THETRIPURABUILDINGS(LEASEANDRENTCONTROL
AnActtoregulatetheleasingofbuildingsandtocontroltherentofsuchbuildings
intheStateofTripura.
BeitenactedbytheLegislativeAssemblyofTripuraintheTwentysixthYearofthe
RepublicofIndiaasfollows:
Shorttitle,extent,applicationandcommencement.
1. (1) This Act may be called the Tripura Buildings (Lease and Rent Control)
Act,1975.
(2)ItextendstothewholeoftheStateofTripura.
(3) It applies at the first instance to the areas mentioned in the Schedule and the
State Government may, by a notification in the Official Gazette, apply all or any
provisionsofthisActtoanyotherareaintheStatewitheffectfromsuchdateasmay
bespecifiedinthenotificationandmay,bylikenotification,cancelormodifysuch
notification or withdraw the application of all or any of the provisions of this Act
fromanyareamentionedintheSchedule:
ProvidedthatthisActshallnotapply
(a)toanypremisebelongingtoanylocalauthority,
(b)toanypremisebelongingtoorrequisitionbytheGovernment,or
(c) to any tenancy created by the government in respect of any premise taken on
leasebytheGovernment.
(4)ItshallbedeemedtohavecomeintoforceonandfromthefirstdayofJanuary,
1975.
Definitions.
2.InthisAct,unlessthecontextotherwiserequires,
(a) "Accommodation Controller" means any person appointed to perform the
functionsofanAccommodationControllerunderthisAct
(b)"building"meansanybuildingorhutorpartofabuildingorhut,letortobelet

separatelyforresidentialornonresidentialpurposesandincludes
(i) the garden, grounds, wells, tanks and structures, if any appurtenant to such
building,orpartofsuchbuildingandletortobeletalongwithsuchbuilding,
(ii) any furniture supplied by the landlord for use in such building or part of such
building,
(iii)anyfittingormachinerybelongingtothelandlord,affixedtoorinstalledinsuch
building, or part of such building and intended to be used by the tenant for or in
connectionwiththepurposeforwhichsuchbuildingorpartofsuchbuildingisletor
tobelet,butdoesnotincludearoominahotelorboardinghouse
(c)"family"meansinrelationtoaperson,thewifeorhusbandofsuchperson,hisor
herchildren,grandchildren,parents,brothersandanyotherrelativedependenton
himandinthecaseofajointHindufamily,anymemberofsuchfamily
(d)"landlord"includesthepersonwhoisreceivingorisentitledtoreceivetherent
ofabuilding,whetheronhisownaccountoronbehalfofhimselfandothersorasan
agent,trustee,executor,administrator,receiverorguardianorwhowouldsoreceive
therentorbeentitledtoreceivetherent,ifthebuildingwerelettoatenant

(e)"prescribed"meansprescribedbyrulesmadeunderthisAct
(f)"RentControlCourt"meanstheRentControlCourtconstitutedundersection3
(g)"Schedule"meansaScheduleappendedtothisAct
(h)"tenant"meansanypersonbywhomoronwhoseaccountorbehalftherentof
any premises is, or but for a special contract would be, payable and includes any
personcontinuinginpossessionaftertheterminationofhistenancyorintheevent
ofsuchperson'sdeath,suchofhisheirsaswereordinarilyresidingwithhimatthe
timeofhisdeathbutshallnotincludeanypersonagainstwhomanydecreeororder
forevictionhasbeenmadebyacivilcourtofcompetentjurisdiction
(i) "town" means an area within the limits of a municipality or such other area as
maybespecifiedbytheStateGovernmentforthispurposebyanotificationinthe
OfficialGazette
(j)"unconscionablerent"meansanyrentwhichismorethandoublethemaximum
ofthefairrentthatcouldbefixedforabuildingundersection5
(k)"village"meansavillageasdefinedinclause(w)ofsection2oftheTripuraLand
RevenueandLandReformsAct,!960.
Constitutionofrentcontrolcourtsandappointmentofaccommodation
controllers.
3. (1) The State Government may, by notification in the Official Gazette, appoint a
personwhoisorisqualifiedtobeappointed,aMunsifftobetheRentControlCourt
forsuchlocalareasasmaybespecifiedtherein.

(2)TheStateGovernmentmay,bynotificationintheOfficialGazette,appointany
officer not below the rank of a subDeputy Collector to be the Accommodation
ControllerforanyareatowhichthisActapplies.
(3) The Accommodation Controller shall exercise his powers and perform his
functionssubjecttosuchgeneraldirectionsastheStateGovernmentmayissue.

4.(1)(a)Everylandlordmaywithinfifteendaysbeforecompletionandshall,within
fifteendaysaftertheconstructionorreconstructionofabuildingintendedtobelet
out or after a building becomes vacant by his ceasing to occupy it, or by the
terminationofatenancy,orbyreleasefromrequisitionbytheStateGovernmentor
anyothercompetentauthority,givenoticeoftheavailabilityorvacancyinwritingto
theAccommodationController.
(b)Everytenantshallwithinfifteendaysofhisvacatingabuildingoccupiedbyhim
givenoticeofthesameinwritingtotheAccommodationController:
Provided that this subsection shall not apply to a building in respect of which the
landlord has obtained an order for possession on any of the grounds specified in
subsection(3),clause(iv)ofsubsection(4)andsubsections(7)and(8)ofsection
12.
(c) Every notice given under clause (a) shall contain such particulars as may be
prescribed.
(2) If the tenant of a building puts another person in occupation thereof and does
notreoccupyitwithinaperiodofthreemonths,ontheexpiryofsuchperiod,the
tenancy shall be deemed to have terminated and it shall be the duty of the tenant
andalsoofthelandlord,ifheisawareofsuchtermination,togivenoticethereofin
writingtotheAccommodationControllerwithinfifteendaysofsuchtermination.
Provided that the tenant may, before the expiry of three months apply to the
AccommodationControllertoreoccupythebuildingwithinaperiodofsixmonths
and if such permission is granted, this subsection shall have effect as if for the
periodofthreemonthsspecifiedtherein,aperiodofsixmonthsweresubstituted.
Explanation:Thissubsectionshallnotapplywherethebuildinghasbeensublet
by a tenant entitled to do so, after giving due notice to the Accommodation
Controller under subsection (1) and in conformity with the provisions of this
section.
(3)If,withinfifteendaysofthereceiptbytheAccommodationControllerofanotice
under subsection (1) or subsection (2), the Accommodation Controller does not
intimate to the landlord in writing that building is required for the purpose of the
State Government or Central Government or of any public institution or for the
occupationofanyofficerofsuchGovernment,orlocalauthority,thelandlordshall
beatlibertytoletthebuildingtoanytenantortooccupyithimself.

