Chapter 1

The Problem and Its Setting

INTRODUCTION

According to Purisima (2013), the government shall pursue an intensive and unrelenting

campaign against the trafficking and use of dangerous drug and other similar substances through

an integrated system of planning, implementation and enforcement of anti-drug abuse policies,

programs and projects. The government shall however aim to achieve a balance in the national

drug control program so that people with legitimate medical needs are not prevented from being

treated with inadequate amounts off appropriate medications, which include the use of dangerous

drugs.

Indeed, in every prosecution for illegal sale of prohibited drugs, the presentation in

evidence of the seized drug, as an integral part is most material. Thus, it is vital that the identity

of the prohibited drug be proved with moral certainty. The fact that the substance bought or

seized is the same item offered in court as exhibit must also be established with the same degree

of certitude. It is in this respect that the chain of custody requirement performs its function. It

ensures that unnecessary doubts concerning the identity of the evidence removed.

In cases involving violations of Dangerous Drug Act, credence should be given to the

narration of the incident by the prosecution witnesses especially when they are police officers

who are presumed to have to have performed their duties in a regular manner, unless there is

evidence to the contrary. Moreover, in the absence of proof of motive to falsely impute such as

serious crime against the appellant, the presumption of regularity in the performance of official

duty, as well as the findings of the trial court on the credibility of witnesses, shall prevail over

appellants self-serving and uncorroborated denial. This is why the researcher would propose to

make this research study on the Degree of Implementation of the Counter Measures on Drug-

Related Cases by the Police Personnel of Maria Aurora, Aurora.

STATEMENT OF THE PROBLEM

This study aims to know the Degree of Implementation of the Counter measures on Drug-

related cases by the Police Personnel in Dipaculao, Aurora.

More specifically, it tries to answer the following questions:

1. What is the profile of the respondents in terms of their age, gender, civil status and

educational attainment?

2. What is the degree of Implementation of the Counter measures on Drug-related cases by

the Police Personnel in Dipaculao, Aurora?

3. What are the problems encountered by police personnel in Dipaculao in reinforcing the

provisions of Republic Act 9165?

SIGNIFICANCE OF THE STUDY

Findings of this study might be used significant insights of and information regarding the

Effectiveness of Republic Act 9165 (Comprehensive Drug Act of 2002) in Dipaculao.

The result of the study might be motivated by parents for responsible parenting and to

develop their children to become responsible citizen in our country.

Policemen might be utilized the findings to organize training for barangay officials and

schools for better, meaningful and effective implementation to different laws and order mostly

about drugs.

The youth stood benefit most from this study to be familiar and to become aware of the

different laws to have a peaceful community since they are most prone in drug.

SCOPE AND DELIMITATION

This study was only limited to the Degree of Implementation of the Counter measures on

Drug-related cases by the Police Personnel in Dipaculao, Aurora. This study also contained

activities of policemen prior to Republic Act 9165 and the problems they encountered. A sample

of thirty (30) selected policemen will be the respondents.

THEORETICAL FRAMEWORK

Republic Act 9165 otherwise known as An Act Instituting the Comprehensive Dangerous

Drug Act of 2002, repealing Republic Act 6425, known as the Dangerous Drug Act of 1972, as

amended by, providing funds there for, and for other purposes. Be it enacted by the Senate and

House of Representatives of the Philippines in Congress.

It is the policy of the State to safeguard the integrity of its territory and the well-being of

its citizenry particularly the youth, from the harmful effects of dangerous drugs on their physical

and mental well-being, and to defend the same against acts or omissions detrimental to their

developmental and preservation. In view of the forgoing, the State needs t enhance further the

efficacy of the law against Dangerous Drugs, it being one of todays more serious social ills.

It further declared the policy of the State to provide effective mechanisms or measures to

re-integrate into society individuals who have fallen victims to drug abuse of dangerous drug

dependence through sustainable programs of treatment and rehabilitation.

DEFINITION OF TERMS

Countermeasure- something that is done in reaction to and as a defense against a hostile action

by somebody

Drugs- substance given to treat or prevent illness

Illegal drugs- are addictive substance that causes changes in the behavior and perception and is

taken for effects.

Drug abuse- is an illegal or excessive drug use.

Reinforce- to make something stronger by providing additional external support or internal

stiffening for it.

Implementation- something needed in order to achieve something.

Police personnel- refers to persons whose job is to maintain peace and order.

Chain of custody- refers to the requirement under the law that should be followed regarding the

movement of the seized illegal drugs from seizure to presentation in court and then destruction.

Raid- a sudden attack made by soldiers, aircraft, police, bandits, or any other force in an attempt

to seize or destroy something

Seizure- to take official or legal possession of something, often something held illegally such as

arms, drugs, or stolen goods.

