct against you till the final decision in
the matter.

6. Your continuance in service of the management is subject to your remaining physically and
mentally fit. As and when required by the management, you will submit yourself to medical
examination by a physician of the choice of the management.
7. Your appointment is terminable either by the management or by yourself without assignment of
any reason on either side, after giving one months notice or of one month salary in lieu thereof.

8. In case there will be any change in your address, you will intimate us in writing within three days
from the date of such change.

9. Your absence for a continuous period of 8 days (including absence when leave though applied for
but not granted) or over-stay for a period of 8 days would make you to lose your lien on the job
and your services shall automatically come to an end without any notice or intimation from the
managements side.

10. Grant of earned leave will depend upon the exigencies of work and shall be at the discretion of the
management. For availing leave, you will have to apply in the prescribed form to the appropriate
authority and seek prior approval for such leave. Similarly, for extension of leave, an application
will have to be made in writing before the expiry of the leave originally sanctioned. While making
such application you will state your address during the leave period. Mere submission of
application will not mean that the leave has been sanctioned.

11. Sick leave exceeding two days shall be granted only for certified sickness. Application for grant to
sick leave must, therefore, be accompanied by a medical certificate acceptable to the management.
If no medical certificate is submitted, leave application will not normally be considered for
adjustment against sick leave. Proper leave application must be submitted immediately upon
falling sick together with the medical certificate. Late submission of application may be liable to
be marked absent. On returning from sick leave, if not found medically fit, you will not be allowed
to resume duty until completely recovered from sickness and on production of a certificate of
fitness from the medical practitioner acceptable to the management.

Note : Please note that in case the contract worker is employed in a factory he is governed by
leave provisions of Factories Act and in case of establishment within a meaning of Shops and
Establishments Act he is governed by the leave provision of the respective Shops Act.

12. You will be bound by any rules and regulations enforced by the management from time to time
in relation to conduct, discipline, medical leave and holidays on any matters relating to service
conditions which will be deemed as rules, regulations and order in the part of these terms of
employment.

13. That the continuation of your service is subject to your being found medically (physically and
mentally) fit.

14. You are liable to retire on your attaining the age of ____ years or earlier if found medically unfit.

15. In matters not herein specified, you will be governed by such rules of the management as are in
force from time to time.

16. You will be governed by Labour Laws applicable to our Company and will be covered under
E.P.F. applicable to our Company.

Termination : During the period of probation, the management can terminate your service without
notice and without assigning any reason and subsequent to your confirmation, if the
circumstances so warrant, your services can be terminated with one month notice or
one month wages in lieu thereof further, in the event of any information, furnished

confidential information and shall not disclose or divulge the confidential information to any
person or persons except in the proper course of his/her duties. You further undertake that after

(4) You are aware that your obligation relating to confidentiality survives the termination of your
employment you will be liable to pay damages and be subject to injunctive or other relief for any

(5) Intellectual Property Rights (IPRS) such as copyrights, patents trade marks, secrets etc. with
respect to any invention, design, including solutions you may develop while in employment of the
company shall remain the exclusive ownership of the company and you shall have no right, title or

financial, places, customers list, making data and other related information strictly confidential.

Dear Sir,

With reference to your application for the post of _____________, as advertised by us and your subsequent
interview by the H.R. department, we are pleased to inform you that you have been selected to the above
post. Your appointment will be as per the terms of the appointment letter and the Standing Orders, Rules
and Regulations applicable to you.

You are required to join your duties on __________ at our office at _________ and produce copies of the
following documents along with the originals for verification, for personnel records:

1. Birth Certificate/School Leaving Certificate for proof of age.


2. Certificates in support of Educational Qualification.
3. Certificates of Work Experience.
4. Document showing last drawn pay
5. N.O.C. from last employer.

This letter does not constitute your appointment and the regular letter of appointment will be issued to you
after joining. Your appointment will be effected on your formal acceptance of the terms of appointment
offered to you and completion of prescribed formalities.

You are required to sign the duplicate copy of this Letter of Intent and return it to us by way of
acknowledgement and acceptance of its terms.

Sub : Terms and Conditions of appointment

Dear Sir,

Please refer to your application dated ..................... and the subsequent interview/test which you had with
us on ............... in connection with your appointment as Personal Secretary-cum-stenographer in this
Company. In this connection, we have the pleasure to offer you the post of Personal Secretary-cum-
Stenographer on the following terms and conditions :-

1. That initially you shall be on probation for a period of............... months from the date of your
joining and the said period of probation is liable to be extended by another............months or more
purely at the discretion of the management.

2. That during or at the expiry of the said period of probation or the extended period of probation, the
management shall have the right to terminate your services without any notice or without
assigning any reasons.