(4)Thelandlordshallnotletthebuildingtoatenantoroccupyithimself,beforethe
expiry of the period specified in subsection (3) unless in the mean time he has
received intimation that the building is not required for the purposes or for
occupationbyanyofthepersonsspecifiedinthatsubsection.
(5) If the building is required for the purposes of the state Government or the
Central Government or a local authority or any public institution or for the
occupationofanyofficerofsuchGovernmentorlocalauthority,orforoccupationby
anyofthepersonsspecifiedinsubsection(3),thelandlordshalldeliverpossession
of the building to the Accommodation Controller and the State Government, the
Central Government, the local authority or public institution or officer or person
shallbedeemedtobethetenantofthelandlord,withretrospectiveeffectfromthe
dateonwhichtheAccommodationControllerreceivednoticeundersubsection(1)
or subsection (2), the terms of the tenancy being such as may be agreed upon
between the landlord and the tenant and in default of an agreement, as may be
determinedundersection5:
Provided that the rent payable shall be the fair rent, if any, fixed for the building
undertheprovisionsofthisAct,andifnofairrenthasbeensofixed,suchfairrent
asmaybedeterminedinaccordancewiththeprovisionsofthisAct:
Providedfurtherthatabuildingusedasaresidentialbuildingshallnotbeusedasa
nonresidential building or vice versa unless the Accommodation Controller after
hearingthelandlordgrantspermissioninthisregard:
Providedalsothatnostructuralalterationshallbemadeinthebuildingunlessthe
consentinwritingofthelandlordisalsoobtainedtherefor.
(6)(a)wherealandlordhastwoormoreresidentialbuildingsinthesametownor
village and they have not been let by him, the landlord may choose any of such
buildings for his occupation or occupation of any member of his family dependent
on him and shall give notice to the Accommodation Controller specifying the
buildingsochosenbyhimandeveryotherbuildingnotsochosen.
(b)Everynoticegivenbylandlordunderclause(a)shallinsofarasitrelatestoany
buildingotherthantheonechosenbyhimforhisownoccupation,bedeemedtobe
anoticeundersubsection(1)andtheprovisionsofsubsection(3)shallthereupon
applyinrespectofsuchbuildings.
(c)TheAccommodationControllershallallotthebuildingvestedinhimundersub
section(5)orsubsection(6)topersonsmentionedinsubsection(3)accordingto
therulesandprioritiesprescribedbytheStateGovernment.
(7) (a) Any officer empowered by the State Government in this behalf may
summarilydispossess
(i)anylandlord,tenantorotherpersonoccupyinganybuildingincontraventionof
theprovisionsofthissectionoranylandlordwhofailstodeliverpossessionofany

buildingundersubsection(5),
(ii)anyofficer,person,localauthorityorpublicinstitutioncontinuingtooccupy,or
failingtodeliverpossessionof,anybuildingaftertheterminationofhisoritslicence
tooccupysuchbuilding,andtakepossessionofthebuildingincludinganyportion
thereofwhichmayhavebeensublet.
(b) If free access to the building is not afforded to the officer empowered under
clause(a)hemay,between6A.M.and6P.M.aftergivingreasonablewarningand
facilitytowithdrawtoanywomennotappearinginpublicaccordingtothecustoms
of the country, remove or open any lock or bolt or break open any door or do any
otheractnecessaryforeffectingsuchdispossession.
(c) Any landlord, tenant or other person or any officer, local authority or public
institution, liable to be summarily dispossessed under clause (a) shall pay to the
StateGovernment
(i) the fair rent payable for the building under the provisions of this Act for the
periodofhisoritsoccupationorpossessionthereofasdescribedinthatclauseand
(ii) the expenses, if any, incurred by the State Government in effecting such
summarydispossession,asdeterminedbythem,whichdeterminationshallbefinal.
(8)Nothingcontainedinthissectionshallapply
(a)toanybuildingofwhichtherentdoesnot,orwheretherenthasnotbeenfixed,
thefairrentwouldnot,whenfixed,exceedfiftyrupeespermensemor
(b)toanybuildingorbuildingsownedbyanycompany,associationorfirm,whether
incorporated or not and bonafide intended solely for the occupation of its officers,
servantsoragentsandsituatedinthesamecity,townorvillage.
Determinationoffairrent.
5. (1) The Rent Control Court shall, on application of the tenant or landlord of a
buildingfixthefairrentforsuchbuildingafterholdingsuchenquiryasitthinksfit.
(2) In fixing the fair rent the Rent Control Court shall take into consideration the
propertytaxorhousetaxfixedforthebuildingatthetimeofletting,intheproperty
tax register or house tax register of the local authority within whose area the
buildingissituated:
Providedthatinthecaseof
(i)anyresidentialbuilding,or
(ii)anynonresidential,exceptingabuildingtowhichfittingshavebeenaffixedorin
which machinery have been installed and such fittings or machinery have been
excluded from valuation for the purpose of fixing the property tax or house tax by
localauthority,
thefairrentfixedmayinpropercasesbelowerthan,butshallinnocaseexceedby
morethanfifteenpercentum,themonthlyrentonthebasisofwhichtheproperty
taxorhousetaxforthebuilding,prevailingtwoyearsimmediatelybeforethedateof

the application, was fixed, or if the building was not assessed to property tax or
housetaxbeforethesaidperiodoftwoyears,themonthlyrentonthebasisofwhich
the property tax or house tax prevailing immediately before the date of the
applicationwasfixed.
(3)Ifthereisnopropertytaxorhousetaxfixedforthebuildingorifitisnotbased
on a rental basis or if the building is situated in an area which is not within a
municipality,Panchayatoranyotherlocalauthority,thefairrentshallbefixedafter
taking into consideration the prevailing rates of rent in the locality for similar
accommodation in similar circumstances during the twelve months preceding the
letting.
(4)IncasetheallotmentofthebuildingismadebytheAccommodationController,
he may, provisionally fix the fair rent for the building and the Rent Control Court
may,onapplicationbyanaggrievedpartymodifythefairrentsofixed.
(5) The Rent Control Court shall intimate the fair rent of the building fixed to the
local authority within whose jurisdiction the building, in respect of which the fair
rent has been fixed, is situated. The local authority on receipt of such intimation
shall make a record of the fair rent fixed in the register kept for the purpose and
shallmaketheregisteravailableforinspectioninsuchplacesandinsuchmanneras
maybeprescribed.Theregistersopreparedshallbekeptuptodatesoastocontain
fullparticularsinregardtotherentfixedinrespectofabuildingbytheRentControl
CourtandalsothesubsequentvariationtheretomadebythesaidCourt.
Increaseorreductionorfairrentinwhatcasesadmissible.
6. (1) When the fair rent of a building has been fixed under this Act, no further
increaseinsuchfairrentshallbepermissibleexceptincaseswheresomenecessary
addition,improvementoralterationhasbeencarriedoutatthelandlord'sexpense:
Providedthatthefairrentasincreasedunderthissubsectionshallnotexceedthe
fairrentpayableunderthisActforasimilarbuildinginthesamelocalitywithsuch
additional improvement or alteration and it shall not be chargeable until such
additionalimprovementoralterationhasbeencompleted:
Providedfurtherthatanydisputebetweenthelandlordandthetenantinregardto
any increase claimed under this subsection shall be decided by the Rent Control
Court.
(2)Where,afterthefairrentofabuildinghasbeenfixedunderthisAct,thereisa
decrease or diminution in the accommodation or amenities provided, the tenant
may claim a reduction in the fair rent as so fixed, and any dispute between the
landlordandthetenantinregardtoanyreductionsoclaimedshallbedecidedbythe
RentControlCourt.