Drug testing- a series of questions, problems, or practical tasks to gauge somebody's knowledge,

ability, or experience related to drugs

Drug dependence- a physical or psychological need to use a drug or other substance regularly,

despite the fact that it is likely to have a damaging effect

Review of Related Literatures and Studies

FOREIGN LITERATURE

According to Santillises (2011), drug addiction,, also called substance dependence or

chemical dependency, is a disease that is characterized by a destructive pattern of drug abuse that

leads significant problems involving tolerance to or withdrawal from substance, as well as other

problems that use of the substance can cause for the sufferer, either socially or in terms of their

work or school performance. More than 2.6% of people suffer from drug addiction at some time

in their life.

The term dual diagnosis refers to the presence of both a drug-abuse or dependence issue

in addition to a serious mental-health problem in an individual. Substance abuse or dependence

unfortunately occurs quite commonly in people who also have severe mental illness. This is

important given that people with a serious mental illness are far more at risk of engaging in

violence, being incarcerated or contracting infection with the human immunodeficiency virus

(HIV). Individuals with dual diagnosis are also at risk of being non-compliant with treatment.

FOREIGN STUDIES

According to Paulsen (2011), psychological associations with substance abuse or

addiction include mood disorders like depression, anxiety or bipolar as well as personality

disorders like anti-social personality disorder. Social risk factors for drug abuse and addiction

include male gender, being between 18 and 44 years of age, Native-American heritage,

unmarried marital status, and lower socio-economic status. According to statistics by state people

residing in the West tend to be at higher risk for chemical abuse or dependency. While male men

are more at risk for developing chemical dependencies like alcoholism, women seem to be more

vulnerable to becoming addicted to alcohol at much lower amounts of alcohol consumption.

LOCAL LITERATURE

The Department of Justice (DOJ) is studying the possibility amending Republic Act No.

9165, otherwise known as the Comprehensive Drugs Act of 2002, following the acquittal of

two of the three members of the so-called Alabang Boys.

PDEA arrested the two as well as another Alabang boy Joseph Tecson in 2008. Brodett

was arrested in Ayala, Alabang subdivision in Muntinlupa City along with Joseph. Tecson was

arrested in a separate operation in Araneta Center in Quezon City. There were charged with

violation of R.A. 9165.

They become controversial after the DOJ dismissed the case against them due to lapses

committed by PDEA in conducting the raid. PDEA accused the DOJ prosecutors of accepting

bribery prompting the Office of the President (OP) to do its own review of the case and

eventually file a case against the Alabang Boys in court.

LOCAL STUDIES

DOJ Secretary Leila De Lima said that the DOJs Task Force on Anti-Drug, chained by

DOJ Secretary Francisco Baraan III, was already studying the provisions of Republic Act 9165

and determine the possible amendments.

If you will read the courts decision, it zeroed on the violated chain of custody of the

drug evidence. Our law enforcers here have difficulty following it. I think it should be relaxed a

little perhaps do away with some of te requirements like the presence of the media and two

elected public officials during the inventory immediately after the seizure. De Lima told the

reporters.

What if the seizure was made in a remote area? We have to wait for these people before

an inventory can be conducted, which is why we will propose that at least two disinterested

members be allowed to witness the inventory immediately after seizure of the illegal drugs, De

Lima said.

De Lima noted that the requirement under the law is impractical.

The chain of custody refers to the requirement under the law that should be followed

regarding the movement of the seized illegal drugs from seizure to presentation in court and then

destruction.

De Lima said that they were particularly looking at the provision on the chain of

custody, which caused the Muntinlupa City Regional Trial Court (RTC) to acquit Richard

Brodett and Jorge Joseph.

Under R.A. 9165, after taking the initial custody of the seized drugs, the authorities are

required to conduct an inventory in the presence of the accused, his/her counsel or representative

of the accused, member of the media, DOJ and an elected public official.

Brodett and Joseph, two of the so-called Alabang Boys, were acquitted on Friday by

Muntinlupa City RTC branch 208 Judge Juanita Guerrero due to violation of chain of custody

of the evidence committed by arresting agents of the Philippine Drug Enforcement Agency

(PDEA).

Chapter 3

Methods, Procedures and Source of Data

METHOD OF RESEARCH

The researcher utilized the normative descriptive type of research design for this specific

study entitled Degree of Implementation of the Counter Measures on Drug-Related Cases by the

Police Personnel in Dipaculao, Aurora. This method enabled the researcher to gather data,

interpreted and further analyzed the result using the verbal interpretation as prescribed in this

study.

RESPONDENTS OF THE STUDY

The respondent for this study was thirty (30) policemen assigned in police station of

Dipaculao. The availability of policemen in their duty was helpful to the researcher as he

conducted the survey.

INSTRUMENT USED

The questionnaire has three parts first part was profile of the respondents. The second

part was about the activities off the policemen prior to Republic Act 9165. The third part was the

problems encountered by PNP personnel in complying with the comprehensive drug act.

DATA GATHERING TECHNIQUES

The researcher prepared the sample questionnaire together with the request letter for the

chief of police. The adviser approved the request letter for the formal conduct of survey. The

researcher personally distributed the questionnaire to the available policemen until the

respondent amounts to thirty total respondents. The result tabulated.

