It is understood that the user may be pre-empted by the City or MRC if scheduling conflicts arise. ‘Applicant MRC Representative Permit must be available for inspection during use of the Sports Complex RESOLUTION NO., ‘A Resolution providing for guidelines on usage of the Mulvane Sports Complex; Setting forth reservation procedures, establishing priorities on access and user fees, providing for insurance coverage and indemnification; and stating the policy of the City. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MULVANE, KANSAS THAT: A. G. All groups, organizations, clubs or individuals desiring the use of any fields or facilities at the Mulvane Sports Complex must complete a “Permit To Reserve” form with the Mulvane Recreation Commission prior to using the facility. Priority of use and applicable fees required to be paid for the use of the facility as set forth below: USD 263 (Mulvane Schools) interscholastic athletics events - No charge. Mulvane Recreation Commission activities - No charge. Optimist sponsored athletic leagues and events - No charge. Mulvane Junior League Football - No charge. All other users with fees as follows: (a) Usage Fee - $100.00 (b) Key Deposit = $50.00 (©) Lights/ per field /per day = $25.00 yaepe Priorities for usage of the Sports Complex and its various facilities will be commensurate with the categories listed in the order above. . All applicants/users shall furnish a policy of liability insurance naming the City of Mulvane as the insured thereunder, having policy limits of not less than $500,000.00 accident/liability coverage and $100,000.00 property damage. . All applicant/users shall sign an approved “Hold Harmless Agreement” with the City. Applicant/user shall abide by the “Guidelines for the Sports Complex Use” approved by the City Council. On timely written application, the city council may waive or suspend enforcement of the provisions and requirements of this resolution. Ford, Mayor Patty Gerwi HOLD HARMLESS AGREEMENT FOR MULVANE SPORTS COMPLEX THIS AGREEMENT, made this day of 20, between the City of Mulvane, Kansas, hereinafter , “CITY” and the below personally identified applicant, hereinafter, “APPLICANT”, whether one or more, the parties agree as follows: 1. Applicant/user has completed a “Permit to Reserve" facility(s) at the City of Mulvane Sports Complex. 2. Applicant/user agrees to abide by all city codes, regulations and rules for use of a city park and or city owned property. 3. The applicantuser agrees to use the facilities “as is” and not to alter, modify, convert or change any city equipment or property without express, written consent from the City. 4. Applicantluser agrees to indemnify and hold harmless the City or the MRC. and its agents, employees, officers and assigns against any and all injury, loss, damage, costs and expenses that user or any of its invitees may sustain or incur arising from the use of any or all the facilities at the above named city park. 5. Applicant agrees to be liable and indemnify the City and MRC for the cost of repair or replacement of any property damaged by the Applicant/User, its agents or invitees in connection with its use of the Sports Complex. 6. This Agreement is binding on all parties, their agents, heirs and lawful assigns. UNDERSTOOD AND AGREED TO the date and year first written above. All reservations of the Sports Complex facility will be made through the Mulvane Recreation Commission at their office at 632 £. Mulvane. Reservation forms, payment of fees (check payable to MRC), and key check out will be done at the MRC office, 2. Walk Through: The person reserving the Sports Complex must contact the Park Superintendent (371-1854) and arrange a “walk through” of the Sports Complex with the park personnel to make sure the keys work and to familiarize users with the alarm system, lights, restrooms, concession stand, etc. This person must sign the “walk through punch list”. 3, Return the Keys: Keys will be tured in to the MRC by 5:00 p.m. the day after use or at the end of the season as per the date on the Permit. The key deposit will be returned when the keys are returned. 4, Users agree not to loan or make copies or otherwise duplicate any Sports Complex keys issued. 5. The use of a separate concession stand trailer, the electric boxes or additional equipment or alteration or movement of any equipment on to the ball fields must be requested in writing at the time the Sports Complex is reserved. 6. The Sport Complex will be opened from 8:00 a.m. until 9:30 p.m. daily unless prior permission is ‘obtained (in writing) for longer hours. 7. The Park Superintendent will call games due to the rain or the fields being too muddy by the day of the games and will notify the MRC. No one is to be on the fields when the games are called due to wet conditions. 8. Facility users will replace divots and smooth the pitching mounds and home plate areas at the conclusion of each day (practice or games). 9. Facility users are responsible for picking up all trash in and around the Sports Complex and the entire parking lot. 10. The person reserving the Sports Complex and completing the “walk through” will be the last person to leave the facility and responsible for; Turning the field lights off. * Closing and locking all doors (restrooms, concession stand, press boxes) and gates. ‘© Calling the police station to have the concession stand alarm reset. Signature of person reserving the Sports Complex Date Sports Complex ~ Walk Through & Instructions ‘Arrange the Walk Through: 1. Call the Parks Superintendent (371-1854) and arrange for a walk through of the Sports Complex with City staff. Concession Stand & Restrooms: 2. Start at the concession stand and make sure the key works to the concession stand door, 3. Before the concession stand door is opened call the police station (777-4262) to have them disable the alarm. 4. Once inside the concession stand, do you have questions about the equipment? 5. Go tothe restrooms and repeat the process. Field Lights: 1, Press box #1: That is where the field light switches are. Staff will show you how to turn them on and off. Ball Fields: 1: Go to the fields and make sure the gate keys work Closing the Complex: 1. Before you leave at night Lock the field gates. ‘Turn the field lights off. Lock the press box door(s), Lock the restroom and the concession stand doors Resetting the alarm: Call the police station at 777-4262 and have them reset the alarm. Front Gate: Lock the front gate, Thave completed the Sports Complex Walk through, have been provided a copy of the instructions and agree to follow those instructions. ‘Applicant Signature Date
