1. Defendant is the sole owner of the internet domain and website

2. The website was purchased from Laurene Stewart in January, 2009 ,

and registration was transferred to Defendant's account with the registrar

Godaddy .com. Defendant also purchased a privacy service (proxy) to prevent

personal information from publication on the internet .

3. Defendant is now and has been since January/ 2009, the sole

operator of the website. Domains By Proxy is the Godaddy division that

provides the privacy services purchased .

clerical error (probably by Defendant) at the time ownership was transferred .

6 6. On or about February 19/ 2009, this Defendant (and only this

7 defendant) did publish on the website an excerpt from the article entitled

8 '%ludge deniea bail to auspects in two deathsêF believing such republication

9 constituted fair use .

10 7. The originator of the material was clearly identified.

11 Hyperlinks to the specific article and to the main (home) page of the

12 originating website were included.

13 8. The website has, since Defendant assumed ownership, had a clearly

14 labeled and fully functional method of contacting the webmaster/owner.

15 9. On or about June 9. 2010, Defendant was contacted (using the

œ lb mechanism on the webaite) by Steve Green, a reporter for the Las Vegas Sun

17 newspaper: asking for comment on a lawsuit.

18 10. Immediately upon learning that Plaintiff objected to the use of

19 the materials on the website from a third partyy subject materials were
20 removed without waiting for a formal request from the Plaintiff. Defendant

21 then emailed Plaintiff (counsel for Plaintiff) informing them of the proper

22 target of the lawsuit.

l FACTS

2 1l. Plaintiff makes a series of pro forma assertions as to Defendants

3 'ties to Nevada' totally lacking substance . Defendant operatee a website in

4 the true crime genre, the popularity of which is common knowledge: and

5 publishes material related to crimese trials, and 1aw enforcement from around

6 the United States and the world - of whtch Nevada and Las Vegas are a part.

7 12. Defendant certainly will not turn away visitors from any

8 location, but residents of Nevada and/or Las Vegas seeking information on

9 local crimesz victimsz 1aw enforcement officials and actions, and court

10 officials and actions, are far more likely to turn to Plaintiff's website or

11 those of its actual competitors than to crimenewszooo -com .

12 13. Plaintiff Makes a specious assertion of harm . According to the

13 Alexa website analysis service, Plaintiff operates a website ranked at 9,688

14 globally and 1,801 in the United States, compared to Defendant's rankings of

15 999,064 and 289,653 respectively (Exhibit A).

16 14. Defendant's website has averaged less than 2,500 page views per

17 day in calendar year 2010 (Exhibit B); the atatistical tools available do not

18 provide detail as to how many vie-ed the specific atory.

19 15. Defendant's website has generated $139.93 during the period

20 February l-lune 3O, 2010 ïExbibit CJ.

21 16. The proper legal atructure of Plaintiff's assertions

22 notwithstanding, the actual damages suffered by Plaintiff are no greater than

23 if a copy of the article in question was tacked to the bulletin board of an

24 of fice, or a copy of the article was electronically reproduced and

25 distributed among acquaintancea .

2 l7. Defendant published on *he website an article to which Plaintiff holds

3 copyright . Defendant did so believing that the reciprocal hyperlinks back to

the originating website constituted fair use. Without adm itting any improper

! action, Defendant offers to settle this lawsuit with Plaintiff for the sum of

$142.88 (revenue generated by the website during the time the offending
6
material was available plus the $2.95 charge for an archived article), along
7
with a guarantee that no material belonging to Plaintiff will ever appear on
B the Website again .

11 18. In the event Plaintiff rejects the offer of settlement made:

12 refuses to make a counter-offer, and persists in demanding trial by jury,
Defendant requests that the Court dismiss the case outright. Plaintiff made