7.(1)Wheretheamountofthetaxesandcessespayablebylandlordinrespectofany

building to a local authority has increased after fixation of the fair rent, such
increaseshallberecoverablebythelandlordfromthetenant:
Provided that no such increase exceeding five per centum of the original fair rent
shallbesorecoveredfromthetenant.
(2) Any dispute between the landlord and the tenant in regard to any increase
claimedundersubsection(1),shallbedecidedbytheRentControlCourt.
Revisionoffairrent.
8.(1)Thefairrentmayberevisedonlyiftherehasbeenanincreaseordecreasein
themarketvalueofthepremises.
(2) Such revision shall be made on application made to the Rent Control Court
eitherbythelandlordorbythetenant,intheprescribedmanner:
Provided that no such application shall be entertained until after the expiry of a
period of five years from the date on which fair rent was last fixed or from the
commencementofthisAct,asthecasemaybe.
(3)Therentofthepremisespayableforayearshallnotbeincreasedordecreasedby
revision by more than two and a half per centum per annum of the difference
betweenthemarketvalueofthepremisesonthedateoftheapplicationundersub
section(2)andthedateoflastfixationofthefairrentorthecommencementofthis
Act,asthecasemaybe.
Landlord not to claim or receive any thing in excess of fair rent or
agreedrent.
9.(1)WheretheRentControlCourthasdeterminedthefairrentofabuilding
(a)thelandlordshallnotclaim,receiveorstipulateforthepaymentof
(i)anypremiumorotherlikesuminadditiontosuchfairrent,or
(ii)saveasprovidedinsection6orsection7,anythinginexcessofsuchfairrent:
Providedthatthelandlordmayreceive,orstipulateforthepaymentofanamount
notexceedingonemonth'srent,bywayofadvance
(b)saveasprovidedinclause(a),anypremiumorotherlikesumoranyrentpaidin
additiontoorinexcessofsuchfairrent,whetherbeforeorafterthecommencement
ofthisAct,inconsiderationofthegrant,continuanceorrenewalofthetenancyof
the building after such commencement, shall be refunded by the landlord to the
person by whom it was paid or at the option of such person, shall be otherwise
adjustedbythelandlord:
Providedthatwherebeforethedeterminationofthefairrent,renthasbeenpaidin
excess thereof, the refund or adjustment shall be limited to the amount paid in
excess for a period of three years immediately before the institution of any
proceedingforsuchdetermination.
(2)Wherethefairrentofabuildinghasbeendeterminedundersection5
(a) notwithstanding anything contained in any contract, the rent payable for the

buildingincaseitisabuildingfallingunderclause(i)orclause(ii)oftheprovisoto
subsection (2) of section 5 shall be, where the property tax or house tax has been
fixedbythelocalauthority,themaximumrentthatmaybefixedbytheRentControl
Courtasprovidedforinsubsection(2)ofsection5,ortheagreedrentwhicheveris
less,andincaseswherenopropertytaxorhousetaxhasbeenfixedforthebuilding
orwhereithasbeenfixednotonarentalbasis,theagreedrent
(b) the landlord shall not, claim, receive or stipulate for the payment of any
premium or other like sum in addition to the rent payable under clause (a) for a
building falling under clause (i) or clause (ii) of the proviso to subsection (2) of
section5,andtheagreedrentinthecaseofanyotherbuilding:
Providedthatthelandlordmayreceive,orstipulateforthepaymentof,anamount
notexceedingonemonth'srent,bywayofadvance
(c)saveasprovidedinclause(b)anysumpaidinexcessoftherentpayableunder
clause(a)inthecaseofabuildingfallingunderclause(i)orclause(ii)oftheproviso
tosubsection(2)ofsection5andtheagreedrentinthecaseofanyotherbuilding,
inconsiderationofgrant,continuanceorrenewalofthetenancyofthebuildingafter
thecommencementofthisAct,shallberefundedbythelandlordtothepersonby
whomitwaspaidor,attheoptionofsuchperson,shallbeotherwiseadjustedbythe
landlord.
(3)anystipulationincontraventionofsubsection(1)orsubsection(2)shallbenull
andvoid.
Rightoftenantpayingrentoradvancetoreceipt.
10. (1) every tenant who makes a payment on account of rent or advance shall be
entitledtoobtainareceiptintheprescribedformfortheamountpaid,dulysigned
bythelandlordorhisauthorisedagent.
(2) Where a landlord refuses to accept, or evades the receipt of, any rent lawfully
payable to him by a tenant in respect of any building, the tenant may either remit
the rent to the landlord by money order after deducting the money order
commissionandcontinuetoremitanyrentwhichmaysubsequentlybecomeduein
respectofthebuildinginthesamemanneruntilthelandlordsignifiesbyawritten
notice to the tenant his willingness to accept the rent or may by notice in writing,
requirethelandlordtospecifywithintendaysfromthedateofreceiptofthenotice
byhim,abankintowhichtherentmaybedepositedbythetenanttothecreditof
thelandlord:
Providedthatsuchbank,ifspecifiedasaforesaid,shallbeonesituatedinthetown
orvillageinwhichthebuildingissituatedorifthereisnosuchbankinsuchtownor
village,withinfivekilometresofthelimitsthereof.
Explanation: It shall be open to the landlord to specify from time to time, by a
written notice to the tenant and subject to the proviso aforesaid, a bank different

