Failure to Have a Certified Operator
Village of Clarence

Dear Mayor Evans:

It has come to the attention of this office that the Village of Clarence Sewer System may not be
operated by a certified operator.

VIOLATION

LAC 48:V.7303 A certified operator for the sewer system was not currently employed or contracted by
the sewer system.

REQUIRED ACTION

The operator of any community sewerage system must hold current and valid professional
certification(s) of the required category(s) at or above the level required for the total system and
individual facility. Additionally (unless the system operates multiple shifts wherein a certified operator is
required to be present on each shift), an operator shall demonstrate that when not actually on site at
the facility, he is capable of responding to that location within one hour of being notified that his
presence is needed.

Required certification categories and levels for your system are Class 1 in Wastewater Treatment and
Class 1 in Wastewater Collection.

Your sewer system has ninety (90) days from the date of receipt of this letter to have your system
operated under the supervision and control of a properly certified sewer system operator(s).

Failure to timely correct this violation may result in further enforcement actions including, but not
limited to, issuance of an Administrative Order. Failure to comply with the terms of an Administrative
Order may lead to penalties of up to $3,000 per day.
