MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This memorandum of agreement is made and entered into by and between:

The NATIONAL MARITIME POLYTECHNIC, an ISO certified government maritime


training and research center under the Department of Labor and Employment, with address
at Cabalawan, Tacloban City and represented by its Executive Director III, ROMULO V.
BERNARDES, D.M. CESO V, hereinafter referred to as NMP;

-and-

The NAVAL STATE UNIVERSITY, and educational institution, located at P.I. Garcia
St., Naval, Biliran, and represented by its OIC University President, DR. VICTOR C.
CAEZO, JR., hereinafter referred to as NSU;

WITNESSETH:

That the National Maritime Polytechnic is a Quality assured government training


center, duly certified by the Anglo Japanese American (AJA) certifying body, equipped
with the required training facilities and tasked to update the countrys maritime manpower
through the conduct of Upgrading and Specialized Courses, as well as Basic and Advanced
Safety Courses for both merchant marine officers and ratings in accordance with STCW
1978, as amended.

The Naval State University, an educational institution, who by nature and character
of their organization desire to avail of Basic Training (BT) for its deck and engine cadets to
be able to comply with the mandatory training requirements of STCW Code.

That for and in consideration of the foregoing premises and stipulations herein set
forth, the parties agreed as follows:

DUTIES AND OBLIGATION OF NMP

1. Provide registration forms to NSU Shipboard Training Officer (STO) in order to facilitate
enrollment of their cadets together with a list of requirements;

2. Conduct Basic Training (BT) with Prevention of Alcohol and Drug Abuse in the
Maritime Sector (PADAMS) and STD/HIV/AIDS Prevention in the Maritime Sector
(SHAPIMS) to NSU cadets at the NMP Training Center, Cabalawan, Tacloban City for
ten (10) days to cover the entire mandatory training courses based on the STCW Code
and in this regard cause the reservation of pertinent slots for the NSU trainees;

3. Endeavor to deliver each subject area through lecture-discussion, demonstration and


hands-on exercises in the delivery of the program as deemed fit and appropriate in order
for trainees to acquire the desired competencies;

4. Issue BT, PADAMS and SHAPIMS Certificates to each participant after completion of
all training requirements;

5. Orient cadets about NMP and existing house rules for their awareness, guidance and
compliance;

6. Properly brief the participants about policies of the NMP and other maritime training
regulatory bodies affecting them and other pertinent information;

7. Provide the NSU cadets pertinent information relating to the approved fees;

8. Take responsibility for the safety of trainees while at the confines of the NMP complex
for the duration of their training.

DUTIES AND OBLIGATIONS OF NSU

1. Ensure the trainees comply with the NMP Registration requirements;

2. Ensure adherence to NMP policies rules and regulations and enforce proper decorum
and discipline of its cadets;

3. Coordinate with NMP management through its Coordinator or Shipboard Training Officer
(STO), in dealing and complying with administrative concerns relative to the training
program, including the scheduling of training;

4. Ensure that the cadets are physically, emotionally and mentally fit to undergo training as
evidenced by a medical certificate from their company physician;

5. Enforce full attendance and participation of its cadets in the training activities;

6. Pay in cash or Managers Check drawn in the name of NMP the following training fees
per trainee to the NMP Cashier: Registration Fee of TWO THOUSAND SEVEN
HUNDRED SEVENTY PESOS (P2, 770.00), Billeting Fee at the Ratings Dormitory of
THIRTY PESOS (P30.00) per day, Trainees ID of FIFTY PESOS (P50.00), Assessment
Fee of TWO HUNDRED FORTY PESOS (P240.00) and Miscellaneous Fee of ONE
HUNDRED SEVENTY PESOS (P170.00). However, all fees hereto mentioned are
subject to change without prior notice;

7. Direct trainees to strictly observe NMP rules and regulations at all times while within the
confines of the training complex during the entire duration of the program;

8. Inform the NMP in writing of any intention to cancel reservation of classes two (2) weeks
before the agreed schedule;

9. Not hold the NMP liable for any claim or damages arising from acts, omission or
negligence on any of the cadets during the training, neither shall it hold the NMP liable
for the death or injuries that may be sustained by any cadet for any cause;

10. Assume full responsibility for any damage, injury to NMP property, officials, employees
or guests, or any third party emanating from acts, commission, omission or negligence
by any of its cadets.

This Memorandum of Agreement shall take effect upon the signing of the parties
concerned, renewable annually upon mutual agreement by the concerned parties. It shall be
incumbent upon the parties concerned to ensure the fulfilment of this agreement.

However, termination of this agreement may be affected by either of the concerned
parties in any time the contract is still in force based on reasonable and legitimate cause
which shall take effect fifteen (15) days from receipt of written notice

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures this