fromtheonealreadyspecifiedbyhimunderthissubsection.
(3)Ifthelandlordspecifiesabankasaforesaid,thetenantshalldeposittherentin
the bank and shall continue to deposit in it any rent which may subsequently
becomedueinrespectofthebuilding.
(4) If the landlord does not specify a bank as aforesaid, the tenant shall remit the
renttothelandlordbymoneyorder,afterdeductingthemoneyordercommission
andcontinuetoremitanyrentwhichmaysubsequentlybecomedueinrespectofthe
building in the same manner until the landlord signifies by a written notice to the
tenanthiswillingnesstoaccepttherentorspecifiesabankinwhichtherentshallbe
depositedinaccordancewiththeprovisionsofsubsection(2)
Rightoftenanttodepositrentincertaincases.
11.(1)Wheretheaddressofthelandlordorhisauthorisedagentisnotknowntothe
tenant, he may deposit the rent lawfully payable to the landlord in respect of the
building together with such fee as may be prescribed for the service of the notice
referredtoinsubsection(2)ofsection10beforesuchauthorityandinsuchmanner
as may be prescribed, and continue to deposit any rent which may subsequently
becomedueinrespectofthebuildingtogetherwiththefeeprescribed,asaforesaid,
beforethesameauthorityandinthesamemanneruntiltheaddressofthelandlord
orhisauthorisedagentbecomesknowntothetenant.
(2)Therentsodepositedmay,subjecttosuchconditionsasmaybeimposedbythe
Rent Control Court, be withdrawn by the landlord or his authorised agent, on
applicationtotheRentControlCourt.
(3)Whereanybonafidedoubtordisputearisesastothepersonwhoisentitledto
receive the rent for any building, the tenant may deposit such rent before such
authority and in such manner as may be prescribed and shall report to the Rent
Control Court the circumstances under which such deposit was made by him, and
maycontinuetodepositanyrentwhichmaysubsequentlybecomedueinrespectof
the building before the same authority and in the same manner until the doubt is
removed or the dispute is settled by the decision of a competent Court or by a
settlement between the parties or until the Rent Control Court makes an order
underclause(b)ofsubsection(4),asthecasemaybe.
(4)(a)TheRentControlCourttowhomareportismadeundersubsection(3)shall,
ifsatisfiedthatabonafidedoubtordisputeexistsinthematter,directthat,pending
removalofthedoubtorsettlementofthedisputeasaforesaid,thedepositbeheldby
theauthorityconcerned.
(b)IftheRentControlCourtisnotsosatisfied,itshallforthwithorderpaymentof
theamountdepositedtothelandlord.
(5)(a)WheretheRentControlCourtpassesanorderunderclause(a)ofsubsection
(4),anyamountoramountsdepositedundersubsection(3)maybewithdrawnonly

bythepersonwhoisdeclaredbyacompetentcourttobeentitledthereto,orincase
the doubt or dispute is removed by a settlement between the parties, only by the
person who is held by the Rent Control Court to be entitled to the amount or
amountsinaccordancewithsuchsettlement.
(b) An order passed by the Rent Control Court under clause (b) of subsection (4)
shall not debar the aggrieved party from establishing his claim in any competent
Court.
Evictionoftenants.
12. (1) Notwithstanding anything to the contrary contained in any other law or
contract,tenantshallnotbeevictedinaccordancewiththeprovisionsofthisAct:
Provided that nothing contained in this section shall apply to a tenant whose
landlord is the State Government or the Central Government or any other public
authoritynotifiedunderthisAct:
Providedfurtherthatwherethetenantdeniesthetitleofthelandlordorclaimsright
of permanent tenancy, the Rent Control Court shall decide whether the denial or
claim is bonafide and if it records a finding to that effect, the landlord shall be
entitledtosuchforevictionofthetenantinacivilcourtandsuchcourtmaypassa
decreeforevictiononanyofthegroundsmentionedinthissection,notwithstanding
thatsuchcourtfindsthatsuchdenialdoesnotinvolveforfeitureoftheleaseorthat
theclaimisunfounded.
(2)(a)AlandlordwhoseekstoevicthistenantshallapplytotheRentControlCourt
foradirectioninthatbehalf.
(b) If the Rent Control Court, after giving the tenant a reasonable opportunity of
showing cause against the application, is satisfied that the tenant has not paid or
tenderedtherentduebyhiminrespectofthebuildingwithinfifteendaysafterthe
expiry of the time fixed in the agreement of tenancy with his landlord or in the
absenceofanysuchagreementbythelastdayofthemonthnextfollowingthatfor
whichtherentispayableandsuchdefaulthascontinuedforthreemonthswithina
period of twelve months, it shall make an order directing the tenant to put the
landlordinpossessionofthebuilding,andifitisnotsatisfieditshallmakeanorder
rejectingtheapplicationthereofbyhim:
Provided that an application under this subsection shall be made only if the
landlord has sent a registered notice to the tenant intimating the default and the
tenanthasfailedtopayortendertherenttogetherwithinterestatsixpercentper
annumandpostalchargesincurredinsendingthenoticewithinfifteendaysofthe
receiptofthenoticeoroftherefusalthereof.
(c)TheorderoftheRentControlCourtdirectingthetenanttoputthelandlordin
possessionofthebuildingshallnotbeexecutedbeforetheexpiryofonemonthfrom
the date of such order or such further period as the Rent Control Court may in its

discretionallowandifthetenantdepositsthearrearsofrentwithinterestandcost
ofproceedingswithinthesaidperiodofonemonthorsuchfurtherperiod,asmay
be,itshallvacatethatorder.
(3)AlandlordmayapplytotheRentControlCourtforanorderdirectingthetenant
toputthelandlordinpossessionofthebuildingifhebonafideneedsthebuildings
forhisownoccupationorfortheoccupationbyanymemberofhisfamilydependent
onhim:
ProvidedthattheRentControlCourtshallnotgiveanysuchdirectionifthelandlord
hasanotherbuildingofhisowninhispossessioninthesametownorvillageexcept
wheretheRentControlCourtissatisfiedthatforspecialreasons,inanyparticular
caseitwillbejustandpropertodoso:
ProvidedfurtherthattheRentControlCourtshallnotgiveanydirectiontotenantto
putthelandlordinpossession,ifsuchtenantisdependingforhislivelihoodmainly
on the income derived from any trade or business carried on in such building and
thereisnoothersuitablebuildingavailableinthelocalityforsuchpersontocarryon
suchtradeorbusiness:
Provided also that no landlord whose right to recover possession arises under an
instrumentoftransferintervivosshallbeentitledtoapplytobeputinpossession
untiltheexpiryofoneyearfromthedateofinstrument:
Provided always that if a landlord after obtaining an order to be put in possession
transfershisrightsinrespectofthebuildingtoanotherperson,thetransfereeshall
notbeentitledtobeputinpossessionunlessheprovesthathebonafiedneedsthe
buildingforhisownoccupationorfortheoccupationbyanymemberofhisfamily
dependentonhim.
(4)AlandlordmayapplytotheRentControlCourtforanorderdirectingthetenant
toputthelandlordinpossessionofthebuilding
(i)ifthetenantafterthecommencementofthisAct,withouttheconsentinwriting
ofthelandlord,transfershisrightundertheleaseorsubletstheentirebuildingor
anyportionthereofiftheleasedoesnotconferonhimanyrighttodoso
Explanation: Where on the partition of a joint family or of the rights of co
tenants,oronthedissolutionofafirm,therightofthejointfamilyorthecotenants
orthefirmunderaleaseisvestedinamemberofthejointfamily,oracotenantora
partner,asthecasemaybe,whetherbyactofpartiesorotherwise,notransferby
thetenantofhisrightundertheleaseshallbedeemedtohavetakenplacewithinthe
meaningofthisclauseor
(ii)Ifthetenantusesthebuildinginsuchamannerastodestroyorreduceitsvalue
orutilitymateriallyandpermanentlyor
(iii) if the tenant already has in his possession building or subsequently acquired
possessionoforconstructsbuildingreasonablysufficientforhisrequirementsinthe

