1. This petition under Article 226 of the

Constitution of India has been preferred by the

petitionerwiththefollowingprayers:

7(A) Be pleased to issue a writ of

mandamus,writinthenatureofmandamusor
any other appropriate writ, order or
direction, quashing and setting aside the
impugned order and letter dated 09.02.2016
(AnnexureF),passedbyRespondentNo.2and
bepleasedtofurtherdirecttherespondent
no. 2 and 3 to issue necessary promotion
orderandpermissionimplementingtheorder
dated23.12.2015(AnnexureD)passedbythe
respondent no. 1 in favour of the
petitioner, promoting the petitioner as an
Associate Professor (Mathematics) in Govt.

Engineering College, Patan, by considering

the promotion period from 23rd December,
2015.

(B) During the pendency and final disposal

of this petition, the respondents may be
restrained from initiating any action or
passing any order, contrary to the order
dated 23.12.2015 (AnnexureD) as far as it
relatestothepresentpetitioner.

(C ) Any other and further relief in the

interestofjusticemaykindlybegranted.

2. Mr. Ekrama Qureshi, learned advocate for the

petitioner has submitted that respondent No.1 has

passed the order dated 23.12.2015 promoting the

petitioner as Associate Professor (Mathematics).

However,therespondentsarenotimplementingthesaid

orderofpromotionforreasonsbestknowntothem.

3. Ms.SangeetaVishen,learnedAssistantGovernment

Pleader,hasdrawntheattentionoftheCourttothe

affidavitinreply filed by the said respondent and

hassubmittedthattheissueregardingthepromotion

ofAssociateProfessorsissubjudicebeforetheCourt

in Special Civil Application No. 15014 of 2015 and

connectedmatters,therefore,theStateGovernmenthas

takenadecisionnottofinalizethesaidpromotions

tillthefinaloutcomeofthosepetitions.

4. Mr. Ekrama Qureshi, learned advocate for the

petitionerstates,uponinstructions,thatpetitioner

has no objection if he is granted promotion to the

postofAssociateProfessor(Mathematics),subjectto

the final outcome of Special Civil Application No.

15014of2015 andcognatemattersandthishasalso

been stated by the respondents in the order of the

promotiondated23.12.2015.

5. In view of the above statement made by the

learned advocate for the petitioner, the following

orderispassed.

6. The respondent shall implement the promotion

order dated 23.12.2015 passed in favour of the

petitioner, subject to the final outcome of Special

Civil Application No. 15014 of 2015 and connected

matters.

7. It is made clear that the petitioner shall not

claimanyrightorequityasaresultofthisorder.

The promotion of the petitioner shall be subject to

the final decision in Special Civil Application No.

15014 of 2015 and connected matters. It is further

clarified that the rights and contentions of the

withoutenteringintothemeritsofthecase.Ruleis

discharged.