3. That you shall continue on probation till your services are confirmed in writing by the
management.

4. That on confirmation, management has the prerogative to terminate your services by giving shall
be liable to be terminated on one months notice or salary in lieu therefor except on the
disciplinary grounds in which case no such notice or payment in lieu thereof shall be necessary.

5. That in your appointment if you shall absent yourself without prior express permission of the
management; and/or shall proceed on leave without prior sanction or permission in writing of the
management and/or over-stay the sanctioned leave, your services shall be liable to be terminated
purely at the discretion of the management. No sick leave will be sanctioned unless you produce
medical certificate.

6. That your appointment and continuance in employment of the company is also subject to your
being found medically fit and the management shall have the right to get you re-examined from
any doctor as it thinks fit and proper at any time during the course of your employment in this
company.

7. That you shall be the whole-time employee of the company and shall not engage yourself in any
work similar in nature to that of the company; and/or engage yourself anywhere in any work
profession or employment either honorary or otherwise during the period of your employment
with the company.

8. That as Personal Secretary-cum-Stenographer of the company, you shall keep high standard of
efficiency, integrity and secrecy.

9. That in your capacity as Secretary-cum-Stenographer you will take down dictation in stenography,
to transcribe, type letters, memorandum, reports etc.; to receive, open, sort, distribute letters and
other incoming mail; to maintain files of letters, reports, catalogues and other documents; to attend
to telephone calls and take message; to receive visitors; to arrange hotel accommodation and/or
travel reservations for the visitors, to maintain visitors diaries; to compose and type routine
letters, to take follow up action; and/or to issue reminders: to compile routine departmental
reports; to keep the typewriter in a neat and clean condition; to do any other duties which are
ancillary and incidental thereto; and also to perform the duty or duties which are specifically
entrusted or assigned to you from time to time by the management.

10. That you shall not divulge and/or disclose any secret or know-how of the business of the company
during or after leaving service of the company.

11. That you shall at all times, abide and/or be governed by the rules and regulations formed from
time to time by the company and/or instructions issued in this behalf by your superiors from time
to time.

12. That in case of any change of address while in service of the company, it shall be your duty to
intimate the same in writing to it within three days from the date of such change and shall also get
the change so effected/recorded in the Register of Addresses maintained for the purpose by the
company.

13. That all communications sent to you by the company at your last given address shall be deemed to
have been delivered to you at the correct address.

14. That you shall receive any communication whenever one is offered or delivered to you personally
or otherwise and shall sign the duplicate or the peon book in token of its having been received by
you.

15. That in case any act or omission constituting misconduct is alleged against you, you shall be
placed under suspension pending enquiry and you shall not be entitled to any salary during the
period of such suspension.

16. That your services shall be liable to be transferred from one place to another; and/or from one
department to another; and/or from one post to another purely at the discretion of the company;
and/or due to exigencies of work.

17. That you shall be retired on attaining the age of __ years and/or when you become medically unfit;
and/or to be unfit to perform the job efficiently whichever is earlier.

18. That the grant of annual increments shall depend upon your performance, efficiency, discipline
and financial position of the company.

In case, the terms and conditions mentioned above are acceptable to you, then please affix your
signatures on the attached duplicate of this letter in token of your having accepted the same as
binding on you and join duty within a week from the receipt of this letter, failing which it shall be
presumed that you are not interested in the appointment/offer and it shall be treated as cancelled.

Dear Sir,

With reference to your application dated ____________ for the post of ________ and the subsequent
interview by _____________, we are pleased to appoint you on the post of ________.

A. Probationer

Your appointment has been made for a period of months from the date of joining,
purely on probation and the probationary period may be extended from time to time at the
discretion of the company. If found necessary probationary period may be extended at the
discretion of the Management or may be dispensed with earlier either during the probation or the
extended period of probation. Unless confirmed in writing, you will be deemed as probationer
after the expiry of the probationary period or the extended period of probation. Your services will
therefore be liable to be terminated without notice or specifying any reasons. No notice of
termination will be necessary on the expiry of the original or extended probationary period.

During the probationary period, you will be paid a consolidated salary of Rs per month
during the tenure of your service and you will be placed in the proper grade after you are
confirmed in writing.

B. Temporary

With reference to your application dated ____________ for the post of ________ and the
subsequent interview by _____________, we are pleased to appoint you on the post of ________.
Your appointment is purely for a temporary period of ___________months. After the completion
of temporary period, this period can be extended in writing and /or your services can be terminated
any time during the temporary period or extended period without assigning any reason or giving
any notice thereof.

You will be paid a consolidated salary of Rs._______ per month.