sametownorvillageor
(iv) if the building is in such a condition that it needs reconstruction and if the
landlord requires bonafide to reconstruct the same and if he satisfies the Rent
ControlCourtthathehasplanandlicence,ifanyrequiredandtheabilitytorebuild
andiftheproposalisnotmadeasapretextforeviction:
Providedthatthelandlordwhoevictsatenantanddoesnotreconstructcompletely
the building within a time which may be fixed or extended by the Rent Control
Court,shallonapetitionbeforethatCourtbeliabletoafineofrupeesfivehundred,
if it is proved that he has wilfully neglected to reconstruct completely the building
withinsuchtime:
ProvidedfurtherthattheRentControlCourtshallhavepoweratanytimetoissue
directionsregardingthereconstructionofthebuildingandonfailureofcompliance
by the landlord, to give effect to the order in any manner the Rent Control Court
deemsfitandinappropriatecasestoputthetenantbackinpossessionorawardto
the evicted tenant damages equal to the excess rent he has to pay for another
buildingthatheisoccupyinginconsequenceofsucheviction:
Providedalsothatthetenantwhowasevictedshallhavethefirstoptiontohavethe
reconstructedbuildingallottedtohimwithliabilitytopayitsfairrentor
(v)Ifthetenantceasestooccupythebuildingcontinuouslyforsixmonthswithout
reasonablecause.
(5) A landlord who wants to renovate the building may apply to the Rent Control
Courtforanorderdirectingthetenanttopermitthelandlordtoenterandcarryout
the renovation within a time to be fixed by the Rent Control Court and the Rent
ControlCourtmayissuesuchorders,asitdeemsfit,andthetenantshallbebound
toabidebytheordersoftheRentControlCourt.
(6)Atenantwhosebuildinghasbeenrenovatedundersubsection(5)shallbeliable
to pay enhanced rent so as to assure the landlord a rent equal to the rent for a
similarbuildingwithsimilaramenitiesinthelocality.
(7) Where the landlord of a building is a religious, charitable, educational or other
public institutions, it may, if the building is needed for the use of the institution,
apply to the Rent Control Court, for an order directing the tenant to put the
institutioninpossessionofthebuilding.
(8) A land lord who is occupying only a part of a building, may apply to the Rent
ControlCourtforanorderdirectinganytenantoccupyingthewholeoranyportion
oftheremainingpartofthebuildingtoputthelandlordinpossessionthereof,ifhe
requiresadditionalaccommodationforhispersonaluse.
(9) Where the tenancy is for a specified period agreed upon between the landlord
andthetenant,thelandlordshallnotbeentitledtoapplytotheRentControlCourt
beforetheexpiryofsuchperiod.

(10) The Rent Control Court shall, if it is satisfied that the claim of the landlord
under subsections (3), (4), (7) or subsection (8) is bonafide, make an order
directingthetenanttoputthelandlordinpossessionofthebuildingonsuchdateas
maybespecifiedbytheRentControlCourt,andiftheRentControlCourtisnotso
satisfied,itshallmakeanorderrejectingtheapplication:
Provided that in the case of an application made under subsection (8) the Rent
Control Court shall reject the application if it is satisfied that the hardship which
may be caused to the tenant by granting it will outweigh the advantage to the
landlord:
ProvidedfurtherthattheRentControlCourtmaygivethetenantareasonabletime
forputtingthelandlordinpossessionofthebuildingandmayextendsuchtimeso
asnottoexceedthreemonthsintheaggregate.
(11) Notwithstanding anything contained in subsections (1) to (10) no order for
evictionorforputtingthelandlordinpossessionshallbepassed
(i) against any tenant who is engaged in any employment or class of employment
notified by the Government as an essential service for the purpose of this sub
section, unless the landlord is himself engaged in any employment or class of
employmentwhichhasbeensonotified,andthelandlordrequiresthebuildingfor
hisownoccupationor
(ii) in respect of any building which has been let for use as an educational
institution, and is actually being used as such, the institution being recognised by
theStateGovernmentoranyauthorityempoweredbytheStateGovernmentinthis
behalf,solongassuchrecognitioncontinues.
(InsertedbyTheTripuraBuildings(LeaseandRentControl)AmendmentAct,1982,
w.e.f.15.11.1983.)[(11A)NotwithstandinganythingcontainedinthisAct
(a) a landlord, who is a member of armed force of the Union or who was such
memberandisdulyretiredwhichtermshallincludeprematureretirement,shallbe
entitled to recover possession of any premises on the ground the premises are
bonafide/required by him for occupation by himself or any member of his family
(whichtermshallincludeparentorotherrelationordinarilyresidingwithhimand
dependentonhim),andRentControlCourtshallpassadecreeforevictiononsuch
groundifthelandlordatthehearingofthesuitproducesacertificatesignedbythe
HeadofhisservicesorhisCommandingOfficertotheeffectthat
(i) he is presently a member of the armed forces of the Union or he was such
memberandisnowadulyretiredexserviceman
(ii)hedoesnotpossessanyothersuitableresidenceinthelocalareawhereheorthe
membersofhisfamilycanreside
(b)whereamemberoftheArmedForceoftheUniondieswhileinserviceorsuch
memberisdulyretiredasstatedaboveanddieswithinfiveyearsofhisretirement,

