AFFIDAVIT

I, JULLY DAHAM, of legal age, married, Filipino, with office

address at CENRO, Zamboanga City, Philippines, after having been
sworn in accordance with law, depose and state:

1. I am employed as a forest ranger of the Community Environment

and Natural Resources Office (CENRO), Zamboanga City, of the
Department of Environment and Natural Resources;

2. I am presently assigned to the west coast communities of

Zamboanga City which includes the barangay of Limpapa;

3. That among my duties and functions, aside from preventing and

apprehending illegal activities within the forestal zones, is also to
monitor compliance of grantees of Certificate of Stewardship
covering forestal lands under the Integral Social Forest (ISF)
Program of the DENR;

4. That Lolita S. Apostol is a grantee/ holder of a Certificate of

Stewardship over a 5- hectare portion of land situated in Sitio
Masalag, Limpapa, Zamboanga; That I personally know Rolly S.
Apostol, one of her children, who is presently occupying and
cultivating a portion of the 5- hectare parcel of land;

5. That sometime on May 16, 2016, I was requested by grantee

Lolita S. Apostol to conduct a subdivision survey of said parcel
since she intended to give each of her children portions of the
land, including Rolly S. Apostol, and which I did;

6. That in the course of my work I come to be informed that grantee

Lolita S. Apostol had mortgage said property to a certain Joel D.
Perspinosas and for which reason I warned such mortgage is
contrary to the rules and regulations governing the Certificate of
Stewardship that was granted to her and is a valid ground for the
cancellation of such Certificate of Stewardship;

7. That according to the rules and regulations governing Integrated

Social Forestry, which includes Contracts of Stewardship, only the
heirs of grantees are qualified to succeed the grantees, nobody
else; and except to financial institutions, parcels of land covered
by Contracts of Stewardship cannot be mortgaged or leased
other than their heirs;
 8. That I am executing their instrument to attest to the truth of the
foregoing facts as well as to state the CENROs position on the
issue involving the Apostols.