STATISTICAL TREATMENT

When the questionnaire had been personally distributed, data were collected, analyzed

using the average weighted mean (AWM) as the statistical tool, each heading were (Always,

Sometimes, Never and Often)

The weights were multiplied by the frequency of response on every item under the four

options. The products obtained the frequency taken and derived to the total number of

respondents to obtain each average weighted mean using the researchers formula.

To find the percentage of every item in the frequency of the response in each option was

taken and divided to the total number of the respondents and the quotient then multiplied to 100

constant numbers. The rank was obtained based on the average weighed mean gained from each

item.

Chapter 4

Presentation, Analysis, and Interpretation

This chapter presents the data gathered for the study was carefully analyzed and

interpreted. These were presented in table to provide a clear view of facts. And also aid the

researcher in a systematic presentation and discussion of the different respondent of the PNP

Personnel of Dipaculao according to their experience and observation.

Table 1, This shows the age distribution of the respondents wherein it reveals that 10 or

3% were belong to the age of 21-30, 13 or 43.3% were belong to the ages 31-40, 12 or 40% were

belong to the age of 41-50, 2 or 6.7% were belong to the age of 51-56. The sex distribution of the

respondents shows that most of them are male with 19 or 63.3% of frequency and percentage

while 11 or 36.7% were female. While the civil status distribution of the respondents was 4 or

13.3 % were belong to the single and 23 or 86.7 % were belong to married of civil status bracket.

The Educational attainment distribution of the respondents showed that the majority were college

graduate.

Findings

The findings implied that the majority for the age distribution of students were those 31-

40 years of age bracket. The majority for the sex distribution were those male of gender bracket.

The majority for the civil status distribution was those married of civil status bracket. And the

majority for the educational attainment distribution was all College graduate.

CHAPTER 5

Summary, Conclusion and Recommendation

This chapter presents the summary, findings, conclusion and recommendation of this

study

SUMMARY

This study aims to know the Degree of Implementation of the Counter measures on Drug-

related cases by the Police Personnel in Dipaculao, Aurora.

More specifically, it tries to answer the following questions:

1. What is the profile of the respondents in terms of their age, gender, civil status and

educational attainment?

2. What is the degree of Implementation of the Counter measures on Drug-related cases by

the Police Personnel in Dipaculao, Aurora?

3. What are the problems encountered by police personnel in Dipaculao in reinforcing the

provisions of Republic Act 9165?

This would be beneficial to the school especially for those students taking up Bachelor of

Science in Criminology. The result of this study may share and contribute to their knowledge and

give information related to their course, and help and to give concern in the awareness of PNP to

the R.A. 9165 (Comprehensive Drug Act of 2002). This study was limited only on the Degree of

Implementation of the Counter measures on Drug-related cases by the Police Personnel in

Dipaculao, Aurora.

This was limited to thirty (30) selected respondents in the DipaculaoPolice Station. The

descriptive normative survey method was applied in this research. This method enabled the

researcher to gather data, interpreted and further analyzed the result using the verbal

interpretation as prescribed in this study. In order to analyze and have a clear understanding

about the gathered data, the weighted mean and percentage were computed using the frequency

distribution; the researcher was aided by the following formulas:

FINDINGS

The following were found out in this study:

1. The findings implied that the majority for the age distribution of students were those

31-40 years of age bracket. The majority for the sex distribution were those male of

gender bracket. The majority for the civil status distribution was those married of

civil status bracket. And the majority for the educational attainment distribution was

all College graduate.

2. Among the PNP personnel perception of the PNP Personnel, responses believed that

be always implemented by the PNP personnel in Dipaculao, Aurora. They also

perceive that Random drug testing to tertiary student was implemented for quite

sometimes.

3. PNP personnel in Dipaculao, Aurora also believed that The family did not intervene

to the problems in drugs was found always a problem by PNP personnel in

reinforcing the provisions of R.A 9165. They also perceived that, The authorized

Drug Testing Center was far from the locality", "Schools did not participate in Drug

testing, The family itself sustained drug addiction among family members" was

said to be that it was their problem sometimes. There were no accredited Drug

Testing/Physician in the locality, Funds for the task force was not competed and

CONCLUSIONS

The following were concluded in this study:

2. The degree of Implementation of the Counter measures on Drug-related cases. It revealed

that Creation of task force performing drug law enforcement and prevention of

functions was the implemented counter measure on Drug-related cases with average

weighted mean of 3.93, interpreted as Always. It only meant that organization of anti-

illegal drugs task force is an effective implementation for the aid of wide spread of illegal

drug users.

3. The problems encountered by police personnel in Dipaculao in reinforcing the provisions

of Republic Act 9165 showed that based on the statement and interpretation, the first in

RECOMMENDATION

1. Enlighten the public on a nation-wide scale as to the dangers of drug addiction

2. Establish a medical treatment system for narcotics addicts, and to rehabilitate them

3. To intensify the guidance and supervision of narcotics officials, to strengthen the

administration of narcotics, and to prevent illegal use.

4. That a family should have a proper parental monitoring and supervision to their children

in dealing with drugs.

5. That another study should be conducted.