his widow who is or become landlords of any premises (Inserted by The Tripura
Buildings (Lease and Rent Control) Second Amendment Act, 1983, w. e. f.
28.6.1983.)[shallbeentitledtorecoverpossessionofsuchpremises]ontheground
thatthepremisesarebonafide/requiredbyforoccupationbyherselforanymember
of her family (which term shall include (Inserted ibid.) [her] or her Husband's
parents or other relation ordinary residing with her) and Rent Control Court shall
pass decree for eviction on such ground if such widow at the hearing of the suit
produces a certificate signed by the Area or SubCommander within whose
jurisdictionthepremisesaresituatedtotheeffectthat
(i)Sheiswidowofdeceasedmemberofthearmedforcesasaforesaid.
(ii)Shedoesnotpossessanyothersuitableresidenceinthelocalareawheresheor
thememberofherfamilycanreside.
Explanation:
1)Forthepurposeofclause(a)ofthissectionthewords"theHeadofthisService"in
thecaseofofficersretiredfromtheINDIANARMYincludestheareaCommander,
in the case of Officers retired from INDIAN NAVY includes the Flag Officer
CommandinginCharge, and in the case of Officers retired from the INDIAN AIR
FORCESincludetheStationCommander.
2) For the purpose of this section any certificate granted thereunder shall be
conclusiveevidenceofthefactsstatedtherein.
12)Wherealandlordwhohasobtainedpossessionofabuildinginpursuanceofan
orderundersubsection(3),doesnotoccupyitwithoutreasonablecausewithinone
month of the date of obtaining possession, or having so occupied it, vacates it
withoutreasonablecausewithinsixmonthsofsuchdate,thetenantwhohasbeen
evictedmayapplytotheRentControlCourtforanorderdirectingthatheshallbe
restored to possession of the building, and the Rent Control Court shall make an
orderaccordinglynotwithstandinganythingcontainedinsection4.
(13) Where a tenant who is entitled to apply for possession under subsection (12)
failstodosowithoutreasonablecausewithinonemonthfromthedateonwhichthe
right to make the application accrued to him, the officer referred to in subsection
(1)ofsection4,shallhavepower,ifthebuildingisrequiredforanyofthepurposes
orforoccupationbyanyoftheofficersorpersonsspecifiedinsubsection(3)ofthat
section to give intimation to the landlord that the building is so required, and
thereupontheprovisionsofsubsections(5)and(8)ofsection4shallapplytothe
building:
Providedthatthesubsectionshallnotapplytoabuildingthemonthlyrentofwhich
doesnotexceedfifteenrupees.
(14) Where the Rent Control Court is satisfied that any application made by a
landlordfortheevictionofatenantisfrivolousorvexatious,theRentControlCourt

maydirectthatcompensationnotexceedingfiftyrupeesbepaidbysuchlandlordto
thetenant.
(15) Where an application made under subsections (2), (3), (4), (5), (7), or sub
section (8) for evicting a tenant has been rejected by the Rent Control Court, the
tenancy shall, subject to the provisions of this Act, be deemed to continue on the
same terms and conditions as before and shall not be terminable by the landlord
exceptononeormoreofthegroundsmentionedintheabovesaidsubsections.
(16)Notwithstandinganythingcontainedinthissection,nopersonwhoisreceiving
or is entitled to receive the rent of a building merely as an agent of the landlord
shall,exceptwiththepreviouswrittenconsentofthelandlord,beentitledtoapply
fortheevictionofatenant.
Payment or deposit of rent during the pendency of proceedings for
eviction.
13. (1) No tenant against whom an application for eviction has been made by a
landlordundersection12shallbeentitledtocontesttheapplicationbeforetheRent
ControlCourtunderthatsection,ortopreferanappealundersection20againstany
ordermadebytheRentControlCourtontheapplication,unlesshehaspaidorpays
tothelandlord,ordepositwiththeRentControlCourtortheappellateauthority,as
thecasemaybe,allarrearsofrentadmittedbythetenanttobedueinrespectofthe
buildinguptothedateofpaymentordeposit,andcontinuestopayortodepositany
rent which may subsequently become due in respect of the building, until the
termination of the proceedings before the Rent Control Court or the appellate
authority,asthecasemaybe.
(2) The deposit under subsection (1) shall be made within such time as the Rent
Control Court may fix and in such manner as may be prescribed and shall be
accompaniedbythefeeprescribedfortheserviceofnoticereferredtoinsubsection
(4):
ProvidedthatthetimefixedbytheRentControlCourtforthedepositofthearrears
ofrentshallnotbelessthanfortyfivedaysfromthedateoftheorderandthetime
fixed for the deposit of rent which subsequently accrues due shall not be less than
twoweeksfromthedateonwhichtherentbecomesdue.
(3) If any tenant fails to pay or to deposit the rent as aforesaid, the Rent Control
Courtortheappellateauthority,asthecasemaybe,shall,unlessthetenantshows
sufficient cause to the contrary, stop all further proceedings and make an order
directingthetenanttoputthelandlordinpossessionofthebuilding.
(4)Whenanydepositismadeundersubsection(1),theRentControlCourtorthe
appellateauthority,asthecasemaybe,shallcausenoticeofthedeposittobeserved
onthelandlordintheprescribedmanner,andtheamountdepositedmay,subjectto
suchconditionsasmaybeprescribed,bewithdrawnbythelandlordonapplication

madebyhimtotheRentControlCourtortheappellateauthorityinthatbehalf.
Landlordnottointerferewithamenitiesenjoyedbythetenant.
14.(1)Nolandlordshall,withoutjustorsufficientcause,cutofforwithholdanyof
theamenitiesenjoyedbythetenant.
(2) A tenant in occupation of a building may, if the landlord has contravened the
provisions of this section, make an application to the Rent Control Court
complainingofsuchcontravention.
(3)IfthetenantsatisfiestheRentControlCourtthattheamenitieswerecutoffor
withheld with a view to compel him to vacate the building or to pay an enhanced
rent, the Rent Control Court may pass an interim order, directing the landlord to
restore the amenities immediately, pending the enquiry referred to in subsection
(4).
Explanation : An interim order may be passed under this subsection without
giving notice to the landlord. Any interim order so passed may be modified or
cancelled by final order, and the Rent Control Court may give effect to such
modificationorcancellation.
(4)IftheRentControlCourtoninquiryfindsthatthetenanthasbeeninenjoyment
oftheamenitiesandthattheywerecutofforwithheldbythelandlordwithoutjust
or sufficient cause, it shall make an order directing the landlord to restore such
amenitiesandforthepurposeofenforcementofsuchorders,theRentControlCourt
mayexerciseallthepowersofacivilcourtinexecutingadecreeforinjunctionorfor
specificperformance.
(5) The Rent Control Court may in its discretion direct that compensation not
exceedingfiftyrupeesbepaid
(a)tothelandlordbythetenant,iftheapplicationundersubsection(2)wasmade
frivolouslyorvexatiously
(b) to the tenant by the landlord, if the landlord had cut off or withheld the
amenitiesfrivolouslyorvexatiously.
Executionoforders.
15.Everyordermadeundersection12orsection13orsection14orsection21and
everyorderpassedonappealundersection20oronrevisionundersection22shall,
after the expiry of the time allowed thereby be executed by the Munsiff having
original jurisdiction over the area in which the building is situated as if it were a
decreepassedbyhim:Providedthatanorderpassedinexecutionunderthissection
shall not be subject to an appeal but shall be subject to revision by the Court to
whichappealsordinarilylieagainstthedecisionofthesaidMunsiff.
Decisionwhichhavebecomefinalnottobereopened.
16. The Rent Control Court shall summarily reject any application under sub
sections (2), (3), (4), (5), (7) or subsection (8) of section 12 which raises between

