Adoptedbyconsensusin1992,theUnitedNationsMinoritiesDeclarationinitsarticle1referstominoritiesas
basedonnationalorethnic,cultural,religiousandlinguisticidentity,andprovidesthatStatesshouldprotect Minoritiesunder
theirexistence.Thereisnointernationallyagreeddefinitionastowhichgroupsconstituteminorities.Itis internationallaw
oftenstressedthattheexistenceofaminorityisaquestionoffactandthatanydefinitionmustincludeboth
objectivefactors(suchastheexistenceofasharedethnicity,languageorreligion)andsubjectivefactors UNNetworkonRacial

Whilethenationalitycriterionincludedintheabovedefinitionhasoftenbeenchallenged,therequirementto Declaration
beinanondominantpositionremainsimportant.Inmostinstancesaminoritygroupwillbeanumerical
minority,butinothersanumericalmajoritymayalsofinditselfinaminoritylikeornondominantposition, Declarationonthe
