Mangrove Mountain Landfill

Ph. 4373 1881

PO Box 111, Enfield NSW 2136

Responses to Questions from ABC TV Four Corners

1. Can you please confirm you are the owner of Mangrove Mountain Landfill, both the operating company and
the company that owns the land? (Corporate records show you as the sole shareholder of MP(NSW) Pty Ltd
and MML (NSW) Pty Ltd, which in turn own the shares in the companies that hold these assets)?

Response

The Tartaks confirm effective ownership of Mangrove Mountain Landfill, since they acquired the existing
waste site in 2011, with a view to remediating the site from its existing state at that point in time, for the
long term benefit of all interest groups.

2. Did Verde Terra Pty Ltd, ultimately owned by you, breach the Development Consent issued by Gosford
Council and deposit more material at the site in certain areas than was permitted?

Response

Not so far as we are aware. The amount of landfill material to be received on site in connection with the
construction of the 18-hole championship golf course will not exceed the limits imposed in 2014 by the
NSW Land and Environment Court.

3. Has Mangrove Mountain Landfill accepted any waste in breach of its EPA licence? Eg Putrescible waste,
treated timber, or asbestos?

Response

Mangrove Mountain Landfill is not aware of ever having accepted waste in breach of its EPA licence. It
has detailed protocols in place to ensure compliance with its EPA licence and is not aware of any breach
of those protocols. Further it has voluntarily not accepted any waste since April 2014.

4. What are your future plans for the site?

Response

To completely remediate the site into a championship golf course.

5. Does Bingo have any current or future plans to landfill any waste at the Mangrove Mountain Landfill?

Response

Mangrove Mountain Landfill owns the site and confirms that Bingo has no ownership of the site. It is
unaware of any plans for the site, other than its own plan to remediate the site into a championship golf
course.

Questions regarding the plans of others, including Bingo, should be directed to those parties.
6. Did yourself and/or Bingo and/ Verde Terra or Mangrove Mountain Landfill representatives meet with
representatives of the NSW RSL in Sydney prior to the February 2014 purchase of the Mangrove Mountain
property/site? Why, when, and who was present?

Response

The parties to the sale of land transaction had usual correspondence between themselves and their
advisors in the lead-up to both the exchange and completion of the transaction.

Mangrove Mountain CEO Damian Ryan said:

Mangrove Mountain continues to work with the local community and all stakeholders to finalise a solution to a
legacy landsite that had been sitting there for years until we decided to take positive action back in 2011. We plan to
remediate the landfill into an 18 Hole championship Golf Course.

There has been a lot of misinformation about the Mangrove Mountain Landfill. We wish to notify you of the
following facts:

The Tartak family took over a legacy waste site and since that time have committed significant capital
into what has been to date a loss-making venture, with the view of implementing a solution that will
benefit the local community, including delivering an 18-hole championship golf course and upgrading
the landfill to meet current environmental guidelines for landfill construction and management.

We also note the following relevant information:

During the court proceedings of September 2012 it was accepted that Verde Terra had taken
demonstrable steps to upgrade the landfill site;

In August 2014 the Land & Environment Court regulated the future landfill operations and the
construction of an 18 Hole championship golf course over the existing landfill site;

Those activities required an Environmental Protection Licence from the EPA and:

o To address community concerns, the EPA engaged an Independent Expert to undertake a peer
review of the operating plans. This peer review included a full assessment of concerns raised by
community groups in relation to the landfill;

o The peer review endorsed Mangrove Mountain's plans and concluded the site was appropriate
for the landfill remediation operation;

o Separately, the EPA last year also conducted an extensive investigation into allegations that
polluted water was escaping the landfill into local waterways and drinking water, following
concerns raised by the community;

o No evidence of pollution was identified by the EPA.