the same parties or between parties under whom they or any of them claim
substantial the same issues as have been finally decided or purports to have been
finally decided in a former proceeding under this Act or under the corresponding
provisions of any law in force prior to the commencement of this Act or the
correspondingprovisionsofanylawrepealedorsupersededbysuchlaw.
OrdersofRentControlCourttobepronouncedinopenCourt.
17.EveryorderpassedbyaRentControlCourtunderthisActshallbepronounced
in open Rent Control Court on the date on which the case is finally heard, or on
somefuturedayofwhichduenoticeshallbegiventotheparties.
Failurebylandlordtomakenecessaryrepairs.
18. (1) Notwithstanding any law, custom, usage or contract to the contrary the
landlord shall be bound to attend to the periodical maintenance and necessary
repairsofthebuilding.Ifalandlordfailstoattendtosuchmaintenanceorrepairsto
thebuildingsandamenitiestheretowithinareasonabletimeafternoticeisgivenby
thetenant,itshallbecompetentfortheRentControlCourttodirect,onapplication
bythetenant,thatsuchmaintenanceandrepairsmaybeattendedtobythetenant
andthatthechargesandcostthereofnotexceedingsuchamountasmaybespecified
intheordermaybedeductedfromtherentwhichispayablebyhim:
ProvidedthatnodirectionshallbegivenbytheRentControlCourtunderthissub
section unless the landlord has been given an opportunity to represent his case
beforeRentControlCourt.
(2)NoappealshallliefromtheorderoftheRentControlCourtpassedundersub
section(1)whichshallbefinal.
Supply of electricity to the building without the permission of the
landlord.
19.(1)Ifalandlordrefusesorwithholdshisconsenttothesupplyofelectricitytoa
tenant,thetenantdesiringtogetsuchsupplyfromlincenseeasdefinedinclause(b)
ofsection2oftheIndianElectricityAct,1910mayapplytotheRentControlCourt
settingouttheschemeforsuchsupply.
(2) On receipt of such application the Rent Control Court may after giving the
landlordandtheownerofthebuilding,ifhebenotthelandlord,anopportunityof
beingheardpermitthetenanttogetthesupplyinaccordancewiththeschemeset
outinthetenant'sapplicationorinaccordancewithanymodifiedscheme.
(3) On such permission being given, notwithstanding anything contained in any
other law for the time being in force the owner shall be deemed to have given the
requisite consent under subsection (2) of section 12 of the Indian Electricity Act,
1910andthelicenseeshallnotbeliabletotheownerfortrespassforstepstakenfor
supplyofelectricityaccordingtothesaidpermission.

20. (1) (a) The State Government may, by general or special order notified in the
Official Gazette, confer on such officers and authorities not below the rank of a
subordinatejudgethepowersofappellateauthoritiesforthepurposesofthisActin
suchareasorinsuchclassesasmaybespecifiedintheorder.
(b)AnypersonaggrievedbyanorderpassedbytheRentControlCourtmay,within
thirtydaysfromthedateofsuchorder,preferanappealinwritingtotheappellate
authorityhavingjurisdiction.
Note : In computing the thirty days in this clause, the time taken to obtain a
certifiedcopyoftheorderappealedagainstshallbeexcluded.
(2)Onsuchappealbeingpreferred,theappellateauthoritymayorderstayoffurther
proceedingsinthematterpendingdecisionontheappeal.
(3) The appellate authority shall call for the records of the case from Rent Control
Court and after giving the parties an opportunity of being heard, and if necessary,
aftermakingsuchfurtherinquiryasitthinksfit,eitherdirectlyorthroughtheRent
ControlCourt,shalldecidetheappeal.
Explanation:Theappellateauthoritymay,whileconfirmingtheorderofeviction
passed by the Rent Control Court, grant an extension of time to the tenant for
puttingthelandlordinpossessionofthebuilding.
(4) The appellate authority shall have all the powers of the Rent Control Court
includingthefixingofarrearsofrent.
(5)Thedecisionoftheappellateauthority,andsubjecttosuchdecision,anorderof
theRentControlCourtshallbefinalandshallnotbeliabletobecalledinquestion
inanycourtoflaw,exceptasprovidedinsection22.
Costs.
21.Subjecttosuchconditionsandlimitations,ifany,asmaybeprescribed,thecosts
of and incident to all proceedings before the Rent Control Court or the appellate
authority referred to in section 20 shall be in the discretion of the Rent Control
Courtortheappellateauthoritywhichshallhavefullpowertodeterminebywhom
oroutofwhatpropertyandtowhatextentsuchcostsaretobepaidandtogiveall
necessarydirectionsforthepurpose.
Explanation:Theappellateauthoritymaysetasideorvaryanyorderpassedby
the Rent Control Court in regard to the costs of and incident to the proceedings
beforeit.
Revision.
22. (1) In cases where the appellate authority empowered under section 20 is a
subordinate Judge, the District Judge, and in other cases the High Court, may, at
anytime,ontheapplicationofanyaggrievedparty,callforandexaminetherecords
relatingtoanyorderpassedorproceedingstakenunderthisActbysuchauthority
for the purpose of satisfying itself as to the legality, regularity or propriety of such

orderorproceedings,andmaypasssuchorderinreferencetheretoasitthinksfit.
(2) the costs of, and incident to, all proceedings before the High Court or District
Judgeundersubsection(1)shallbeinitsorhisdiscretion.

23.AnyorderfortheevictionofatenantpassedunderthisActshallbebindingon
allsubtenantsundersuchtenant,whethertheywerepartiestotheproceedingsor
not,providedthatsuchorderwasnotobtainedbyfraudorcollusion.Incaseswhere
sublettingisallowedundertheoriginalagreementoftenancythesubtenantshall
bemadeapartytotheproceedingsifhehadgivennoticeofthesubtenancytothe
landlord.
Proceedingsbyoragainstlegalrepresentative.5of1908.
24. The provisions of section 146 and Order XXII of the Code of Civil Procedure,
1908shall,asfaraspossible,beapplicabletotheproceedingsunderthisAct.

25. (1) Subject to such conditions and limitations as may be prescribed, the
AccommodationController,theRentControlCourtandtheappellateauthorityshall
havethepowerswhicharevestedinacourtundertheCodeofCivilProcedure,1908,
whentryingasuitinrespectofthefollowingmatters:
(a)discoveryandinspection
(b) enforcing the attendance of witnesses, and requiring the deposits of their
expenses
(c)compellingtheproductionofdocuments
(d)examiningwitnessesonoath
(e)grantingadjournments
(f)receptionofevidencetakenonaffidavit
(g)issuingcommissionfortheexaminationofwitnessesandforlocalinspection
(h)settingasideexparteorders
(i)enlargementoftimeoriginallyfixedorgranted
(j)powertoamendanydefectorerrorinordersorproceedingsand
(k)powertoreviewitsownorder.

