(The following was heard in open court at
10:50 a.m.)
THE COURT: Good morning, please be seated.
MR. BERG: Good morning.
THE COURT: We have a number of motions
before the Court. We have plaintiffs’ emergency motion
for an injunction and temporary restraining order. We
have the motion of Theodore Hoppe to withdraw from the
representation of Linda Sue Belcher, the Hale
defendants, and the Sankey defendants.
We have Defendant Taitz’s motion for Rule 11
sanction. We have Defendant Taitz’s motion to dismiss
in response to plaintiffs’ motion for TRO, and we have
the motion to dismiss with prejudice and to enjoin
Phillip Berg, which is filed by a non-party, a J.
Johnson. 1 think preliminarily we can address a couple
of these motions.
First, the motion to dismiss with prejudice,
filed by a non-party, that will be dismissed and will
be denied, in that a non-party cannot participate in
this proceeding without intervention. No motion for
intervention having been filed, the motion is denied.
We have the motion of Mr. Hoppe to withdraw.
No objections were received to that motion, so the
motion will be granted, and Mr. Hoppe will be allowed
