 STATEMENTOFPROBABLECAUSE

TheComplainantstatesthatthefollowingfactsestablishprobablecause:

YourcomplainantisalicensedpeaceofficerintheStateofMinnesota,andisemployedbytheCottage
GrovePoliceDepartment.Inthatcapacityanduponreviewofthereportsandattachments,your
complainantstatesthefollowingtoestablishprobablecause:

OnAugust2,2017officersweredispatchedtothe8000blockofJensenAvenueSouthinCottageGrove,
WashingtonCountyonthereportofaphysicaldomesticassault.Asofficersapproachedafemale,S.T.,in
avehicleflaggeddowntheofficersandreportedthatanotherfemaleat8090JensenAvenueSouth
neededhelpasshewasbeingassaultedinthebasement.Atthatpoint,B.D.camewalkingoutofthe
housevisiblyinjuredwithblooddrippingoutofhermouthandalargebumparoundhereye.Itwas
confirmedthatshehadatoothmissingthatwaslaterfound.

B.D.reportedthatJEFFERYJOHNDUBAY,DOB:1-19-1968defendant,livedinthebasementofher
house.Thatsheandthedefendanthavehadsexualrelationsinthepastanditmadeherupsetwhenhe
broughtwomentothehouse.Onthisday,thedefendanthadawoman,S.T.,inhisbedroom.B.D.asked
himtoaskhertoleave.ThedefendantbecameangryandshovedB.D.tothefloor.Tonote,B.D.has
bilateralprostheticlegsandhadadifficulttimegettingherbalance.Whilelyingonthefloor,thedefendant
reachedoverandpunchedherseveraltimesinthefacewithclosedfists.Severalpuncheslandedabove
herlefteyecausingthebump,andonepunchknockedoutherfronttooth.Thedefendantatsomepointleft
thehouseandtriedtoevadethepolicebutwasapprehendedoutside.B.D.showedtheofficerwherethe
assaultoccurredandtherewereobvioussignsofastruggle,bloodonthefloor,brokenbabygate,abent
broomhandle,etc.B.D.reportedthatthiswasnotthefirsttimethedefendanthasassaultedher,infact,he
hadthreatenedtokillherseveraltimesandchokedherinthepast.

Thedefendantwasmirandizedandinterviewed.ThedefendantclaimedthatB.D.wastheaggressor,
however,S.T.,theeyewitnessandthefemalethatwaswiththedefendant,flaggedthepolicedownand
alertedtheofficersthatB.D.neededhelpasshewasbeingassaultedbythedefendant.