(2) The Accommodation Controller, the Rent Control Court or the appellate
authoritymaysummonandexaminesuomotoanypersonwhoseevidenceappears
toittobematerialanditshallbedeemedtobeacivilcourtwithinthemeaningof
section345and346oftheCodeofCriminalProcedure,1973.
Timewithinwhichproceedingshavetobedisposedof.
26.TheRentControlCourtshall,asfarasmaybepracticable,passfinalordersin
any proceeding before it within four months from the date of appearance of the
partiesthereto.

Exemptions.
27.(1)NotwithstandinganythingcontainedinthisActtheStateGovernmentmay,
in public interest or for any other sufficient cause, by notification in the Official
Gazette,exemptanybuildingorclassofbuildingsfromalloranyoftheprovisionsof
thisAct.
(2) Without prejudice to the generality of the foregoing power, the State
Governmentmay,bynotificationintheOfficialGazette,exemptfromtheprovisions
of sections 4, 5, 6, 7, 8 and 9 any class of buildings the construction of which has
begunafterthecommencementofthisAct,andinrespectofwhich
(a) the assessment to property tax or house tax by a local authority is based on a
monthlyrentoffiftyrupeesormoreor
(b) there has been no such assessment to property tax or house tax by a local
authority and the monthly rent will be fifty rupees or more, having regard to
prevailing rates of rent in the locality for similar accommodation in similar
circumstancesandtheAccommodationControllercertifiesthatrentofthebuilding
willbefiftyrupeesormore.
Explanation:Forthepurposesofthissubsection,constructionshallnotinclude
reconditioningorrenovationorpartialreconstruction.
Executive authorities of local bodies to furnish certified extracts from
propertytaxorhousetaxassessmentbooks.
28.(a)TheexecutiveauthorityoramunicipalityorPanchayatshall,onapplication
madeinthisbehalfandonpaymentofsuchfeeasmay,fromtimetotime,befixed
by the State Government, by notification in the Official Gazette, grant to the
applicant a certified copy of the extract from the property tax or house tax
assessmentbookofthemunicipalityorPanchayat,asthecasemaybe,showingthe
value of the building or buildings in respect of which application has been made,
relatingtotheperiodspecifiedintheapplication.
(b) Such certified copy shall be received as evidence of the facts stated therein in
proceedingsunderthisAct.
Landlordandtenanttofurnishparticulars.
29. Every landlord and every tenant of a building shall be bound to furnish to the
AccommodationController,theRentControlCourtoranypersonauthorisedbyitin
thatbehalf,suchparticularsinrespectofthebuildingasmaybeprescribedbyrules
madeunderthisAct.
Inspectors.
30. (1) The State Government may, by notification in the Official Gazette, appoint,
suchofficersasitthinksfittobeinspectorsforthepurposeofenforcingthepenal
provisionsofthisActandmayassigntothemsuchlocallimitsasitthinksfit.
(2)ForthepurposeofanyinvestigationorenquiryundertheActtheinspectormay

enteranypremiseswithsuchassistanceashethinksnecessary.
Penalties.
31. (1) If any person contravenes any of the provisions of subsections (1), (2), (5)
and(6)ofsection4,clause(a)ofsubsection(1)andclause(b)ofsubsection(2)of
section9,subsection(1)ofsection14,subsection(1)ofsection18andsection29,
he shall be punishable with fine which may extend to one thousand rupees and in
defaulttosimpleimprisonmentwhichmayextendtoonemonth.
(2)Ifanylandlordreceivesunconscionablerentinrespectofanybuildingheshall
be punishable with simple imprisonment for a term which may extend to three
months,orwithfinewhichmayextendtotwothousandrupees,orwithboth.
Fixationoffairrentsuomotobycourt.
32. (1) If during the course of a prosecution under this Act, it is disclosed that a
landlordwasreceivingarentinexcessoftherentthatmaybefixedundersection5,
the court before which the complaint was filed shall, after the close of the
proceedingsbeforeit,forwardtotheRentControlCourttherelevantextractsofthe
proceedingsforthepurposeoffixingthefairrent.
(2) The Rent control Court, on receipt of such extracts of proceedings, shall issue
noticetotheconcernedlandlordandtenantandaftergivingthemanopportunityof
being heard, fix the fair rent of the building and the fair rent so fixed shall be
deemedtobefairrentasdeterminedundersection5.
Powertomakerules.
33.(1)TheStateGovernmentmaymakerulestocarryoutthepurposesofthisAct.
(2) Without prejudice to the generality of the foregoing power, such rules may
providefor
(a)allmattersexpresslyrequiredorallowedbythisacttobeprescribed
(b) the procedure to be followed by the Rent Control Courts, Accommodation
Controllers and appellate authorities in the performance of their functions under
thisAct
(c)themannerinwhichnoticeandordersunderthisactshallbegivenorserved
(d)settingasideexparteorderspassedunderthisAct
(e) applications for making legal representatives of deceased persons parties to
proceedings under this Act and the time within which such applications shall be
preferred
(f)theorderofpriorityinwhichbuildingshavetobeallottedamongtheapplicants
(g)theofficersorclassesofofficerswhomaybeappointedasinspectors.
(3) In making a rule under this section, the State Government may provide that a
personwhocontravenesanyoftheprovisionsthereofshallbepunishablewithfine
whichmayextendtotwothousandrupees.
(4)Thepowertomakerulesunderthissectionshallbesubjecttotheconditionof

therulesbeingmadeafterpreviouspublication.
(5)AllrulesmadeunderthissectionshallbepublishedintheOfficialGazette.
(6)EveryrulemadeunderthisActshallbelaidassoonasmaybeafteritismade,
before the Legislative Assembly while it is in session for a total period of not less
than fourteen days which may be comprised in one session or in two or more
successivesessionsandifbeforetheexpiryofthesessioninwhichitissolaidorthe
sessions aforesaid the Legislative Assembly makes any modification in the rule or
decidesthattheruleshallnotbemade,theruleshallthereafterhaveeffectonlyin
suchmodifiedformorbeofnoeffect,asthecasemaybeso,however,thatanysuch
modification or annulment shall be without prejudice to the validity of anything
previouslydoneunderthatrule.
Protectionofactiontakeningoodfaith.
34.(1)Nosuit,prosecutionorotherlegalproceedingshalllieagainstanypersonfor
anythingwhichisingoodfaithdoneorintendedtobedoneinpursuanceofthisAct
oranyrule,orderordirectionmadeorissuedthereunder.
(2)NosuitorotherlegalproceedingshalllieagainsttheGovernment,anyofficeror
authorityforanydamagecausedorlikelytobecausedbyanythingwhichisingood
faith done or intended to be done in pursuance of this Act or any rule, order or
directionmadeorissuedthereunder.
