Contractor Sustainability Requirements


Detailed below is the MAFP Sustainability requirements which are to be included as part of the tender specifications and terms and
conditions of the contract and as deemed appropriate by MAFP.

Contract requirements

1. MAF Sustainability Policy


a. Requirement that all successful bidders should comply with MAFP Sustainability Policy. Refer Appendix A.
b. Contractors to submit a compliance statement answering the following questions:
i. How do we, the Contractor understand the MAFP policy? Explain.
ii. How will we, the Contractor be following the policy? Explain.
2. Sustainability Implementation Plan
Consultants & Contractor to fulfill the requirements assigned to them in the Sustainability Implementation Plan (SIP) created and
managed by the MAFP Project Management team.
3. Health & Safety Key Performance Indicators
a. Requirement that all successful bidders should comply with the MAFP Health & Safety Policy. Refer Appendix B.
b. Contractor to measure and report on the following (monthly):
i. Total number of accidents
Fatalities
Serious injuries
Minor injuries & first aid incidents
Broken down by circumstance
ii. Accident Frequency Rate (AFR)
iii. Number of H&S audits
4. Labour Standards
a. Requirement to comply with the following MAF labour standards in the supply chain policy commitment. Refer Appendix C.
b. Requirement that the Contractor should expect to be audited against this objective in line with international standards.
c. Contractor to submit compliance statement, as below, refer to Appendix C for format:
The Contractor will work with MAF Properties to operate in line with the commitments set out in the MAFP sustainability
policy. The Contractor will be required to report on their performance in line with the sustainability policy. We only use
suppliers who can guarantee that their workforces are fairly treated and remunerated at work, and who ensure that their
immigrant workforces are provided with appropriate working conditions, housing, healthcare and repatriation.

5. LEED Target and Key Performance Indicator


Requirement that Contractors measure and report on the investment required to achieve the following:
a. All new developments to achieve LEED Gold, BREEAM Excellent or equivalent
b. All new developments in concept design in 2013 moving to schematic design after January 1 st 2014 to achieve LEED Gold,
BREEAM Excellent or equivalent
c. New developments that commenced schematic design prior to January 1st 2014 to achieve LEED Silver (or BREEAM
equivalent) or higher
d. Extensions of existing LEED or BREEAM rated buildings to maintain rating achieved.
e. Contractor to ensure that all required documentation is submitted to USGBC for certification.
6. Resource Efficiency Key Performance Indicators
a. Monitoring and reporting: The Contractor will report monthly in a form in line with the MAFP Key performance Indicators
(KPIs).
b. Contractor to measure and report on the following (monthly):
i. Water intensity construction (m3 project spend)
ii. Energy intensity (includes electricity, gas, oil) construction (kWh/m2 build)
iii. Proportion of total waste by disposal route (tonnes)
7. Local Job Creation Key Performance Indicator
a. Contractors to measure and report on the following (quarterly):
i. Job creation (total number of contractors & sub-contractors employed)
8. Community Investment Key Performance Indicators
a. Consultant and Contractor to measure and report on the following (quarterly):
i. Cash contributions to community
ii. In-kind contributions to community
iii. Community investment through planning agreements

Appendix B
HEALTH AND SAFETY POLICY STATEMENT

It is the policy within MAF Properties to conduct its activities with due regard for the health, safety and welfare of employees,
contractors, clients, visitors and members of the public.

Our obligations in relation to health, safety and welfare is recognised and taken seriously by MAF Properties and to this extent;
the assessment of risks to the health, safety and welfare of everyone directly and indirectly affected by its activities is a top
management priority. To achieve our policy we have set clear mutual objectives for MAF, contractors and consultants as
follows:

1. To integrate health and safety management within all of our activities and operations.

2. To consult with employees, and third parties on health and safety matters

3. To ensure employees are given adequate information and/or instruction in health and safety to enable them to
conduct their work activities safely.

4. To establish MAF Properties - Project Management and Construction Delivery as a health and safety leader within
the industry.

The purpose of our objectives is to promote a pro-active approach to the prevention of incidents, ill health, dangerous
occurrences and damage in the workplace. This will be achieved, so far as is reasonably practicable, by the identification of
hazards, and the management of risk, thus providing safe systems of work and compliance with relevant regulations,
standards, and industry best practices.

Employees of MAF Properties are required to co-operate in ensuring the policy is effective and each individual has a
responsibility to
take reasonable care for the health and safety of himself/herself and those who may be affected by his/her acts or omissions
at work.

MAF Properties will communicate information with employees, contractors and consultants with respect to health, safety and
welfare to ensure that all necessary measures are taken to make the policy effective.

The organisation is committed to continual improvement and actively encourages feedback from all levels of staff to ensure
that health and safety is maintained.