C. Casual

With reference to your application dated ____________ for the post of ________ and the
subsequent interview by _____________, we are pleased to appoint you as a Casual Worker for a
period of ___________. You will be paid a salary of Rs._______ per month during this period
and after the expiry of said period your services will automatically stand terminated.

D. Fixed Period

With reference to your application dated ____________ for the post of ________ and the
subsequent interview by _____________, we are pleased to appoint you on the post of
____________. Your appointment will be for a fixed period of ___________ and thereafter your
services will automatically stand terminated. You will be paid a salary of Rs._______ per month
during this period.

(Note : This appointment will be in accordance with the provisions of Section 2(oo) and 2(bb) of
Industrial Disputes Act, 1047)

1. You will be paid salary as per grade applicable to you and increment will be granted on
your satisfactory and loyal discharge of duties at the place you have been assigned the
work and the same can be withheld in case the standard of work and/or your conduct is
found substandard and accelerated if the same is found commendable at the sole
discretion of the management.
2. You are aware that the Company is taking contract at different places and you can be
deputed in any of the establishment where the Company has taken the contract doing
certain jobs whether it is in town/out of town, whether in city/out city and/or any where
in India.

(Note : Wages/salary is payable to the employee of contractor as per Minimum Wages


applicable to the Contractors establishment and / or wages as per any statute which is
applicable to particular state but the employees of the contractor is not entitled to wages.

accordance with the Judgement of Indian Labour Organisation & Ors v. D.H.
Deshmukh, Presiding Officer, VI Labour Court Bombay reported in 1996 II CLR P.630

3. You will act within the frame-work of organisational structure and policies and directions
as may be laid down by the management from time to time.

4. You will be whole time employee and will not undertake any other business, work or
public office on payment or otherwise except with the written permission of the
Management.

5. The management may transfer you for work in any section/department assigned from
time to time with different establishment/companies where it has undertaken contract
worker in any part of India as it may consider necessary in its discretion from time to
time.

6. Your services will automatically be terminated on your attaining the age of


superannuation as per management rules in force from time to time.

7. You are liable to be suspended from service without pay, pending inquiry for charges of
misconduct against you, till the final decision in the matter.

8. Your continuance in service of the management is subject to your remaining physically


and mentally fit. As and when required by the management, you will submit yourself to
medical examination by a physician of the choice of the management.

9. Your appointment is terminable either by the management or by yourself without


assigning any reason on either side, after giving one months notice or payment in lieu
thereof.

10. In case there will be any change in your address, you will intimate us in writing within
three days from the date of such change.

11. Your absence for a continuous period of 8 days (including absence when leave though
applied for but not granted) or over-stay for a period of 8 days would make you to lose
your lien on the job and your services shall automatically come to an end without any
notice or intimation from the side of the management.

12. Grant of earned leave will depend upon the exigencies of work and shall be at the
discretion of the management. For availing leave, you will have to apply in the
prescribed form to the appropriate authority and seek prior approval for such leave.
Similarly, for extension of leave, an application will have to be made in writing before
the expiry of the leave originally sanctioned. While making such application you will
state your address during the leave period. Mere submission of application will not mean
that the leave has been sanctioned.
13. Sick leave exceeding two days shall be granted only for certified sickness. Application
for grant to sick leave must, therefore, be accompanied by a medical certificate
acceptable to the management. If no medical certificate is submitted, leave application
will not normally be considered for adjustment against sick leave. Proper leave
application must be submitted immediately upon falling sick together with the medical
certificate. Late submission of application may be liable to be marked absent. On
returning from sick leave, if not found medically fit, you will not be allowed to resume
duty until completely recovered from sickness and on production of a certificate of
fitness from the medical practitioner acceptable to the management.

14. You will be bound by any rules & regulations enforced by the management from time to
time in relation to conduct, discipline, medical leave and holidays on any matters relating
to service conditions or Model Standing Order or Certified Standing Order etc which will
be deemed as rules, regulations and order in the part of these terms of employment.

15. Annual increment will be based on performance of duty, if found satisfactory during the
past year of service in terms of efficiency, regularity, punctuality and discipline and the
same may be withheld if the performance is found unsatisfactory or accelerated in case of
exceptionally good performance.

(Note: This clause is discretionary)

16. You are liable to retire on your attaining the age of 58 years or earlier, if a found
medically unfit.

17. In matters not herein specified, you will be governed by such rules of the management as
are in force from time to time.

18. You will be governed by Labour Laws applicable to our Company and will be covered
under E.P.F., ESIS applicable to our Company.

This letter is being sent to you in triplicate. Please return two copies of the same, duly signed, in
token of your acceptance of the above terms and conditions for our records.
