For example, AJ Intemational “partnered” with Reprieve to produce a documentary to deter tourism to Egypt on basis ofits approach to detention without due process. + Most of the NGOs readily distinguish between AJ's International arm and its Arabic arm. The concer about its Arabic content is widely held (although I note many of them would be prepared to take the AJ coin if it comes from the International arm). Amnesty International, in particular, appears to be very ertical ofthe Arabic language output + Fahmy continues to engage with self-styled Qatari opposition leader Khalid Al-Hail. KAH tured up atthe Soho “House event and, in what looked like a choreographed exchange, Fahmy gave him the floor and KAH asked him questions about Qatar's domestic political situation. + My interpretation ofthat exchange was that KAH sought to lead Fahmy to talk about domestic Qatari affairs in a public setting. Bluntly Fahmy doesn’t have the writing skills to produce that type of ‘content. Fahmy is highly susceptible to flatery and prospect of money. ‘Status on lawsuit [AS L reported before, the next step in the lawsuit isto settle jurisdiction. Fahmy’s case for having it heard in Canada is on the Common Law principle of necessity. In other words, he can’t get a fair hearing in Qatar, or Egypt. A-J contest this. We know from AJ's lawyers they are struggling to find expert witnesses who will suppor their claim that Qatar is a safe Jjurisdiction, We also know that A-J lawyers are aware that Fahmy ison the search for a new legal team and he is ‘constrained financially. Fahmy travels Saturday to Cairo to seek financing. He tells me he wants to travel to AD, presumably to seck funding, there. ‘Legal team ‘The relationship with his existing lawyers Caroline and Gislason appeared to break down irrevocably this week over the dispute about outstanding fees. I know that he has reported this to Youssef. (Caroline and Gislason point out Fahmy owns ‘wo properties in Cairo and see litle preparedness on his part to risk own money in this suit). It remains to be seen whether the new lawyer Fahmy believes he has found will tke on the project given Fahmy is now ina dispute with his former lawyers over unpaid fees plus he is expecting the new lawyer to work on a contingency basis. This then is a critical point forthe whole lawsui understand thatthe new lawyer is From a reputable and lange firm, He is highly media savvy and will take this on purely ‘with a view to the PR benefits This means going forward Fahmy may be well served by that law firm’s in -house PR team. ‘Summary. "Notwithstanding the closure of AJ America, it appears Qatar and AJ have some traction on other fronts; at UNESCO (who have been extraordinarily reluctant about meeting Fahmy); and with Al's dispute against Egypt filed st ICSID and ‘which was announced by Carter Ruck last week, This is the same suit filed 18 months ago in the midst ofthe A-J3 tral ‘The treatment of Fahmy, Greste and Mohamed have now been highlighted as central reason forthe claim. So this story is going to continue. | have cause for concer about continuing to support Fahmy, but it remains the case that A-J are onthe offensive as ‘champion of media freedom and protection of journalists. I have some thoughts on this which we can discuss when we see each other next. To listen to his presentation, click here © Ac the Frontline Club event, Clooney belitled the grounds for Fahmy's lawsuit, arguing that the issue ofthe broadcast licences - a key component in his case - was nothing more than a minor administrative technicality. ‘The Foreign & Commonwealth Office were keen to understand Falumy's observations about the Egyptian case, the (Qatar / Egypt dispute, the way he had been released, what had worked in his campaign / what had not, and the issue of torture in prisons. They explained a priority is toto get Turton and Kane pardoned. # In London Fahmy met Amnesty International, the National Union of Jouralists, the Intemational Federation of | Journalists and Media Defence Legal Initiative. All of these organisations, particularly the latter thee, were openly ‘condemning A-I's behaviour, The journalists unions said it was an open secret among their membership that A-J pursued a highly politicised editorial line. ‘© He met Liberal International (intemational association of Liberal partes) to thank them for their campaigning support. They had a candid conversation about AJ and Qatar. In return for his engagement, Liberal International offered to mount an anti-Qatar campaign. In Toronto, Fahmy met the leader ofthe Liberal Party and newly elected Prime Minister Justin Trudeau. The chemistry was very good. Trudeau was particularly vocal in ealling for Fahmy’s release. He seemed engaged on the (Qatar / Egypt dispute, Under the outgoing Conservative government, Canada has forged very close diplomatic relations with Israel, + Fahmy and his team were invited to dinner atthe home of Gerry Schwartz and Heather Reisman, one of Canada’s ‘wealthiest couples. Highlights and key take-aways from the two weeks include: AlJazeeta ‘Fahmy spoke at The Frontline Club in London. Among others present was Dominic Kane, like Peter Greste he is one of the A-J journalists sentenced in absentia and not included on the presidential pardon. ‘* One week earlier, A-J had flown Dominic Kane, Peter Greste and Sue Turton (also sentenced in absentia) to New ‘York to participate in a press conference on the fringes of the UN General Assembly organised by the Committee on Protecting Journalists. Using those journalists appears important to A-I's PR defence. ‘+ Kane privately explained to Fahmy that he, Greste and Turton are carefully watching his court action and have been discussing between them launching their own joint action. All three are unhappy with A-J and the way they have been handled. Fahmy understood that if he is successful in the lawsuit, they will initiate joint proceedings. ‘¢ Fahmy understands that another former journalist, Aktham Suliman who was for 10 years A-J Arabic’s Berlin bureau chief is also considering his own challenge. ‘ Another former A-J journalist Anita McNaught, who participated in a major C4 News report in February, has confirmed to Fahmy's lawyers thatthe grounds of his action are solid. Indeed, she thinks Fahmy's case isthe tip of the iceberg. However, she remains unpersuaded to bring her own action at the present time. Lawsuit ‘+ Fees so far incurred by Fahmy's legal team amount to C$300,000 (US$230k). They have now suspended any further ‘work until they are paid, ‘Critically, they are now stalling on engagement with A-J's Canadian lawyers (from a highly reputable Vancouver based firm). The issue of jurisdiction is the next step in the case, with A-J challenging action in Canada. The lawyers are concerned that A's lawyers may now be concluding that Fahmy doesn't have the financing behind him to proceed. ‘+ The lawyers argue that itis critical not to allow A-J to sense weakness. ‘They also point out securing a Canadian court judgment that state the Qatar courts are not a safe or fai jurisdiction would have immense PR upside. + Fahmy's lawyers, Gary Carotine and Joanna Gislason, both have history in class action and are politically well connected in Canada. Both have an appetite to take on further action against A-I and Qatar since they believe they have begun to acquire a knowledge and expertise. ‘They are currently in dialogue with academic Adel Iskandar, formerly at Georgetown University and now at Simon Fraser University in Vancouver. ‘+ He has agreed to be an expert witness on the case. In 2001 he wrote a highly favourable book about Al-Jazeera, however, believes by 2010/11 it had embraced a highly politicised, Islamist editorial line. ‘+ Iskandar is particularly incensed at A-J's coverage of the Syrian conflict and believes that its Arabic broadcasts incited violence towards the Shia community. He considers A-J to be akin to Radio Télévision Libre des Mille Collines's role in the Rwandan genocide (the UN's international tribunal on Rwanda went on to prosecute the leadership of RTLMC and a number of broadcasters). «Iskandar and the lawyers have worked up a scoping paper on taking Al-Jazeera to the Intemational Criminal Court.