Appendix C
STAFF ACCOMMODATION AND STAFF TREATMENT
MINIMUM REQUIREMENTS
As part of its continued commitment to Corporate & Social Responsibility (CSR), Majid Al Futtaim Properties requires that all of
its contracted and group companies meet the requirements set-out below for the accommodation (where provided) and the
treatment of its staff.

These requirements are the minimum standards to be provided, all contracted companies are required to complete and sign
the attached declaration as part of the bid process.

Regular visits and confidential staff interviews will be planned throughout the contract term by members of Majid Al Futtaim
Properties management team. Failure to comply with the requirements or to make a false declaration will constitute a breach
of contract and result in an immediate improvement notice being issued with a timeline for rectification. Further non
compliance could lead to blacklisting and /or contract termination.

STAFF TREATMENT

Staff are to receive and benefit from the full terms of their contract without exception and without undue delay. Specifically, the
following requirements are to be maintained at all times.

1. Contract A legal employment contract to work with the company in accordance with local laws and regulations valid for the
term of the contracted work with Majid Al Futtaim Properties. The workers contract is not to be altered or renegotiated at any
time during the contract term.

2. Salary To be paid within 7 days of the due date at the rates agreed in the contract without deductions not previously
agreed to.

3. Additional Benefits Including but not limited to;

Supplemental salary - for additional hours worked in accordance with local labour law and any additional contract
terms.
Transport to and from the place of work in air conditioned, insured and local government approved vehicles.
Workers compensation insurance In accordance with local laws and regulations.
Medical insurance In accordance with local laws and regulations.
Sick pay For the period of absence (supported by a sick certificate issued by an approved medical practitioner)
at no less than the base salary agreed in the contract.
Travel ticket to declared country and place of normal residence at least every 2 years and in accordance with
local laws and regulations.
Visa for the country of work at no cost to the worker.
Accommodation Where contractually agreed and required by local law to the minimum standards laid out within
this documents and any additional local laws.
Food (Or sufficient food allowance where agreed) to ensure a varied and healthy diet throughout the contract
term.
Paid Holidays In accordance with local labour laws and relevant grade is to be granted and paid at the

contracted rate.

4. Working Hours Workers are not to work for periods longer than those noted terms of the workers contract without
additional salary (overtime). Workers are not to work more than 6 days continuously unless they volunteer to do so and then
only at the agreed overtime rate.

5. Public holidays Staff required to work on public or government declared holidays are to receive additional holiday in lieu
to be taken within the same calendar year.

6. Work clothes / Uniform /PPE Workers are to be provided with all sufficient work clothes, uniforms and personal protective
equipment required to carry out their duties at no cost to them for cleaning and replacement

STAFF ACCOMMODATION

All staff accommodation must be structurally sound, fit for purpose and built to internationally recognized standards of build
quality and safety. It is to be situated within a secure area and not situated within or near an inappropriate or hazardous area
i.e. next to a chemical factory.

All staff are to be provided with:

A clean well maintained room with at least 3 m2 of personal space for each worker with additional space for
circulation.
All staff are to have their own bed equipped with a new clean mattress, shared or hot-bed systems will not be
tolerated.
No more than 6 persons should occupy any room at one time.
Supervisory grades are to be accommodated at no more than 3 persons to a room.
A locker, wardrobe (lockable) to secure personal items and clothing is to be provided for each worker.
All rooms are to have sufficient and fully maintained AC with suitable fresh air circulation in accordance with
international standards.
A minimum of 1 toilet, 1 shower and 1 sink is to be provided for every 10 staff within the immediate vicinity of the
accommodation sleeping area. Hot and cold water is to be provided at all times.
Free Laundry facilities are to be provided with a continuous supply of hot water and an area in-which to dry
clothes.
Internationally recognized fire detection, fire fighting and means of escape measures are to be in-place and all
equipment is to be regularly maintained. Potable fire extinguishers must be available in locations complying with
local and international regulations and a proof of maintenance is to be provided to MAF properties on demand.
Each accommodation block is to contain at least 1 suitably sized community room for staff socialization.
A suitably sized kitchen is to be available for staff use fitted out with cooking equipment of a high standard with
free gas or electricity.
A dining hall/room sufficient to seat at least 30% of the staff at any one time is to be provided adjacent or near to
the kitchen.
Where staff meals are not provided as part the contractual arrangements with the staff a suitable food allowance
(to be declared to MAF properties) is to be provided additional to the gross salary.
A pest control contract and additional measures are to be in place to ensure that the accommodation is kept free
of, Cockroaches, Mice, Rats, Flies, Mosquito and any other pests to ensure that the hygiene regulations in the
country of operation are complied with.
Each accommodation shall include a Camp supervisor accommodated on site in their own room responsible for
the management of the property.
Notwithstanding the above mentioned requirements the local regulations of each Emirate and Country is to be
complied with. Where local regulations are of a lower standard the above standards shall apply.
